About this file
This document is a Questions and Answers amendment to a Design-Build Services North Flume Replacement solicitation (NO. 140FGA26R0001) issued by the Department of the Interior. The amendment addresses three primary bidder inquiries regarding contract requirements and project timeline expectations.
The first question and answer clarifies insurance requirements, incorporating clause 1428.301 (Liability Insurance - Department of the Interior) into the solicitation and resulting contract. Contractors must procure and maintain liability insurance with minimum coverage limits of $500,000 each person, $500,000 each occurrence, and $500,000 property damage, with amounts subject to Contracting Officer adjustment. The named insured parties must include both the Contractor and the United States of America. Insurance companies must provide endorsements notifying the Contracting Officer 30 days prior to any cancellation, termination, or adverse modifications. Contractors must submit an acceptable insurance certificate prior to work commencement. The second question and answer addresses past performance documentation requirements, clarifying that offerors may submit either CPARS evaluations for completed projects or Past Performance Questionnaires (PPQs) completed by clients with current contact information; no standard PPQ form is mandated, but the form must be client-completed and supplemented with information outlined in the solicitation's Section L.2.1.2 for Evaluation Factor 1 (Recent Relevant Experience). The third question and answer establishes the project timeline, with an aimed period of performance start date of April 20, 2026. However, the construction phase start date remains unknown and contingent upon 100% design approval. Per the Statement of Work, the overall period of performance is 18 months, with design and permitting completed within six months from Notice to Proceed, and construction/build completed within twelve months from design phase acceptance.

Design-Build Services North Flume Replacement Questions in Response to the Solicitation
Solicitation NO. 140FGA26R0001 Amendment #1
Question 1: Noted that FAR 52.228-5 (Insurance - Work on a Government Installation) is incorporated by reference; however, I did not see specific insurance coverage types or minimum limits identified in the solicitation documents. Please advise on the required insurance coverages and the minimum limits applicable to this solicitation.
Answer: The following clause is hereby incorporated into this solicitation and also the contract once executed:
1428.301 Liability Insurance - Department of the Interior (JUL 1996)
(a) The Contractor shall procure and maintain during the term of this contract and any extension thereof liability insurance in form satisfactory to the Contracting Officer by an insurance company which is acceptable to the Contracting Officer. The named insured parties under the policy shall be the Contractor and the United States of America. The amounts of the insurance shall be not less than as follows:
$500,000 each person*
$500,000 each occurrence*
$500,000 property damage*
(b) Each policy shall have a certificate evidencing the insurance coverage. The insurance company shall provide an endorsement to notify the Contracting Officer 30 days prior to the effective date of cancellation or termination of the policy or certificate; or modification of the policy or certificate which may adversely affect the interest of the Government in such insurance. The certificate shall identify the contract number, the name and address of the Contracting Officer, as well as the insured, the policy number and a brief description of contract services to be performed. The contractor shall furnish the Contracting Officer with a copy of an acceptable insurance certificate prior to beginning the work.
*These amounts to be set by the Contracting Officer.
(End of clause)
Question 2: If we don't have a CPARS for one of our projects but we do have an existing PPQ, is it OK to use that rather than get a new one? If we don't have either, is there a PPQ form you would like us to use?
Answer: Please refer to page 47 of the solicitation under L.2.1.2. Submit CPARS evaluations for projects completed or a Past Performance Questionnaire (PPQ) completed by client with up-to-date contact information. No standard form for the PPQ, however, the form must be completed by offerors client with up-to-date contact information. Separate from the CPARS/ PPQ
Design-Build Services North Flume Replacement Questions in Response to the Solicitation
Solicitation NO. 140FGA26R0001 Amendment #1 submission requirement, offerors must also submit the information as outlined in the solicitation in section L.2.1.2 for Evaluation Factor 1, Recent Relevant Experience.
Question 3: If known, what is the expected start date for construction?
Answer: Refer to the solicitation on page 3. The aimed period of performance start date is April 20, 2026, however, please note since this is a design-build project the start date for the construction phase is unknown at this time and dependent on when the design is %100 fully approved. Refer to the SOW on page 1 which says the following: "The overall period of performance is 18 months. Design and permitting phase shall be completed and approved within six (6) months from NTP. Construction/build phase shall be completed within twelve (12) months from completion and acceptance of design phase."
