About this file
This document is Amendment 0003 to a federal solicitation for an Indefinite Delivery, Indefinite Quantity (IDIQ) contract for sports equipment and apparel to supply Riverside Indian School in Anadarko, Oklahoma. The solicitation number is 140A2326Q0248, issued by the Indian Education Acquisition Office. The amendment's primary purpose is to release final Questions and Answers addressing offeror inquiries regarding the procurement.
The contract covers five sports (Boys Basketball, Girls Basketball, Boys Track, Girls Softball, and Golf) with a maximum contract value of $350,000 over a five-year period (base year November 1, 2026–October 31, 2027, plus four one-year option years). This is a total small business set-aside, replacing the original Indian Small Business Economic Enterprise (ISBEE) and Indian Economic Enterprise (IEE) set-aside due to lack of competition. The solicitation requires offerors to price all line items from Attachment 2 (a detailed schedule specifying brand-name products from manufacturers including Nike, Adidas, Wilson, Rawlings, Mizuno, New Balance, and Titleist). Products must be new, unused, and comply with applicable league requirements; current-year equivalents are acceptable for items with annual model changes. The nonmanufacturer rule applies per 13 CFR 121.406(c). Delivery orders will include a 10,000-unit guaranteed minimum per order, with 30-calendar-day delivery required to Riverside Indian School. Decoration (screen printing, embroidery, heat press) for school names, logos, and numbers is acceptable via subcontract and will be priced per delivery order. The Government will conduct final inspection and acceptance at delivery. Payment will be processed via IPP (Integrated Procurement Platform) with accelerated small-business payment of 5–7 days upon proper invoice submission. The quote submission deadline is October 28, 2026, at 16:00 CDT, and award is anticipated 30 days after solicitation close.

Q&A for Solicitation 140A2326Q0248
### I. Set-Aside Change: ISBEE/IEE to Total Small Business (Amendment 0001)
1. Can the Government confirm the basis for changing the set-aside from ISBEE/IEE to a total Small Business set-aside (e.g., market research, anticipated limited ISBEE/IEE interest, or pricing concerns)? No competition as a IEE/ISBEE.
2. Are any residual IEE/ISBEE requirements, preferences, or evaluation factors still applicable despite Amendment 0001 — for example, any price evaluation preference, award priority, or subcontracting credit for IEE/ISBEE offerors? No.
3. Does the withdrawal of DIAR 1452.280-1, 1452.280-2, 1452.280-3, and 1452.280-4 mean the Buy Indian Act (25 U.S.C. § 47) no longer applies to this acquisition in any form, including any post-award subcontracting or reporting obligations? Correct.
4. For any offerors that submitted quotes under the original ISBEE set-aside, are those offers still valid, or must they be resubmitted under the SB parameters? Solicitation is total SB set-aside.
Will previously submitted DIAR IEE self-certifications (Attachment 4) be disregarded entirely?
Yes
5. Does the change to a total SB set-aside modify the evaluation criteria or basis of award in FAR 52.212-2 and Section E, or will evaluation remain strictly comparative under FAR 13.106- 2(b)(3)? The evaluation criteria stay the same.
### II. Nonmanufacturer Rule & Product Sourcing
6. The schedule lists products manufactured by Nike, Wilson, Rawlings, Adidas, Mizuno, New Balance, and other large entities. Can the Government confirm whether an SBA class waiver is in effect for this requirement under 13 CFR 121.406, or must offerors source each line from a small U.S. manufacturer to comply with the nonmanufacturer rule? In accordance with 13 CFR 121.406(c).
7. If no class waiver applies, how should offerors handle lines where no small manufacturer exists or the listed brand/model is available only from large manufacturers? In accordance with 13 CFR 121.406(c).
Riverside Indian School
8. Is proof of authorized distributor/reseller status required for every brand listed, or only where the offeror is not the original manufacturer? The latter.
### III. Pricing, Quantities & Delivery Orders
9. Are the base-year quantities in Attachment 2 the best available estimate for all five years, or should offerors anticipate materially different volumes in Option Years 1–4 when pricing? Yes, after award those details will change as required by each delivery order.
10. Will delivery orders be issued per sport individually or consolidated across sports, and roughly how many delivery orders are anticipated per year? Possibility of both.
11. Does the 350,000 maximum contract value include the 10,000 guaranteed minimum per delivery order, or is the ceiling exclusive of those minimums? Yes
12. If a delivery order exceeds the base-year estimate for a line item, does the contract unit price hold, or should offerors account for volume-tiered pricing? This is an unknown factor that will be discussed with the awardee at time of delivery order.
13. Is the 30-day delivery ARO measured in calendar days or business days, and does it apply to each individual delivery order? Calendar days.
14. Should unit prices include decoration (logos, names, numbers) on every apparel line, or only items the school specifically requests? Only items the school specifically requests, see SOW logos for further details. Will a definitive list of items requiring decoration be provided post-award? See SOW logos for further details.
### IV. Substitutions, Equal Products & Availability
15. Where a listed item is discontinued, out of stock industry-wide, or unavailable at quote time, may an offeror propose an equal product under FAR 52.211-6, and what documentation of "equal" is required with the quote? In accordance with FAR 52.211-6(b).
16. For footwear lines listing multiple sizes (e.g., Boys Basketball shoes in sizes 9.5, 10, 10.5), will the school provide exact size breakdowns per delivery order, or should offerors allocate quantities across sizes at quotation? This information is an unknown variable and exact size, and quantities will be provided at time of the delivery order. Use the pricing schedules information for best estimates for bid submissions.
17. Must all items be new, unused, and the exact model/year specified, or will current-year equivalents be accepted for equipment with annual model changes (bats, gloves, shoes)? Yes, and comply with applicable league or association requirements.
### V. Delivery, Logistics & Decoration
18. Are deliveries to a single receiving point at Riverside Indian School (101 Riverside Dr., Anadarko, OK 73005), or multiple campus locations? Is a receiving dock/warehouse available, and are deliveries accepted during school breaks? One location, Riverside Indian School, see page 4, section 2.
19. Will the Government provide PMS/thread color specifications, approved decoration placements, and sport-specific logo variants along with the vector art confirmed in Amendment 0002? See SOW, logos for details. What is the expected turnaround from art receipt to delivery order issuance? Discussions and delivery expectations will be discussed during delivery order.
20. May decoration (screen print, embroidery, heat press) be subcontracted, or must it be performed by the prime? Acceptable If subcontracted, are there small-business or set-aside requirements for the decorator? No.
21. Are there specific packaging, labeling, or sorting requirements (e.g., individual player-name labeling, size sorting, per-sport boxing)? See SOW for details.
### VI. Schedule Errors & Ambiguities (Attachment 2)
22. **Boys Basketball:** Item NKII7520 (Black Lebron Witness IX) lists size 10 twice (10 pairs each) alongside sizes 9.5 and 10.5. Is the duplicate intentional (20 pairs total), or should one entry be a different size? Duplicate, disregard line 9.
23. **Boys Track tab** is labeled "Independent Government Cost Estimate" rather than "Price Schedule." Should offerors enter pricing on this tab, and is the IGCE available to help benchmark price reasonableness? Disregard.
24. **Girls Basketball equipment:** The CAMBVO Patella Tendon Knee Straps line appears twice with identical descriptions and quantities. Should these be combined into one line of 10 units? Keep lines separate and quote both.
25. Several lines list "N/A" as the Item # (e.g., Nike sports bra, 210DF/4080DF jerseys, Titleist golf balls, socks, spikes). Should offers be based on Government-provided specs/model numbers, or may offerors quote their equivalent in-stock product? The latter.
26. **Golf balls:** The schedule lists "Titleist" (5 dozen) without a model. Which Titleist model (e.g., Pro V1, TruFeel) is required, or is any current Titleist model acceptable? The latter.
27. Every tab contains "Produce and Perishable" subtotal rows, which appear to be template artifacts. Can the CO confirm these should be disregarded and no perishable goods are contemplated? This is the subtotal for equipment.
28. **Softball pants:** Line 4's description notes "(Sm-5, M-6, L-7)" but the quantity shows 18 each. Should quantity reflect the stated breakdown, and will size breakdowns be confirmed per delivery order? Yes and yes.
### VII. Contract Ceiling, Minimums & Scope
29. Is there a guaranteed minimum at the contract level across all delivery orders, or is the only guarantee the 10,000 per-order minimum? The latter.
30. Is ordering strictly limited to Riverside Indian School, or may other BIE schools place delivery orders against this contract? Only to Riverside Indian School.
31. The SOW mentions protective equipment, helmets, pads, warm-ups, and jackets, but the schedule contains no such lines. Should offerors expect these as delivery-order line items priced at consistent rates, or are they out of scope? Items will be priced during delivery order, is not out of scope.
32. Are consumables (athletic tape, cohesive bandages, first aid supplies, towels) expected to be reordered on a recurring basis, or are listed quantities one-time annual purchases? As required for each delivery order.
### VIII. Economic Price Adjustment Mechanics (FAR 52.216-2)
33. During performance, what documentation will verify an "established price" increase for EPA purposes — manufacturer price-increase letters, published catalog changes, or distributor cost confirmations? All of the above are acceptable.
34. Does the 10% EPA cap apply per line item per year, per line item over the life of the contract, or on an aggregate basis? Line items per year.
35. Will EPA increase requests be entertained during the base year, or only at option-year boundaries? The latter. Are there minimum frequency or blackout periods? Government year-end shutdown is a blackout period. No orders or invoice submissions will be accepted.
36. For dealer/reseller pricing, the clause references the contractor's "established catalog or market price." Since distributors typically maintain no public catalog, what benchmark will the Government use to validate that awarded prices do not exceed established prices? Current economic pricing at time of delivery order.
### IX. Funding & Fiscal Considerations
37. Can the Government confirm which fiscal year's funds will support the base year beginning November 1, 2026, and whether any availability-of-funds contingencies (FAR 52.232-19) could delay performance? No delivery orders will be place if no funding is available.
38. Amendment 0001 states the Period of Performance "will be revised upon award." Given the quote due date of 10/28/2026 and a PoP start of 11/01/2026, what is the realistic anticipated award date, and will the PoP start shift accordingly? 30 days after the solicitation closes.
39. Are option years funded on an annual appropriation cycle, and is there any indication of intent to exercise all four option years? Yes and no.
40. Please confirm the Government is tax-exempt for deliveries to the school and that no Oklahoma state, local, or tribal sales/use taxes should be included in quoted pricing. BIE is tax-exempt, however tribal taxes should be considered.
### X. Evaluation & Award Process
41. Will the Government hold discussions or request clarifications/revisions before award, or is this a one-shot submission evaluated on initial quotes? If clarifications and best offers are warranted, they will be requested.
42. Is a single award definite, or is there any scenario of multiple awards by sport? The IDIQ is a single award, but the delivery orders will be sport and could be combined.
43. When can offerors expect an award decision following the 10/28/2026 deadline, and will unsuccessful offerors be notified? 30 days after close date.
44. Does the Government anticipate a pre-award responsibility determination or site visit (warehouse, decoration capability, inventory review)? No
45. Will the SAM.gov interested-vendors list be used to distribute future amendments automatically? No Can you confirm the SAM.gov contract opportunity notice number?
140A2326Q0248
46. Can the Government confirm the exact due date/time (October 28, 2026, 16:00 CDT) and the required subject-line format: "140A2326Q0248 SPORTS EQUIPMENT AND APPAREL [VENDOR NAME]"? Correct
47. Must offerors price all line items across all tabs, or may partial quotes (specific sports only) be submitted and evaluated? All items must be priced for the bid to be considered complete, partial bids will be considered incomplete and will be rejected.
48. What specific evidence satisfies the requirement to demonstrate capability to deliver fully manufactured items in stock and ready to ship — distributor confirmations, inventory statements, warehouse photos, or a signed capability statement? Distributor confirmation and tracking number.
49. Should the completed SF-1449 and pricing schedule be separate PDF attachments or one combined PDF, and is there a maximum attachment size? Separate, pricing schedule stays in the current format.
50. If an offeror discovers an error after submission but before the deadline, may a revised quote be submitted, superseding the prior one entirely? Yes.
### XI. Performance, Inspection & Warranty
51. What is the inspection and acceptance process at delivery — who inspects, where, and within what timeframe — and does acceptance occur per line item or per order? The Government point of contact at Riverside will complete the final inspection and acceptance before payment is rendered.
52. If items are rejected at receiving, what is the replacement timeline relative to the 30-day ARO window, and is advance replacement (ship-then-credit) acceptable? 30-day ARO, and yes.
53. Are partial deliveries per order acceptable, or must each order ship complete? Partial delivery is acceptable, but entire order will need to be received by 30 days for it to be considered on time.
54. For defects discovered after acceptance (e.g., bat cracking, shoe delamination), what is the no-cost replacement window — 30/60/90 days, or the manufacturer's warranty period? The latter.
55. Will pre-production decorated samples be required for approval before bulk decoration, and how does sample approval time interact with the 30-day delivery requirement? Sample time is not considered in the 30-day delivery.
56. Are expedited/rush deliveries anticipated (e.g., mid-season losses), and is there a mechanism for expedited pricing or freight upgrades, or must all pricing assume standard ground shipping?
If required.
57. When is the first delivery order anticipated after award, and will option-year pricing be locked at award or subject to renegotiation at exercise? First order depends on sport season, and no renegotiation will be considered.
58. For defective/incorrect item replacement at no cost, what is the required process (return-then-replace vs. advance replacement), and who bears return freight? Contractors will bear the costs.
59. Will the COR be designated at award, and will the school provide rosters, size charts, or fit-kit requirements promptly to support the 30-day window? Yes.
60. Is CPARS point-of-contact information required with the quote, or only within 30 days after award? After award.
61. **Will payment be processed per line item as items are received and accepted, or only upon complete delivery and acceptance of an entire delivery order?** If partial shipments are accepted, may the contractor invoice and receive payment for accepted line items only? It is at the CO and programs discretion. Expectation is the complete order must be received before payment is rendered.
62. **If a delivery order contains both decorated apparel (longer lead time) and off-the-shelf equipment (shorter lead time),** may those be shipped, accepted, and invoiced separately, or must each order ship and bill complete? See above response.
63. **Is the payment amount strictly limited to the accepted quantities per delivery order,** and is there any mechanism for the contractor to invoice estimated quantities with a final reconciliation (e.g., for size exchanges or substitutions approved by the school)? The expectation is that when the final invoice is approved by the CO/receiver will payment be rendered.
**IPP Registration & Submission Mechanics**
64. **If a contractor encounters delays in IPP enrollment** (registration instructions from the FRBB, account activation, or CAGE/UEI matching errors), is there a grace period for alternative submission, or must all payment requests wait until IPP access is active? All payments will be processed via IPP.
65. **If IPP experiences system outages or the contractor has documented technical issues,** what is the fallback procedure for submitting a proper invoice without incurring Prompt Payment Act interest penalties for delays not caused by the contractor? It is the contractor’s responsibility to work with IPP customer services if issues arise through the IPP system. My experience is that all issues are resolved with a respectable timeframe and no penalties have ever been incurred.
66. **Are there any IPP invoice fields or attachment formats specific to this contract** (e.g., required attachment naming conventions, contract number format, order number references) that the Government can share in advance to prevent rejections? This will be discussed with the awardee.
67. **Who is the designated IPP invoice reviewer/approver for this contract** — the CO, the COR, or the school — and will the approver be identified at award to avoid misrouted invoices?
It can be any one listed in this question.
**Invoice Content & Supporting Documentation**
68. **Beyond the itemized PDF invoice and the COR's written receipt validation, what supporting documents must accompany each IPP payment request** — packing slips, bills of lading, delivery receipts, signed receiving reports, or photos of delivered goods? This will be discussed with the awardee.
69. **Will the Government provide a standard receiving report or acceptance form** signed by the COR for each delivery, and does the contractor receive a copy to attach to the invoice? No
70. **For decorated items, is any additional documentation required for payment** — such as photos of finished goods, decoration approval sign-off, or comparison proof against the vector art provided by the school? Acceptance by the receiver confirming all items conform to the specifications/requirements.
71. **How should invoices reference delivery order numbers, contract line items, and option-year pricing** to ensure clean matching in IPP — and will the Government provide a sample properly formatted invoice at award? This will be discussed with the awardee.
**Timing, Discounts & Disputes**
72. **What are the expected invoice submission and payment timelines in practice** — e.g., invoice upon acceptance, Government payment within 30 days of a proper invoice under the Prompt Payment Act — and when does the payment clock start: receipt of invoice, delivery, or COR acceptance? Accelerated pay for SB (5-7 days) once the invoice has been submitted by the contractor.
73. **Does the Government offer any prompt payment discount terms** (e.g., net 20 for a discount), and are such discounts considered in evaluation? No, this is a FFP award, no incentive.
74. **What is the process and timeline for resolving disputed or rejected invoices** (deficiency notices, resubmission, and whether the Prompt Payment interest clock restarts), and who is the point of contact for invoice discrepancies? This will be discussed with the awardee.
75. **Will the Government confirm timely payment interest penalties under the Prompt Payment Act** if payment is not made within the required period, and are interest claims submitted through IPP or separately? Yes and IPP.
**Financial Protections & Miscellaneous**
76. **Is there any retainage, holdback, or withholding of any portion of payment** pending final inspection, end-of-season use, or warranty expiration — or is 100% of the accepted amount payable upon proper invoice? The latter.
77. **Is any contract financing or progress payment available** for large delivery orders requiring upfront inventory purchase (e.g., a 90,000 order of footwear), or must the contractor carry the full inventory cost until delivery and acceptance? The latter.
78. **Will payments be made by EFT to the account in SAM (52.232-33), and must the contractor reconfirm banking details with the paying office at award,** or does IPP pull payee data directly from SAM? The latter.
79. **If an incorrect or duplicate payment is issued, what is the correction process** — offset against a future invoice, demand letter, or IPP adjustment — and what is the expected resolution timeframe? This would not happen, but if it did the CO would determine the course of action to resolve the matter.
80. **Are accelerated payments to small-business subcontractors required to flow down** under FAR 52.232-40, and does the Government expect any reporting on subcontractor payment timing? No.
1. Nonmanufacturer rule: Most items in Attachment 2 are specific brand-name products (for example Nike, adidas, New Balance, Wilson, Rawlings, Mizuno and Titleist) made by large manufacturers, largely outside the U.S. Under the nonmanufacturer rule, a small business reseller must supply U.S.-made products of small business manufacturers unless SBA grants a waiver.
Does the agency plan to request a waiver for these items? In accordance with 13 CFR
121.406(c). Alternatively, since the maximum contract value of $350,000 does not exceed the simplified acquisition threshold, does the exception in 13 CFR 121.406(c) apply? Yes
2. Authorized reseller proof: For brand-name items, will proof that we purchase from an authorized distributor of that brand satisfy the requirement, or must the offeror itself hold a dealer authorization from each manufacturer? The offeror.
1. Most line items are brand-name products from large manufacturers. Will the Government request an SBA individual waiver of the nonmanufacturer rule for this requirement, or should offerors supply the named products regardless of manufacturer size? In accordance with 13 CFR 121.406(c).
2. FAR 52.211-6, Brand Name or Equal, is incorporated. Where a listed style, model year or colorway is discontinued at quote time or during the ordering period (for example Nike Sabrina 3 IQ5085-102, 2023 Anderson Rocketech, Wilson A2K WBW1010101275), will the Government accept the manufacturer's current equivalent model at the quoted unit price? Yes
3. The SOW calls for school names, logos, numbers or embroidery "when requested," but Attachment 2 has no decoration lines. Should any Attachment 2 unit prices include decoration?
Yes If so, which lines, and what method, locations and colors? See SOW logos for details. Or will decoration be priced per order? Yes, when required.
4. Please identify the manufacturer for items 210DF (Women's Skye or Georgia Jersey) and 4080DF (Women's Collegiate Short), the Titleist golf ball model (5 dozen), and the brand and model for "Mens Running shoes" (FTWR, 19). On the Softball tab, is the Wilson A9011B line the 12-inch fastpitch ball as numbered, and is the Dream Seam line meant to be the 11-inch or the 12-inch NFHS high school ball? Offers choice.
5. In Attachment 2, columns I through L (Option Years 1-4) have no unit price column.
Should offerors enter each option year's extended amount (base-year quantity x option-year unit price) or the option-year unit price? OY extends amount.
Is it possible to substitute these with items from other brands? Please let us know if brand substitutions are acceptable and if you have any specific approved alternatives in mind. In accordance with FAR 52.21-6 Brand Name or Equal.
