STATEMENT OF WORK (SOW)
Appraisal and Valuation Services Office
Agency Case ID 00160674
AVIS Number F220043
SECTION 1 – Subject Identification & General Information
Identification Case Name LA/CAT/19,a Location Cat Island Road Sections 16 & 42, Township 2S, Range 4W West Feliciana Parish, Louisiana
Acreage 273.89± acres (Proposed Acquisition) Property Type Non-Federal Vacant Land Case Type Acquisition
Appraiser’s Client U.S. Department of the Interior, Appraisal and Valuation Services Office
(AVSO).
Intended Users The intended users of the appraisal report are the Client and U.S. Fish and
Wildlife Service (FWS) on behalf of the United States of America.
Intended Use The appraisal report will be used by the FWS in conjunction with negotiating the proposed acquisition of the identified property via purchase with the landowner.
It is not intended for any other use.
Property Description The property to be acquired is located approximately seven miles west of the town of St. Francisville, West Feliciana Parish, Louisiana. The Proposed Acquisition includes two tracts, Tracts 19 and 19a, totaling approximately 273.89 acres. Tract (19) is approximately 144.60 acres and Tract (19a) is approximately 129.29 acres. Actual acreage will be determined by a survey prior to transfer of title to the United States of America. Tract (19) is offset from the Mississippi River by approximately 1,000 feet and Tract (19a) is situated on the Mississippi River on its north boundary. Tracts (19) and (19a) are non-contiguous to one another, separated by approximately 1500 feet. Both tracts are primarily bottomland hardwood forest and experience annual flooding from the Mississippi River. There are no improvements on the property. The subject is identified as West Feliciana Parish Tax Parcel #100001028.
It is anticipated that additional and more detailed information on the Subject Property will be uncovered during a physical inspection and due diligence research by the Appraiser. All site characteristics are to be independently researched and verified by the Appraiser. The Appraiser must immediately notify the AVSO Review Appraiser of any significant discrepancies in the property description provided above. This may result in amended instructions.
The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
140D422Q0308 008
140D422Q0308 009
Minerals The mineral rights are included in the fee simple estate. Per AVSO Division of Minerals Evaluation (DME), the subject is outside of any known hydrocarbon or mineral producing area. The parcel is outside of any known hydrocarbon or mineral producing area. Datasets such as USGS's Mineral Resources Data System, local aerial imagery (Google Earth, Digital Globe), and IHS Enerdeq were reviewed for relevant mineral information. There are no recognized mineral development or mineral valuation issues.
Timber FWS reports that the property may contain merchantable timber. Timber on the property is a mixture of ages due to historical harvests, with most recent selective cut in 2008. There are some very large cypress trees on the property that have not been harvested in many years. The Appraiser is encouraged to research common local practices. A timber cruise (by a qualified forester approved by the AVSO Review Appraiser) which complies with AVSO timber cruise specifications may be needed as part of this appraisal assignment. Note: Should the Appraiser determine that a timber cruise is necessary, he/she must immediately notify the AVSO Review Appraiser so that arrangements can be made through FWS. If a timber cruise is needed, the cost will NOT be incurred by the Appraiser and the period of performance may need to be adjusted to accommodate completion of the cruise. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
140D422Q0308 010
Legal Description The Legal Description provided by FWS for the Subject Property is based on the Preliminary Land Survey Assessment and the most recent transfer document, Instrument #79906, Book 140, Page 197 dated June 29, 2000. Both documents will be provided upon contract award.
Property Interest to be Acquired The property interest to be appraised is fee simple interest subject to riparian, roadway right-of-way and utility right-of-way. Water and mineral rights are included in the fee simple estate.
Reservations/Outstanding Rights FWS has provided Fidelity National Title Insurance Company Title Commitment #34120-B-GOV dated February 22, 2021. Outstanding rights or reservations specifically identified within the transfer documents, Title Commitment or by FWS include: riparian, roadway right-of-way and utility right of way. Verification with the property owner regarding outstanding rights, reservations and right of ways is advised.
No reservations easements, or other restrictions or outstanding rights are known by FWS to affect the property to be acquired. Please note that any recorded or unrecorded documents, conditions, agreements, reservations, easements and/or encumbrances discovered during a due diligence investigation must be identified and discussed in the appraisal report in relation to their impact on value. The Appraiser must investigate for and promptly report additional or inaccurate encumbrances on the property to the AVSO Review Appraiser. This may result in amended instructions. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
Improvements None
Property Access Legal and physical access is via River Road (also known as Cat Island Road). River Road runs along the north boundary of Tract 19 and along the east boundary of Tract 19a. River Road is a gravel parish road that runs along the Mississippi River through the refuge. This portion of the Mississippi River is un-leveed and the property floods annually preventing vehicular access during high water periods. Additional access to Tract 19a is from the Mississippi River by watercraft.
Larger Parcel The agency request indicates that the proposed acquisition consists of 273.89± acres. No other contiguous or proximate lands under the same ownership have been identified by FWS via their request for appraisal services. However, it is ultimately the Appraiser’s responsibility to identify any and all lands having unity of ownership in conjunction with unity of highest and best use for the purposes of determining the larger parcel(s). The Appraiser is encouraged to research the ownerships that may have an impact on the Larger Parcel analysis. The Appraiser must conduct all research necessary for a well-supported Larger Parcel(s) conclusion presented in the appraisal. As the Appraiser, you must identify a larger parcel (or potentially multiple larger parcels) which satisfies the tests of title, unity of highest and best use, and contiguity as it relates to highest and best use with UASFLA, Sections 1.2.7.3.1., 1.4.3 – 1.4.7., 4.3.3 –
4.3.4.5. and 4.6.1.1. Section 2.3.3.1.2 of UASFLA requires that the Appraiser must describe the factual basis and analysis that led to the larger parcel determination and the determination itself be reported.
140D422Q0308 011
Ownership/Occupant This information will be provided to the Appraiser upon contract award.
Tenancies None known. The Appraiser should confirm with landowner whether there are any leases and/or rental agreements on the property.
Appraiser’s Use of Consultant’s Reports The Client and/or owner indicated there may be merchantable timber on the property to be appraised. However, no timber cruise has been provided to help determine any contributory value. The contracted appraiser is to notify the AVSO review appraiser if it is determined, upon inspection, that a timber cruise is necessary to achieve credible assignment results (note: this notification generally occurs subsequent to inspecting the subject property and often after completing preliminary highest and best use analysis and identifying potential comparable sales). In response, the AVSO review appraiser will request justification supporting your determination that a timber cruise is necessary to achieve credible assignment results. Assuming adequate support exists, the AVSO review appraiser will arrange for a timber cruise to be completed at the U.S. Fish and Wildlife Service (FWS) expense. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
Please note that Section 1.13 of UASFLA states “the appraiser cannot merely accept such consultant reports as accurate, but rather must analyze such reports and adopt them only if reasonable and adequately documented and supported. The results of secondary valuation reports (minerals, fixtures, or timber valuations) cannot simply be added to the value of the land to arrive at a value of the property as a whole without proper analysis by the appraiser. To do so would violate the unit rule and professional standards.
The appraiser must consider these components of the property in light of how they contribute to the market value of the property as a whole.”
Owner Contact Information The List of Contacts in the contract award package will provide owner contact information to the Appraiser upon contract award.
Provided Subject Property Exhibits The following additional Exhibits will be provided with the contract award package:
7. Transfer Document
8. Title Commitment
9. Permission to Appraise & Inspect
10. Survey
11. PLSA
12. Project Contacts List
SECTION 2 – Appraisal Requirements & Instructions
Appraisal Standards
• Uniform Standards of Professional Appraisal Practice (USPAP- 2020/2021 edition)
Standards 1 & 2
• Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA - 6th Edition, 2016)
140D422Q0308 012
• Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended; 49 CFR, Part 24
Market Value Market Value is the amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property. (Uniform Appraisal Standards for Federal Land Acquisitions, 1.2.4 of 6th Edition) This definition of value must be placed in the Scope of Work section of the report in accordance with UASFLA 2.3.1.8.
Date of Value The date of value is to be the date of the last property inspection, which should be within 30 days of the date of the report.
Extraordinary Assumptions (EA’s) None. If the Appraiser determines that a extraordinary assumptions is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
Hypothetical Conditions (HC’s) None. If the Appraiser determines that a hypothetical condition is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
Jurisdictional Exceptions (JE’s) Opinions of market value for federal acquisition purposes shall not be linked to a specific opinion of exposure time [UASFLA, 6th Ed., Section 1.2.4, 1.2.7.2 and 4.2.1.2 (legal basis)], unlike other appraisal assignments subject to USPAP [Standard Rule 1-2(c) and 2-2(a)(vi)]. This exclusion of exposure time requires the use of a Jurisdictional Exception (JE) to USPAP. (Refer to page 15 of USPAP for proper reporting).
If the Appraiser believes that USPAP’s Jurisdictional Exception Rule is needed to comply with any other additional law or UASFLA regulation, he/she must contact the AVSO Review Appraiser to obtain prior written approval. The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
Please also note that in accordance with UASFLA, Section 1.2.4, estimates of marketing time are not appropriate and must not be included in appraisal reports prepared to UASFLA standards.
Placement in Report The Appraiser must clearly identify and discuss the implications of any authorized Extraordinary Assumptions and Hypothetical Conditions (including a statement that their use might have affected the assignment results) within the Scope of Work section of the appraisal report along with the Jurisdictional Exception (assignment condition) per UASFLA Section 2.3.1.8. Please also identify any authorized EAs and HC’s wherever the final value conclusion is stated.
140D422Q0308 013
Property Inspection The Appraiser must physically inspect the subject property. The owner has given permission to enter the property to conduct an inspection. The document granting permission to appraise will be provided to the contracted Appraiser upon award. Please contact the owner directly, after award, to arrange a date and time for inspection. You must notify the AVSO Review Appraiser, in advance, when the property inspection will occur.
For appraisals with an intended use of acquisition, the Appraiser must certify in the report that he/she extended an offer to the property owner (or the owner’s representative) to accompany him/her during the property inspection. [Uniform Relocation Assistance & Real Property Acquisition Policies Act of 1970 (PL 91-646) as amended and the Uniform Appraisal Standards for Federal Land Acquisitions, 6th Ed.
(Section 2.3.1.4)]
Pre-Work Meeting/Conference Call The contracted Appraiser will be required to participate in a pre-work meeting by telephone with the assigned AVSO Review Appraiser. The AVSO Review Appraiser will coordinate the date and time of the pre-work meeting directly with the Appraiser once a contract is awarded.
Controversies/Issues Should the Appraiser identify controversies or issues during the assignment, immediately notify the assigned AVSO Review Appraiser.
Legal Instructions None given.
Special Appraisal Instructions
1. Even though communication is encouraged with the property owner and the client agency, only the
AQD Contracting Officer, in conjunction with the AVSO Review Appraiser’s concurrence, can modify appraisal instructions (in writing). The Contracting Officer is the only individual authorized to enter into or terminate this contract, modify any term or condition of this contract, waive any requirement of this contract, or accept nonconforming work.
2. The Appraiser may not communicate assignment results to any party except AVSO unless authorized to do so in writing by AVSO.
3. Any communication (verbal or written) with the client agency realty contact shall include the assigned AVSO Review Appraiser.
4. The area of acquisition is estimated to contain 273.89 +- acres, with the actual acreage to be acquired dependent upon completion of a formal survey. Consequently, it is requested that in addition to stating the final value conclusion of the larger parcel within the appraisal report, the unit value (e.g., $XX/acre) be stated along with the range of acreage within which that unit value would be valid (e.g., $XX/acre is valid for a range of XX-XX acres). This range would consider no material changes to the physical characteristics of the larger parcel.
5. This statement of work (SOW) has been prepared during the COVID-19 pandemic. Market impacts may vary by property type, geographic location, etc., but the potential exists for
140D422Q0308 014 significant changes to real property values. For this reason, the appraisal must include a thorough market analysis, based upon the data available as of the effective date of value, in support of any market condition adjustments or for no adjustments. As applicable, this analysis can include interviews with real estate market participants (such as brokers, lenders, buyers, sellers), economic trends in the market sector and location, listing and sales activity or non-activity, commodity pricing, and changes in the financial markets.
The market research, analysis and rendered value opinion for this appraisal assignment is to be based upon the data available as of the effective date of value. In the wake of social, financial and real estate market impacts caused by the COVID-19 pandemic, the appraiser is responsible for recognizing, researching, analyzing and reporting measurable economic impacts affecting market value/marketability (if any) as of the effective date of the appraisal.
General Appraisal Requirements & Instructions
1. The Appraiser must hold a valid license as a Certified General Appraiser as demonstrated by a copy of the state certificate. (Valid credentials would also include those issued under a reciprocity agreement and/or those characterized as “temporary” under the jurisdiction’s licensing and certification statutes where the subject is located and must also be provided if applicable.)
2. This AVSO Statement of Work and pages 1 & 2 of the Contract Award document must be included within the Addenda to the appraisal report along with the Appraiser’s license, to include temporary if applicable, and qualifications.

The property to be acquired is located approximately seven miles west of the town of St. Francisville, West Feliciana Parish, Louisiana. The Proposed Acquisition includes two tracts, Tracts 20 and 20a, totaling approximately 273.89 acres. Tract (20) is approximately 144.60 acres and Tract (20a) is approximately 129.29 acres. Actual acreage will be determined by a survey prior to transfer of title to the United States of America. Tract (20) is offset from the Mississippi River by approximately 1,000 feet and Tract (20a) is situated on the Mississippi River on its north boundary. Tracts (20) and (20a) are next to one another, however, they are separated by Cat Island Road, which runs through the property and is the dividing line between Tract (20) and (20a). Both tracts are primarily bottomland hardwood forest and experience annual flooding from the Mississippi River. There are four improvements on the subject property: three semi-permanent structures and one residential cabin-like structure. An allocated contributory value of each of the semi-permanent improvements is requested (see Special Instruction 5 and Extraordinary Assumption on Page 8 regarding the existing usufructs for the improvements). The subject is identified as West Feliciana Parish Tax Parcel #100001027.
It is anticipated that additional and more detailed information on the Subject Property will be uncovered during a physical inspection and due diligence research by the Appraiser. The mineral rights are included in the fee simple estate.

Survey Assessment and the most recent transfer document, Instrument #113465, Deed Book 204, Page 688 dated August 30, 2014. Both documents will be provided upon contract award. Please note that the Exchange document incorrectly cites the Tract numbers as 3A and 3B, but the previous Act of Partition 140/197 cites ownership of this property at Tracts 1A and 1B.
Property Interest to be Acquired The property interest to be appraised is fee simple interest subject to riparian rights, utility and road rights-of-way. Water and mineral rights are included in the fee simple estate.
Reservations/Outstanding Rights FWS has provided Fidelity National Title Insurance Company Title Commitment #34120-A-GOV dated February 22, 2021. Outstanding rights or reservations specifically identified within the transfer documents, Title Commitment or by FWS include: usufruct rights (COB 204, Page 688), utility right-of-way (COB 59, Page 568). Verification with the property owner regarding outstanding rights, reservations and right of ways is advised. Refer to EA regarding existing usufructs that will be terminated prior to transfer.
No reservations easements or other restrictions or outstanding rights are known by FWS to affect the property to be acquired.
Improvements There are four hunting camps/structures on Tract 20 of the subject property consisting of one wooden frame hunting camp and three camper trailers. All four structures are elevated 12’ on wooden pilings.
Water is provided by an on-site water well. An allocated contributory value of each semi-permanent improvement is requested (please see Special Instruction 5).
Structure Summary 24’ X 38’ wooden frame house/camp with tin roof 12’ X 60’ trailer

12’ X 60’ trailer 24’ X 20’ trailer (Two 12’ X 20’ trailers with a common roof, serves as one camp)
Property Access Legal and physical access is via River Road (also known as Cat Island Road). River Road runs along the north boundary of Tract 20 and along the east boundary of Tract 20a. River Road is a gravel parish road that runs along the Mississippi River through the refuge. This portion of the Mississippi River is un-leveed and the property floods annually preventing vehicular access during high water periods. Additional access to Tract 20a is from the Mississippi River by watercraft.
Ownership/Occupant This information will be provided to the Appraiser upon contract award.
Tenancies It is reported that there is a two-year hunting agreement on the subject property. The terms of the current lease are from July 1,2020 through June 30, 2022 for $4,282. The agreement includes a provision that the lease will be terminated if the property is sold. A copy of the Lease Agreement will be provided to the Appraiser upon Contract Award.
The results of secondary valuation reports (minerals, fixtures, or timber valuations) cannot simply be added to the value of the land to arrive at a value of the property as a whole
140D422Q0308 021 without proper analysis by the appraiser. To do so would violate the unit rule and professional standards.
The appraiser must consider these components of the property in light of how they contribute to the market value of the property as a whole.”

Standards 1 & 2
• Uniform Appraisal Standards for Federal Land Acquisitions (UASFLA - 6th Edition, 2016)
Market Value is the amount in cash or on terms reasonably equivalent to cash, for which in all probability the property would have sold on the effective date of value, after a reasonable exposure time on the open competitive market, from a willing and reasonably knowledgeable seller to a willing and reasonably knowledgeable buyer, with neither acting under any compulsion to buy or sell, giving due consideration to all available economic uses of the property.
Extraordinary Assumptions (EA’s) There are two (Camp A and Camp B) usufructs for Life as recorded in Conveyance Book 204, Page 688 on March 24, 2015 in the land records of West Feliciana Parish, Louisiana. The camps referred to in the usufruct are the four improvements described herein (four hunting camps/structures on Tract 20 of the subject property consisting of one wooden frame hunting camp and three camper trailers). According to FWS, the existing usufructs will be terminated upon transfer to the USA since there would no longer be any land associated with the camps to hunt. Therefore, the reviewer is authorizing the following extraordinary assumption:
140D422Q0308 022
“The AVSO client, U. S. Fish and Wildlife Service (FWS), has requested that I assume, if negotiations for acquisition are successful, that at the time of transfer to the USA, the usufructs will be terminated. As a result of the EA, the property is to be appraised as though the terms and conditions of the usufructs do not impact the appraised value of the property. The use of this EA may impact the conclusions reached in this appraisal.”
If the Appraiser determines that any other extraordinary assumption is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
Hypothetical Conditions (HC’s) None. If the Appraiser determines that a hypothetical condition is necessary for credible assignment results, he/she must contact the AVSO Review Appraiser for prior written approval.
For appraisals with an intended use of acquisition, the Appraiser must certify in the report that he/she extended an offer to the property owner (or the owner’s representative) to accompany him/her during the property…
