SOLICITATION: 140L4323Q0005

AMENDMENT: 0002

SECTION: RECEIVED VENDOR QUESTIONS AND GOVERNMENT’S RESPONSE

1. I notice that the NAICS Code and Small Business Size Standard is 115310, Support Activities for Forestry; $10.0 Million.

From the US Census Bureau:” This industry comprises establishments primarily engaged in performing particular support activities related to timber production, wood technology, forestry economics and marketing, and forest protection. These establishments may provide support activities for forestry, such as estimating timber, forest firefighting, forest pest control, treating burned forests from the air for reforestation or on an emergency basis, and consulting on wood attributes and reforestation. “

My opinion is that this NAICS Code does not correctly apply and that NAICS Code 238910 or 237310 and their size standards more accurately apply to this project. This change will allow our company and other major contributors to the industry to bid on this project.

GOVERNMENT RESPONSE: The NAICS Code will remain 115310 because Aquatic Restoration is a Forestry Support Activity.

2. I have a question about the Aquatic Restoration Services Solicitation No. 140L4323Q0005 currently advertised on SAM.gov.

The Description of Work on page 6 of the RFP lists activities that seem to be those provided by construction/forestry contractors; however, the listed Product Service Code states the solicitation is “non-construction” (F018 - NATURAL RESOURCES/CONSERVATION- OTHER

FOREST/RANGE IMPROVEMENTS (NON-CONSTRUCTION)).

Could you tell me if a construction contractor is typically who would supply the services needed for this solicitation? Do they typically include other consultant firms as subcontractors for the needed aquatic, riparian, and upland restoration activities? If not, is there another contract of your agency that might work in conjunction with this one that utilizes AE consultant services (NAICS 541330 or other) for restoration activities?

GOVERNMENT RESPONSE: The listed PSC is correct. The requirements under this BPA are not classified as construction. The Government awards contracts to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Because this is a total small business set aside, contractors must comply with FAR clause 52.219-14, Limitations on Subcontracting. BLM Oregon State Office does not have another contract to work in conjunction with this BPA.

3. A) There is only one line item (per district) for moving the four sizes of excavators which require a quote at this time. With the sizes ranging from under 25,000 lbs up to 90,000 lbs there is a very substantial price difference in moving the various sizes. This makes it not possible to give a single price for all four without defaulting to only quoting the largest and therefore most expensive one to move. Is it possible to add the extra line items needed to price each excavator size separately to avoid a higher than necessary price for moving the smaller machines?

B) This question is related to mobilization (page 5) also. The line item numbers for moving equipment to the Roseburg District and Medford District are both 00130 series followed by the appropriate letters per machine. This may cause confusion when answering a BPA call.

GOVERNMENT RESPONSE: 3(A)- Extra line items have been added to price each excavator size separately. Please see attached and updated Cost/Price Schedule and Attachment 3, Standing Price Quote Schedule.

3(B) Medford District, Mobilization-Medford BLM Site Mobilization (per piece of equipment) and its associated line items has been updated in the attached and updated Cost/Price Schedule.
