1 Solicitation 140L0120R0008 Vol IV - Price Table

Since the SF1449 states the period of performance is 3/1/21 – 3/1/31, should we include those actual years on the top of the schedule B pricing table or leave it as TBD? Base Year would be 3/1/2021 – 2/28/2022 for example.

The offeror can leave the date range blank on their price proposal, however the offeror shall indicate which contract period the pricing is for

(i.e. base period, option period one, etc.)

2 General

History indicates the corrals oftentimes have much less than their contract maximum in their corrals for an extended period. To assist with developing the most competitive pricing while not basing it on a full capacity throughout the entire year, can BLM provide a percentage of the maximum quantity that should be considered as an average per day throughout each year?

BLM is unable to provide a percentage to be used as an average, due to unknown annual budget fluctuations, tentative gather and removal schedules and constant movement throughout the off range corral and pasture systems. The only guarantee BLM is able to provide is the contract minimum of 500 head.

WORK HOURS on page 7 of 54, it states Contractor shall be available to support the care, feeding, and holding of animals year-round, 365 days per year. But it does not give any hours of when they should have someone available. Please clarify. Thanks.

Facility operations (feeding, humane care, animal observation, etc.) occur mainly during daylight hours, however, someone should be available 24 hours per day in case of emergencies

The Utah Location indicates facility may be located west of I-15 and Us

Hwy 191. They both run north and south. It seems everything west of I-

15 would also be west of Hwy 191. Is any ranch west of Hwy 191 considered to be an acceptable area in Utah?

Yes, a ranch west of Highway 191 and north of I-70 would be considered.

Nothing south of I-70 and east of Highway 191 is allowable.

5 Vol I - General

There is no requirement listed to provide evidence that SAM.gov registration has been completed. Does BLM need that to be included with the representations, or is it not necessary (I only ask that because we have had to submit it with each previous proposal opportunity)?

The offeror shall include their DUNS number in VOL I of their proposal package. The Contracting Office will verify that the offeror has an Acive

SAM registration at time of proposal receipt.

6 General Does BLM have any certain file-name preference for the proposal files that will be sent?

A pdf format would be preferred.

Section C, page 15 of 54 provides details that need to be included in the proposal, but in the proposal instructions, at least what I could find there is no reference as to where you want this data included. I am assuming you want it in Vol II, but figured I better check first.

a. This NEPA requirement indicates a topo map is required for all improvements to land and ownership. Can we print out a map, then hand write in the improvements that are going to take place upon notification of contract award? Or do we need to somehow get the map to represent the improvements before we print it out?

Either way mentioned would be acceptable.

b. Does all of this NEPA info count against the 50 pages if it is to go into Vol II. The legal descriptions of the land could be quite a few pages alone.

The legal land descriptions could be provided as an attachment to the 50 pages.

c. What is meant by Contractor Schedules? Does that mean the schedule for improvements or the hours of daily operations?

Contractor Schedules refers to the times that offerors would be available if the NEPA team required a visit to the offerors facility.

Section K provides various reps and certs that need to be added into Vol I.

However, under the clauses incorporated by reference, there is the

Offeror Reps and Cert clause 52.212-3. Do you want us to include both that included in Section K and the standard Commercial Reps and certs found in 52.212-3?

The offeror shall complete all representations and certifications contained in the solicitation. If an offeror has an active SAM account the representations and certifications can be updated in SAM, the offeror should indicate in their proposal that all representations have been updated in SAM.

52.212-1 Instructions to Offerors – Commercial Items indicates the proposal price should be valid for a period of 30 days unless specified separately in the solicitation. The past proposals have had a valid period of 180 days, but I do not see any in this solicitation. Is it included and I overlooked it, or should we really only make these valid for 30 days?

Amendment 0002 to this solicitation changed the number of days that the offeror shall make their price proposal valid from 30 days to 365 days.

The synopsis says "For Utah, facility may be located west of Interstate 15 and US Highway 191" This is confusing since I-15 and Hwy 191 are parallel roads. Please clarify. I'd .like to know if my property, which lies between I-

Yes, Between I-15 and Highway 191, and north of I-70 would be considered. Nothing south of I-70 and east of Highway 191 is allowable.

All locations could be included in one offer; however, clearly name and delineate the legal descriptions for all locations for NEPA purposes.

However, preference would be to narrow down the locations to three or less.

Technical evaluation, site visit, and subsequent NEPA process may take up to a year, before contracts may be officially awarded.

In a previous solicitation the BLM allowed proposals to include a request to use BLM property for all or part of the corral system. In reading the current solicitation I do not see where that same option is allowed. Can you please confirm whether or not a proposal can include a request to use BLM property.

The ORCs must be located on private land, the use of BLM land will not be considered.

I have two pieces of property that could be used for the facility. Can I submit one proposal that includes both options. Then the BLM could look at both pieces and decide which one they prefer. The pricing would be the same for either property. Or would you like them submitted as two separate proposals?

We submitted a bid back in April. Since none of our operations or references have changed (banks, vendors, etc.), can I use those same reference letter/emails in this bid? Or do I need to have those updated?

You can use the same letters/emails.

The bid calls for a minimum of 500 animals. Given the current capacity of our facility (approx. 3,500) we would prefer a minimum of 1,000. If our bid called for a minimum of 1,000 animals, would that invalidate our whole bid or cause us not to be considered?

Yes, that would invalidate the bid, as the minimum for this contract is 500 head.

What is the best way to show a tiered pricing proposal? For example:

between 1,000-2,000 animals the daily price would be $4.50. If the animal count was between 2,001 and 3,000 the daily price would be

$4.25.

This is up to the offeror to propose a tiered pricing schedule based on animal inventory. BLM cannot provide input on pricing.

What is the best way to show a potential increase in capacity? Our current facility will house approx. 3,500 animals. We are thinking we would like to expand this to the 5,500 range. It would take about a year to construct the increased pens. Would bidding for 3,500 horses the first year and then increasing to 5,500 horses the second year work?

This is up to the offeror to propose an increased animal inventory and shall propose their maximum for each option year. BLM cannot provide input on offeror pricing schedules.

I have five possible locations for an WH&B ORC within a three-mile radius. Do I need to submit separate offers/applications for each location? Or, can I submit an application for (1) location and the

BLM/vetting committee can explore the other locations as desired during the vetting process?

24 How do government shutdowns effect ORCs?

The ORCs must continue to operate and will be paid when the government reopens.

If we got the increased headcount, we might be in a position to have a lower daily feed cost. For example: up to 4,000 animals would be X/day and above 4,000 would be X minus $.25/day. What would be the best way to show that variable rate schedule?
