SECTION C – PERFORMANCE WORK STATEMENT

C.1. GENERAL INFORMATION

C.1.1. Purpose

Park roads and visitor transportation systems are intended to enhance visitor experience while protecting park resources. Transportation is, in many ways, the connection between the National Park Service mission of resource protection and visitor enjoyment. The purpose of the Visitor Transportation System (VTS) in Gulf Islands National Seashore (GUIS) is to provide transportation for passengers riding the new concessioner run tour boats service to Fort Pickens as well as allowing a park and ride option for visitors arriving in their own vehicle.

C.1.2. History

In February 2009, the national seashore, in cooperation with the Federal Highway Administration, Eastern Federal Lands Highway Division, completed an alternative transportation study to assess the current and future transportation needs at the Fort Pickens area and the nearby gateway community and identify potential alternative transportation systems capable of meeting those needs. Although water transportation and docking systems to connect various locations in the Florida District of the national seashore were identified in the 1978 General Management Plan; none were implemented. Several planning and study efforts have been done since that time. Support for the tour boats service in the Pensacola Bay area is long standing and supported by projects such as the Maritime Park Development and City of Pensacola. The Santa Rosa Island Authority, the Regional Metropolitan Planning Organization, and the local Transit Authority are among those who support the current efforts to establish the tour boats service in the bay. A strategy for supplementing the road with alternative transportation systems is essential to providing consistent public access to the Fort Pickens area in the future. Improved transportation options to the Fort Pickens area could reduce congestion and parking demand while maintaining visitation. The implementation of alternative transportation systems also could protect natural and cultural resources and reduce impacts on the environment.

Fort Pickens road would continue to provide vehicular access between Pensacola Beach and the Fort Pickens area. The intent of the national seashore is to reconstruct the road after major storms, if feasible. The National Park Service (NPS) intends to continue access via Fort Pickens road to Fort Pickens, but there are situations that may arise in the future where conditions become so altered that it is no longer feasible to build or maintain the road. This would be determined on a case-by-case basis. Costs for rebuilding could be high, and at this time, they are unknown because the severity or damage of future storms is unknown. Other options to provide access to Fort Pickens would be considered given the circumstances of the storm or other events that may cause such a decision to become necessary. The national seashore’s hurricane recovery plan would include a provision to procure and deploy, if feasible, temporary surfacing to accommodate administrative vehicular and public foot/bike access to the Fort Pickens area until road repairs could be completed after major storms. Two small beach access areas with parking would continue to be provided and possibly expanded along Fort Pickens road. Bike and pedestrian access would continue to be permitted along the road shoulders. The bike lane along Fort Pickens road may be extended from Langdon Beach to Fort Pickens, and the bike trail between the campground store and Fort Pickens may be improved. Other designated bike trail opportunities would continue between the campground and Fort Pickens. The route could also be made available for a shuttle system or trolley service, if such a system were found to be feasible in the future. Access by water would continue to be permitted by private boat, with unrestricted landings along the Gulf of Mexico shoreline (except in designated swim areas). To enhance visitor access by water, a new passenger tour boat pier has been constructed to accommodate commercial water-based transportation service and NPS administrative use.

In order to ensure that tour boats passengers have transportation from the Fort Pickens landing to Langdon Beach, the seashore’s only guarded beach and the campground, the park secured six, 27-passenger electric trams. In 2017, the park secured approval to implement a Transportation Fee in order to provide funding for a service contract for the operation of the trams.

The VTS will operate daily during periods of peak visitation and weekends in the shoulder season. Ridership is expected to be approximately 10,000 to 15,000 annually.

Although schedules are developed by the Contractor and approved by the NPS, the emphasis is on providing service and on meeting specific times at stops. Many factors affect schedules, including traffic congestion, which are beyond the control of the Contractor. Schedules are altered as approved by the NPS to meet desired levels of service, based on availability of equipment.

C.1.3. Period of Performance

The VTS may operate up to seven days per week, 9:30 AM – 5:30 PM, year round or as requested by the CO. Service could be scaled back to only weekends between March 13 and May 17 and between August 14 and November 1 with seven day per week operation May 18 to August 15 and no service November 2 to March 12, or similar. Refer to the Route, Schedule and Period of Performance Changes section below for additional information.

C.1.4. Routes

Following are the current VTS routes:

Langdon Route

The Langdon route operates from the ferry dock at Fort Pickens to Langdon Beach with a stop at the Fort Pickens campground. In addition, the Park may consider an additional stop at Battery Worth in the future. The ferry is expected to drop off approximately 20,000 riders a year to the ferry dock at Fort Pickens.

C.1.5 Route, Schedule and Period of Performance Changes

Non-emergency Changes

As the VTS responds to changing visitor patterns and needs, the Contractor and the NPS will work together to provide the best visitor services while maintaining the legal framework of this contract. Minor non-emergency service changes will be communicated from the COR to the Contractor’s On-Site Operations Manager at least 7 days prior to the required change. The Contractor shall not deviate from the NPS approved Route and Schedule without first receiving prior NPS approval in writing. In addition should the need arise the Government may, after giving the contractor sufficient notice, alter, change, add or delete the period of performance and routes within the park without a change to the contract unit price; however, differences between estimated quantities and actual quantities of service hours may result in changes to the contract unit price in accordance with contract clause 52.211-18, Variation in Estimated Quantify.

Following are potential reasons for route and / or schedule changes:

a) Meet desired service levels and hours of operation according to visitor and Park needs.

b) Extension of the service year.

c) Special orders concerning detours or other similar issues by the CO.

Emergency Changes

In the event of emergency situations such as dangerous weather, fire, or collisions, tram vehicle drivers with the concurrence of the Contractor’s On-Site Manager, may modify routes and schedules as they deem necessary during the period of the emergency. All situations requiring modification of routes and schedules must be immediately relayed in order of priority within 15 minutes to:

The CO, Superintendent, Deputy Superintendent or Chief Ranger may request the Contractor’s On-Site Manager to modify routes and schedules as they deem necessary during periods of emergency (e.g. transporting NPS staff).

C.2. GOVERNMENT FURNISHED PROPERTY

C.2.1. General

Government-furnished property shall be governed by FAR Clause 52.245-1, Government-Furnished Property. The NPS makes no warranty of any kind, nature, or description, expressed or implied, as to the quality, performance, or state of repairs of any NPS provided property. The Contractor is expected to exercise diligence in the protection of Government facilities and equipment. The NPS shall furnish, without price or cost to the Contractor, the following:

C.2.2. Equipment

The NPS will provide four - six 27 passenger Moto Electric Vehicles trams. Equipment shall remain in sole ownership by the NPS. Nothing contained in this Contract or in the payment of services shall enable the Contractor to acquire any right, title, or interest in or to Government property.

C.2.3. Facilities

The Government shall provide and the contractor shall maintain a trams storage facility at Battery Langdon. The contractor can store, stage and charge trams at this facility during the day and overnight. It is the responsibility of the Contractor to follow all federal, state, and local regulations while using and maintaining this facility.

Following is a brief description of the Battery Langdon facility:

a) Parking for electric trams.

b) Charging ability for electric trams

c) Asphalt paved / concrete surface,

d) Crushed rock driveways,

e) Garage doors with electric garage door openers,

f) Lightning

g) Wash station

C.3 CONTRACTOR RESPONSIBILITIES

C.3.1. General

The Contractor shall operate the VTS, including but not limited to the operation and maintenance of tram vehicles over NPS approved and designated operating routes and route schedules, with an emphasis on safety.

The contractor shall provide safe, timely, professional and reliable services as described in the following sections. The Contractor shall provide and/or maintain all resources, equipment, supplies, vehicles, equipment, tools, materials, supervision, personnel and other items and services necessary to provide the transit service as defined in this contract.

All waste materials shall be disposed of in an environmentally friendly and NPS approved manner that complies with all federal, state, and local regulations.

Passenger/visitor lost articles found by Contractor personnel shall be secured and turned over to NPS staff.

NPS may periodically request the Contractor distribute survey forms to be filled out by passengers and returned to the NPS.

C.3.2. Schedule

The Contractor shall develop and submit, for approval, a Route Schedule to the COR no later than the end of January of each year. The proposed Route Schedule submitted by the Contractor shall be based upon the following limiting factors:

· The core hours of operation shall be 9:30 AM – 5:30 PM.

· The route frequency may not exceed a time period of every 15 minutes

C.3.3. Battery Langdon Facility

The Contractor shall operate and maintain the NPS provided Battery Langdon facility located on Fort Pickens Road. The contractor is responsible for the following:

a) Ensuring that their property and assigned facilities are secure and safe-guarded, to include locked doors and adhering to general standards for physical security of property and vehicles.

b) Garbage removal.

c) Normal building maintenance including:

1. All cleaning supplies and general supplies.

2. Replace burned out or defective light bulbs

3. Interior and exterior basic maintenance and minor repairs

4. Maintenance and cleaning of the non-public areas shall occur on a frequent basis (at least weekly) ensuring cleanliness of the work areas.

The contractor shall not post any signs within the park or on the tram vehicles without the prior written approval of the CO.

Overnight parking of tram vehicles shall be allowed at the Battery Langdon facility only.

Maintenance, other than minor daily routine checks, of tram vehicles is allowed within the walls of the Battery Langdon facility only.

Federal and State OSHA Officials and NPS Officials may perform scheduled safety inspections. The park may request additional inspections by the State Department of Transportation. The Contractor shall permit and cooperate with the aforementioned inspections.

Contractor shall be conservative in water use and all other resources and utilities.

C.3.4. Vehicles

General The Contactor shall maintain all Service provided tram vehicles as well as any other contractor vehicles such as maintenance repair vehicles, supervisor cars, maintenance vehicles, tram vehicle trailers, etc. necessary for the accomplishment of this contract.

Specifications

Each Service provided electric tram vehicle shall:

a) Operate at speeds up to 25 mph

b) Operate per federal, state and local regulations.

c) Be covered with a plastic zipper enclosure

d) Be equipped with:

· Automatic windshield wiper

· Internal PA System

· Americans with Disabilities Act (ADA) compliant ramp and restraint system

· On board smart charging system

· Trojan batteries (5 year life)

· Headlights, tail lights, break lights and turn signals

· Horn

· Digital dashboard

· Speedometer

· Battery capacity meter

· Dual quick charge system

· Grab handle bar kit

· Reverse bench seat

· High back bench seating

· Side and rear view mirrors

· Parking brake

· Aluminum rust protected rims

e) Technical Specification per Tram:

· Model: MotoEV Electro Transit Buddy 27 passenger tram

· Range: 50 miles (full capacity)

· Climb: 20% grade (full capacity)

· Electric motor: 5KW (6.7 hp)

· Minimum turning radius: 18 feet

· Ground clearance: 7

· Batteries: QTY 16 – Trojan 105

· Charger: Eagle on Board-Dual Charging System

· Braking System: Rear & Front Hydraulic Brakes w/ Rear Mechanical Parking Brake

· Suspension: Independent/ Rear Steel Plate Suspension

· Drive: Rear Wheel Drive

· Body: Steel Framework + Fiberglass

· Roof: Fiberglass Painted to Match Vehicle

· Floor: Non- Slip Plastic

· Windshield: AS1 DOT Approved

f) Be operated & maintained in a mechanically sounds state

g) Be clean and have an attractive appearance as defined herein:

1. Free of graffiti – interior and exterior.

2. Absence of oil or other excessive residue on the exterior.

3. Windows, seats, dashboard, stanchions, and exposed surfaces free of sand, dust, gum, grease, soil, etc.

4. Floor areas free of sand dust, gum, grease, oil, etc.

Any vehicle that the NPS determines does not meet the above standards shall not be utilized and shall be immediately swapped out by the Contractor and cleaned and/or repaired by the Contractor.

Vehicle Maintenance

The Contractor shall maintain all tram vehicles in a safe and clean operating condition as per manufacturer requirements and industry best management practices. General maintenance includes, but is not limited to:

· Regular grease and lubricate the rear power assembly, wheels and steering column.

· Battery and tire replacement as needed

· Adjusting brake system as needed

· Checking the electrical system, contacts and wires for any obstructions, dirt or grease and clean with a cloth, brush or air.

· Keeping contacts free of dirt/sand (loose contacts can become hot)

· Checking the rated current of fuses before replacing

· Disconnect the positive lead on the battery when servicing, for safety.

· Using only distilled water in the batteries.

· Monthly checking of the water levels and tightening the battery cables as well as inspecting the cable lock washers are present

· Checking the torque on all wheel lug nuts (all tires) to be sure, they are completely tight.

· Battery levels checked

· Lubricating shifting cables

· Tire pressure checked

· Brake system/fluids checked

· Torque battery terminals/clean/spray battery terminals

· Check all lights and signals

· Check all windows and mirrors for cracks, visibility, wipers

· Check solar panel 72V charging system

· Check all seatbelts and safety equipment on board

All aspects of repair and maintenance for the trams is the responsibility of the Contractor. This above this is not all-inclusive. It is the responsibility of the Contractor to know what maintenance and repairs are needed and ensure it is completed and documented.

The contractor shall submit documentary evidence that vehicles are being maintained in a safe, clean and environmentally friendly condition. Documentary evidence shall include but is not limited to maintenance and inspection plans, cleaning plans, Federal and State Transportation Department inspection reports (if required), etc.

In the event of a hurricane or other incident that requires the trams to be transported from Fort Pickens (Santa Rosa Island) it will be the Contractors sole responsibility, including any and all costs, to secure appropriate off island space to ensure the safeguarding of NPS owned trams; secure a mechanism to transport the trams to the off island space (they are not to be driven outside seashore boundaries) ; and return them to the Seashore when appropriate and advised by the Service it is safe to do so.

C.3.5. Equipment

The contractor shall be responsible for procurement costs for any contractor provided equipment necessary in the fulfillment of the contract.

Communication Equipment

The Contractor shall supply:

a) Operable two way radio onboard all vehicles and must provide the Service with the channel(s) used for general communication,

b) Mobile units or cellular phones for each tram vehicle.

Radios or cell phones shall be operated in conformance with NPS polices. Tram vehicles shall not be operated without an operational voice radio and / or cell phone communication system.

Cell phones shall not be used while vehicles are in motion.

C.3.6. Personnel

C.3.6.1 General

Hiring Requirements

Prior to the Contractor’s hiring, training, or utilizing any employee for this contract, the Contractor shall ensure that all employees meet the requirements set forth herein.

The Contractor shall:

a) Review personal & character references of employees provided for this Contract.

b) Not employ or utilize, for any type of services under this contract, any person who is a wanted felon. If the Contractor determines that such a person has applied for a position, the Contractor shall notify the Gulf Islands National Seashore Chief Ranger.

c) Reference section I for FAR Clauses 52.204-9 (Personal Identity Verification of Contractor Personnel) and 52.222-54 (Employment Eligibility Verification) for further guidance.

Personnel Training

The Contractor shall train personnel employed by the Contractor in the operation, repair, maintenance, and safety inspection of the equipment used in the transportation service.

Substance Abuse Plan

The Contractor shall maintain and enforce a written Substance Abuse Plan that complies with the Federal Highway Administration Regulation 49 CFR, Pat 382.

Firearms & Weapons:

Employees are prohibited from possession of firearms and weapons while on duty.

Employee Uniform Guidelines

Uniforms shall consist of matching pants (short or long) or skirt (short or long), matching shirt (short or long sleeve), matching jacket or sweater, and matching baseball style hats (optional). Footwear shall be sturdy and shall not include clogs or sandals. Uniforms shall be clean and pressed. Uniforms shall include employee identification such as a nametag or embroidered name. The Contractor shall submit uniform proposal samples, within 30 calendar days after contract award, for approval by the CO. Uniforms shall not match National Park Service uniforms in color.

Conduct of Contractor Personnel

Federal Law and Title 36 of the Code of Federal Regulations – Parks, Forests, and Public Property, which also applies to Contractors and Contractors’ employees, regulate the NPS. Contractor personnel in contact with the public shall follow the National Park Service’s, Expected Behaviors, set forth during NPS provided training provided after award and prior to the start of operations.

The Contractor shall ensure employees receive proper training and provide courteous, helpful and safe operations. All Park visitors will be treated with a respectful attitude. A quiet, calm and professional voice shall be used when addressing Park visitors.

Opinions about park management shall not be shared with the public during working hours. Employees will be familiar with contents of the current the Superintendent’s Compendium.

C.3.6.2 On-site Operations Manager

The contractor’s On-site Operations Manager shall:

a) Be on-site or on-call whenever the contractor’s employees are performing work on the site, or have an appointed replacement known to the CO.

b) Shall attend & participate in all meetings as requested by the CO, which pertain to the VTS.

c) Be an on-site, experienced manager.

d) Be trained in CPR. A copy of certification shall be submitted to the CO upon request.

e) Maintain On-Site Managers Reporting Logs. Refer to “Reports” section below for additional information

C.3.6.3 Dispatchers

The Contractor shall provide a sufficient number of dispatchers to ensure coverage at all times during service hours. If adequate, On-Site Manger may serve as dispatcher. Dispatchers shall:

a) Meet all driver requirements listed herein.

b) Are responsible for communications with the NPS for on-street service operations.

C.3.6.4 Tram Drivers

The Contractor shall not hire any person for a Driver position that:

a) Has a driving/motor vehicle record with more than five infractions points within the last two years.

b) Has a driving/motor vehicle record which contains a conviction within the last five years for any of the following:

1. Reckless operation

2. Careless driving

3. Driving under the Influence (DUI)

4. Driving While Intoxicated (DWI), and or Implied Consent

5. Any suspension or revocation of any driving privileges under any Implied Consent statutes regardless of the type of vehicle that was being driven.

This requirement shall be read broadly to cover any similar offense of operating any type of motor vehicle while under the influence of, or impaired by, any drug, substance or alcoholic beverage.

Drivers shall:

a) Be least 21 years of age.

b) Have a high school or equivalency diploma.

c) Clearly speak, read and write the English language.

d) Possess, before the operating season, a valid Florida operator’s license for the size and class of the vehicle driven. Tram vehicle drivers shall meet all other requirements and have all other licenses, permits, endorsements, or other privileges that, although may not be specifically referenced, are required by Federal and State laws and regulations.

e) Meet the minimum physical standards as described in the Federal Motor Vehicle Carrier Regulations, Title 49 of the Code of Federal Regulations.

f) Have completed, in addition to possessing the required licensing, a course of training in vehicle operations to include backing, that will ensure safe and professional operation of said tram vehicles. The Contractor will develop this training, and tram vehicle driving experience may be substituted for formal training.

g) Attend an NPS orientation developed by NPS staff relating to park issues, resources, history, customer service etc. Tram vehicle drivers are employed primarily as transportation providers and not tour guides; information provided to park visitors will be to encourage them to use the viewpoints and visitor services. This training will enable drivers to provide basic, accurate information to questions from visitors in a courteous manner.

h) Adhere to the following appearance requirements. Drivers shall present a clean, well groomed and neat appearance at all times. Hands, teeth, ears, and fingernails shall be clean. Hair shall be neat, clean, combed, and acceptably trimmed and groomed. Hair must not obstruct the vision of the operator from either the front or sides. Beards, mustaches, and sideburns shall be neat, clean, and trimmed to give a well-groomed appearance. Uniforms shall be cleaned and pressed at frequent intervals; must be neat, clean and in satisfactory fit, and must be in good repair. Buttons, emblems or logos shall not be worn, except for Contractor logo, name, and Contractor awards, such as safe driving pins.

i) All drivers shall be trained and certified in first aid, CPR/AED. Documentation of certification shall be provided to the COR at start of contract and within 30 of an any re-certification.

Drivers shall adhere to the following requirements.

a) As a condition of employment all drivers shall ensure their seatbelts are properly fasten prior to putting their vehicle in motion.

b) Engines shall be turned off and key removed when drivers leave their vehicles in public areas.

c) Other roadway users (walkers, bicyclists, other vehicle drivers) shall be respected in word, deed and attitude.

d) If unable to pass, a safe distance shall be maintained behind bicyclists or pedestrians on the roadway. If passing, a safe distance shall be given between tram vehicles and bicyclists or pedestrians.

e) When passengers create an unsafe atmosphere the tram vehicle shall be stopped in a safe location and appropriate NPS or Contractor staff shall be immediately notified of the situation.

f) Vehicle horns shall be used to warn of unsafe conditions, not to gain attention.

g) All Park visitors will be treated with a respectful attitude. A quiet, calm and professional voice shall be used when addressing Park visitors.

h) Drinking and eating by drivers shall be allowed only when the tram vehicle is fully stopped.

i) Cell phone use shall be allowed for tram operations purposes only when the tram vehicle is fully stopped.

j) Opinions about park management shall not be shared with the public during working hours.

k) A complete uniform shall be worn when operating tram vehicles with passengers aboard.

l) Tips shall be neither solicited nor accepted.

m) Operate over designated routes in compliance with approved operating schedules and times with an emphasis on safety, positive customer service, and protection of NPS property and equipment.

n) Make a thorough pre-trip inspection at the beginning of each shift.

o) Be in a uniform at all times while operating tram vehicles.

p) Communicate with the Contractor’s personnel for all service related communications via radio or cell phone. (Cell phones may only be used when the tram vehicle is not in motion).

q) Record numbers of all passengers at each stop according to On-Site Operations Manager Reporting Logs, as described herein. Reference C.6

r) Immediately notify GUIS dispatch when the following occur:

1. Any injury or illness warranting medical attention,

2. Any property damage,

3. Any vehicle accident,

4. Any complaint against an NPS employee or volunteer

s) Contact Contractor’s personnel with immediate notification of GUIS dispatch as appropriate when:

1. Involved in a collision of any type (regardless of the amount of damage), and/or any injury, regardless of severity, to contractor’s staff, passengers, Service staff, visitor or wildlife.

2. There is a mechanical problem, including wheelchair lift, destination sign, no-starts, as well as any other mechanical problem that may cause a delay.

3. There is an incident on the tram vehicle, (e.g. argument with a passenger, injury, sick passenger, and physical violence on the tram vehicle).

4. Encountering a detour or blockade on the route that was not previously reported.

5. Passengers are passed up due to an overload or a lift not working.

6. Resuming picking up passengers (giving the approximate number of passengers passed up).

7. Requiring information, assistance, or action by dispatch.

8. Reporting a collision or emergency that is observed in which there are obvious injuries or the parties involved ask the tram vehicle driver to call.

C.3.7. Reports and Performance Plans

General

All reports shall become the property of the NPS upon submittal.

On-site Manager’s Logs:

Maintain an On-Site Managers Reporting Logs noting number of passengers boarding and exiting at each stop, delays due to visitor traffic blocking access in duration of more than 5 minutes, collisions, daily activities, and driver shifts for each tram vehicle.

Monthly Reports:

The Contractor shall submit monthly Service Reports within 5 days of the end of the month. Reports shall support invoices. The Contractor shall provide the service report to the CO, who will verify its submission before a monthly invoice may be submitted for payment. Invoices submitted without adequate support will be returned unpaid for reprocessing.

The monthly service report shall include:

a) Drivers Hours

b) Mileage Log. Logs, the vehicle number, the odometer readings.

c) Repair Log

d) Rider Statistics by Route, Day, Hour, and Month, Counting Boardings. (Drivers will count passengers boarding at each stop)

e) A narrative of the significant events for the month. Examples of items include exceptional crowding at loading points, items of concern in operations, numbers of particular repairs or inspections made, drivers or mechanics’ suggestions for improved operations, etc.

f) Total number of actual hours of service provided for the invoiced month in accordance with the contract and any amendments.

End of the Service Year Report

The Contractor shall submit end of Season Annual reports within 15 days of the last day of operation. Reports shall summarize the information from the Monthly Service Reports and include the yearly total for number of employees by title and the turnover rate for the year.

Service Statistics

The Monthly Service Report shall contain the following monthly totals and year-to-date cumulative totals:

a) Hours of transit service provided (total by route if more than one route). (This does not include dead heading time)

b) Total mileage driven

c) Number of passengers transported

d) Wheelchair loadings that were successful

e) Wheelchair loadings that were attempted but not successful

f) Number of vehicle collisions

g) Number of passenger collisions

h) Number of late and missed trips

i) Number of employees hired, disciplined and terminated

j) Copy of complaints/suggestions made by passengers

k) Copy of compliments made by passengers

l) Traffic violations

Emergencies, Collisions & Other Misc. Incident Reports

The Contractor will follow NPS procedures for the reporting of collisions and incidents and shall provide written reports. The Contractor shall report all collisions, incidents, damage to NPS property, loss of keys, personal injuries, and/or hazardous conditions to the COR, Office Phone TBD (leave message and call Cell Phone TBD if not available at the office) within six work hours after such occurrence.

The Contractor shall immediately notify the NPS regarding all disruptions in the provision of service, including but not limited to, vehicle breakdowns, detours, collisions, delays, environmental hazards and missed runs.

The Contractor’s tram vehicle drivers shall notify the NPS immediately of any collision (regardless of how minor) or incident. Two copies of a written collision or incident report shall follow this notification within 72 hours to the CO. This includes collisions on NPS property and anytime the vehicle is transporting visitors. The Contractor shall provide the CO with the total number of collisions incurred in the previous month, broken down by the number of preventable and non-preventable collisions.

Vehicle Data & Maintenance Files

The Contractor shall maintain individual up-to-date files on each tram vehicle including but not limited to:

· Make

· Model

· VIN

· Coach serial number

· Major component change outs

Consolidated reports (vehicle)

· Repair Log and Work orders

· Mileage or hours in service

· Failure/road call information

· Radio serial numbers or replacements

Other Reports

The Contractor shall maintain reports that include, but are not limited to, the following: Add/Drop list of all Contractor employees; justification of need to alter or modify schedule to meet passenger demand; employee training records/motor vehicle records; drug and alcohol policy and compliance statement. These reports shall be submitted with the End of Year Service Report, and be available for review by the CO upon request during operations.

Performance Plan

The Contractor shall establish a Performance Plan to assure the requirements of the contract are provided. The plan shall include, but not be limited to, the following:

· An inspection system covering all services (transit and mechanical) to be performed under the contract, which must specify areas to be inspected on either a scheduled or an unscheduled basis and the title of the individuals who will perform the inspection.

· A method for identifying deficiencies in the quality of services performed before the level of performance becomes unacceptable. The Contractor shall maintain a file of all inspections conducted and corrective actions taken. This documentation shall be made available to the COR and/or COR upon request.

C.3.8. Invoices

No later than ten days after the end of the billing month, the Contractor shall submit an invoice to the NPS. The invoice shall provide a detailed accounting of billed transit service hours.

No payment due in any month shall be paid unless the monthly reports required pursuant to this contract due for all periods prior to and including the month for which payment is requested have been filed with NPS in accordance with this Contract.

C.3.9. Complaints & Commendations

Complaints about service are an adverse reflection on both the Contractor and the NPS. It is in the best interest of both parties under this Contract to minimize complaints about transportation services.

TRAM SERVICE - Every complaint, concern, suggestion, or commendation concerning personnel and service provided by the Contractor received by the Contractor, must be provided to the COR within 24 hours of receipt and investigated with corrective action taken within 72 hours of receipt by the Contractor. Complaints involving safety issues shall require the immediate action of the Contractor. Within 72 hours of the Contractor's receipt of the complaint, the Contractor must respond with the disposition of the complaint to the COR, including any action taken to prevent re-occurrence of the complaint in the future.

PARK SERVICE - The Contractor will also forward to the COR any and all complaints, concerns, suggestions, and commendations that are received directly by the Contractor concerning the park service within 24 hours of receipt.

The NPS shall provide the Contractor with standard Visitor Comment forms. Visitors that offer verbal comments to Contractor personnel shall be provided a comment form to be completed by the visitor and returned to the Park, if they choose.

C.3.10. Safety

General

The Contractor shall develop, maintain and implement a written Safety Program. The contractor shall submit the plan to the COR for approval prior to commencing any work on this contract. The program / plan shall include the following elements:

· Adherence and implementation of all requirements and recommendations of OSHA, the National Park Service Loss Control Management Plan, Guideline National Park Service-50)

· Purpose, Duties, Responsibilities and Administration

· Inspection and Abatement

· Collision Investigation and Reporting

· Safety Committee and Annual Plan Review

· Training

· Emergency Procedures

· Spill prevention and response procedures

The Contractor shall maintain a safe and healthful environment for all employees and visitors under the influence of the Contractor's operations.

Federal and State OSHA Officials and National Park Service officials may perform scheduled safety inspections. The park may request additional inspections by the state Department of Transportation.

The Contractor shall ensure that the On-site Operations Manager is trained in Root Cause Analysis and implementation for response to incidents. (Root Cause Analysis – A technique used to identify the conditions that initiate the occurrence of an undesired activity or state.)

The Contractor shall submit a Monthly Safety Report, including, but not limited to, narrative of all collisions or incidents, notice of attendance at safety meetings, notice of safety training held and suggestions for safety improvements.

The Contractor shall prepare and submit a Collision Report, for any collision or incident involving Contractor employees or Contractor vehicles within Gulf Islands National Seashore or Government vehicles at any location. Except for witness statements, reports will be typed or prepared on computer.

In addition, NPS dispatch must be notified at the time of all motor vehicle collisions and a law enforcement ranger will be requested in order to complete an investigative report.

The On-site Operations Manager shall insure that weekly safety meetings are conducted to allow the largest driver attendance.

The Contractor shall maintain a system of records to meet United States Department of Transportation (USDOT) and Florida Department of Transportation (FDOT) regulations regarding employee records for driving time and for on-duty time for all tram vehicle drivers.

Safety Training

The Contractor shall develop an ongoing Safety and Training/Refresher Training Program. This program shall address any unsatisfactory tram vehicle driver performance, or if the driver has not driven for 90 days for any reason. This training shall be at the Contractor’s expense. The Contractor shall maintain a complete training file on each employee and shall make it available to COR upon request.

C.3.11. Media

Passengers shall not be subjected to requests for interviews by the media in an environment where the passenger is held “captive”, such as on board a tram vehicle. Any member of the media boarding one of the tram vehicles with the intent to conduct passenger interviews shall be instructed that, providing the passengers are willing to be interviewed, the interview can take place when the passengers are off the tram vehicle; and there are to be no interviews on board the tram vehicle.

C.4 QUALITY ASSURANCE

Quality assurance reviews, observations and inspections (ROI) by NPS staff shall be performed periodically. The NPS shall perform ROI on all areas of the VTS. The NPS reserves the right to perform ROI at any time, both announced and unannounced. During ROI the COR will inform the Contractor of all conditions which must be corrected and the time the Contractor has to correct the condition. All corrective actions are subject to follow-up ROI by the COR or their designee.

All inspections performed by the COR or their designee are for the benefit of the government and do not absolve the contractor of the need to perform inspections of their own.

The following table indicates contractor tasks upon which the Government intends to evaluate the contractor’s performance via ROI. The Government and Contractor shall maintain a record of all ROI. At the end of each month, the Government shall calculate the percentage of ROI for which the contractor did not comply with the contract requirements. When the percentage of non-compliance exceeds the acceptable quality level, (ACQ) noted below the contract price and the noted Price Reduction shall reduce subsequent invoiced amount.

The Government may enforce other contractual remedies including but not limited to termination for default, if the contractor performs significantly below the AQL and / or should the contractor’s performance not meet the AQL for 2 or more months within a 1-year period.
