About this file

This is a Questions and Answers attachment for federal contract solicitation 140FC126R0023 for Vieques National Wildlife Refuge (NWR) Road Rehabilitation, dated 28 July 2026. The document clarifies requirements and conditions for the awarded contractor performing roadway repair work.

Key contractual requirements include mandatory submission of a bid guarantee (as specified in FAR 52.228-17 and FAR 52.228-1) for award consideration; failure to provide the bid guarantee in proper form and amount by the proposal due date renders the proposal ineligible for award. The awarded contractor bears full responsibility for completely closing public access to roads and pathways during construction, with closures coordinated with Refuge Manager Mr. Mike Barandiaran. Roadways must be repaired and covered to a 20-foot width (not the original 12-foot specification), though on-site material is confirmed sufficient for this expanded scope, and bidders should not account for additional material quantities in pricing. The contractor must haul material from the designated secure storage area within Vieques NWR to each road site and bear associated hauling costs. No physical inspection office is required, but the contractor must maintain adequate on-site supervision, implement quality control measures per contract requirements, and comply with all OSHA safety and health regulations. Additional coordination with La Marina (another government agency) may be required for road closures; the Refuge Manager directs this coordination, and the contract Period of Performance includes sufficient time for such coordination, with potential delays eligible for discussion and compensation through additional contract time upon mutual agreement. No temporary storage facility, potable water, electricity, or restroom facilities are available at the project site for contractor use.

Attachment 5 – Question and Answers 28 July 2026

Question 1: Regarding the Bid Bond, is this required to be deemed a responsive offeror or is it something that can be waived based on the CO's Judgement?

Answer: Unless the solicitation is amended, submission of a bid guarantee is required for award consideration. FAR 52.228-17 is included in Section K, and FAR 52.228-1, Bid Guarantee, is included in Section L. Volume IV requires submission of the bid guarantee and states: Failure to provide a bid guarantee in the proper form and amount by the proposal due date and time may render the proposal ineligible for award.

Question 2: Please confirm whether the awarded contractor will be responsible for completely closing public access to the roads and/or pathways during construction activities. If so, please clarify whether such closures will be coordinated with the client and any relevant authorities.

Answer: The awarded contractor WILL be responsible for completely closing public access to the roads and/or pathways during construction activities.

Such closures time, logistics, and methodologies shall be coordinated with the Refuge Manager: Mr. Mike Barandiaran, as they may vary per road.

Question 3: The SOW specifies the use of material for roadways that are 12 feet wide and 4 inches thick. However, based on site conditions, several roads appear to be significantly wider than 12 feet, with some sections exceeding 20 feet in width. If the material is applied only over a 12-foot width, portions of the existing roadway would remain untreated.

Conversely, if the full existing roadway width is treated, it appears that the quantity of material specified in the SOW may be insufficient. Could the Government please clarify whether the work is intended to cover only a 12-foot width or the full existing roadway width, and confirm how bidders should account for material quantities in their pricing?

Answer: That is correct, it was brought to my attention that roads are wider than 12 feet.

Awarded contractor shall repair/cover 20-ft width for each road. Even with this condition the material available on site WILL BE SUFFICIENT for the construction.

Bidders should NOT account for additional material quantities in their pricing.

Attachment 5 – Question and Answers

Question 4: During the site visit, the Government indicated that roadway closures associated with this project may be coordinated with work planned by another government agency in nearby areas in order to minimize prolonged public access restrictions to beaches and other facilities. Please clarify the extent of the required coordination, identify any known schedule constraints, and confirm whether delays, restricted access, or resequencing resulting from such coordination will be considered excusable and/or compensable under the contract. Additionally, please confirm how offerors should account for these potential impacts in their proposals.

Answer: This project may require additional coordination with another government agency: La Marina. But the Refuge Manager will be in charge of that coordination and will notify the awarded party accordingly.

Sufficient time was allocated on the SOW Period of Performance (PoP) for this type of coordination. Should there be any delays or issues resulting from such coordination, they could be discussed and compensated WITH ADDITIONAL NEEDED TIME ADDED to the contract, if necessary upon mutual agreement between the parties.

When contract is awarded, we encourage the contractor to immediately initiate coordination for road closures with the Refuge Manager. Not all roads will be closed simultaneously.

Question 5: Can there be an assigned area for the selected contractor to allow for setting up a temporary storage facility?

Answer: The material is in storage in a secure area inside the Vieques NWR. There is no other temporary storage facility available that will prevent material theft during construction. Contractor shall consider in the proposal the cost of hauling the material from the storage area provided (specified on the SOW) to each road.

Question 6: Is it required for the awarded contractor to establish an inspection office during the execution of the project?

Answer: No. It is not a requirement for the awarded contractor to establish a physical inspection office during the execution of the project. However, the contractor is responsible for maintaining adequate on-site supervision and implementing quality control measures in accordance with the contract requirements. Additionally, the contractor must comply with all applicable OSHA safety and health regulations throughout the duration of the project.
