The purpose of this amendment is to provide further information to a vendor request for information #47. Additionally, the NPS has provided some West Virginia AST requirements which directly follow the clarification of RFI #47.

Requirement is for ICC 3RD Party inspector.

Will an STI SP0001 inspector meet this requirement? Typically used for to commission and during the service life of aboveground storage tanks. ICC seems to indicate commercial building code for fuel oil/gas code, but isn’t the same as an STI inspection.

a. It seems as though the STI SP0001 inspection relates only to the tank. The intention behind this requirement is to ensure the full installation meets the ICC and associated codes.

The ICC does not issue a specific standalone code exclusively for ASTs; instead, the IFC and IBC incorporate requirements for ASTs, particularly for flammable and combustible liquids, hazardous materials, or oil storage. Post-installation inspections focus on compliance with these codes and standards, as well as federal, state, and local regulations, such as the EPA’s Spill Prevention, Control, and Countermeasure (SPCC) requirements (40 CFR Part 112) and industry standards like STI SP001 or API 653.

These inspections generally require additional items such as, but not limited to, the following:

• Verifying spill control measures (Overfill prevention devices, alarms, or shut off valves, etc.) are installed and operational

• Piping integrity, inspecting for leaks corrosion or improper connections

• Inspection of valves and pressure or leak testing results

Additionally, we have attached a word document that states some basic, and some not so basic, WV AST requirements. We have provided these for their benefit and the list is not all inclusive, but it identifies some 30-day periods for the application and other items for them to be aware of.

In West Virginia, when replacing an above-ground storage tank (AST), you need to comply with the regulations outlined in the West Virginia Administrative Code (WAC) and follow the guidelines provided by the WV Department of Environmental Protection (DEP). Specifically, you'll need to submit a written notice to the WVDEP 30 days before the replacement, and the work must be done by a certified worker.

Here's a more detailed breakdown:

1. Notification and Permit:

• Written Notice:

You must submit a written notice to the WVDEP at least 30 days before starting the replacement process.

• Certified Worker:

The installation must be performed by a Class A certified worker who is on-site during the entire process.

2. AST Regulations:

If you are replacing an existing tank, you'll need to submit an AST closure form to the Secretary at least 30 days before closing the old tank, unless it's a corrective action ordered by the Secretary.

New Tank Requirements:

New ASTs must be designed, constructed, and installed according to the manufacturer's instructions, the AST Rule, and industry standards.

Secondary Containment:

All ASTs must be surrounded by a secondary containment area capable of holding 100% of the largest tank's contents, plus an additional 10% for precipitation.

3. Important Considerations:

• Tank Size: Compartment tanks must have a minimum capacity of 1,320 gallons.

• Manifolded Tanks: Manifolded tanks must meet capacity requirements and be Level 1 ASTs.

• Notification to Emergency Response Agencies: Notification to the county and municipal emergency management agencies is required.

• Final Closure Report: After completing the tank replacement, a final closure report must be submitted to WVDEP.
