About this file

This document is Amendment 0002 to Solicitation 140L3726Q0131 for BDO BLM ESR Range Fence Repair, issued by the Bureau of Land Management (BLM) Interagency Fire Center located in Boise, Idaho. The amendment, effective September 1, 2026, provides government responses to 20 contractor questions submitted prior to the question cutoff date and notifies that no further questions will be accepted due to timing for award. The amendment must be acknowledged in accordance with the solicitation requirements.

Key clarifications provided in the questions and answers include: BLM will not stake or flag the fence alignment; contractors may use skid steer or similar tracked equipment along the 99,700-foot fence line and corridors; all government-furnished materials will be available for pickup on the first day of performance; a broker-issued bond satisfies the bid guarantee requirement of 20% of the bid price under FAR Clause 52.228-1; the warranty period is one year from final payment per FAR Clause 52.246-21; excusable delays related to weather or unforeseeable conditions will be addressed on a case-by-case basis; no fence removal is required as part of this solicitation; site visit attendance is not restricted to small businesses only, though all proposals will be evaluated for small business status and SAM.gov registration; and the basis for contract award remains unchanged, with newly established small businesses potentially receiving neutral ratings if lacking federal experience. The period of performance dates are system-generated on the SF-18. No subcontracting plan is required, and subcontractors need not be small businesses.

Questions/Responses September 1, 2026

BDO BLM ESR Range Fence Repair Solicitation Number 140L3726Q0131

CONTRACTOR QUESTIONS GOVERNMENT RESPONSE

1. Will BLM stake or flag the proposed fence alignment prior to construction, including the locations of corners, end panels, stress panels, and gates, or will the contractor be responsible for laying out these locations from the maps/drawings?

1. Refer to the Work Statement, Part 6 –

6.1 Special Considerations A.

2. The work statement states that vehicle traffic is permitted along the proposed fence line and fence corridors. Is the majority of the 99,700-foot fence alignment accessible and suitable for travel with a skid steer or similar tracked construction equipment? If there are portions where this type of equipment cannot be used, could BLM identify those areas or provide an approximate length?

2. Yes, a skid steer or similar tracked construction equipment may be used along the proposed fence line and fence corridors.

Please refer to the Work Statement, Part 1 – 1.6 C for additional information on allowable cross-country travel and other related restrictions.

3. Were any portions of the fence alignment identified during the site visit as particularly steep, rocky, rough, or otherwise difficult to access with construction equipment?

3. Please refer to Work Statement, Part 1

– 1.6 B

4. Are there currently any known archaeological, wildlife, vegetation, or other sensitive areas along the proposed alignment where motorized equipment will be restricted?

4.

Archaeological – BLM staff completed a Cultural Resource clearance for this project in coordination with SHPO which resulted in a finding of ‘No Properties/No Effect’. However, Part 1 – 1.6 H. of the Work Statement is still applicable to this project.

Wildlife and Vegetation - please refer to the Work Statement, Part 6 – 6.1 Special Considerations B. and C.

5. Regarding the government-furnished fencing materials, will all materials be available for contractor pickup at the designated staging/wareyard location at the beginning of the project, or will material pickup be scheduled/released in stages during construction?

5. All government-furnished materials listed the Work Statement Part 2 – 2.1 A will be available for contractor pick up on the first day of the period of performance.

The number of times the contractor will need to return to the BLM Wareyard to pick up government-furnished materials will be determined by the quantity of material the contractor can transport each trip.

6. Question – I was reviewing the other vendors who participated in the site visit from Amend 0001. Over half the companies who signed in are not registered in sam.gov under that firms name. My understanding is any Offeror must be registered in sam.gov to bid on the requirement – correct?

6. All proposals received will be evaluated for SB Status/Registration.

Site Visit is not restricted to SB only

7. Just being a small business alone does not qualify you elible to bid… I am inquiring for clarity – the RFQ cites that

– but I wanted to be sure…. This also applies if I wanted to ask one of the companies to be a subcontractor to me, right? The subc needs to be registered in sam.gov as well….???..

7. All proposals received will be evaluated for SB Status/Registration.

There is no SubContracting Plan requirement for subs to be SB.

8. We are inquiring to see if the above solicitations period of performance can be extended to start next spring?

8. No, the period of performance will not be extended to accommodate a start date next spring.

9. Can the government clarify the ‘warranty period’? Although this is a ‘construction’ Highway NAICS code being used – all material is government provided. Since the Offeror(s) are only providing installation/labor – once the government accepts final payment / final inspection it is assumed the government inspected the installation of the fence and therefore any warranty would be associated with the material and not the installation. The above section is not clear if the warranty period is immediately after final payment; 90 days after final payment / final inspection or 1 year after final payment. This is essential and critical clarification for the duration of the Bid Guarantee or Bond each Offeror will have to keep in place.

9. As stated, the warranty period is 1 year from final payment. Refer to FAR Clause 52.246-21 Warranty of Construction, full text available at https://www.acquistion.gov

10. Can the government please clarify the Bid Guarantee requirement? For clarity to my question and response I am using the value of $240,000.00 as the Offeror’s bid price. My corporate broker is pricing out and securing a Contract Bond – Bid Bond to be submitted with our proposal. This will become the bid guarantee and bid bond for our proposal that will remain in place 90 days after the final payment (as I have understood the requirement). 20% of the bid guarantee of a $240,000.00 bid would be a bid guarantee / bond of $48,000.00.

10. Refer to FAR Clause 52.228-1 Bid Guarantee on page 18. A bid Guarantee is required under this solicitation as stated. That calculation will be based on contractors proposed amount.

11. Can the government clarify that a broker issued bond for the Bid Guarantee satisfies the requirement in section 52.228-1, page 18/21?

11. Refer to FAR Clause 52.228-1(b) regarding acceptable bid guarantees.

12. Please clarify the due date for the proposal is Sept 9, 2026 at 10am MST, submitted via email to Matthew Steele?

12. Please refer to SF-18 Block 10 for proposal due date/time.

13. Is the Standard Form 28, Affidavit of Individual Surety part of the proposal response or is it due within 10 days post award notice?

13. Please refer to FAR Clause 52.228-11 for submission requirement of SF28.

14. Can the government release a copy of the site visit sign in roster for possible collaboration prior to the Aug 28 due date for questions (with a likely amendment being released on sam.gov after Aug 28?)? This would be very helpful to discuss possible teaming and allow time for the proposal process to be completed by the due date.

14. Site Visit Roster was included in Amend 0001

15. Period of Performance – can the government provide their best estimate for the period of performance? On page 2/21 of the RFQ solicitation document page 2 of the OF 336 cites the period of performance 9/14/2026 – 11/13/2026. With the quotes due to the government on 9/9/2026@10am MST will the government actually complete the contract and award within 5 days? Would the government consider citing or amending the solicitation document to reflect a 60 days period of performance, after the kick off and schedule has been accepted? (see Q2 for cause and further reasoning in asking the question).

15. Please refer to the note in Block 11 of the SF-18, regarding the period of performance dates on the solicitation being system generated.

16. page 6/21 of the solicitation RFQ document, CLAUSES 52.211-12 Liquidation Damages. ….” the Contractor shall pay liquidated damages to the Government in the amount of $696.84 for each calendar day of delay until the work is completed or accepted”… Q2a. How will the government manage and accept delays caused by fire, weather, rain, snow migratory birds/animals or other delays not as a result of the contractor?

Q2b. How will the government manage delays if the contract is not awarded in a timely manner, and if during the 60 days period of performance it overlaps with ‘winter’ freezing temperatures that freeze the ground extending the time necessary to install the posts in the ground etc?

16.

2a. Any delay would be addressed under FAR Clause 52.213-4 Terms and Conditions—Simplified Acquisitions (Other Than Commercial Products and Commercial Services). (e) Excusable Delays

2b. Any delay would be addressed under FAR Clause 52.213-4 Terms and Conditions—Simplified Acquisitions (Other Than Commercial Products and Commercial Services). (e) Excusable Delays

Any delays due to weather or any other unforeseeable condition will be addressed on a case-by-case basis.

17. page 13/21 of the solicitation RFQ document, 52.225-

18 PERFORMANCE BONDS.

Q3a. If the contract amount is greater than $150,000.00 there is a requirement for a payment bond to secure the work being performed. If the award is between $35,000.00-$150,000.00 can the government clarify any additional or alternative payment protections / bond that may be required?

Q3b. ref: page 18/21, 52.228-1 BID GUARANTEE (c) ..”the amount of the bid guarantee shall be 20% of the bid price or $3,000,000.00 whichever is less”… can the government clarify that there is a bid guarantee of 20%, assuming the bid/quote is $250,000.00 then the bid guarantee would be 20% of $250,000.00?

17.

3a. Please refer to FAR 28.102-1(b)(1) for alternative, Paragraph (i) and (ii). Refer to FAR 28.102-1((b)(2) for receipt of payment protections.

3b. Refer to answer on Question 10.

18. page 21/21 of the solicitation RFQ document BASIS FOR CONTRACT AWARD 4) Experience. ACCEPTABLE or UNACCEPTABLE. For newly created small businesses bidding who may lack federal past performance or experience, if there is no or limited past performance or experience highlighted will the Offeror receive a NEUTRAL rating, and by default ACCEPTABLE?

18. The basis for contract award remains unchanged.

19. Can the government clarify “fence removal” requirements, hauling off at the contractor’s expense, etc? Are all steel posts, wooden posts and wire currently being used required to be removed and hauled away as a task included in this RFQ? Ref: page 3/11 of the SOW Section PART 2 B – Fence removal specifications 1. None.

19.

There is no fence removal scheduled as part of this solicitation.

20. When will the government have the old fence site marked with the referenced colored flags marking gate locations, and other markers?

20. See government response to Q19.

There is no fence removal scheduled as part of this solicitation.
