GENERAL: This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Federal Acquisition Regulation (FAR) subpart 12.6, in conjunction with the policies and procedures for solicitation, evaluation and award prescribed in FAR Part 13, Simplified Acquisition Procedures, and as supplemented with additional information included in this notice. THIS ANNOUNCEMENT CONSTITUTES THE ONLY SOLICITATION; QUOTES
ARE BEING REQUESTED AND A WRITTEN SOLICITATION WILL NOT BE ISSUED.
The Department of the Interior Acquisition Services Directorate (AQD) on behalf of the Office of the Special Trustee for American Indians (OST) is requesting a quote for brand name or equal GNB Sprinter flame retardant Uninterruptible Power Supply (UPS) batteries and associated services.
This RFQ is a Total Small Business set-aside, under NAICS code 335912 - Primary battery, dry and wet, non-rechargeable, and PSC 6135 - Batteries, Nonrechargeable.

QUOTATION DUE DATE & TIME
Solicitation Closing Date/Time: 09/19/2019 @ 4:00 PM (Eastern Time Zone)
Send questions and quotes via email to gloria_crayton@ibc.doi.gov and denise_lopez@ibc.doi.gov. Questions and quotes shall be emailed with the subject line "RFQ 140D0419Q0429 – UPS Batteries”. Telephone questions will not be accepted.
ANTICIPATED AWARD TYPE: The Government anticipates an award of a Firm-Fixed-Price (FFP) Purchase Order as a result of this RFQ. The Government will not consider quotes for partial items or quantities.
AWARD BASIS (FAR 52.212-2): Awards in response to this RFQ will be made in accordance with the Lowest Price Technically Acceptable (LPTA) terms.
DELIVERY DATE: The delivery of the products shall be within 30 days of award, or sooner.
The quoter shall provide the best delivery time. Installation shall be completed upon delivery of the Batteries. However, the Government is willing to allow installation a day or two after delivery. The contractor shall contact the IT POC prior to delivery to confirm the delivery time and date. The IT POC information will be provided at time of award.
INSTALLATION OF BATTERIES: To prevent operational disruptions, work shall be performed after normal business hours. Contractor work shall be performed from 7:00 PM to 5:00 AM.
The contractor shall provide the best installation time. STATEMENT OF REQUIREMENTS
BACKGROUND: Headquartered in Albuquerque, NM, the Office of the Special Trustee (OST) was established in 1999 to develop and implement a program for the economical and efficient management of trust records in compliance with the American Indian Trust Fund Management Reform Act of 1994 (Public Law 103-412) and the Federal Records Act (44 U.S.C. Chapter 31 Records Management by Federal Agencies).
SCOPE: The OST requires brand name or equal GNB Sprinter flame retardant Uninterruptible Power Supply (UPS) batteries and associated services. Batteries have reached their end of life And OST needs to replace 120 batteries.
REQUIREMENTS: The OST is requesting Brand name or Equal Batteries, GNB Sprinter flame retardant UPS 12-300MR, 12VDC battery, with manufacturer warranty, including professional installation, removal and proper disposal/recycling of UPS Batteries. Batteries quoted must be manufactured in the USA.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

QUOTATION PREPARATION INSTRUCTIONS
Quotation Preparation Instructions: The Department of the Interior, Interior Business Center
– Acquisition Services Directorate, is issuing this RFQ to solicit vendors for the purpose of entering into a Firm-Fixed Price Purchase order. This requirement is being competed a Small Business set-aside.
The following information must be submitted in order to be considered for award:
1. Price Quote: your price quote shall include the unit price for the items quoted, to include the cost of the UPS batteries with extended warranty, battery installation, removal and disposal of old batteries, and the shipping to location, and the extended total Purchase Order amount. Vendor must review all items and specifications included in this solicitation.
2. Specifications/Descriptions of all items including all warranties being submitted (contractor’s format), broken down by line item.
3. Provide pricing information to include all discounts taken into consideration. The Government requests a discount from vendors pricing.
4. If any software license agreement required, quoter must submit license agreement. The Quoter is advised that the license agreement must comport with applicable Federal Laws, Regulations and otherwise satisfy the government’s rules.
5. Include any shipping and/or handling charges that apply.
6. Include Representations and Certifications. The offeror's representations and certifications in accordance with FAR 52.212-3 and 52.219-1 shall be verified in the System for Award Management (SAM).
7. Include Period of Acceptance for quotes: The quoter agrees to hold the prices firm for 60 days from the date specified for receipt of quotes.
8. Specifications of the battery brand, and the country of manufacturer.

Method of Quotation Delivery: Quotations shall be submitted via email by the date and time specified in the RFQ, Quotation Due Date and Time. Please note it is the quoter’s responsibility to ensure/verify that the Government receives their submission on or before the date and time specified. If the quote is not received by the Government on or before the date and time specified, the quoter’s submission may be removed from further consideration for award.
Assumptions, Conditions, and/or exceptions: Quoters must submit, under separate cover, all (if any) assumptions, conditions, or exceptions with any of the terms and conditions of this RFQ. If not noted in this section of your quote, it will be assumed that the quoter proposes no assumptions for award, and agrees to comply with all of the terms and conditions as set forth herein. It is not the responsibility of the Government to seek out and identify assumptions, conditions, or exceptions buried within the quoter’s quote.
Other General Information: The government reserves the right to request additional information as may be necessary to determine the prospective quoter’s qualifications for an award or to clarify any aspects of their submissions. Payment for Unauthorized Work: No payments will be made for any unauthorized supplies and/or services or for any unauthorized changes to the work specified herein. This includes any services performed by the Contractor of their own volition or at the request of an individual other than a duly appointed Contracting Officer. Only a duly appointed Contracting Officer is authorized to change the specifications terms, and conditions under this effort.
Physical Security: Pursuant to Federal Acquisition Regulation (FAR) clause 52.204-9, incorporated into this solicitation and the resulting contract, each contractor and subcontractor must comply with Agency Personal Identity Verification (PIV) procedures when the contractor and subcontractor will have unescorted physical access to a federally-controlled facility and/or access to a federally-controlled information system (including, but not limited to, computer systems, networks, or information technology infrastructure).
Release of Information: The contractor will provide to the COR and other authorized Government representatives, all contractor-generated technical records, reports, files and other documentation during the performance of this contract. The contractor will obtain approval from the COR before releasing any information, regardless of media.
No news release (including photographs and films, public announcements, denial or confirmation of same) on any part of the subject matter of this effort or any phase of any program hereunder shall be made without the prior written approval of the Contracting Officer.
There shall be no dissemination or publication, except within and between the Contractor and any subcontractors, of information developed under this contract or contained in the reports to be furnished pursuant to this effort without prior written approval from the Contracting Officer.
The Contractor is prohibited from releasing to any source, other than the sponsoring activity, any interim, draft and final reports or information pertaining to services performed under this contract until report approval or official review has been obtained. Furthermore, the contractor shall insure that the cover of all interim, draft and final reports contain the following statement:
"The view, opinions, and/or findings contained in this report are those of the author(s) and should not be construed as an official Government position, policy or decision, unless so designated by other documentation."
Miscellaneous: All contractor-generated technical records, reports, files, and other documentation created in the performance of this contract will be considered to be property of the Federal Government. At the end of this contract, the Government may require the contractor to return any and all documentation created in performance of this contract back to the Government or require the contractor to destroy the records.

Disclosure of Information: Information made available to the contractor by the Government during the contract term shall be used only for those purposes of performing issued task and associated administration and shall not be used in any other way without the written agreement of the Contracting Officer.
The contractor agrees to assume responsibility for protecting the confidentiality of Government records, which are not public information. The contractor shall instruct each of its employees who might have access to information during the course of performing this contract against unauthorized disclosure and assure that all of its personnel performing the contract have executed a Non-Disclosure Agreement prior to beginning any work hereunder.
Data, Data Rights and Computer Software: Notwithstanding any other clause concerning data, data rights and computer software and hardware under this contract, all data and source code produced, recorded, transferred or manipulated under this contract will remain the exclusive property of the Government, irrespective of the manner or method of recording or storage and no matter what form of computer mechanism is used in the processing of said information or data. The Government will retain exclusive rights and domain over any by-product produced under this contract, or any other use of the data produced under this contract by either plan or accident.
Contractor Interfaces: The Contractor and/or his subcontractors may be required as part of the performance of this effort to work with other Contractors working for the Government. Such other Contractors shall not direct this Contractor and/or their subcontractors in any manner. Also, this Contractor and/or their subcontractors shall not direct the work of other Contractors in any manner.
The Government shall establish an initial contact between the Contractor and other Contractors and shall participate in an initial meeting at which the conventions for the scheduling and conduct of future meetings/contacts will be established. Any Contracting Officer's Representatives (COR) of other efforts shall be included in any establishment of conventions.
EVALUATION OF QUOTATIONS: The source selection method for this requirement will be “Lowest Price Technically Acceptable.”
The Government will use the criteria set forth below to evaluate and select the awardee. To be considered technically acceptable, Contractor must demonstrate the capability to provide the requirements set forth in the specifications. Acceptability will be based on the following:

Technical Acceptability: Extent to which the Quoted items conform to the specifications contained in the RFQ. All Vendor terms, conditions, and agreements comport with applicable Federal laws, regulations and otherwise satisfy the Government’s needs. In order to be considered technically acceptable, the quoter must be able to provide the product that meets

AQD Custom Clause - INTERNET PROTOCOL version 6 (JUNE 2012)
(a) Any system hardware, software, firmware and/or networked component (voice, video, or data) developed, procured, or acquired in support and/or performance of this contract shall be capable of transmitting, receiving, processing, forwarding, and storing digital information across system boundaries utilizing system packets that are formatted in accordance with commercial standards of Internet Protocol (IP) version 6 (IPv6) as set forth in the USGv6 Profile (NIST Special Publication 500-267) and corresponding declarations of conformance defined in the USGv6 Test Program. In addition, this system shall maintain interoperability with IPv4 systems and provide at least the same level of performance and reliability capabilities of IPv4 products.
(b) Specifically, any new IP product or system developed, acquired, or produced must:
(1) Interoperate with both IPv6 and IPv4 systems and products, and
(2) Have available contractor/vendor IPv6 technical support for development and implementation and fielded product management.
(c) As IPv6 evolves, the Contractor commits to upgrading or providing an appropriate migration path for each item developed, delivered or utilized at no additional cost to the Government. The Contractor shall retrofit all IPv6 capable equipment, at no additional cost to the Government.
(d) The Contractor shall provide technical support for both IPv4 and IPv6.
(e) Any system or software must be able to operate on networks supporting IPv4, IPv6 or one that supports both.
(f) Any product whose non-compliance is discovered and made known to the Contractor within one year after acceptance shall be upgraded, modified or replaced to bring it into compliance at no additional cost to the Government.

AQD Custom Clause – PREVENTION OF MALICIOUS CODE
(a) Definitions Malicious code is a computer code developed for the purpose of causing some form of intentional damage to computer systems or networks. Malicious code may be a complete program or code imbedded in software programs that appear to provide useful functions. The term includes computer viruses and other destructive programs, such as "Trojan Horses" and network "worms."
(b) The contractor must have in place an anti-virus procedure to ensure that media supplied is uncontaminated by malicious code.
(c) The contractor is required to scan all delivered software to insure it is free of malicious code prior to its installation or operation on Government-owned computers or contractor-owned computers connected to Government computer systems or networks. Contractors using diagnostics software disks or connecting to a non-Government computer while performing repairs or upgrades to a Government computer will scan the serviced computer's drive(s) to insure they are free of malicious code upon completion of the service call, or prior to return of serviced equipment, if servicing is performed off-site.

The Contractor must immediately notify the Contracting Officer or designated representative when delays exceeding 1-business day are expected, and in the following cases:
1. When the Contractor anticipates difficulty in complying with the contract delivery schedule or date, and
2. When the Contractor has knowledge that any actual or potential situation is delaying, or threatens to delay, the timely performance of this contract.
In cases of delays that are under 1 business day and/or in cases when the Contractor is unable to comply with the delivery schedule, the Contractor must immediately notify the Contracting Officer or designated representative by phone. These notifications shall be informational in character and this provision shall not be construed as a waiver by the Government of any delivery schedule or of any rights or remedies provided by law or under this contract.
The Contractor will not be liable for failure to perform services where such failure is caused, directly or indirectly, by: (i) a strike, (ii) an act of God, or (iii) circumstances beyond the control of the Contractor.
