52.212-1 Instructions to Offerors—Commercial Items, applies to this Acquisition.
52.212-2 Evaluation—Commercial Items
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
Selection & Award
A Best Value – Lowest Price Technically Acceptable (LPTA), selection process will be used to evaluate, select and award the work of this request for Quote (RFQ). The LPTA process provides for award to the lowest priced proposal that meets a set of minimum standards of technical acceptability specified in the solicitation. This method is generally used when a minimum acceptable level of technical ability / quality can be established, and clearly described, which will meet the government’s requirements. There shall be no trade-offs. The Government reserves the right to reject all offers.
Offerors submitting proposals in response to this RFQ should limit submissions to data / information specifically requested, and considered essential for proper evaluation of proposals, so that a minimum of time and money will have been expended in preparing proposals. However, in order to be effectively and equitably evaluated, the proposals must include information sufficiently detailed to clearly describe the offeror's qualifications, based on the evaluation factors identified below.
Selection and award will be based on evaluation of the factors provided below. The evaluation factors are listed in their order of importance, and all evaluation factors other than cost or price, when combined, are equal than cost or price. Each factor must be individually and explicitly addressed in all proposals submitted. Submission requirements for each of the factors are described below.
Evaluation Factors
1) Experience & Past Performance
2) Cost / Price
Factor 1 ----- Experience & Past Performance
Experience will be used to evaluate the offeror’s most recent and relevant efforts at accomplishing work similar in nature to the requirements of this RFQ. To be considered relevant, projects submitted must be similar in scope, magnitude, complexity, and cost to mailto:david_larson@nps.gov the requirements of this RFQ. To be considered recent, projects submitted must be on-going, or must have been completed within the past five years.
Past performance will be evaluated on the extent of client satisfaction with the previous performance of the offeror; the offeror’s effectiveness in managing and directing resources; the offeror’s demonstration of reasonable and cooperative behavior in dealing with clients; the offeror’s quality of previously performed services; the offeror’s ability to control costs and manage contract activities; and the offeror’s effectiveness in meeting schedules in providing services and products.
The Government will use its discretion to determine the sources of past performance information used in its evaluation process. Past performance information may be obtained from references provided by the offeror, the agency's knowledge of contractor performance, other governmental agencies, or governmental past performance databases.
Submission Requirements
1. The offeror must provide a list of a minimum of 5 references to include the following: company name, official point of contact name, DUNS number, TIN number, address, phone, fax number, and email address. The list should also include the project performance period of time and the value of the contract.
Acceptable experience will be providing the reference list.
Acceptable past performance will be three acceptable ratings or above.
NOTE: The lowest price will be the only one evaluated. If it is unacceptable, the next lower will be evaluated until the LPTA is accomplished.
Factor 2 ----- Cost / Price
Cost/Price will be evaluated and considered but will not be scored. The proposed prices will be analyzed for fairness and reasonableness. They will also be analyzed to determine whether they are realistic for the work to be performed, reflect a clear understanding of the requirements, and are consistent with the information provided by the Offeror. Additionally, all offers will be analyzed for unbalanced pricing.
Submission Requirements
1. The offeror must submit a total price as shown on the Bid Schedule.
2. Submission of an incomplete / partially completed bid schedules will be considered non-responsive, and may result in possible elimination from further consideration for award.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 Offeror Representations and Certifications—Commercial Items, applies to this Acquisition.
The Offeror shall complete the annual representations and certification electronically via the System for Award Management (SAM) website located at https://www.sam.gov/portal. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u) of this provision.

Statement of Work
The National Park Service (NPS) is soliciting the services of responsible proposers to remove abandoned utility power poles, cross arms, conductor wire, hardware, and associated equipment from a section of abandoned power line in Big Bend National Park.
The Contractor is responsible for providing all necessary vehicles, personnel, equipment, person protective and other safety equipment, labor and permits required to complete the work identified in this Statement of Work (SOW). No work will begin until a Notice to Proceed is issued by the Contracting Officer.
Purpose
The goal of this project is to remove the poles, cross arms, conductor wire, hardware, and associated equipment from a 2 mile section of abandoned power line in Big Bend National Park, and to dispose of this material outside of the park in a proper, legal manner. This section of line consists of about 27 poles with 3 conductor wires and a ground wire (4 wires total). An important objective is to perform this work with a minimum of disturbance and environmental damage. An existing Rio Grande Electric Cooperative right-of-way road is present in the project area, but it has several washouts and requires repair before it could be used by vehicles.
All potential bidders are strongly encouraged to visit the work location and examine actual conditions prior to submitting a bid.
Scope/Mission
Repair unpaved right-of-way road as necessary to gain access to work area.
Safely remove about 2 miles (about 27 poles) of abandoned 3-phase electric transmission line and associated wire, hardware, cross-arms, and poles.
Remove all material from the park. Transport and dispose of toxic waste (including poles) at a legal, permitted facility.
Recycle or salvage other materials if feasible.
Perform work with a minimum of disturbance and damage to park resources. Rake out tracks and re-habilitate disturbed areas to reduce scars and prevent erosion.
Period and Place of Performance
The period of performance shall be between January 1, 2018, and December 31, 2018. The place of performance is within Big Bend National Park, about 10 miles west of Panther Junction, on the southern side of the park’s West Entrance Road and extending about 2 miles to the south of the road (see attachments: Big Bend Powerline Removal Maps, Big Bend Powerline Removal Photos).
Background
This power line was probably constructed in the 1950s and has not been in use since the 1980s. The line formerly connected an active line to Study Butte/Terlingua, but is now disconnected from the active line and is abandoned. The conductor wires and ground wire have been detached from the active line and the remainder of the inactive line at both ends of the project area. This section of line consists of about 27 poles. As can be expected of equipment of this age, the poles are in poor condition with numerous woodpecker holes, splits, cracks, and other evidence of weathering. It is highly probable that the poles are unsafe to climb.
The park is interested in this work being performed with a minimum of disturbance and environmental damage. A utility right-of-way access road is present adjacent to, or in the vicinity of, most of the line. However, about 9 of the poles are in locations that are not accessible to vehicles. Three additional poles are not along the access road, but could be reached by driving cross-country in relatively flat desert terrain
Additionally, the access road has several washouts that must be repaired before the road could be traveled by vehicles. Some sections of the road are very steep and require four-wheel drive vehicles and skilled drivers.
Performance Objectives
The objective of the project is removal of an abandoned power line with minimal damage to park resources.
Poles may be pulled out of the ground or cut off within 1 foot of the ground surface. At one or more locations the park may opt to have more of the pole base kept intact (i.e., the pole would be cut about 4 feet above ground surface), to serve as a marker for the location of the access road. The park will inform the contractor at the pre-construction meeting of poles to be treated in this manner.
Damage to resources, such as tracks created by off-road driving or by dragging of poles or other equipment, must be raked or otherwise repaired to reduce scars and prevent erosion. No planting of vegetation or seeding will be required, but damage to vegetation must be kept to a reasonable minimum.
An invasive, non-native species of grass, Lehmann lovegrass, is known to be present in the project area. To help prevent the spread of weeds, all vehicles must be clean upon arrival at the beginning of the project, and upon demobilization at the end of the project.
Operating Constraints
The access road along the powerline right-of-way is maintained by Rio Grande Electric Cooperative (RGEC), the local electricity supplier. The access road is used by RGEC to access the segment of active powerline that is located at the southern end of the line that is the subject of this project. During a site visit, by the park employees, on September 26, 2017 several washouts and locations needing repair were observed along the access road.
Some poles are located on side slopes, rocky outcrops, rocky ridges, and other locations that preclude the close approach of vehicles.
Other than repair to the existing access road, road work or road construction will not be permitted. The park will entertain proposals to access the non-adjacent poles with a minimum of disturbance, such as by using manual labor, horses or mules, UTV (utility vehicles), ATV (all-terrain vehicles), 4-wheel drive vehicles, and the like. Poles may be cut into manageable sections to make removal easier. Vehicle tracks and pole-dragging scars must be raked out or otherwise rehabilitated. Vegetation removal or damage must be kept to the minimum that is reasonably necessary for completion of the work.
Testing has been performed on samples from a pole in the project area. The samples tested positive for arsenic, barium, and creosote (see attached Lab Report). The sample found arsenic in excess of TCLP (Toxicity Characteristic Leaching Procedure) standards.
Therefore, the poles and cross-arms may qualify for designation as hazardous waste under Environmental Protection Agency (EPA) and State of Texas regulations, and such material must be disposed of in an appropriate and legal manner that meets EPA and State of Texas standards. Recyclable materials should be recycled or salvaged to reduce landfill waste and to conserve resources.
The potential presence of hazardous materials also requires the proper use of appropriate personal protective equipment (PPE) by workers associated with the project. Other safety hazards should be expected during performance of this project, including damaged poles, tension on intact conductor wires, steep and uneven terrain, thorny vegetation, venomous snakes, other wildlife, and environmental hazards, such as heat, cold, sun exposure, wind, thunderstorms, flash floods, and the like. A detailed Safety Plan must be submitted to, and accepted by, the Contracting Officer’s Representative (COR) before work can commence.
Supplies and Equipment
