About this file
This is Amendment 1 to a National Park Service (NPS) solicitation for the purchase of trash receptacles. The solicitation number is 140P3026Q0009, issued by the NPS, NCR Regional Contracting Acquisition Management Division located in Washington, DC. The amendment is effective as of April 16, 2026, and does not extend the deadline for offer receipt.
The requirement is for the NACE purchase of 25 Victor Stanley Ironsites Model S-25 trash receptacles in High Gloss Black including associated hardware, with a brand name requirement specified. The period of performance runs from June 1, 2026 to June 30, 2026. The amendment addresses three substantive items: (1) Buy American Act compliance requirements, clarifying that FAR 52.225-1 and 52.225-2 (DOI deviation versions) apply, with COTS status not exempting either clause but waiving component analysis for COTS items except for predominantly iron or steel products—which still requires 95% domestic iron-and-steel content certification; (2) confirmation that installation will be completed by the park and is not part of the contractor's scope; and (3) incorporation of FAR 52.240-90 as Attachment 4 in its entirety. Offerors must acknowledge receipt of this amendment prior to the solicitation deadline using one of the specified methods. The Contracting Officer is Casey Winters (casey_winters@ios.doi.gov).

Amendment 1, Q&A:
1) Regarding Buy American Act - depending on the final quote the CO anticipates the following to apply -
FAR 52.225-1, Buy American¿Supplies, paired with the solicitation provision 52.225-2, Buy
American Certificate. Both use the DOI class deviation version rather than the stock FAR text. At [IGE] the Israeli Trade Act threshold of $50,000 is not crossed, so 52.225-3 and its alternates do not apply, and the WTO GPA and
Trade Agreements clauses are well out of range.
COTS status does not except either clause. The clauses still ride in the solicitation and in the award. What COTS changes is how "domestic end product" is evaluated. Under FAR
25.101(a)(2)(ii), the component test, meaning the domestic content percentage, is waived for
COTS items. Only the "manufactured in the
United States" prong remains. An offeror selling a receptacle manufactured domestically can certify as a domestic end product without a component-by-component analysis of bolts, hinges, fasteners, paint, or finish.
The caveat sits at FAR 25.101(a)(2)(ii)(B). The
COTS component-test waiver does not extend to end products that are predominantly iron or steel. A steel trashcan is squarely in that category. The 95% domestic iron-and-steel content rule still applies, and the offeror has to affirm iron/steel content on the 225-2 certificate, not just U.S. manufacture. Most
U.S.-manufactured commercial receptacles clear this, but it is not a rubber stamp and should not be treated as one.
52.225-1 and 52.225-2, DOI deviation versions, in the solicitation and contract. Offeror certifies on 225-2. No component analysis required, iron/steel content still required.
2) Installation will be completed by the park, this answer confirms that installation is not a part of this requirement.
3) Add Attachment 4 and incorporate FAR
52.240-90 into this solicitation in its entirety.
No further changes.
