About this file

This document is a justification for limiting competition to a specific brand name product on a federal contract. The National Park Service National Capitol Region contracting office seeks to procure a Bobcat Model UW56 skid steer loader from Bobcat to match existing equipment and attachments already owned by the park. The park currently uses interchangeable attachments on its other Bobcat skid steer and wishes to avoid increased costs of purchasing new attachments needed if a different brand were selected. Two open market quotes were obtained and will be evaluated for price reasonableness. No efforts to seek competition were pursued due to the specific need to match existing Bobcat equipment. The related solicitation is for the identified Bobcat product with a closing date of September 11, 2023 under National Park Service contract number 140P3023Q0074.

2. Description of the action being approved:

The National Park Service (NPS) shall be soliciting for Name Brand Bobcat Skid Steer Model UW56. The documents included with the solicitation call for specific brand name products that are peculiar to one manufacturer. 3. Description of supplies and services:

Bobcat Skid Steer Model UW56

4. Authority:

FAR 13.106-1(b)(1) circumstances of the contract action deem only one source reasonably available (Brand Name)

5. The description of the product’s unique qualifications or the unique nature of the acquisition:

The park is in need of an additional Bobcat Skid Steer. The park currently has another Bobcats and various attachments that are interchangeable. In order to keep government costs down, the park is requesting another Bobcat Skid Steer be purchased so that the existing attachments will be usable on the new Skid Steer. If the park was to purchase another brand of Skid Steer, they would also have to purchase all new attachments required for the various work to be completed around the park. This would drive up the cost of the procurement and therefore, would not be in the best interest of the government to accept another Brand of Skid Steer.

6. Efforts to obtain competition:

Due to the specific requirements needed by the park for this procurement, no efforts to obtain competition exist.

7. Determination that costs will be fair & reasonable:

Price analysis will be conducted using the techniques as described in FAR 13.106-3(a).

8. Description of the market research conducted:

Market research was not conducted due to the specific requirements on this procurement.

However, this procurement was originally solicited through GSA, where it was determined that Bobcat is no longer available for purchase on that Supply Schedule. However, two vendors submitted Open Market Quotes that were used to help determine price reasonableness.
