About this file
This is Amendment 001 to Request for Quote (RFQ) 140F1S26Q0127 issued by the U.S. Fish and Wildlife Service (USFWS), Central Washington National Wildlife Refuge Complex, with an effective date of August 24, 2026. The amendment extends the quote submission deadline to Tuesday, September 1, 2026, at 5:00 PM EST and provides clarifications and corrections to licensing, evaluation, and eligibility requirements.
The procurement requires the supply of 115 gallons of Plateau (ammonium salt of imazapic, 23.6% active ingredient, 2.0 lbs per gallon) and 115 gallons of Rejuvra (indaziflam, 19.05% active ingredient, 1.74 lbs per gallon) or equal products suitable for pre-emergence and post-emergence treatment of invasive annual grasses in non-crop areas. All herbicides must be registered for use in Washington and Oregon. A critical new requirement mandates that vendors distributing herbicides directly into Washington hold an active Washington Pesticide Dealer License under RCW 15.58.180 and provide the license number with their quotation; the apparent successful vendor must possess an active license prior to award. Delivery must occur within 14 days of contract award to McNary National Wildlife Refuge in Burbank, Washington, with a performance period deadline of October 30, 2026. The Government will use Lowest Price Technically Acceptable (LPTA) methodology, evaluating quotes on Technical Acceptability (Pass/Fail), Past Performance (Pass/Fail), and Price. All quoted firm-fixed prices must include applicable Washington taxes, licensing fees, and registration costs, with no post-award price adjustments permitted. The SBA Nonmanufacturer Rule class waiver for NAICS 325320 applies, allowing small-business vendors to supply products manufactured by other-than-small manufacturers. Questions must be submitted by Wednesday, August 26, 2026, at 12:00 PM EST to lawrence_aragon@ios.doi.gov, with quotes submitted to the same email address.

IV. Evaluation Factors (LPTA) This acquisition uses the Lowest Price Technically Acceptable (LPTA) source selection process. Technical and past performance factors will be evaluated on an acceptable/unacceptable basis. No tradeoffs will be made.
1) Factor 1 – Technical Acceptability (Pass/Fail)
The Government will evaluate the offeror’s quote to verify compliance with all requirements in the RFQ and requirements document.
• Pass: Quote meets all mandatory requirements.
• Fail: Quote does not meet one or more mandatory requirements.
2) Factor 2 – Past Performance (Pass/Fail)
Past performance will be evaluated to determine acceptability only. The Government will review past performance information from CPARS, agency records, or other sources.
• Acceptability: Offeror demonstrates satisfactory performance on similar contracts and has no terminations for cause or default within the past three (3) years.
• Unacceptability: Offeror has a record of unsatisfactory performance or one or more terminations for cause or default within the past three (3) years.
• Neutral: If no past performance information is available, the offeror will receive a “neutral” rating, which will be treated as acceptable.
3) Factor 3 – Price Price will be evaluated for reasonableness and completeness. Award will be made to the lowest-priced offeror whose quote is technically acceptable and whose past performance is acceptable.
V. Responsibility Determination In accordance with RFO FAR 9.104-1(g), the Government will determine whether the apparent successful vendor is otherwise qualified and eligible to receive an award under applicable laws and regulations. This determination includes confirming that the apparent successful vendor is legally eligible to sell and distribute commercial pesticides directly into Washington, including compliance with RCW 15.58.180 and the requirement for a Washington Pesticide Dealer License.
Failure to meet applicable federal, state, or local legal eligibility requirements prior to award will render a vendor non-responsible.
VI. Bais of Award Award will be made to the responsible offeror submitting the lowest-priced, technically acceptable quote. The Government intends to award without discussion; however, the Contracting Officer reserves the right to conduct discussions if necessary.

The Contractor shall not be required to comply with the cost accounting standards or contract cost principles for this purpose. This paragraph does not give the Government any right to audit the Contractor’s records. The Contractor shall not be paid for any work performed or costs incurred which reasonably could have been avoided.
(m) Termination for cause. The Government may terminate this contract, or any part hereof, for cause in the event of any default by the Contractor, or if the Contractor fails to comply with any contract terms and conditions, or fails to provide the Government, upon request, with adequate assurances of future performance. The Government will send a cure notice to the Contractor, unless the reason for the termination is late delivery. In the event of termination for cause, the Government shall not be liable to the Contractor for any amount for supplies or services not accepted, and the Contractor shall be liable to the Government for any and all rights and remedies provided by law. If it is determined that the Government improperly terminated this contract for default, such termination shall be deemed a termination for convenience.
(n) Title. Unless specified elsewhere in this contract, title to items furnished under this contract shall pass to the Government upon acceptance, regardless of when or where the Government takes physical possession.
