BACKGROUND:

The National Institute of Standards and Technology (NIST) Inorganic Chemical Metrology Group (ICMG) within the Chemical Sciences Division of the Material Measurement Laboratory (MML) performs elemental measurements using a variety of instrumental methods. With these methods, the ICMG fulfills stakeholder needs through the provision of NIST Standard Reference Materials (SRMs), and also develops such methods for the value assignment of elemental data to SRMs and for transfer to industry. In support of a CHIPS project, the ICMG requires a glow discharge mass spectrometry (GDMS) instrument to develop new SRMs, Reference Materials (RMs), and Research Grade Test Materials (RGTMs) of high-purity solids currently lacking in chips manufacturing. This will enable more effective, efficient, and comparable characterizations of source materials, process control improvements, and further innovations in chips manufacturing. See Attachment 1, Statement of Work (SOW) for full requirement details.

Addendum to FAR 52.212-1, Quotation Preparation Instructions:

All quotations shall conform to solicitation provisions/clauses and be prepared in accordance with this section. The quotation shall be clearly and concisely written as well as be neat, indexed (cross-indexed as appropriate) and logically assembled. Note: The term “indexed” refers to a table of contents that lists sections and page numbers. All pages of the quotation shall be appropriately numbered.

In preparing the quotation, each volume shall stand on its own. For each given evaluation factor the Government will only evaluate the information provided in the corresponding section/volume of the quotation. The Offeror’s quotation shall be clearly divided into the following distinct volumes:

Volume I – Technical Volume II –Experience Volume III – Price Volume IV– Terms and Conditions

Incomplete quotations (a quotation missing any volume) may be considered non-responsive and removed from further consideration.

Volume I - Technical:

No pricing information shall be included in this volume. It shall consist of a technical description or product literature for the proposed product, which clearly identifies each requirement listed in the Statement of Work (SOW) document. The offeror must demonstrate that its proposed product meets or exceeds each minimum requirement listed in the SOW by providing a citation to the relevant section of its technical description or product literature. The offeror must not simply state they will meet or exceed the requirement; evidence must be provided. If applicable, evidence that the offeror is authorized by the original provider to provide the item(s) in the quotation must be included.

Volume II – Experience:

The offeror shall describe up to three (3) relevant contracts/projects completed over the past five (5) years with Federal, state, or local governments, and/or commercial customers, demonstrating experience that aligns with the requirements of this solicitation. Relevant means similar in scope and size to the requirements of this solicitation.

The description of each contract/project described in this volume shall not exceed one page in length and shall include the following information:

0. Contract/Project Number and Title

0. Reference Contact –Name and address of client, point of contact name, title, current telephone number, and email address

0. Detailed description of product and/or service provided and how it is relevant to this solicitation’s SOW requirements

0. Role as the prime contractor or subcontractor.

0. Period of Performance (POP) start and end dates by month and year (or “ongoing” if not yet completed)

0. Total dollar amount/value over the entire POP

The Government may contact the Reference POCs to assess the validity and accuracy of the experience submissions.

Volume III - Price:

The price quotation shall be separate from any other portion of the quotation. The quoter shall propose a firm-fixed-price inclusive of all shipping costs (FOB Destination) for all CLINs. Price quotations shall remain valid for a period of 120 days from the date quotations are due. Contractor shall state express warranty coverage (if applicable).

Quoters that are proposing products manufactured outside of the United States must identify any other or unknown charges that may be applicable to the sale of these products (here indicated as CLIN 0003) as a separate line item. This price element may be listed as part of the cost of the product or as a sub-total element but must be clearly identified. This price element must only apply to the total value of the goods identified for customs processing. Only include the country of origin and the tariff percentage currently in place or the expected amount at time of delivery for that country. Price quotes shall clearly identify the relevant tariffs in terms of percentage and total cost. If there are multiple countries of origins and associated tariffs, identify each separately.

Volume IV – Terms and Conditions:

NOTE: System updates may lag policy updates. The System for Award Management (SAM) may continue to require entities to complete representations based on provisions that are not included in agency solicitations. Examples include:

52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals—Representation, 52.222-25, Affirmative Action Compliance, and 52.212-3, Offeror Representations and Certifications—Commercial Products and Commercial Services - paragraph (d).

Acceptance of Terms and Conditions (Addendum to FAR 52.212-1(b)(11)):

If the contractor objects to any of the terms and conditions contained in this solicitation, the contractor shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion, or addition of the following:” [Contractor shall list exception(s) and rationale for the exception(s)]. It is the sole responsibility of the contractor to identify in their quotation any exceptions to the terms and conditions of the solicitation. If the contractor does not include such a statement, the submission of a quotation in response to this solicitation will be regarded as the Contractor’s acceptance of the Government’s terms and conditions for inclusion into the resultant purchase order.

Note: This procurement is not being conducted under the GSA Federal Supply Schedule (FSS) program or another Government-Wide Area Contract (GWAC). If an Offeror submits a quotation based upon an FSS or GWAC contract, the Government will accept the proposed price. However, the terms and conditions stated herein will be included in any resultant purchase order, not the terms and conditions of the Offeror’s FSS or GWAC contract, and the statement required above shall be included in the quotation.

(End of provision)

FAR 52.212-2, Evaluation-Commercial Products and Commercial Services applies to this procurement. The evaluation criteria included in paragraph (a) of the provision are as follows:

EVALUATION CRITERIA

The Government intends to award a single firm fixed price purchase order (PO) from this solicitation using simplified acquisitions procedures for Certain Commercial Products and Commercial Services in accordance with FAR part 13.5. The Government reserves the right not to award a PO and to make an award without discussions based solely upon initial quotations. NIST reserves the right to request revised quotations from, or negotiate final contract terms with, one or more, but not all, Contractors if later determined by the Contracting Officer to be necessary.

Basis for Award:

The Government will make an award based on best value, considering price and other factors discussed below, to the quoter with the most advantageous proposed solution. When combined, non-price factors are significantly more important than factor 3 Price. Accordingly, the Government may award the PO to other than the lowest priced quoter or other than the highest technically rated quoter.

An Offeror's failure to address any factor may be considered indicative of the Offeror's lack of understanding of the Government's requirements.. The Government may remove the offer from further consideration/evaluation if the Government determines the failure results in an incomplete and non-responsive offer.

Evaluation Factors:

Factor 1: Technical: No prototypes, demonstration models, used or refurbished instruments will be considered. NIST will only consider proven, commercial solutions. The Government will evaluate the extent to which the proposed instrument and solution meets SOW requirements to determine the level of confidence the Government has in the quoters’ ability to successfully deliver and perform SOW requirements. Stronger consideration will be given to quoters that offer the following optional specifications:

a. Lower limits of detection.

b. Depth profiling capability of flat surfaces to depths of a few micrometers.

c. Rapid sample throughput and analysis.

d. Maximal use of dry vacuum pumps in place of oil pumps.

e. Inclusion of consumables for high-purity materials analysis for 1 year or longer.

f. Inclusion of multiple glow discharge sources to enable uninterrupted operation while the last source used is being cleaned.

g. Inclusion of common sample preparation equipment (e.g., die and press).

h. Ability to process data on a remote computer (e.g., licenses for software to be installed on more than one computer).

i. Free access to software upgrades for a period of 5 years after installation and acceptance.

j. Instrument software provided on CD and/or other convenient media (e.g., memory stick) so that software can be reloaded in the event of computer malfunction or accidental corruption of software.

k. LIMS connectivity.

l. Service/maintenance contract for additional years beyond the first year.

m. Evidence that maintenance and repair services for the instrument will be available for at least 10 years.

n. Boxed equipment can fit through a doorway of width 48 inches

Factor 2: Experience: NIST will evaluate the extent of the offeror’s prior demonstrated experience for providing instruments similar to the those in the SOW to determine the level of confidence the Government has in the quoters’ experience and ability to successfully deliver and perform SOW requirements. Projects submitted for evaluation with a direct correlation to the proposed requirements may instill higher confidence than those with lesser relevance. Additionally, NIST will give preference to offerors who demonstrate evidence of:

a. Experience providing instruments for high-purity materials analysis to at least three current/recent users.

b. Successful and timely delivery and installation of the proposed instrument model or a closely related model in North America to at least three current/recent users.

c. Prompt and effective instrument repair/maintenance service in North America directly to NIST and/or to at least three current/recent users.

Factor 3: Price: The price quotation will be evaluated for consistency with the technical approach, current marketplace, and Independent Government Estimate. A price quotation that is found to be either unreasonably high or low in relation to requirements, may be indicative of an inherent lack of understanding of the RFQ requirements and may instill lower confidence. A price realism analysis will be conducted. The price offer will be evaluated for reasonableness.

The option line items will be evaluated for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

Evaluation Ratings:

The evaluation of each non-price factor may be done holistically with a rating scale of "high confidence," "some confidence," and "low confidence," representing the Government’s confidence that the vendor understands the requirement and will be successful in performing the work per factor.

High Confidence
The Government has high confidence that the vendor understands the

requirement, proposes a sound approach, and will be successful in performing the SOW requirements with little or no Government intervention.

Some Confidence
The Government has some confidence that the vendor understands the requirement, proposes a sound approach, and will be successful in performing the SOW requirements with some Government intervention.
Low Confidence
The Government has low confidence that the vendor understands the requirement, proposes a sound approach or will be successful in performing the SOW requirements even with Government intervention.

Upon evaluation, if a quotation is deemed Low Confidence in any of the non-price factors, that quotation will not be evaluated further by the Government.

Once the Government determines the quoter that is the best-suited (i.e., the apparent successful quoter), the Government reserves the right to communicate with only that quoter to address any remaining issues, if necessary, and finalize a contract with that quoter. These issues may include technical and price. If the parties cannot successfully address any remaining issues, as determined pertinent at the sole discretion of the Government, the Government reserves the right to communicate with the next best-suited quoter based on the original analysis and address any remaining issues. Once the Government has begun communications with the next best-suited quoter, no further communications with the previous quoter will be entertained until after the purchase order has been awarded. This process shall continue until an agreement is successfully reached and a contract is awarded.

A revenue ruling is the conclusion of the IRS on how the law is applied to a specific set of facts. For questions relating to the interpretation of the IRS regulations go to https://www.irs.gov/help/tax-law-questions.
