About this file
This is a Title VI Nondiscrimination Provisions document for the 181st Ave Safety Upgrades project (SE Stark St to E Burnside St) in Oregon, a federally-funded project under the U.S. Department of Transportation. The project involves sidewalk construction, paving, storm drainage, street lighting, interconnect, and utility undergrounding work. The document establishes mandatory compliance requirements for contractors and subcontractors participating in this federally-assisted program.
The contractor must comply with U.S. Department of Transportation regulations under Title 49, Code of Federal Regulations, Part 21, prohibiting discrimination based on race, color, national origin, Limited English Proficiency, sex, income, age, or disability in all aspects of contract performance, including subcontractor selection, retention, and employment practices. The contractor is required to notify all potential subcontractors and suppliers of these nondiscrimination obligations, maintain records and provide access to information for federal agency compliance verification, and incorporate these provisions into all subcontracts and procurements. Form FHWA-1273 must be physically incorporated into each construction contract funded under Title 23. Noncompliance may result in contract sanctions including payment withholding, contract cancellation, termination, or suspension as determined by the applicable federal agency.
