Subject: Guidelines for Park Access and Credentialing

The Statue of Liberty National Monument and Ellis Island Immigration Museum are American Icons of freedom, recognizable around the world. The United States Park Police provide law enforcement and security services at this National Park Service site. Access to this site is restricted and regulated by our “Guidelines for Park Access & Credentialing” plan. This comprehensive plan is designed to enhance security operations at the park. Your cooperation and adherence to these guidelines is required and appreciated.

Statue of Liberty N.M. & Ellis Island Guidelines for Park Access & Credentialing

The following rules and procedures shall guide all Contractors, Subcontractors, Concessionaires and Partners of the National Park Service through the process of obtaining a Park ID for authorized access to the Park.

Park Identification Cards

• A completed U.S. Park Police Identification Card Application & Background Check Request Form (attached) must be submitted to the U.S. Park Police (USPP) at least (2) weeks in advance of the employment or work start date. All ID applications shall be submitted to Mr. Douglas Osoba, U.S.

Park Police Administrative Assistant. The USPP Administrative Assistant’s desk is located inside the Ellis Island Police Office (EPO); see attached map. Direct contact: douglas_osoba@nps.gov Phone: 646-356-2121.

• All criminal history must be included on the form. Although the main concern of the USPP is serious criminal activity, and/or appearance on terrorist watch lists, omission of minor criminal incidents is a credibility issue which will delay approval and may be cause for denial. Intentionally providing false information in any way will result in denial of the application.

• Once the application is approved you will be required to arrange an appointment with the USPP

Administrative Assistant to have your photograph taken and ID card issued. You must come in person to EPO for this appointment. Digital photographs will not be accepted via email.

• ID cards will be valid for the anticipated term of the project or for a (1) year period for concessioners and long term contractors.

• A replacement ID card will not be issued unless the expired or damaged card is returned. If the ID card is lost or stolen a report must be immediately filed with the USPP. The USPP case number must be provided to the USPP Administrative Assistant prior to issuance of the replacement card.

• Short-term contractors & sub-contractors (requiring access for up to 7 calendar days) do not require a

Park ID, but will need to be placed on a list to obtain a day-pass at the service entrance. This can be accomplished by requesting access for non-NPS credentialed contractors or visitors through your NPS Project Manager or designated NPS point of contact. These requests will be routed to Ms.

Jennifer Getter, Confidential Assistant to the Superintendent, who will have the requests approved and added to the access list. Direct contact: Jennifer_Getter@nps.gov Phone: 646-356-2102.

• The day-pass program is designed to allow access to visitors and/or contractors who will be on site for a very brief period. If we identify that you are attempting to utilize the day-pass program for a period beyond (7) calendar days you will be removed from the list and prohibited from entering the park.

Be prepared to present your Park ID/day-pass to a USPP Officer or National Park Service (NPS) employee if you are in an area closed to the general public. Generally, the ID/day pass should be worn on an outer garment and kept readily visible at all times. You will also be required to present a Federal or State issued photo ID at the service entrance during the check-in & screening process.

Violations of this policy will be documented and relayed to your NPS point of contact.

Truck Deliveries & Access

Deliveries via Post IV can be arranged (7) days a week, between the hours of 0700 to 1400.

(48) hours advance notice is required.

Vehicles attempting to enter the Park through Post IV in Liberty State Park must be placed on the access log by your NPS point of contact. All concessionaires/project managers will have a designated person who will act as a single point of contact with the NPS. This individual will be responsible for properly completing the Post IV & Battery Park access request forms (attached) and providing these forms to the Confidential Assistant to the Superintendent prior to 1400 hours each day. The list for Monday will be submitted Friday afternoon along with any requests for weekend access.

All trucks must be equipped with a lift gate for canine access. The center isle of the truck must be left open to allow for a walkthrough. Delivery trucks cannot be overloaded, or the driver will be required to empty out the truck’s contents at Post IV for canine inspection. Some deliveries may not be easily screened (soil or cement for example) and an officer may need to be present when off-loaded.

The driver’s name, company name and receiving company or NPS point of contact must be provided.

Driver and all delivery personnel must carry a valid photo ID. The driver must have a bill of lading.

The time of delivery must be provided.

Armored vehicles must be on the Post IV access list. When an armored vehicle arrives at Post IV the driver must stop the vehicle and make contact with the USPP Officer. The driver must provide valid photo identification and open the back of the vehicle for a visual only inspection. At no time will the driver be asked to leave the vehicle unattended. Barring any exigent circumstance, a USPP Officer or canine team will not enter the armored vehicle. A canine team will conduct an exterior sweep of the vehicle.

There may be random inspections of departing motor vehicles & vessels.

All persons and bags are subject to search and canine inspection when entering or departing the park and at all times while on-site.

Unscheduled or late deliveries (whether by boat or Post IV bridge) will be denied access and turned away by USPP.

Barge Deliveries & Access

All barges & vessels will be screened by a USPP Canine Team prior to entering the maritime security zones or arriving at Liberty or Ellis Island. Be advised that unauthorized entry into the USCG security zones around the islands is a violation of law and punishable by appropriate law enforcement action including summons issuance and/or arrest. At no time should a vessel enter the security zone without permission. (See attached security zone map)

Emergency requests may be made by calling the 24 Hour USPP Dispatch Center at (718) 338-3988.

Deliveries by water, with a qualified need to go directly to Liberty or Ellis Island, must be arranged at least (48) hours in advance and are by strict appointment only.

Canine Sweep requests for off-site locations such as Miller’s Launch require dedicated personnel and will be considered on a case by case basis. Additional canine teams may be required to accommodate these requests. The NPS/USPP will provide a cost estimate to the contractor for services outside 0600-1400 or at locations other than Post IV (NJ), Liberty State Park (NJ), or Battery Park (NY) where canine teams are typically assigned. The contractor will be responsible for reimbursement of all expenses related to these special request sweeps. A minimum of (48) hours advance notice is required and a weekly summary of scheduled deliveries is preferred.

Canine sweeps for waterside deliveries may be conducted at a pre-arranged local boat ramp, marina or Miller’s Launch in Staten Island (NY). After the sweep is completed the vessel will either be escorted by The USPP Marine Patrol Unit (MPU) or be monitored on CCTV while entering the security zone. In some cases a USPP Officer may remain present on the barge while it is in transit to Liberty Island.

Prohibited Items

Restricted Areas

Contractors and subcontractors are only authorized to be on-site in a designated work zone. Individuals may not enter closed or restricted areas, or take park property as souvenirs. The vast majority of buildings and other park resources are historic in nature and therefore protected by ARPA

(Archeological Resource Protection Act). This Federal Law protects the resources against theft, destruction and vandalism. ARPA imposes severe penalties for these types of violations.

Parking

Parking on Ellis Island is limited and restricted. Contractors will be allotted parking permit hang tags per the contract documents. All vehicles must display the hang tag when on island and only park in designated areas if outside of the Contractor’s staging and laydown area. In general, Contractor parking will be restricted to the area north of the Baggage and Dormitory building. If additional parking is authorized, then the Contractor/Subcontractor vehicles are restricted to YELLOW parking spaces as designated by yellow wheel stops. At no time may any contractor vehicle park in a space with green, grey or black & white wheel stops, nor in any area designated by signage or striping as no parking. Violators of this policy will be issued summonses and may be towed at the owner’s expense. Parking in unauthorized areas is prohibited.

(See attached parking map).

The contractor is free to manage parking for itself and subcontractors within the designated staging and laydown area. The Contractor will need to coordinate swing space for parking or alternate off-site parking needed to accommodate parking. Any contractor vehicles that park in Liberty State Park must use the metered day lot off of Audrey Zapp Drive, located west of the Railroad Terminal building. Liberty State Park may allow parking in other locations if the Contractor coordinates with Liberty State Park management and pays the required permit fees. The National Park Service will not be liable for any fines if vehicle owners are ticketed or towed for illegal parking in Liberty State Park.

The Confidential Assistant to the Superintendent may authorize Post IV to issue a limited number of yellow “Visitor” parking placards for single day use for deliveries or other contract activities.

If an assigned parking placard is lost or stolen, a report must be immediately filed with the USPP.

1) (a) Depending on your starting location, drive north or south on the New Jersey Turnpike to the Turnpike Newark Bay Extension (Exits 14 A-B-C) and head east on the Extension toward the Holland Tunnel.

(b) If you are coming west, through the Holland Tunnel to New Jersey, keep to the right for several blocks after you exit the tunnel in Jersey City. You will eventually come to signs directing you to the New Jersey Turnpike. Take this Turnpike road and pass through the first tollbooths then follow the instructions beginning with # 2 below.

2) Leave the Extension at Exit 14 B, bearing to the left immediately after passing through the tolls.

DO NOT drive over the bridge to your right!

3) Follow the signs to the Statue of Liberty/Ellis Island Ferry. You will quickly come upon a traffic circle where you will bear to the RIGHT, going past the circle and heading down Morris Pesin Drive, which is lined with flags. You will reach a barrier somewhat further along that road at which point you should turn left onto Freedom Way.

4) Follow Freedom Way about 9/10th of a mile at which point you will see an asphalt drive turning off on your right with a sign saying “Ellis Island Deliveries / Authorized Vehicles Only,” with concrete barriers & a Police checkpoint further down in the direction of the island.

5) You should turn right and drive carefully & slowly along this road, because there are sometimes bicyclists, joggers, and pedestrians crossing the road. You must yield to pedestrians.

6) When you reach the guardhouse you must stop for inspection by the United States Park Police. The officer will ask you to present a photo ID and to raise the hood of your vehicle and also to look in your vehicle trunk. The private security guard at the guardhouse will check a list for your name, which has been placed there in anticipation of your arrival. He or she will ask you to fill out a temporary ID tag form to place on your clothes and may provide you with a temporary parking tag for your car.

SECTION 01 11 00 - SUMMARY OF WORK

PART 1 - GENERAL

1.1 SUMMARY

A. This Section includes the following:

1. Work covered by the Contract Documents.

1.2 WORK COVERED BY CONTRACT DOCUMENTS

A. Project Location: Historic Fort Wood, Statue of Liberty National Monument (STLI), New York, New York.

B. The Work consists of the following:

1. The Work includes rehabilitation of the Historic Fort Wood stone walls and coping stones, foundation repairs, including but not limited too; repair, patching, pinning, grouting, re-adhering, partial replacement, full replacement, joint repointing and cleaning.

2. This project is not seeking a Certification Level according to the U.S. Green Building Council's Leadership in Energy & Environmental Design (LEED) Rating System. See as Division 01 Section "Sustainable Design Requirements for Non LEED Projects” for additional information.

C. Project will be constructed under a single prime contract.

1.3 CONTRACTOR USE OF SITE

A. General: Contractor shall have full use of the approved designated fenced in project areas for construction operations during the construction period. Contractor's use of the site is limited only by the Government's right to perform work or to retain other contractors on portions of Project. There will be no visitor access within the designated fenced in approved project areas.

1. All emergency egress points, including the dock, are to remain unobstructed at all times during construction.

2. The perimeter of the security screening facility shall remain accessible to the Park/USPP at all times.

3. The two (2) existing emergency helicopter landing zones (see LZ map; minimum 50’ diameter each), located in the Monument lawn, must be maintained at all times. The work site must always be maintained such that spontaneous high helicopter winds from landing/take off do not cause construction material, debris, etc. to become airborne, as per Statue of Liberty N.M. & Ellis Island, Guideline for Park Access & Credentialing, attached at the end of Division 1 specifications.

4. Construction areas inside wall boundary at Terreplein level shall adhere to the following criteria;

a. Parapet level construction may be divided into work sections per approved work plan; a maximum of 25% - 50% of the total parapet area is permitted to be under construction at one time.

b. Contractor will be solely responsible for maintaining a general public access route around the perimeter of the Pedestal at all times during construction.

c. Contractor to occupy the narrowest width possible out from the inside points of the Fort star walls to feasibly accommodate work operations.

d. Areas between interior Fort wall points may be enclosed with straight runs (not following salient corners) of 8’ high painted wood-framed/plywood walls, with portion of Plexiglas windows.

e. Contractors are NOT permitted beyond the construction areas or further onto the Terreplein or into the Monument.

f. Minimize footprint of construction area and impact on visitor experience to the extent possible.

5. Construction areas within the perimeter fence located on the Monument lawn shall adhere to the following criteria;

a. While work at ground level is commencing, no construction is to take place on the parapet.

b. Approved staging areas must be tucked away from the Statue’s front to the greatest extent feasible, thereby minimizing the impact to the visitor experience. Final staging area boundaries to be approved by the Contracting Officer.

c. Contractor to occupy the narrowest width possible out from the points of the Fort star walls to feasibly accommodate necessary scaffolding and work operations.

d. Areas between interior Fort wall points may be enclosed with straight runs of fence (not following salient corners).

e. Minimize footprint of construction area and impact on visitor experience to the extent possible.

f. Staging area/mobilization shall remain in the approved locations for the duration of the project.

6. Contractor use of and access to the landing “beach” on the northwest portion of the Island, as well as transporting/circulating over/across the Island on visitor walks, Malls, etc., is prohibited on this project. The only exceptions will be:

a. Non-motorized transportation of materials and equipment from work dock across

Perimeter and along Wing Walks to work site during non-visitor hours.

b. If craning items from waterside to landside, the contractor may temporarily close a small portion of the perimeter walk from the public for a short time period (up to 2 hours) with advanced notice (min. 72 hours) and park approval.

c. Contractor to provide all related temporary barricades, flaggers, etc. throughout project.

7. Limitations to contractor use of the existing park work dock, located to the northeast of the Monument, include:

a. No damage is permitted; protect dock accordingly. Photo document prior to start of work.

b. No heavy equipment or materials may by loaded onto or transported across dock.

Pending review of capacity.

c. No storage of material, equipment, etc. permitted on dock; items to be removed immediately.

d. Schedule use before and after visitor hours only. Visitor use of the Island-end of the dock must be maintained throughout the course of work.

8. Contractor permitted to deliver materials to/from the barge and the project area prior to the arrival of the first public ferry

a. After first public ferry, all contractor activities are confined to the approved designated staging area(s)

b. Work dock is the only permitted location for barge docking.

c. Contractor shall provide dock capacity limitation, prepared by a qualified professional Engineer licensed New York.

9. Contractors are NOT permitted beyond the construction areas or further onto the Terreplein or into the Monument.

10. Contractors are NOT permitted to utilize or enter any building facilities on the Island.

11. Contractor will be solely responsible for maintaining a general public access to and from all of the NPS facilities and adjacent properties throughout the duration of construction, per requirements of all authorities having jurisdiction.

12. Contractor to identify and provide all means necessary for maintaining general public access per ABAAS requirements, egress routes, emergency access and service access.

Contractor to sequence construction as necessary and relocate temporary ramps, fencing and gates, signage, barriers and other identified means necessary for access as needed throughout the construction period.

13. Contractor to coordinate pedestrian detour plan with Contracting Officer. Temporary closers to be approved by the Contracting Officer, except that the Monument shall NOT close due to this project work.

14. Reference 1.7 for work restrictions.

B. Limit use of premises to approved project areas. Do not disturb portions of Project site beyond areas in which the Work is indicated.

C. Storage of Materials: Confine storage of materials to the staging areas identified on the drawings.

Contractor is to coordinate the final staging area boundaries with the Contracting Officer.

Modifications to the approved staging area boundaries are to be approved by the Contracting Officer.

1. Existing walls, pavers, sidewalks, curbs and gutters, landscape, structures, and improvements destroyed, damaged or removed due to construction of this project shall be replaced or restored in like kind at the contractor’s expense.

D. Concurrent Projects: Several concurrent projects will be underway during this projects construction season. Contractor to coordinate limits of construction, temporary fencing and barriers, temporary utilities, staging area, placement of temporary facilities and access needs to not interfere with concurrent projects. Maintain a clear path for emergency access and deliveries at all times. Adjust limits of construction, staging areas limits and temporary utilities throughout the construction season as per the direction of the Contracting Officer.

E. Preservation of Natural Features:

1. Prevent damage to natural surroundings. Restore damaged areas, repairing or replacing damaged trees and plants, at no additional expense to the Government.

2. Maintain the temporary chain link fence with privacy screen throughout the duration of construction. Remove fence when construction is complete.

3. Provide temporary barriers to protect existing trees and plants and root zones.

4. Do not remove, injure, or destroy trees or other plants without prior approval. Consult with

Contracting Officer and remove agreed-on roots and branches that interfere with construction.

5. Do not fasten ropes, cables, or guys to existing trees.

6. Carefully supervise excavating, grading, filling, and other construction operations near trees to prevent damage.

F. Preservation of Existing Build Features:

1. The Statue of Liberty, Fort Wood is a New York City Landmark, UNESCO World Heritage

Site, U.S. National Monument and a U.S. National Registered Historic Place. All built features are contributing resources and all work must adhere to the Secretary of Interior’s Standards.

2. Prevent damage to portions of existing features not included in the scope of Work. Restore damage to pre-existing conditions, repairing or replacing damage as directed by Contracting Officer, at no additional expense to the Government.

3. Provide temporary barriers to protect existing features and portions thereof.

4. Carefully supervise excavating, grading, filling, and other construction operations near existing features to prevent unintended damage.

G. Driveways and Entrances: Keep driveways, docks and entrances serving premises clear and available to Government, Government's employees, and emergency vehicles at all times. Do not use these areas for parking or storage of materials.

1. Schedule deliveries to minimize use of driveways, docks and entrances.

2. Schedule deliveries to minimize space and time requirements for storage of materials and equipment on-site.

3. Docks and access routes to docks are to remain clear and operational throughout the duration of the project.

H. Construction Camp: Establishment of a camp within the park will not be permitted.

I. Hauling Restrictions: Comply with all legal load restrictions in the hauling of materials. Load restrictions on park roads are identical to the state load restrictions with such additional regulations as may be imposed by the Park Superintendent. Information regarding rules and regulations for vehicular traffic on park roads may be obtained from the Office of the Park Superintendent. A special permit will not relieve Contractor of liability for damage which may result from moving of equipment.

J. Contractor to provide an Under-an-Acre Pollution Prevention Plan (UPPP) in conformance with NPS guidelines, Best Management Practices (MBPs), NPDES and adherence to all applicable construction storm water management practices.

1. See Section 01 57 23 “Under-An-Acre Pollution Prevention” for requirements.

2. Erosion control is to be implemented and maintained at all times during construction.

3. Water containing waste from construction activities shall be discharged into a self-contained, leak-proof wash out system located within the defined project area; contractor provided, maintained and disposed of per regulations. The direct or indirect discharge of water containing waste to the storm system or water bodies is prohibited.

1.4 PUBLIC USE OF SITE

A. Contractor shall at all times conduct his operations to ensure the least inconvenience to the public.

Building closures will NOT be permitted.

B. The approved designated fenced in project areas will be closed to the public during construction.

Contractor will be solely responsible for maintaining a general public access to and from all of the NPS facilities and adjacent properties throughout the duration of construction, per requirements of all authorities having jurisdiction.

C. Public visitation will continue throughout the Statue of Liberty island, around Fort Wood, on to the terreplein and within the monument during construction.

D. Contractor shall at all times conduct his operations to ensure the least inconvenience to the public.

Contractor shall make any and all necessary measures to protect the general public from the construction sites. Temporary walk closures will be permitted, when required, upon specific approval of Contracting Officer for a maximum amount of time as approved by NPS.

1. Contractor to identify and provide all means necessary for maintaining ABAAS access routes, egress routes, emergency access and service access within NPS property.

Contractor to sequence construction as necessary and relocate temporary ramps, fencing and gates, signage, barriers and other identified means necessary for access as needed throughout the construction period.

2. Contractor to coordinate vehicular and pedestrian detour plan with Contracting Officer.

Temporary closers to be approved by the Contracting Officer.

1.5 OCCUPANCY REQUIRMENTS FOR BUILIDINGS

A. Existing Buildings

1. Full Government Occupancy: Government will occupy buildings that will be under construction during the entire contract period. Cooperate with Government during construction operations to minimize conflicts and facilitate Government usage. Perform the Work so as not to interfere with Government's day-to-day operations. Maintain existing exits, unless otherwise indicated.

a. Maintain access to existing walkways, corridors, and other adjacent occupied or used facilities. Do not close or obstruct walkways, corridors, or other occupied or used facilities without written permission from the CO.

b. Repair damage caused by construction operations. Protect building and its occupants during construction period.

1.6 CONDUCT OF OPERATIONS

A. At all times the contractor shall conduct his operations in conformance with the rules and regulations promulgated by the Secretary of the Interior for the National Park Service, and applicable park rules and regulations prescribed by the Park Superintendent.

B. Work on Saturdays, Sundays, Federal holidays or at night may not be performed without prior consent from the Contracting Officer. Submit requests 48 hours in advance of the work to the Contracting Officer for approval.

C. No signs or advertisements (except those specified herein) shall be displayed on the construction site or within the park unless approved by the Contracting Officer.

D. All work is being accomplished within a New York City Landmark, UNESCO World Heritage Site, U.S. National Monument and a U.S. National Registered Historic Place, and must adhere to the Secretary of Interior’s Standards.

1.7 WORK RESTRICTIONS

A. Schedule: Expected construction campaign: April - October 2021 and April - October 2022.

Recommended contract length is 2 seasons, but specifications allow for contractor to work over the winter if conditions for masonry work can be provided. Contractor shall schedule activities as necessary to comply with weather-related constraints for construction activities. Weather limitations include temperature range between 40F and 85F. All work is exterior, limited work can be done during rain events. In the event of a major weather event (high winds, hurricanes), equipment, scaffolding, and materials will need to be secured. If more than one season is required to complete the work, the owner shall be left with a fully functioning project area during the interim season.

B. On-Site Work Hours: Work shall be generally performed during normal business working hours of 7:00 a.m. to 5:00 p.m., Monday through Friday, except when otherwise indicated.

1. Weekend Hours: 7:00 a.m. to 5:00 p.m., are permitted upon request and approval by the Contracting Officer.

2. Early Morning Hours: are permitted upon request and approval by the Contracting Officer.

3. Hours for noisy activity: are permitted prior to visitors arriving to the park, upon request and approval by the Contracting Officer.

4. Dust: Contractor to adhere to all NPS, Under-An-Acre-Pollution Prevention (UPPP), Best

Management Practices (BMPs) and NPDES requirements. Correction measures to take place immediately upon the Contracting Officers request.

5. The Park is closed on Thanksgiving and Christmas Day.

6. Work is not permitted on July 4th.

7. Severe weather conditions.

C. Existing Utilities

1. Existing Utilities: Notify Contracting Officer and utility companies of proposed locations and times for excavation.

2. Contractor shall be responsible for locating and preventing damage to known utilities. If damage occurs, repair utility at no additional expense to the Government.

3. If damage occurs to an unknown utility, repair utility. An equitable adjustment will be made in accordance with the Changes clause of the contract.

D. Existing Utility Interruptions: Do not interrupt utilities serving facilities occupied by Government or others unless permitted under the following conditions and then only after arranging to provide temporary utility services according to requirements indicated:

1. Notify Contracting Officer not less than two days in advance of proposed utility interruptions.

2. Do not proceed with utility interruptions without Contracting Officer’s written permission.

3. Hours for Utility Shutdowns: are per approval by the Contracting Officer for no longer than 2 hours’ maximum in duration.

E. Nonsmoking Building: Smoking is not permitted within the building or within 25 feet of entrances, operable windows, or outdoor air intakes.

F. Existing Historic Resources: Historic structures and features once existed on or near the Project areas. All remnants of existing historic structures and features are to remain undisturbed and archeologically monitored under all circumstances associated with the scope of this Contract.

G. Concurrent Projects: Several concurrent projects will be underway during this projects construction season. Contractor to coordinate limits of construction, temporary fencing and barriers, temporary utilities, staging area, placement of temporary facilities and access needs to not interfere with concurrent projects. 1.8 SPECIAL CONSTRUCTION REQUIREMENTS

A. Project Website: A project website administered by the NPS will be used for purposes of managing communication and documents during the construction stage.

B. Statue of Liberty island and the monument are secured historic sites. Staging, access and periods of construction/installation shall provide that there is no interruption of site security. Contractor to coordinate site security with the Contracting Officer and USPP.

C. The Park is closed on Thanksgiving and Christmas Day.

D. Work is not permitted on July 4th.

E. Contractor to provide all third party inspections. Contractor to submit inspection reports to the Contracting Officer.

F. Winter Work is permitted. Contractor to submit winter operation plan to the Contracting Officer.

G. Severe weather conditions.

PART 1 - GENERAL

1.1 SUMMARY

A. The work of this section consists of administrative and procedural requirements for contract modifications.

1.2 DEFINITIONS AND ALLOWANCES

A. Home Office Overhead: Those costs incurred in support of all of a contractor’s projects and not attributable to a specific job. The cost for home office overhead is only allowed as a percentage of all direct work excluding profit. The following items represent allowable home office overhead costs identified in Part 31 of the Federal Acquisition Regulation (FAR):

1. Worker Hourly Rates are costs directly associated with the individual worker and consist of the following:

a. Base Rate: This is the hourly rate paid directly to the worker

b. Labor Burden: Employer payments of all applicable burdens, this includes insurance and taxes that the business must pay on behalf of the worker to government entities and educational forums , such as:

1) Social Security

2) Medicare

3) Workers Compensation– Policy and company calculation to be made available.

4) FUTA– Cap Rate and percentage to be proportionally allocated over one year.

5) SUTA– Cap Rate and percentage to be proportionally allocated over one year.

c. Fringe Benefits: Various non-wage compensations provided to employees such as:

E. Bonuses or Deferred Compensation: No Bonus or Deferred Compensation will be allowed within any components of pricing including Home Office Overhead, General Conditions, General Requirements, Hourly Worker Rates, or the direct costs of work.

F. General Liability Insurance: An insurance policy that protects the contractor from claims resulting from bodily injury or property damage to a third party. Include this as a separate line item within all modification proposals and provide a current insurance quote upon request.

G. Performance and Payment Bonds: A performance bond is a surety bond issued by an insurance company or bank to guarantee satisfactory completion of a project. The Payment Bond guarantees that the contractor will pay the labor and material costs they have incurred. Banks and Insurance companies charge a premium for each individual project based on a sliding scale which relates to the size of the project. Include this as a separate line item in modification proposals and provide current company bonding rates upon request.

H. Builder’s Risk Insurance: This covers the contractor’s loss due to fire, high winds, or other natural forces. This is not reimbursed by the National Park Service (NPS) and shall not be included in modification proposals.

1.3 MODIFICATION PROPOSAL PRICING REQUIREMENTS

A. General:

1. Your proposal must be received in the format and within the time frame specified in the Request for Proposal letter. Costs or delays resulting from failure of contractor to submit within the time frame specified will not be compensable.

2. The proposal must be detailed with itemized lists of equipment, materials, labor, production rates, overhead, profit, and bond markup for each item. Labor costs must be itemized by craft and hourly rate, including Fringe Benefits and Labor Burden. If the costs of Fringe Benefits and Labor Burden are not itemized, it is assumed that that they are included in the hourly rate shown, or contractor is not requesting reimbursement.

Contractor may utilize the government provided Contractor Estimate Form, or their

own form, provided that it contains the same information and level of detail as the Gov’t provided form.

3. Requests for extensions of contract time as a result of this change must be justified with a Time Impact Analysis (TIA). Refer to Division 01 Specification, “Construction Schedule”, for time impact analysis requirements. TIA and associated costs must be received with the proposal by the date shown within the Request for Proposal letter.

Contractor’s failure to submit within the specified time frame will be construed as the Contractor waiving the right for additional time and no time extension will be allowed.

4. All supporting documentation used to justify the proposed modification will be made available to the Contracting Officer upon request.

5. Contractor must review and approve all subcontractor/supplier pricing in detail for proper format, scope, production rates, and pricing prior to submission to the NPS. All delay costs associated with not reviewing and approving subcontractor/supplier pricing will be borne by the Contractor.

6. All pricing and production rates within the estimate must be based on fair and reasonable pricing and cannot include built-in contingency.

B. Labor:

1. Contractor shall estimate the cost of labor by itemizing each craft involved, indicating worker hourly rate (base rate + labor burden + fringe benefits) for each and itemizing the hours required for each craft that will be directly engaged in modification work.

Any work proposed that will require overtime work or premium pay shall be itemized separately. All rates shall be in accordance with the Davis-Bacon Act as incorporated herein. Labor Burden may include payroll taxes, Social Security, unemployment insurances, workers compensation insurance, FICA, FUTA, and other direct costs resulting from Federal, State or local laws.

2. Itemize labor costs for equipment operators separate from equipment costs.

3. The labor cost for foremen shall only be costs for related work required for the modification.

C. Materials:

1. The estimated cost for materials shall include quotes from multiple sources. Material prices must include all applicable fees and credits, including but not limited to, sales tax, freight and delivery charges, and tax rebates.

2. No markup shall be applied to any material provided by the NPS.

D. Equipment:

1. Equipment used for the project must be appropriately sized for the work being performed.

2. Do not include costs for “miscellaneous tools and equipment”, in your proposal for a replacement value of $500 or less. Costs shown in excess of $500 must be broken out separately.

3. Regardless of ownership, the rates to be used in determining equipment rental costs shall be the lowest cost from one of the following sources:

a. U.S. Army Corps of Engineers , Ownership and Operating Expense Schedule (use latest edition and applicable region)

b. Construction Blue Book

c. Local equipment rental rates, documented by actual invoice charges, or itemized vendor quotes.

4. The estimated equipment rates shall include the operating costs of all fuel, oil, lubrication, supplies, small tools, necessary attachments, ground engaging components, tires & tracks, routine repairs and maintenance (cost of major repair and overhaul is not allowed per FAR 31.105(d)(2)), depreciation, storage, insurance, and all incidentals.

Mobilization, if applicable, may be included for equipment solely used on the modification work but must be listed separately.

5. Estimate the full rate for equipment only for the duration that the equipment will be utilized to accomplish the work of the modification.

6. Standby unit rates used are to be in accordance with paragraph 1.3, D, 2, above. If the US Army Corp of Engineers is utilized then their standby rates prevail. If Bluebook or local equipment pricing is accepted, then ½ of the equipment costs minus any operating costs, major repair and overhaul will be accepted.

7. If equipment is in standby mode due solely to a documented NPS delay, the established standby rate shall apply from the first day of the delay.
