About this file

This document is an Attachment 1 containing questions and answers for Solicitation 140L0125R0007 for the Bureau of Land Management's Wild Horse & Burro Program Drive Trapping Services. The Q&A addresses three key topics: media communications during gather operations, key personnel experience requirements, and insurance provisions. Specifically, the responses clarify that contractors may use gather operation images after completion with written contracting officer approval, require holding facility and transportation supervisors to have at least six months experience with wild horses/burros or livestock, and indicate that comprehensive general liability insurance is the contractor's responsibility under this fixed-price contract, consistent with FAR 28.306 guidelines.

ATTACHMENT 1 - QUESTIONS RECEIVED FOR SOLICITATION 140L0125R0007 AND BLM RESPONSES

Question Answer Under h. Public and Media - Says the following: “ During gather operations the Contractor and/or their crew members shall not post any information or images to social media networks or release any information to the news media or the public regarding the activities being conducted under this contract. All communications regarding BLM management, including but not limited to media, public and local stakeholders, are to come from the BLM unless the Contractor is expressly authorized to give interviews, etc.”

We would like to see the During gather operations added back to this paragraph in this new solicitation. As a contractor, once gather operations are completed, we have always been able to use pictures and videos taken during a gather to promote our business with other agencies and to defend ourselves against lies and mis-quotes made by advocates. This is very important to our business.

All communications regarding the BLM management, including but not limited to media, public and local stakeholders, are to come from the BLM unless the Contractor is expressly authorized to give interviews, etc. Once gather operations are completed the contractor may use images but must get written approval from the contracting officer before release of any information to the news media or the public regarding the activities being conducted under this contract.

Under e. Key Personnel on page 29 of this solicitation qualification for the Ground Foreman and the Trap Supervisor state that the person should have had at least one season previous experience in trapping wild horses and burros. Then it also states that qualifications for the Wranglers and/or Drivers should have six months experience working in wild horse and burro handling. Why is there not any amount of any season previous experience required for the Holding facility supervisor or the Transportation director?

The Holding facility supervisor or the Transportation director should have at least six months of previous experience with wild horses and burros or livestock.

Mandatory Comprehensive General Liability Insurance was required on the last Drive Trap Contract. Does the contractor not have to have Mandatory Comprehensive General Liability Insurance for this contract?

Pursuant to FAR 28.306 Insurance under fixed-priced contracts. This is a fixed priced contract where insurance is not ordinarily a Government concern. The gather operations will not be performed on a Government installation. It is the contractor’s responsibility to ensure they have the necessary insurance to support their gather operations.
