SECTION D – INSTRUCTIONS TO OFFERORS AND

EVALUATION OF OFFERS

Instructions to Offerors—Commercial Items (52.212-1 JUL 2021) Tailored

D1 General Information

D1.1 The services of this Request for Proposals (RFP) are being acquired under the authority of Federal Acquisition Regulations (FAR), Part 12, Acquisition of Commercial Items and FAR Part 15 Contracting by Negotiation.

D1.2 Offerors who wish to compete for the contract described in Sections A through C of this RFP must submit a proposal that includes a signed and dated offer (SF1449) and other required information by the time and date shown on the SF1449, unless changed via solicitation amendment.

D1.3 It is the offeror’s responsibility to read the RFP and all related documents carefully and completely and to monitor the SAM website (https://sam.gov) on a regular basis for any updates to the RFP. Additionally, it is the offeror’s responsibility to ensure/verify the Government receives the proposal on or before the date/time specified.

D1.4 Assent to Solicitation. If the Offeror takes exception to any of the terms and conditions of the RFP, then the Government may consider its offer to be unsatisfactory.

Aircraft proposed must at least meet the Minimum Aircraft Requirements provided in the solicitation. Unsatisfactory offers will be eliminated without further consideration of the proposal.

D2 North American Industry Classification System (NAICS) Code and Small Business Size Standard

This requirement is a 100 percent small business set-aside. The North American Industry Classification System (NAICS) Code and small business size standard for this acquisition is 481211 and 1,500 employees, respectively. Only proposals from small businesses will be considered. Proposals from large businesses will be deemed unacceptable and removed from further consideration.

D3 Instructions to Offerors

D3.1 The Contracting Officer is the point of contact for this acquisition. Address any questions or concerns you may have to the Contracting Officer in accordance with D12.

D3.2 The proposal due date and time is identified in Box 8 on the SF1449 solicitation form. One (1) electronic copy of the proposal shall be submitted to the Contracting Officer via email to 140D8021R0017@ibc.doi.gov. The email subject line should include the contractor/business name and solicitation number.

D3.3 The email message size limit is 40MB. Depending on the size of the files, multiple emails may be required to ensure proper receipt of all required documents. If multiple emails are required, each email should be numbered “1 of __”, “2 of __”, etc. in the subject line to show how many emails there are in total. Proposals shall have separate files for EACH required document and NOT one large document.

D3.4 The Contracting Officer will acknowledge receipt of each email submitted; however, the offeror remains responsible for on-time delivery to, and receipt by, the Contracting Officer.

D3.5 The proposal shall be prepared clearly and concisely to demonstrate the offeror has a complete understanding of the requirements. Offerors shall prepare proposals on the presumption that the Government has no previous knowledge of the offeror’s capabilities. Proposals shall be evaluated only on the information specifically presented within the proposal, with the exception of the Past Performance evaluations as explained in Section D11.

D3.6 Hard copy/mailed offers will not be accepted.

D4 Offer Contents

The contents must be tabbed and organized in the order described below:

D4.1 SF 1449, Solicitation/Contract/Order for Commercial Items, completed and signed.

D4.2 Acknowledgment (Signed SF30s) of Solicitation Amendments (if any).

D4.3 Pricing page(s) (See Section A2) completed for each aircraft offered. Unit rates will be offered in whole U.S. dollars.

D4.3.1 This solicitation has six (6) items listed in Section A2 that distinguish between different aircraft types. Offers may be submitted for one (1), a few, or all of the items. Pricing pages for items not proposed shall be left BLANK and will not be included in a subsequent conformed contract.

D4.4 Offeror’s Representations and Certifications are incorporated by reference in accordance with FAR 52.212-4 paragraph (v). Offerors shall complete their annual representations and certifications online at www.SAM.gov in the System for Award Management (SAM) and include a copy of the first page of their SAM registration showing current SAM registration status.

D4.5 A completed copy of Offeror’s Miscellaneous Information (see Exhibit E-1).
