UNITED STATES DEPARTMENT OF THE INTERIOR
OFFICE OF THE SECRETARY
Appraisal and Valuation Services Office
STATEMENT OF WORK
SECTION 1: CASE PROPERTIES
Case Name: Mineral Point Ditch and Water Right Acquisition
Case Type: Acquisition
Agency: Bureau of Land Management (BLM)
Agency Case ID: COC-80555
AVIS Project Number: L210100
Requested Service: Market value appraisal
Location: San Juan County, Colorado
SECTION 2: SUBJECT OF THE APPRAISAL
Proposed Acquisition: The Appraisal and Valuation Services Office (AVSO) is requesting an appraisal of a transbasin diversion and associated water rights. The transbasin diversion is known as the Mineral Point Ditch comprised of an 11 cfs water right (absolute, decreed for irrigation use) and a 3,225-foot ditch. The ditch includes a headgate, measuring weir, and associated rights-of-way.
The Mineral Point Ditch is located in the Bonita Peak Mining District Superfund Site, which was added to the National Priorities List in 2016. The Bonita Peak Mining District site consists of 48 historic mines or mining-related sources including historic hardrock mines, tailings, and waste rock – within the Mineral Creek, Cement Creek and Upper Animas River drainages in San Juan County, Colorado.
Legal Description: The ditch is in New Mexico Principal Meridian, Colorado, T. 43 N., R. 7 W., Protraction Block 24 A, sec. 36; unsurveyed (protraction diagram approved May 5, 1965).
Water right for 11 cfs, absolute, decreed for irrigation use in a decree entered by District Court, San Juan County, Colorado. The decree awarded an appropriation date of September 27, 1956, and assigns appropriation priority number 1965-74 and ditch number 74.
Property Rights Appraised: Water right as decreed.
140D0422Q0342 008
Current Use: Flood irrigation
SECTION 3: APPRAISAL PROBLEM IDENTIFICATION
Client: AVSO
Intended Users: AVSO and BLM, on behalf of the United States of America
Intended Use: The appraisal report will be used to assist the BLM in its determination of the amount to be paid as just compensation for the property rights acquired. The appraisal report is not intended for any other use. (UASFLA 1.2.3, pg. 10)
Type of Value: Market Value (subject to reservation of mineral estate)
Definition of Market Value: Market value is the amount in cash, or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.
(UASFLA Section 1.2.4.)
Effective Date: The effective date of value shall be the latter of the date of the last property inspection, or the date upon which the appraiser has concluded his/her market research and analyses.
SECTION 4: ASSIGNMENT CONDITIONS
Applicable Standards: Uniform Standards of Professional Appraisal Practice (USPAP), 2020-2021 edition; and Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA), 6th Edition
Extraordinary Assumptions and/or Hypothetical Conditions:
None. If the appraiser determines that extraordinary assumptions and/or hypothetical conditions are necessary, he/she must contact the AVSO Review Appraiser for prior written approval.
Jurisdictional Exceptions: The appraiser has been instructed to produce a UASFLA compliant appraisal.
Section 1.2.4 of UASFLA states that “appraisers should not link opinions of value under these Standards to a specific opinion of exposure time.” USPAP requires the appraiser to develop and report a reasonable exposure time if it is a component of the definition of market value, which contravenes the UASFLA.
Therefore, the appraiser should invoke USPAP’s Jurisdictional Exception Rule.
140D0422Q0342 009
Pre-Work Meeting: A meeting with the appraiser will be conducted prior to the inspection of the property. The purpose of the meeting will be to discuss the Statement of Work.
The AVSO Review Appraiser will coordinate the date and time of the meeting with the appraiser. The meeting may occur at the property at the time of the inspection or by teleconference. BLM will be invited to attend the meeting.
Property Inspection: The appraiser must inspect the subject property and all comparable market data used in the appraisal, unless the AVSO Review Appraiser has approved other conditions in writing. The inspection of the subject property will be coordinated with the BLM realty staff.
The subject water right originates from a diversion located above timberline, in an area which is typically inaccessible until mid to late June; therefore, property inspection cannot take place, until the snow melts in June 2022.
The appraiser will schedule the property inspection as soon as practicable, providing the Review Appraiser and the agency not less than a two-week notice.
Contacting Landowners: In accordance with the Uniform Act, the owner or the owner’s designated representative must be given an opportunity to accompany the appraiser during the inspection of the property (UASFLA 1.2.6.4).
Larger Parcel: The appraiser must conduct all research necessary to develop a well-supported larger parcel conclusion in accordance with UASFLA 6th Edition.
SECTION 5: APPRAISAL REQUIREMENTS AND INSTRUCTIONS
1. The AVSO Statement of Work, engagement letter, and other assignment instructions must be included in the addenda to the appraisal report. Reference to these documents should be provided in the body of the report.
2. The appraisal report should conform to the sequence and content described in Section 2 of the UASFLA.
3. The appraisal should include detailed descriptions of the comparable properties including location maps and photographs. The appraisal must include color photographs (ground or aerial) of all comparable sales.
4. All comparable sales must be confirmed by the buyer, seller, broker, or other person having knowledge of the price, terms, and conditions of sale. The appraisal must include contact information for the party or parties relied upon to verify each sale (i.e. telephone number, email, etc.), along with maps clearly showing the location of the subject relative to the comparable property. It is important that the locations of the comparable sales and the subject property are shown on the same map so that a reader of the report who may not be familiar with the area can understand the relative proximity of the properties and locate them in the field. (UASFLA, Footnote 133, p 66.)
5. Sales requiring extraordinary verification in accordance with UASFLA Section 1.5.2.4 must adhere strictly to the standards enumerated therein.
6. If including any proprietary information in the appraisal, the appraiser must gain concurrence from the AVSO Review Appraiser and deliver the proprietary information in a separate binder.
140D0422Q0342 010
7. When the appraiser has performed any services regarding the subject property within the prior three years, he/she must disclose this in the bid proposal.
8. The appraisal report content should rely on the “AVSO Review Checklist” which has been attached as an exhibit to this Statement of Work. The appraiser should refer to this checklist prior to submitting the appraisal report for review.
9. AVSO is the appraiser's sole client. The appraiser may not communicate assignment results to any party except AVSO, unless authorized to do so in writing by AVSO.
10. If the appraiser discovers material facts which differ from those provided by AVSO or encounters circumstances which prevent the appraiser from developing an unbiased appraisal, the appraiser must contact the AVSO Review Appraiser for instructions.
11. Any communication (verbal or written) with the BLM realty contact shall include the AVSO Review Appraiser.
12. This Statement of Work has been prepared during the COVID-19 pandemic. Market impacts may vary by property type, but potential exists for significant changes to real property values. For this reason, the appraisal should include a thorough market analysis available at the effective date in support of market condition adjustments or no adjustments. As applicable, this analysis should include interviews with real estate market participants (such as brokers, lenders, buyers, sellers), economic trends in the market sector and location, listing and sales activity or non-activity, commodity pricing, and changes in the financial markets. Any changes in market conditions caused by the COVID-19 pandemic should be discussed in the report.
SECTION 5: PERFORMANCE / DELIVERABLE REQUIREMENTS
Draft Appraisal Report Due:
A draft appraisal report will be due 120 days from the date of contract award.
The appraiser is requested to provide a digital copy of the report that will allow the AVSO Review Appraiser to search text, highlight text, and include review comments. The draft report should not be signed and must be clearly marked as a draft or a work in progress.
Review Period: The review period will be 30 days from the receipt of the draft appraisal report.
The draft report will be reviewed for compliance with the terms of this Statement of Work, including all cited standards and regulations. Any findings of inadequacy will require clarification and/or correction.
Comments Provided to the Appraiser:
Review comments and/or suggestions, if any, will be provided to the appraiser, and to the extent that revisions are required, the appraiser shall complete the revisions within 10 days. An electronic copy of the revised report must be submitted directly to the AVSO Review Appraiser.
Final Appraisal Report: Once the report is reviewed and approved by AVSO, the review appraiser will notify the BLM and the contracted appraiser in writing that the appraisal has been approved for use by the BLM. The review appraiser will provide the BLM with a secured digital copy of the appraisal report at that time. The contracted appraiser will then submit two signed paper copies of the appraisal report to the
140D0422Q0342 011
BLM realty contact within 10 days. Submission of the report to any other party is strictly prohibited.
