Government Responses to Vendor Questions

Solicitation No. 140FS126Q0185 Sonny Bono Salton Sea National Wildlife Refuge Ground Herbicide Application Services

Question 1 SOW paragraph 8.2 item 2 requires licensed pesticide applicators, and item 13 requires application records listing the applicator name and California pesticide applicator license number. Under California practice, a licensed pest control business may operate with non-certified employees working under the direct supervision of a Qualified Applicator License or Certificate holder. Will the Government accept a QAL or QAC supervised crew, with the supervising license holder's name and license number entered on the application records?

Government Response: Yes, The Statement of Work has been amended accordingly. The Government intends to clarify SOW paragraph 8.2 to permit a crew arrangement that is lawful under applicable California requirements when work is performed under the legally required supervision of a Qualified Applicator License (QAL) or Qualified Applicator Certificate (QAC) holder. The Contractor remains solely responsible for ensuring that each individual performing pesticide-related work is properly qualified, trained, licensed or certified to the extent required for the duties performed, and that the required level of supervision is maintained. Application records shall identify the individuals who performed the application and the supervising QAL/QAC holder, including applicable license or certificate numbers, to the extent required by the amended SOW and applicable law. This clarification does not waive or supersede any federal, State of California, or local licensing, certification, supervision, recordkeeping, or product-label requirement.

Question 2 Does the Refuge hold a current Imperial County Agricultural Commissioner Operator Identification Number, and given the use of 2,4-D, a Restricted Materials Permit covering the treatment areas? If not, is the Contractor expected to obtain them?

Government Response: The Refuge currently holds the required Restricted Materials Permit covering the contemplated treatment areas and that the proposed use of 2,4-D has been approved for the Refuge's contemplated treatment activities. The Contractor is not expected to obtain the Refuge's Operator Identification Number or a landowner/site authorization on the Refuge's behalf.

Question 3 Will the Refuge furnish a written recommendation signed by a licensed Pest Control Adviser for each application, or is the Contractor responsible for obtaining the PCA recommendation?

Government Response: The Refuge will provide the treatment prescriptions, mixtures, application rates, treatment areas, and operational instructions contemplated by Section 6 of the SOW. The Contractor shall not obtain additional services or incur additional costs on behalf of the Government without prior written authorization from the Contracting Officer.

Question 4 Section 6 specifies surfactant at 1 gallon per 100 gallons of water and buffer at 4 pints per 100 gallons of water, but does not state a carrier volume per acre. What total spray solution volume per acre should offerors assume for pricing?

Government Response: For pricing purposes, offerors shall assume that the total spray solution (carrier) volume per acre may be up to the maximum volume permitted by the applicable pesticide product label for the prescribed application. Actual application rates and spray volumes shall be established in accordance with the applicable product label, the Refuge’s treatment prescription, and all applicable federal, State, and local requirements. Where more than one product is used in a tank mixture, the most restrictive applicable label requirement shall govern.

Question 5 Paragraphs 2.1, 2.4, and 8.2 item 3 specify tractor-mounted ground spray equipment. Will the Government accept self-propelled ground spray equipment that meets the same coverage, calibration, droplet size, and drift control requirements?

Government Response: Yes. The Government will accept tractor-mounted or self-propelled agricultural ground spray equipment, including an agricultural spray coupe, provided the equipment meets all coverage, calibration, application-rate, droplet-size, buffer-zone, and drift-control requirements of the Statement of Work. Truck- or UTV-mounted spray equipment may also be used for perimeter, buffer, or other localized treatment areas where appropriate and where all applicable requirements are met. The Statement of Work has been amended accordingly.

Question 6 Should the optional second application at paragraph 2.3 be priced as a separate line item, or included within the single CLIN 00010 price?

Government Response: No separate option line item is required. All application services shall be priced under CLIN 00010. The total cumulative treatment acreage under CLIN 00010 shall not exceed 850 acres during the period of performance. Any subsequent application to previously treated acreage shall count toward the 850-acre cumulative treatment limit. The Statement of Work has been amended accordingly.

Question 7 FAR 52.217-9 appears in the clause list while SOW paragraph 4.2 states the procurement is for one year only.

Does the Government intend this order to be extendable beyond August 31, 2027?

Government Response: The Government’s current intent is for the period of performance to be completed by August 31, 2027. FAR 52.217-8 and FAR 52.217-9 will remain applicable to the resulting contract. Inclusion of these clauses preserves the Government’s right to extend services or the term of the contract, if exercised in accordance with the applicable clause, but does not obligate the Government to exercise any such extension.

Unless and until an extension is exercised in writing by the Contracting Officer, the period of performance remains October 1, 2026 through August 31, 2027.

Supplemental clarification to Question 5 The proposed equipment is an agricultural spray coupe, described as a 2WD tractor chassis with a permanently mounted production spray boom, supplemented by truck- and UTV-mounted booms with side nozzles for perimeter and buffer treatment. Would that satisfy the tractor-mounted requirement, provided coverage, calibration, droplet size, and drift control requirements are met?

Government Response: Yes. The Government will accept an agricultural spray coupe or other self-propelled ground spray equipment for broadcast herbicide applications, provided the equipment is properly calibrated and is capable of meeting all prescribed application rates, uniform coverage, droplet-size, buffer-zone, and drift-control requirements of the Statement of Work. Truck- and UTV-mounted spray equipment with appropriate boom or nozzle configurations may be used for perimeter, buffer, or other localized treatment areas, provided such equipment meets all applicable performance, pesticide-label, safety, and regulatory requirements.

Acceptance of an equipment type does not relieve the Contractor of responsibility for ensuring that the equipment selected is suitable for the work and complies with all applicable federal, State, and local requirements. The Statement of Work has been amended accordingly.

Question 9 Will the Government make an on-site water source available for tank filling, such as an irrigation canal draw point or standpipe within Unit 1 or Unit 2, or is the Contractor responsible for hauling all mix water from off site? This materially affects pricing given the acreage involved.

Government Response: The Refuge will provide access to an on-site irrigation canal or ditch identified by Refuge staff for purposes of obtaining application water. The Contractor shall provide all pumping, filtration, transfer, and related equipment necessary to withdraw and use the water. The Government makes no representation or warranty regarding the quality or suitability of water obtained from the designated source. The Contractor remains responsible for ensuring that water used for pesticide applications is suitable for the intended use and complies with applicable pesticide-label requirements. The Statement of Work has been amended accordingly.

Question 10 Paragraph 6 lists Milestone at a rate to be determined. Milestone is aminopyralid, which is persistent in soil and plant residue and highly active on broadleaf species. Will the Government identify which fields Milestone is prescribed for, and confirm the buffer required to adjacent commercial vegetable ground?

Government Response: Yes. Before any Milestone application is performed, the Refuge will identify the treatment field(s), prescribed application rate, and Refuge-designated buffer zones applicable to the directed treatment. No Milestone application shall begin until those items have been communicated and any required notifications or approvals have been completed. The Contractor remains responsible for compliance with the product label and all applicable federal, state, and local requirements. If a product label or applicable law imposes a more restrictive setback, buffer, or use limitation than a Refuge instruction, the more restrictive requirement controls, and the Contractor shall notify the Technical Coordinator and Contracting Officer of any conflict before proceeding.

STATEMENT OF WORK

Ground Herbicide Application Services at

Sonny Bono Salton Sea National Wildlife Refuge Amended September 8, 2026

1. GENERAL

The United States Fish and Wildlife Service (USFWS), Sonny Bono Salton Sea National Wildlife Refuge Complex (NWR or Refuge), 906 West Sinclair Road, Calipatria, CA 92233- 9744, requires ground-based broadcast herbicide application services utilizing ground-based application equipment meeting the requirements of paragraph 2.1 of this Statement of Work.

Herbicide, surfactant, and fertilizer (buffer) applications are required to control invasive broadleaf weeds and other undesirable vegetation in managed agricultural fields. The Refuge will provide the herbicides, surfactants, and fertilizer (buffer), along with application prescriptions and rates. Herbicide treatments are necessary to maintain productive forage fields that provide critical winter habitat for approximately 40,000 geese and other migratory birds.

The Refuge manages approximately 850 acres of forage fields that may require treatment during the period of performance.

2. SCOPE SUMMARY

2.1 Contractor shall furnish all labor, qualified application personnel, and all ground-based broadcast spray equipment necessary to perform the required herbicide applications. Acceptable equipment may include tractor-mounted or self-propelled agricultural spray equipment, including agricultural spray coupes, provided the equipment is capable of achieving the prescribed application rates, uniform coverage, required droplet size, calibration, buffer-zone compliance, and drift-control requirements of this Statement of Work. Truck-mounted or UTV-mounted spray equipment may be used for perimeter, buffer, or other localized treatment areas where appropriate, provided such equipment is properly calibrated and capable of meeting all applicable performance, pesticide-label, safety, and regulatory requirements. The Contractor remains responsible for selecting, maintaining, calibrating, and operating equipment suitable for the work and for ensuring compliance with all applicable federal, State, and local requirements and pesticide product labels. Acceptance of an equipment type by the Government does not relieve the Contractor of responsibility for meeting the requirements of this Statement of Work.

Applications shall be made using medium-to-coarse droplet spray tips, or as otherwise directed by Refuge staff consistent with applicable product-label requirements, to minimize drift while achieving effective coverage.

2.2 Application rates and total spray solution (carrier) volume per acre shall be based on the herbicide or herbicide mixture prescribed by Refuge staff and shall be in accordance with the applicable pesticide product label and all applicable federal, State, and local requirements. For purposes of pricing, Offerors shall assume that the total spray solution volume per acre may be up to the maximum volume permitted by the applicable product label for the prescribed application. Where multiple products are included in a tank mixture, the most restrictive applicable label requirement shall govern. The actual application prescription and spray volume will be identified by the Refuge prior to application.

2.3 The Government may require a subsequent herbicide application to all or portions of previously treated acreage during the period of performance. Any subsequent application shall be included within CLIN 00010 and shall count toward the total cumulative treatment acreage specified in this Statement of Work. No separate option line item is contemplated for a subsequent application.

2.4 The Contractor shall be capable of applying broadcast herbicide treatments over a cumulative treatment area not to exceed 850 acres using ground-based application equipment meeting the requirements of paragraph 2.1. Applications shall be completed in accordance with all applicable federal, State, and local pesticide requirements and pesticide product-label requirements.

4. PLACE AND PERIOD OF PERFORMANCE

4.1 All fields are located at the Sonny Bono Salton Sea National Wildlife Refuge near the southeast corner of the Salton Sea in Imperial County, California. Specific treatment areas include Unit 1, the Union Fields, and other Refuge-managed agricultural fields as designated by Refuge staff. The total cumulative treatment acreage under CLIN 00010 shall not exceed 850 acres during the period of performance. This total includes any subsequent application to previously treated acreage. Acreage treated more than once shall be counted separately toward the 850-acre cumulative treatment limit for each application.

4.2 The Government’s current intent is for performance under the base period to be completed by

August 31, 2027. Any extension of services or the contract term beyond the stated period of performance may be exercised only by the Contracting Officer in accordance with the applicable terms and conditions of the contract, including FAR 52.217-8 and FAR 52.217-9.

4.3 Period of Performance: October 1, 2026, through August 31, 2027. Most herbicide applications are anticipated between late October and the end of January.

5. EVALUATION AND ACCEPTANCE

5.1 Evaluation and acceptance will be determined by the Technical Point of Contact/Refuge Manager. All spraying will be accepted on a per-field basis.

5.2 Contractor shall provide uniform broadcast herbicide coverage at the prescribed application rates while maintaining all required buffer zones and minimizing off-target drift. Buffer zones on and around Government property and adjacent private lands shall be strictly observed.

6. GOVERNMENT FURNISHED EQUIPMENT/INFORMATION

6.1 The Refuge will provide all herbicides, surfactants, fertilizer (buffer), and other chemicals required for application. The Contractor shall follow Refuge staff prescriptions regarding herbicide selection, tank mixes, and application rates.
