QUESTIONS AND ANSWERS

Offerors for this RFQ, including subcontractors and teammates, shall consolidate questions related to this solicitation and site visit in a Request for Information (RFI) formatted Word document. Any RFI is to be emailed as an editable attachment to Christine Mundt (cmundt@blm.gov) with the subject line: RFI – 140L3622R0009 Cottonwood Road Reconstruction. Only written RFI’s will be considered and responded to. BLM responses to the RFI will be posted as an amendment to the solicitation on https://sam.gov/content/opportunities.

Solicitation Number: 140L3622R0009 Project Title: Cottonwood Road Reconstruction, Montana

Q1: Can clarification be provided on if the pipe run lengths include the FETs or if the FETs are in addition to the pipe run length provided?

A1: The pipe lengths do not include the length of the FETs. The pipe run lengths are for the length of pipe only. The FETs will be in addition to the length of pipe.

Q2: Asphalt coated CMP has kind of gone by the wayside except for structural plate. We now have coatings that MDT has reviewed and approved for 75 year design life which out perform asphalt coated. The usual switch is to polymeric coated CSP. That is the Cadillac of coatings on CSP. The area you are looking at could also allow Aluminized type II CSP but without soil report it may not perform. Do you think we could allow an option to the asphalt coated CSP?

A2: Upon discussion with the TPOC for this project, polymeric coated CSP will be an acceptable alternative to the bituminous coated CSP described in the specs.

Q3: When excess fill material is required per the plans, can the contractor use excess cut material from other culverts?

A3: Yes: Culverts requiring excess fill material per the cut/fill balances on the plans can obtain this fill material from excess cut material at a different culvert or from imported backfill material.

Q4: In areas where the road must be built up to obtain the 1‐foot minimum bury depth over the culvert, what grade should be used or how far out should the material be graded on the road?

A4: Grade the road according to the plan surface contours and profiles shown on the drawings.

Q5: Can the contractor shut the road down at the culvert location they are working on?

A5: Yes: Contractor should plan on having the ability to shut the road down at the culvert they are working on.

If it is possible to keep one lane of traffic open to bypass the project, the Contractor should consider this option for the public’s use of the road. Contractor is required to submit their traffic control plan to the Government for approval, and if they plan to shut the road down at a culvert, their traffic control plan should include signs on either end of the road (the intersection with Schwend Road and the intersection with US Route 310) stating the point on the road at which traffic will not be able to pass and for how long. A map showing the location at which the contractor is working would be a helpful part of the traffic control plan.

Q6: Is rip‐rap required as part of the project?

A6: No: rip‐rap is not required as part of this project.

mailto:cmundt@blm.gov https://sam.gov/content/opportunities

Q7: Is geotextile fabric material and slope seeding required as part of this project?

A7: No: Geotextile fabric and slope seeding will not be required as part of this project.

Q8: Will the Government stake the project?

A8: Yes: The Government will stake the culverts involved in this project upon request of the contractor. The Government will require a minimum 2‐week notice for the staking. The coordinates of each culvert are also shown on the plans and can be imported into a handheld GPS or cell phone.

Q9: Do existing culverts need to be disposed of off‐site?

A9: Yes: All existing culverts that are removed and replaced with new culverts need to be disposed of off‐site.

Q10: Where can the contractor stockpile construction materials?

A10: The Government will allow stockpiling of materials within the road right of way or nearby established parking areas. Removal and cleanup of any excess stockpiled materials will be the responsibility of the contractor. Contractor shall coordinate all stockpiling and/or staging areas with the Government for approval, prior to construction.

Q11: What is the right‐of‐way of the road?

A11: Cottonwood Road Right of way is a total of 100‐feet; 50‐feet either side of the centerline of the road.

Q12: Is there water on site to be used for construction?

A12: Contractor shall plan on providing water needed for construction from off site.

Q13: What is the period of performance for the project?

A13: Per the solicitation, the revised period of performance is 390 calendar days after the contractor receives the Notice to Proceed. The contractor will also be allowed to begin construction this year, and complete it next year, if work is performed within the 390 calendar days.

Q14: What is the size of the existing Culvert 71, Culvert 72, and Culvert 82?

A14: The existing Culvert 71, Culvert 72, and Culvert 82 appear to be incorrectly labeled on the plans.

Assume that the existing Culvert 71 is 36‐inches in diameter, existing Culvert 72 is 36‐inches in diameter, and existing Culvert 82 is 24‐inches in diameter.

See the revised Technical Drawings provided with this Amendment.

Q15: CMP is specified for the culverts. Would an alternate such as RCP or ADS be allowed?

A15: Advanced Drainage System pipe (plastic pipe) will not be allowed. Reinforced Concrete Pipe may be considered on the project as long as construction total is within the Government’s allotted budget. If the Contractor proposes RCP vs. Poly-coated CMP and the government does not have budget, the project will not be awarded.

Q16: Will a road closure be allowed at each location?

A16: Total road closure will be allowed in each installation location with the prior approval/notification of the Government. Close coordination will be required between the contractor, the Contracting Officer, the Contracting Officer’s Representative, Project Inspector, permittees, landowners, and the Field Office.

After award, the Government will generate a list of grazing permit holders and look up landowners as well so that when the time comes, a letter can be sent out ahead of the scheduled work (by BLM). The contractor may do daily updates on approximate locations of work as part of the required Traffic Control Plan.

SECTION F – DELIVERIES OR PERFORMANCE

(REVISED)

F.1 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF

WORK APR 1984

The Contractor shall be required to:

(a) Commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed,

(b) Prosecute the work diligently, and

(c) Complete the entire work ready for use not later than 390 calendar days after receipt of the notice to proceed.

The time stated for completion shall include final cleanup of the premises.

Note: The Government desires the offeror to commence and prosecute the start of this project work during the 2022 construction season. However, 390 calendar day period of performance will allow the offeror to commence, prosecute, and complete the entire work for use during the 2023 construction season. As such, a Government Shutdown of work due to winter weather is not anticipated. The Government will require close coordination next spring/summer regarding the extent of ground disturbance on either side of the road to determine if a timing stipulation for nesting birds is warranted.

F.2 52.236-15 SCHEDULES FOR CONSTRUCTION CONTRACTS APR 1984

(a) The Contractor shall, within five days after the work commences on the contract or another period of time determined by the Contracting Officer, prepare and submit to the Contracting Officer for approval three copies of a practicable schedule showing the order in which the Contractor proposes to perform the work, and the dates on which the Contractor contemplates starting and completing the several salient features of the work (including acquiring materials, plant, and equipment). The schedule shall be in the form of a progress chart of suitable scale to indicate appropriately the percentage of work scheduled for completion by any given date during the period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required schedule.

(b) The Contractor shall enter the actual progress on the chart as directed by the Contracting Officer, and upon doing so shall immediately deliver three copies of the annotated schedule to the Contracting Officer. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved schedule, the Contractor shall take steps necessary to improve its progress, including those that may be required by the Contracting Officer, without additional cost to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, and/or the amount of construction plant, and to submit for approval any supplementary schedule or schedules in chart form as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.

(c) Failure of the Contractor to comply with the requirements of the Contracting Officer under this clause shall be grounds for a determination by the Contracting Officer that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in the contract. Upon making this determination, the Contracting Officer may terminate the Contractor’s right to proceed with the work, or any separable part of it, in accordance with the default terms of this contract.

F.3 52.242-14 SUSPENSION OF WORK APR 1984

(a) The Contracting Officer may order the Contractor, in writing, to suspend, delay, or interrupt all or any part of the work of this contract for the period of time that the Contracting Officer determines appropriate for the convenience of the Government.

(b) If the performance of all or any part of the work is, for an unreasonable period of time, suspended, delayed, or interrupted

(1) By an act of the Contracting Officer in the administration of this contract, or

(2) By the Contracting Officer’s failure to act within the time specified in this contract (or within a reasonable time if not specified), an adjustment shall be made for any increase in the cost of performance of this contract (excluding profit) necessarily caused by the unreasonable suspension, delay, or interruption, and the contract modified in writing accordingly. However, no adjustment shall be made under this clause for any suspension, delay, or interruption to the extent that performance would have been so suspended, delayed, or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an equitable adjustment is provided for or excluded under any other term or condition of this contract.

(c) A claim under this clause shall not be allowed-

(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved (but this requirement shall not apply as to a claim resulting from a suspension order); and

(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the suspension, delay, or interruption, but not later than the date of final payment under the contract.

F.4 BLM 1510-

52.211-70 BLM - VARIATION IN QUANTITY (DEVIATION) MAY 1987

If the quantity of a unit-priced item in this contract is an estimated quantity and the actual quantity of the unit-priced item varies more than 20 percent above or below the estimated quantity, an equitable adjustment in the contract price shall be made upon demand of either party. The equitable adjustment shall be based upon any increase or decrease in costs due solely to the variation above 120 percent or below 80 percent of the estimated quantity. If the quantity variation is such as to cause an increase in the time necessary for completion, the Contractor may request, in writing, an extension of time, to be received by the Contracting Officer within 10 days from the beginning of the delay, or within such further period as may be granted by the Contracting Officer before the date of final settlement of the contract. Upon the receipt of a written request for an extension, the Contracting Officer shall ascertain the facts and make an adjustment for extending the completion date as, in the judgement of the Contracting Officer, is justified.
