1.1. SUMMARY
A. Description of Work: The Contractor shall provide all labor, supplies, supervision, tools, materials, equipment, and transportation necessary to remove and reconstruct the Miner’s Delight Exclosure
Fence in accordance with the contract. The existing fence to be removed consists of approximately
900 feet of 4-wire fence, 1,250-feet of post-and-pole, and 1,900 feet of buck-and-rail fence, as well as one large steel-frame gate, one small steel-frame gate, one stile pedestrian walk-through gate, and two wire gates. The fence shall not be reconstructed in kind. Instead, the contractor shall construct
3,250 feet of 2-wire pole top fence, 350 feet of 3-wire pole top fence, and 550 feet of buck-and-rail fence, as well as one large steel-frame gate, three wire gates, and two stile pedestrian walkthrough gates. All measurements are to be verified by the contractor. Standard drawing Specifications are attached. In cases where they may conflict, drawings supersede other guidance.
B. Location: The project site is shown on the attached access map (Map 1) and detail site plan map (Map
2) in the drawings package. The project site is remote, and although the main parking/staging area near the cemetery (see Map 2) is accessible by passenger car, portions of the fence are only accessible via ATV or on foot.
C. Work Data Sheet: Designates the type and quantity of work required at the project location, and dimensions required for typical drawings.
D. Removed Materials: Debris consisting of wood posts and poles, metal t-posts, panels, wire, and steel-frame gate assemblies shall be removed from the work site and disposed of in a legal fashion by the contractor.
E. Salvageable Items: Much of the fence to be removed is in poor condition but any salvageable items consisting of wood, posts, metal t-posts, gates, and wire shall become the property of the Contractor.
Items which have become the property of the Contractor shall be removed from the work site.

1.3. DEFINITIONS
A. Approvals: Approval of the submittals is an indication that the Contractor's submittals have been reviewed and that there are no objections, except as noted. Approval of deviations shall apply only to those deviations or omissions from the requirements of the drawings and specifications brought to the Contracting Officer's attention in writing. After approval of an item, submit a substitute for approval when the approved item cannot be purchased or delivered in time to avoid delay in completion of the project.
1.4. SUBMITTALS
A. Scope: Submittals include design computations, shop drawings, manufacturers' literature, as-built drawings, samples, and maintenance manuals.
B. Requirements: Refer to specifications for submittals required. Allow at least five working days for review. Submittals shall be delivered to the Contracting Officer.
C. Identification of Submittals: Completely identify each submittal by showing at least the following information:
1. Name and address of submitter, plus name and telephone number of the individual to contact for further information.
2. Name of project as it appears in these specifications.
3. Contract number, drawing number, and specification section number to which the submittal applies.

1.5. DELIVERY, STORAGE, AND HANDLING:
A. Delivery: The Contractor shall protect products incorporated into the work from damage while in transit to the site.
B. Storage: The Contractor shall provide temporary storage facilities for products. Storage shall comply with the manufacturer’s instructions. The storage area shall permit access for inspection and handling.
C. Handling: The Contractor shall load and unload products in such a manner that protects them from damage.
1.6. CERTIFICATES OF CONFORMANCE
A. Requirements: The Contracting Officer may permit use, prior to sampling and testing, of materials when accompanied by Certificates of Conformance. Materials used on the basis of a Certificate of
Conformance may be sampled and tested. Installation of materials on the basis of Certificates of
Conformance shall not relieve the Contractor of responsibility for incorporating materials which conform to the requirements of the drawings and specifications. Material not conforming to those requirements will be subject to rejection, whether in place or not.
B. Format: The Certificate of Conformance provided by the supplier shall:
1. State that the named product conforms to the Contract requirements.
2. Either be accompanied with a certified copy of the test results, or certify that such test results are on file with the manufacturer and will be furnished to the Contracting Officer upon request.
3. Provide the name and address of the manufacturer, the testing agency, and the date of tests.

This Contract incorporates materials, applications, and tests by reference with the same force and effect as when they were given in full text.
B. Conflict: Where a conflict occurs between reference documents and project specifications, the project specifications shall govern.
1.8. PROJECT/SITE CONDITIONS:
A. Access to the Work: See attached map.
1. Location should be considered remote. Access to the main parking area near the cemetery
(see Maps 1 and 2) is via paved and gravel roads. Access to other parts of the fence is via two-track roads. Construction of access roads to the work site will not be permitted by the
Contracting Officer. Driving off road or making new trails is prohibited. Cross-country travel shall be permitted only along and limited to the fence line.
2. Public or State access roads damaged by the Contractor shall be restored, at the Contractor’s expense, to the same condition they were in at the commencement of work.
B. Environmental Considerations:
1. Blading of the fence line will not be permitted. Clearing of vegetation is permitted up to 4 feet either side of the fence line, provided no soil is disturbed.
2. All vehicles, trailers, and power equipment used on the job will be power-washed prior to moving on-site, to prevent spread of weed seeds. Contractor shall submit two copies of the record of when and where each piece of equipment was power-washed.
3. Livestock may be present in the area until September 30. Therefore, a temporary barrier to exclude livestock shall be built in any open areas of the fence when the Contractor is not working on the fence, during this period.
4. Due to the time of year, it is possible that BLM Stage 1 Fire Restrictions will be active during the execution of this work. If they are in place, the Contractor shall comply with all restrictions.
Of particular relevance to this contract, the Contractor shall only use chainsaws with a U.S.

As a minimum, the estimated start and completion dates shall be shown in the schedule.
1.10. CULTURAL AND PALEONTOLOGICAL STIPULATIONS
A. Cultural Resource Discoveries: The Miner’s Delight Fence surrounds an historic mining ghost town. It is expected that the contractor will encounter numerous historic artifacts during the removal and construction of the fence. If the contractor finds artifacts associated with the historic period such as glass bottles, tin cans, pottery, nails, etc., they may continue work on the fence. If the contractor encounters such materials, they shall leave them in place unless they would be imminently destroyed by the Contractor’s activities, in which case they shall place them out of the way. No artifacts shall be removed from the site by the Contractor. If the contractor finds pre-contact artifacts such as arrowheads, flakes or chips, or bones, the Contractor shall suspend all operations within 50 feet of the discovery until authorization to proceed is issued by the Contracting
Officer. An evaluation of the discovery will be made by the BLM to determine appropriate actions to prevent the loss of significant cultural and scientific values. The Contractor shall not pick up or move any pre-contact artifacts or bones.
B. Paleontology Discoveries: Any paleontological resource (i.e., fossil) discovered by the Contractor, or any person working on the Contractor’s behalf, shall be immediately reported to the BLM. The
Contractor shall suspend all operations within 50 feet of the discovery until authorization to proceed is issued by the BLM. An evaluation of the discovery will be made by the BLM to determine appropriate actions to prevent the loss of significant scientific values.
