All deliverables shall be delivered to the Contracting Officer’s Representative (COR) identified in Section G and shall be marked as follows:

SECTION E – INSPECTION AND ACCEPTANCE
E.1 INSPECTION AND ACCEPTANCE
Pursuant to FAR clause 52.212-4, all work described in Section C to be delivered under this purchase order is subject to final inspection and acceptance by an authorized representative of the Government. The authorized representative of the Government is the Contracting Officer’s Representative (COR), who is responsible for inspection and acceptance of all services, materials, or supplies to be provided by the Contractor.
E.1.1 Inspection and Acceptance Criteria
Final inspection and acceptance of all work performed, reports and other deliverables will be performed at the place of delivery by the COR.
E.1.2 General Acceptance Criteria
General quality measures, as set forth below, will be applied to each work product received from the Contractor under this Statement of Work.
• Accuracy – Work Products shall be accurate in presentation, technical content, and adherence to accepted elements of style.
• Clarity – Work Products shall be clear and concise. Any/all diagrams shall be easy to understand and be relevant to the supporting narrative.
• Consistency to Requirements – All work products must satisfy the requirements of this
Statement of Work.
• File Editing – All text and diagrammatic files shall be editable by the Government.
• Format – Work Products shall be submitted in hard copy and electronic copy. The electronic copy must be in a format as indicated in the Deliverables section.
SECTION F – DELIVERIES OR PERFORMANCE
F.1 PERIOD OF PERFORMANCE
The Period of Performance shall be 365 calendar days from award. Estimated Period of Performance will be September 19, 2024 – September 19, 2025
F.2 PLACE OF PERFORMANCE
• Two sites requiring conservation treatment are in the North Fork of Mill Creek Canyon near
Moab, in Grand County, Utah
• Two sites requiring conservation treatment, as well as the workshop, are located near Parowan, Iron County, Utah

SECTION G – CONTRACT ADMINISTRATION DATA
G.1 AUTHORITY OF GOVERNMENT PERSONNEL
Notwithstanding the Contractor’s responsibility for total management during the performance of this contract, the administration of this purchase order will require maximum coordination between the Government and the Contractor. The following individuals will be the Government’s points of contact during the performance of this call order:

G.2 1452.201-70 AUTHORITIES AND DELEGATIONS
(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer’s Representative (COR) at time of award. The COR will be responsible for technical monitoring of the Contractor’s performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor’s right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.

(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.

SECTION H – SPECIAL CONTRACT REQUIREMENTS
H.1 CONTRACTOR SUPPORT-KEY PERSONNEL
If during performance of the order, Contractor support key-personnel resign or are terminated, the Contractor shall provide the Contracting Officer within 15 business days the proposed substitute’s resume demonstrating comparable qualifications to the individual being replaced.
All proposed substitutes will be subjected to a two-week trial period. Proposed replacements which do not satisfy the Government during the trial period will be removed from the order at no cost to the Government and no adjustment to any other terms and conditions of the contract arising from or relating to the removal.

H.2 POST AWARD ORGANIZATIONAL CONFLICT OF INTEREST
a. General: The Contractor shall have programs in place to identify, report, and mitigate actual and potential conflicts of interest for itself, its employees, subcontractors and consultants.
The existence of such programs and the disclosure of known actual or potential conflicts are material performance requirements of this contract.
b. Disclosure: The Contractor shall report all actual and potential conflicts of interest pertaining to this contract to the Contracting Officer, including those that would be caused by a contemplated modification to this contact or another contract. Such reports shall be in writing (including by email). Upon request, the Contractor shall respond to a Contracting Officer's request for an OCI mitigation plan.
c. Resolution: In the event the Contracting Officer determines that a conflict of interest exists, based on disclosure from the Contractor or from other sources, the Contracting Officer shall take action which may include, but is not limited to, requesting a mitigation plan from the Contractor, terminating part or all of the contract, modifying the contract or obtaining a waiver in accordance with applicable law, including FAR 9.503 as applicable.
H.3 GOVERNMENT FURNISHED INFORMATION
All pertinent information necessary for the completion of the requirement shall be provided by the BLM.
H.4 GOVERNMENT FURNISHED PROPERTY
The government will make available the materials, supplies, property, or services listed below.
The Contractor shall be liable for the loss or damage to such property until returned to the Government in good condition. Government furnished property will be provided to the contractor at the pre-work meeting.
• Site Forms for sites to be treated.
• ARPA damage assessments or photographs of damaged areas to be treated.
The contractor shall furnish all other equipment and material necessary to complete this project.

SECTION L: INSTRUCTIONS, CONDITIONS, AND NOTICES TO RESPONDENTS
L.1 General Notices
• BLM intends to award one (1) purchase order for this requirement.
• The quoter’s must quote on the entire project.
• Upon receipt of quotations and prior to the start of evaluations, the Government will conduct a preliminary assessment of two elements as follows:
1. Query each quoter's unique entity identification via sam.gov for active exclusions. Should a quoter have active exclusions, the quotation will be immediately removed from the competition without further consideration for award.
2. Compliance to price quotation instructions. Failure to strictly adhere to these instructions will render the quote non-compliant and immediately removed from the competition without further consideration for award.
• The Government intends to evaluate quotations and award a purchase order without exchanges. Quoters are strongly advised to submit a quotation containing the best terms from a technical and price standpoint. Should it be necessary, the Government may engage in exchanges with select quoters to clarify or amplify certain aspects of a quotation. These exchanges include the ability to submit additional information to amplify assertions already included in the quotation and the opportunity to resolve minor or clerical errors. The Government reserves the sole discretion to engage with some, none or all quoters.
L.1.2 Submission Deadlines

L.1.3 Quotation Preparation Instructions
• The quotation shall be prepared in separate volumes and clearly marked:
o Volume I – Technical and Past Performance o Volume II – Price
• Include the following information on the cover page and each subsequent page in the header:
o Quoter Name o 140L5724Q0069 – Conservation Treatment – Four Rock Imagery Sites in Grand and
Iron Counties, Utah.
• The quotation shall contain adequate information for each factor identified in Section L to enable the Government to fully ascertain each quoter’s capability to perform the requirements in accordance with the evaluation criteria in Section M. Quotations which parrot the Government scope of work or merely offer to perform work in accordance with the scope of work will render the quotation ineligible for award.
• Volume I – Technical and Past Performance must not contain reference to price/cost.
However, it may include resource information, such as labor hours and categories, materials, subcontracts, etc.
• Volume I – Technical and Past Performance is limited to 10 pages, single spaced, 1-inch margins, and not less than 12- point font in Times New Roman. If tables or figures are used, it can be single-spaced and not less than 9-point font in Times New Roman. Any Cover Page, Table of Contents or Executive Summary, if included, must be clearly headered and do not count toward the page limit. Resumes and curriculum vitae should be included and will also not be counted toward the 10-page limit.
• Quotations which do not adhere to these guidelines may be disqualified from competition.
Volume I- Technical and Past Performance
FACTOR 1: Organizational and Personnel Experience 1.Provide details of proposed key personnel who possess current knowledge, skills, abilities and associated experience to meet the requirements. Include:
a. Verification that key personnel are in good standing with the American Institute for the
Conservation of Historic and Artistic Works (AIC) at Professional Associate Member level or higher.
b. Resumes or curriculum vitae for key personnel detailing their background of professional training and experience as well as their experience in the region of this requirement.
c. List of staffing for this requirement.
FACTOR 2: Technical Approach 1.Provide a narrative describing the approach to perform the SOW requirements including a general work plan, quality control measures, etc.
2.Provide a schedule demonstrating a sound and reasonable approach to meet SOW deadlines.
FACTOR 3: Relevant Past Performance 1.Provide three (3) past performance examples, including recent and relevant contracts of similar size, scope, and complexity. Include the following information for each past performance example:

SECTION M: EVALUATION FACTORS FOR AWARD
M.1 52.252-1 Solicitation Provisions Incorporated by Reference (Feb 1998) This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. In lieu of submitting the full text of those provisions, the offeror may identify the provision by paragraph identifier and provide the appropriate information with its quotation or offer. M.2 Basis for Award The Government intends to award a single requirement resulting from this solicitation.
Award will be made to the responsible quoter whose quotation conforming to the solicitation will be most advantageous to the Government and represents the best value (appropriate combination of price and non-price factors) using the trade-off method. The Government reserves the right to make an award to other than the lowest-priced quoter if the Contracting Officer determines that to do so would result in the best value to the Government.
M.3 Evaluation Factors for Award The Government will evaluate quotations in accordance with FAR 13.106-2 for i) completeness, ii) quality, and iii) overall logical approach to fulfill the SOW based on the factors listed below:

Organizational and Personnel Experience, Technical Approach, and Relevant Past Performance are of equal importance. When combined, the non-price factors (Organizational and Personnel Experience, Technical Approach, Relevant Past Performance) are considered more important when compared to price. When quotations reach parity across non-price factors, price will increasingly become a determining factor.
Pricing will be evaluated for fairness and reasonableness in accordance with FAR 13.106-2 to include assessment of skill mix, level of effort, and hourly rates. Total evaluated price will be calculated as the summation of all CLINs. It is anticipated that price reasonableness will be established through competition, comparison with the IGE, and recent historical prices.

1.0. Introduction
The Bureau of Land Management (BLM) Utah State Office requires conservation treatments to mitigate graffiti at four rock imagery localities in Grand and Iron Counties, Utah, and a conservation treatment methods workshop for BLM staff. The purpose of this work is to mitigate graffiti damage that is on or adjacent to indigenous and historic rock images and train BLM staff in minimally invasive conservation methods. Objectives include submission of a treatment plan, the physical treatment of identified areas, preparation of a report on the treatment methods used, and preparation and execution of a classroom and field-based conservation treatment methods workshop.
This project constitutes an undertaking under Section 106 of the National Historic Preservation Act and therefore will be subject to consultation requirements with the Utah State Historic Preservation office and interested Tribes.
1.1 Sites
Graffiti will be treated at four sites as part of this contract. Photos for each of the required treatment areas are attached to this statement of work, site forms will be provided upon contract award.
Two sites in the North Fork of Mill Creek Canyon near Moab, in Grand County, Utah (42GR2904, and 3004)
The North Fork of the Mill Creek Canyon is located with a narrow sandstone canyon, northeast of Moab, in Grand County, Utah. The Canyon is a popular and well-known recreation destination, accessed from the Mill Creek and Power Dam Trailhead, adjacent to Moab City limits. The Canyon is well known for its high density of rock imagery and historic inscriptions and several of these sites have been badly damaged by graffiti. The BLM requires conservation treatments at two of the most popular sites (42GR2904 and 3004) to improve their appearance to minimize future incidents of graffiti.
42GR2904 consists of four panels of pictographs and historic inscriptions located on a south-facing cliff face approximately one-mile up the North Fork of Mill Creek Canyon (Figure 1). The site is located directly above a popular waterfall and swimming area that during peak season may be visited by over 100 people per day. The site is frequently visited by the public and has sustained extensive graffiti that has accumulated over decades. Much of the graffiti is located on the patinated areas surrounding the panels;
however, Panel 3 has been subject to several layers of scratched graffiti, deeply incised graffiti, and a poorly executed unprofessional effort to repair past graffiti (Figure 2). In 2022, BLM staff completed minimally invasive treatments of the lightly scratched graffiti in the areas surrounding the panels and used kneadable art erasers on the “MORMANS SUCK” graffito on Panel 3 (Figures 4 and 5). The 2022 treatment successfully minimized the appearance of some of the scratched graffiti around the panels but did not successfully mitigate the “MORMONS SUCK” graffito (Figure 5). In 2023 new graffiti was documented, including “Bing CHI” (which is deeply incised) and “ATOM” (Figure 2). Panel 3 is the most visible from the recreation trail below the site and is the most badly damaged (Figure 6).
The BLM requires treatment of the right side of Panel 3 to minimize the appearance of graffiti (Figure 2).
Panel 3 measures approximately 3.1 meters in length by .86 meters high (Figures 2 and 3). Most of the graffiti is concentrated on the right side of Panel 3 and includes (but is not limited to) to “JR ’95” (appears to have been poorly repaired post 2015), “DAWG” (Documented in 2010 and somewhat repatinated), “E NOMNAN” (done between 2010 and 2015), a leaf (done between 2010 and 2015 and appears to have been poorly repaired), “MORMANS SUCK” (done in 2022 and treated by BLM in 2022 but still visible),” “Bing CHI” (done in 2023), and “ATOM” (done in 2023). It is unclear what medium was used for the poorly executed repair of “JR ’95” and the leaf. The petroglyphs at Panel 3 and throughout the site, are weathered and repatinated. In 2022, A. Schlosser made a sketch map showing the petroglyphs that were still identifiable (Figure 7).
42GR3004 is located approximately 1.6 miles from the Mill Creek and Power Dam Trailhead and consists of four loci located in and around a large sandstone alcove (Figure 9). Loci B is the alcove, and it contains two rock imagery panels (Panel 2 and 3) which include both pictographs and petroglyphs.
Panel 2 is in the back of the alcove and measures approximately 5.9 meters in length by 1.6 meters high and consists of approximately 20 pictographic and petroglyph images (Figure 10). Panel 3 is on the eastern edge of the alcove and consists of at least 43 handprints and four or more anthropomorphic figures (Figure 11). Modern illegal camping in the alcove has resulted in an abundance of charcoal which has been used as a medium for graffiti throughout the alcove. Panel 2 has been subject to repeated incidents of graffiti, including scratched graffiti and charcoal graffiti over laying the pictographs (Figure 12). Panel 3 has not been directly subject to graffiti; however, there are numerous scratched, incised, and charcoal graffitos throughout the alcove.
In 2020 the BLM completed an Archaeological Damage Assessment for the graffito “@cassi_pia” (Figure 12). The BLM requires the “@cassi_pia” graffito, along with the charcoal residue and scratched graffiti below the graffito at Panel 2 to be treated in a manner that minimizes its appearance.
Two sites near Parowan, Iron County, Utah (42IN53 and 42IN266)
Two sites require conservation treatments in Iron County. The first site, Parowan Gap (42IN266), is located approximately 20 miles north of Cedar City on Highway 130. The site, which is well known and listed on the National Register of Historic Places receives heavy annual visitation and is comprised of hundreds of petroglyph panels. Exclusionary fences, interpretive signage, and steady monitoring reduce the amount of vandalism that might normally occur at a heavily trafficked site; however, Parowan Gap is not immune to occasional vandalism, including painting and scratching. The second site, 42IN53 is not a public use site, but it is near to and visible from a frequently travelled road. Vandalism at the site includes paint, charcoal, incisions, and bullet pocks. The paint and charcoal are more prevalent than the pictographs themselves and as such has inspired people to shoot at the site from the road, inadvertently damaging the panel further. The BLM requires treatment of graffiti at these two sites (42IN53 and 42IN266) to improve their appearance and to minimize future incidents of vandalism.
42IN266 (Parowan Gap) is known for being one of the best examples of rock imagery in southwestern Utah. The Gap and its petroglyphs are referenced in a Southern Paiute Creation story and hold ceremonial and spiritual significance to Indigenous groups. The site has hundreds of petroglyph panels spread throughout a 350 by 100 m area. It is located west of Parowan, approximately 20 miles north of Cedar City and is accessible via paved road. A developed trailhead with parking area, vault toilet, picnic tables, and interpretive signage is located on the east edge of the site.
Nine areas (Areas A-H) of concentrated panels were documented in 2013, each with varying numbers and styles of petroglyphs. White paint graffiti is located on panels within Area E and light scratching of numbers and images are located near panels within Area F. Additional vandalism exists within a shallow cave east-southeast of Areas E and F, which is fenced off. All three places of vandalism are located on the south side of the road that passes through the gap on north-northeast facing sandstone rock. Graffiti in Area E consists of white paint and light scratching over an area 1.5 by 0.8 m and between 1 and 2 m above the surface (Figure 13). Rock imagery on this specific panel is predominately historic pecking and inscriptions of initials and dates. Graffiti in Area F consists of a smiley face and butterfly in a 35 by 15 cm area within 1 m of a petroglyph (Figure 14). Another graffiti of heavily scratched “2024” is 30 by 15 cm and is located a further 3 m east of the butterfly graffiti (Figure 15). The scratched date is not on or adjacent to a petroglyph panel, however. BLM requests treatment of the graffiti within Areas E and F.
42IN53 consists of a south-facing shallow overhang 12 feet deep, 40 feet wide, and 8 feet high with four pictographs on the sandstone back wall (Figure 16). The site is located 80 m from a well-graded dirt road and 28 miles from Cedar City. Access to the site requires a small creek crossing and a short scramble up loose slopes, rising 30 m above the creek bottom. The pictographs include white painted motifs of hands, hand reliefs, and an animal figure. While the site does not appear to be visited frequently, black charcoal writing, drawing, and a profane image were superimposed over the pictographs at some unknown time in the past. Additional paint and charcoal vandalism are located above the pictographs (Figure 17). These motifs make the site more visible from the road and as such the site has become a target for people shooting from the road (Figure 18). Without the paint and charcoal, the site would be rather inconspicuous to the public and would likely receive less visitation and vandalism.
The BLM requires the charcoal and some paint vandalism removed from the rockshelter. Vandalism includes dark letters, two hands, and profane imagery on an area of rock face approximately 2 by 0.5 m;
most of which is directly in contact with the underlying white paint pictograph panel which is 1.2 by 0.3 m in area and 1 to 1.3 m above the surface. Above the panels is additional charcoal writing and some white paint writing over an area 1.5 by 1 m and up to 2.5 m above the surface of the rockshelter, which also must be treated. This vandalism does not overlap pictographs, but it does draw attention to the site from the road and clean up could affect the pictographs below. Access to this area is precarious, which may hamper treatment efforts (Figure 19).
1.2 Workshop for BLM Staff
The amount of space and nature of some of the graffiti at 42IN53 provide a training opportunity for BLM staff. BLM requires the contractor to plan and conduct a graffiti removal workshop for BLM staff at either 42IN53 or at Parowan Gap, which may also include a classroom component. The class size will be limited to 15 participants and instruction must include instruction on minimally invasive removal techniques (e.g. brushes, water, erasers, etc.) that are appropriate for BLM staff to employ at BLM sites when the damages are further than 20 cm from a petroglyph and what types of graffiti require professional treatments. The training must include demonstration and supervised practice of minimally invasive removal techniques (e.g. brushes, water, erasers, etc.) that may be used at other BLM sites by trained BLM staff.
2.0 Scope
The Bureau of Land Management (BLM) Utah State Office is requesting a qualified contractor to conduct conservation treatments to mitigate graffiti at four rock imagery localities in Iron and Grand Counties, Utah and to provide a training workshop for BLM volunteers.
The contractor will review the photos attached to this Statement of Work and the site forms delivered at the time of award and propose treatment options to reduce the appearance of graffiti. This information will be used by the BLM to consult with the Utah State Historic Preservation Office (SHPO) as part of the associated undertaking. Once methods have been consulted up on and the SHPO has concurred on the finding of effect, the selected contractor will conduct the conservation treatments at each of the identified locations. Furthermore, the contractor will also prepare a curriculum for the training of up to 15 selected BLM Utah Cultural Resource staff on minimally invasive and appropriate treatment methods to reduce the appearance of graffiti that is not immediately adjacent or atop rock images in accordance with the provisions of Appendix I of the Utah Statewide Protocol (https://www.blm.gov/sites/blm.gov/files/Utah_SHPO_Protocol_2020.pdf).
This workshop training will occur in both a designated BLM office setting and onsite at either 42IN53 or the Parowan Gap petroglyph site.
The contractor shall supply the necessary qualified personnel, materials, and equipment to review the provided information, prepare and conduct treatment, and plan and execute the workshop requirements.
The contract period shall be 365 calendar days.
All work shall be performed in accordance with the requirements stated in this document, the Secretary of the Interior’s Standards and Guidelines for Archaeology and Historic Preservation, and with the Guidelines for Practice as set forth by the American Institute for the Conservation of Historic and Artistic Works (AIC).
3.0 Objectives
This project will address the following objectives:
1) Review and propose conservation treatments for six areas of damage at four sites.
2) Provide technical assistance as required during BLM’s consultation period.
3) Complete treatment activities at four sites.
4) Prepare Documentation for all conservation and treatment efforts
5) Development of a training syllabus and classroom materials for a conservation training for removal of applied graffiti within 20 cm of rock images
6) Completion of conservation training of up to 15 BLM employees
The objective of this contract is to obtain a qualified principal conservator to mitigate the visual effect of graffiti at four rock imagery sites in Iron and Grand Counties, Utah and to provide a workshop on low impact conservation treatment methods for BLM Cultural Resource employees. These objectives will be completed through the execution of fieldwork to reduce the appearance of graffiti. Treatment details will be described in two professionally produced reports for the Utah State Office and Utah State Historic Preservation Officer’s office.
Fieldwork will be coordinated with the BLM and may not commence until Tribal consultation and consultation under Section 106 of the National Historic Preservation Act is completed. Original data, photos, sketches and field observations will remain with the contractor. Electronic copies of all photos, logs, and all other such things will be provided to the BLM at the completion of the field work.
Following the fieldwork, the contractor should produce draft reports detailing the methods and outcome of the treatments. This may be submitted to the BLM electronically for review. The contractor shall make revisions to the draft reports based on the BLM’s comments. If necessary, the BLM will require multiple drafts until comments are sufficiently addressed. A final report shall be of publication quality and meet the guidelines established by the Secretary of Interior’s Standards. The contractor’s editor is strongly encouraged to review the documents prior to submission to correct factual, technical, typographic, and grammatical errors. Failure to do so may result in the rejection of draft reports. Submission of the final report to the BLM shall include one hardcopy, one electronic copy on a USB flash drive containing a PDF version of the final Report.

5.0 Administration, Supervision, and Personnel
The contractor must provide a list of the key personnel and how they meet the requirements and qualifications listed below at it relates to this Statement of Work. The contractor will meet the professional requirements:
1. Knowledge and familiarity with Utah rock imagery resources
2. Demonstrated experience with conservation of petroglyphs and pictographs, providing at least three examples of past projects of a similar size and scope
3. Documented registration with a professional conservation association, such as the American Institute for Conservation.
The selected contractor must employ a principal conservator that is a member in good standing of the American Institute for the Conservation of Historic and Artistic Works (AIC) at Professional Associate Member level or higher and must meet or exceed the following qualifications:
- The principal conservator should have been a practicing, full time conservator for a minimum of 5 years.
- The principal conservator should hold a Masters degree (or equivalent) in conservation from a recognized conservation degree program.
- The principal conservator should be able to demonstrate having completed similar work on rock imagery sites within the last 3 years.
All personnel employed or subcontracted by the contractor shall be fully qualified for the services they are assigned. If any services performed by an individual do not conform to the contract requirements, or jeopardize successful performance of the contract, the BLM may require the contractor to immediately remove the individual from the contract at no additional cost to the government. The contractor shall conduct only business covered by this contract during the period paid for by the government and shall not conduct any other business on government premises. The contractor agrees to supply all field equipment and materials needed to conduct fieldwork and produce reports. Strict confidentially of the geographical location of cultural site data is required of the contractor pursuant to the Archaeological Resources Protection Act and Section 304 of the National Historic Preservation Act.
All work shall be performed in accordance with the Secretary of the Interior’s “Standards and Guidelines for Archaeology and Historic Preservation” (Federal Register, Volume 48, Number 190, Thursday, September 29, 1983, page 44716) and the American Institute for Conservation’s “Guidelines for Practice” (https://www.culturalheritage.org/about-conservation/code-of-ethics).
5.1 Government Furnished Property
The government will make available the materials, supplies, property, or services listed below. The Contractor shall be liable for the loss or damage to such property until returned to the Government in good condition. Government furnished property will be provided to the contractor at the pre-work meeting.
• Site Forms for sites to be treated
• ARPA damage assessments or photographs of damaged areas to be treated
The contractor shall furnish all other equipment and material necessary to complete this project.
6.0 Deliverables and Scheduling
One digital copy of the spreadsheet and all associated tabs are required to be submitted to the BLM. In addition, the contractor must supply a brief one-to-two-page report on the work completed one month prior to the closeout of the contract.

7.0 Future Use of Project Data
The Contractor must delete all site forms provided as part of this project upon completion of the contract.
8.0 Place of Performance
Base contract work will be performed on site within the Moab and Cedar City field offices with the classroom training conducted at the Cedar City Field office in Cedar City, Utah.

(a) The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
(b) The Contracting Officer will designate a Contracting Officer's Representative (COR) at time of award. The COR will be responsible for technical monitoring of the contractor's performance and deliveries. The COR will be appointed in writing, and a copy of the appointment will be furnished to the Contractor. Changes to this delegation will be made by written changes to the existing appointment or by issuance of a new appointment.
(c) The COR is not authorized to perform, formally or informally, any of the following actions:
(1) Promise, award, agree to award, or execute any contract, contract modification, or notice of intent that changes or may change this contract;
(2) Waive or agree to modification of the delivery schedule;
(3) Make any final decision on any contract matter subject to the Disputes Clause;
(4) Terminate, for any reason, the Contractor's right to proceed;
(5) Obligate in any way, the payment of money by the Government.
(d) The Contractor shall comply with the written or oral direction of the Contracting Officer or authorized representative(s) acting within the scope and authority of the appointment memorandum. The Contractor need not proceed with direction that it considers to have been issued without proper authority. The Contractor shall notify the Contracting Officer in writing, with as much detail as possible, when the COR has taken an action or has issued direction (written or oral) that the Contractor considers to exceed the COR's appointment, within 3 days of the occurrence. Unless otherwise provided in this contract, the Contractor assumes all costs, risks, liabilities, and consequences of performing any work it is directed to perform that falls within any of the categories defined in paragraph (c) prior to receipt of the Contracting Officer's response issued under paragraph (e) of this clause.
(e) The Contracting Officer shall respond in writing within 30 days to any notice made under paragraph (d) of this clause. A failure of the parties to agree upon the nature of a direction, or upon the contract action to be taken with respect thereto, shall be subject to the provisions of the Disputes clause of this contract.
(f) The Contractor shall provide copies of all correspondence to the Contracting Officer and the COR.
(g) Any action(s) taken by the Contractor, in response to any direction given by any person acting on behalf of the Government or any Government official other than the Contracting Officer or the COR acting within his or her appointment, shall be at the Contractor's risk.
