This is a request for a Firm Fixed Price quotation for commercial products. This solicitation is issued in accordance with the Revolutionary FAR Overhaul (RFO) Part 12 - Acquisition of Commercial Products and Commercial Services as supplemented with additional information included in this notice.

This solicitation is a Request for Quotation (RFQ). The solicitation document and incorporated provisions and clauses are those in effect through the RFO.

NIST REQUIREMENT

Microwave Induced Combustion (MIC) Package

I. BACKGROUND INFORMATION

The National Institute of Standards and Technology’s (NIST) Fire Research Division (FRD) seeks a Microwave Induced Combustion (MIC) Package. The MIC package is an attachment for Multiwave 5000 that allows for samples to be combusted using microwave induced combustion.

The Multiwave 5000 is a laboratory system that facilitates the break down of complex solid samples into liquid samples by using strong heat and acids. These liquid samples can be run on analytical instruments like Ion Coupled Plasma Mass Spectrometry (ICP-MS), and Atomic Absorption Spectrometer (AAS). Samples combusted using this MIC system can be run on our ion chromatography system (IC). The IC is a laboratory system that can quantify ions like fluorine, chlorine, bromine and sulfur. Within the FRD, the IC is used to support research requiring measurement of total fluorine as an indicator of per- and polyfluoroalkyl substances (PFAS) and chlorine at parts-per-million levels. PFAS are used in a wide range of industrial and consumer products, including textiles, cookware, food packaging, and fire suppression materials.

Measurement of total fluorine supports NIST’s mission to advance measurement science and provide data critical to fire safety, environmental health, and public protection.

II. PURPOSE

The purpose of this acquisition is to procure a MIC package including the installation and training services associated with the system.

a. Place of Performance The Contractor shall perform installation and training services of the system in Building 224, Room A354, at 100 Bureau Drive, Gaithersburg, MD 20899. Installation and training services shall be performed for all items listed below. These services shall take place during normal business hours, between 8:30 am and 5:00 pm Eastern Time, Monday through Friday except Federal Holidays, and shall be coordinated with the NIST Subject Matter Expert (SME).

III. SCOPE OF WORK

This SOW covers the procurement and delivery of an MIC package for the Multiwave 5000 (part number 320154) digester. This effort includes purchasing the MIC package parts, installation service, and training.

IV. REQUIREMENTS

The Contractor shall provide a system that meets all technical specifications identified below. All items must be new. Used or remanufactured equipment will not be considered for award.

Experimental, prototype, or custom items will not be considered. The use of “gray market” components not authorized for sale in the U.S. by the Contractor is not acceptable. All line items shall be shipped in the original manufacturer’s packaging and include all original documentation and software, when applicable.

Quantity: 1 Technical Specifications: The contractor shall provide one (1) MIC package that includes parts that meet the specifications below:

• Full compatibility with existing Multiwave 5000 Digester system

• Rotor capable of operating at high temperatures (up to 300 °C) and high pressure (up to 80 bar) for digestion of samples for evaluation via ion chromatography and other methods

• Parts allowing for the connection of the new rotor with the Multiwave 5000 digester system.

(POC) within 3 days of receipt of deliverable. This section applies to deliverables requiring Government review and acceptance.

VI. DELIVERY & INSTALLATION REQUIREMENTS

Delivery shall be F.O.B Destination and shall occur within 6 weeks after contractor receipt of order. The contractor shall deliver all Line Items to:

FOB Destination means: The contractor shall pack and mark the shipment in conformance with carrier requirements, deliver the shipment in good order and condition to the point of delivery specified in the purchase order, be responsible for any loss of and/or damage to the goods occurring before receipt and acceptance of the shipment by the consignee at the delivery point specified in the purchase order; and pay all charges to the specified point of delivery.

The contractor shall install the required products and meet contract specifications no later than 6 weeks after delivery. Installation, at a minimum as applicable, shall include uncrating/unpackaging of all equipment, rigging, set-up and hook-up of the system, demonstration of all specifications, and removal of trash. Onsite installation and training shall be done at NIST, (Gaithersburg, MD- Building 224)

VII. TRAINING

The contractor shall provide training shall provide a thorough demonstration of proper upkeep and cleaning of the MIC package. The training shall include hands-on exercises as part of the instruction. The training shall include copies of training materials and related information, including (but not limited to) training handouts and operator manuals. The training shall be completed at NIST immediately after setup and installation but shall be completed no later than 30 calendar days after delivery.

VIII. INSPECTION & ACCEPTANCE

In addition to the inspection and acceptance terms articulated in 52.212-4, the Government reserves the right to perform such performance tests and evaluations as defined below to verify specified system performance. Such tests and evaluations, if performed, shall be conducted within the environment that the system is to be operated. The Contractor has the right to be present during the tests and evaluations, if performed, at the Contractor’s expense.

1. A visual and performance inspection to verify that delivered equipment meets all technical requirements identified in this document.

The Government shall have sole discretion to require repair or replacement of damaged and/or nonconforming supplies at no cost to the Government. The Government at any time prior to acceptance shall reject the equipment due to defects and/or nonconformance. The vendor is responsible for latent defects discovered any time after final inspection. However, the extent of its liability shall be prorated over the useful life of the equipment.

IX. WARRANTY

The contractor shall warrant the entire system with the contractor’s or original equipment manufacturer’s (OEM) standard commercial practices, for a minimum period of 1 year after inspection and acceptance have been completed. Warranty shall be in accordance with terms in FAR 52.212-4 and shall commence upon acceptance of the system by the Government.

X. MISCELLANEOUS INFORMATION

Government Furnished Property: The Government will provide visitor’s access to the NIST facilities and equipment as needed for the performance of this requirement.

Safety: Contractor installation shall comply with all applicable installation safety prevention regulations. Such regulations include, but are not limited to, general safety, fire prevention, and waste disposal.

Security: NIST is a restricted campus. An identification badge is required for access for entry into buildings and is shown to the armed Security Police when entering the campus.

Identification Badges: Contractor employees shall comply with NIST identification and access requirements. Each Contractor employee on the NIST site shall wear a visible identification badge provided by the NIST Security Office.

Vehicle Registration: All Contractor employees on the NIST site shall register their vehicles with the NIST Security Office to gain access to the campus. A valid driver’s license, Government-furnished civilian ID, proof of insurance and current registration must be presented to the NIST Security

XI. PAYMENT SCHEDULE

The Contractor will be paid, in accordance with the payments clause in the contract and as otherwise noted in this document, upon receipt of a proper invoice. Invoices shall reference the contract number and itemize delivered items.

NOTE: Partial invoices will not be accepted, unless otherwise requested and accepted by the Contracting Officer prior to award offer. Payment shall be made in one lump sum upon the Contractor's successful completion of all required deliverables, including delivery, installation, and training, and upon the Government's acceptance of the completed work in accordance with the terms of the contract.

FAR 52.212-2 Evaluation - Commercial Products and Commercial Services

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Please see the attached Request for Quotation document for evaluation factors.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

FAR 52.219-1 Small Business Program Representation

(a) Definitions. As used in this provision-

Economically disadvantaged women-owned small business (EDWOSB) concern means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127, and the concern is certified by SBA or an approved third-party certifier in accordance with 13 CFR 127.300. It automatically qualifies as a women-owned small business concern eligible under the WOSB Program.

Service-disabled veteran-owned small business (SDVOSB) concern means a small business concern- (1)

(i) Not less than 51 percent of which is owned and controlled by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran or;

(2) A small business concern eligible under the SDVOSB Program in accordance with 13 CFR part 128 (see subpart 19.14).

(3) Service-disabled veteran, as used in this definition, means a veteran as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16), with a disability that is service-connected, as defined in 38 U.S.C. 101(16), and who is registered in the Beneficiary Identification and Records Locator Subsystem, or successor system that is

(1) Effective January 1, 2024, is designated in the System for Award Management (SAM) as certified by the Small Business Administration (SBA) in accordance with 13 CFR 128.300; or

(2) Has represented that it is an SDVOSB concern in SAM and submitted a complete application for certification to SBA on or before December 31, 2023.

Service-disabled veteran-owned small business (SDVOSB) Program means a program that authorizes contracting officers to limit competition, including award on a sole-source basis, to SDVOSB concerns eligible under the SDVOSB Program.

Small business concern—

(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in its field of operation, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (b) of this provision.

(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13 CFR 121.103.

Small disadvantaged business concern, consistent with 13 CFR 124.1001, means a small business concern under the size standard applicable to the acquisition, that-

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by-

(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States, and

FAR 52.222-18 Certification Regarding Knowledge of Child Labor for Listed End Products

(a) Definition.

Forced or indentured child labor means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.

(b) Listed end products. The following end product(s) being acquired under this solicitation is (are) included in the List of Products Requiring Contractor Certification as to Forced or Indentured Child Labor, identified by their country of origin. There is a reasonable basis to believe that listed end products from the listed countries of origin may have been mined, produced, or manufactured by forced or indentured child labor.

FAR 52.225-2 Buy American Certificate (a)

(1) The Offeror certifies that each end product, except those listed in paragraph (b) of this provision, is a domestic end product and that each domestic end product listed in

(2) The Offeror shall list as foreign end products those end products manufactured in the United States that do not qualify as domestic end products. NIST LOCAL-53 Contract Performance During Changes in NIST Operating Status

All contractors performing work on active contracts at the U.S. Department of Commerce(DOC), National Institute of Standards and Technology (NIST) campuses and/or working in NIST workspaces should go to the www.nist.gov website and under the "About NIST" tab click on "Visit". This site includes information about campus access and security information; identification requirements; parking information and more.

Contractor personnel are required to check the appropriate campus operating status and personnel requirements at https://www.nist.gov/campus-status daily prior to arriving on site. All personnel must adhere to the requirements set forth in the operating status.

Unless otherwise stated in the contract terms and conditions, normal days of business operation are Monday through Friday, excluding Federal Holidays. However, throughout the contract period of performance, there may be circumstances beyond the control of NIST that will impact normal days of business operation such as inclement weather, power outages, etc.

In the event of a lapse in appropriation, access to Government facilities and resources, including equipment and systems will be limited to excepted personnel for both Federal employees and contractor personnel. If performance of the contract is onsite and/or requires Government interaction, unless the contractor has been, or is notified that it is required to work under an excepted status, the contractor must stop work. The work stoppage shall remain in effect until the lapse is resolved and notification is provided via the NIST website at www.nist.gov (banner on front page) and/or the NIST operating status line(s). Additionally, contractors are encouraged to monitor public broadcasts or the Office of Personnel Management's website at www.opm.gov for the Federal Government operating status.

NIST will provide notification to all contractors that are determined to have excepted status. All excepted contractors are required to continue performance and communicate with the appointed Contracting Officer's Representative (COR) for further guidance, or NIST Contracting Officer if a COR is not appointed.

Contractors with active supply or service contracts that are fully funded at the time of contract award and do not require access to Government facilities, resources, or active administration by Government personnel in a manner that would not cause the Government to incur additional obligations during the lapse in appropriation may continue performance.

Please note that in all circumstances that impact operations on the NIST campuses, contractors are expected to follow all direction and guidance provided by NIST authorities.

NIST LOCAL 56 Invoicing Processing Platform – Alt I

Upon written notice from the contracting officer the following supersedes all other instructions for the submission of payment requests. Accordingly, following written notice payment requests must be submitted electronically through the U.S. Department of the Treasury's Invoice Processing Platform System (IPP).

"Payment request" means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable payment request or invoicing instructions, Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions - Commercial Items included in commercial item contracts.
