About this file
This pre-solicitation notice provides details for an upcoming solicitation seeking catering services. The National Institute of Standards and Technology requires catering for conferences and meetings at its Boulder, Colorado site, which lacks an on-site cafeteria. Services include breakfast, lunch, snacks, and beverages for events of 25 to 325 attendees over one to five days. The base period is one year with three one-year option periods. The solicitation will utilize simplified acquisition procedures and set aside this requirement for small businesses only with a size standard of $8 million. The solicitation is anticipated to be posted within five days on sam.gov using request for quotation number 1333ND22QNB100131. It will utilize firm fixed pricing and seek both base and option prices.

STATEMENT OF WORK
PAGE 13 OF 39 1333ND22QNB100131
BACKGROUND
The National Institute of Standards and Technology (NIST)/Public Affairs Office (PAO) works to help ensure strong, mutually beneficial relationships with NIST's major stakeholder groups. The Conference Program and
Audiovisual Services (AV) Group of the PAO supports NIST Laboratories and major programs by providing professional conference planning and AV in a cost-effective manner and in accordance with all Government rules and regulations.
The NIST site in Boulder, CO, does not have an onsite cafeteria. The Government has a need for catering services for official conferences and meetings that will include pre-registered participants and invited guests. Attendee numbers will vary by event. Numbers may be as few as 25 or as many as 325. NIST events are anticipated to be 1-5 days long, and will be held at the NIST site in Boulder, CO. NIST anticipates five catered events during the one year base period, and eight events per year in each of the three one year option periods.
There is not an incumbent Contractor for this statement of work.
SCOPE
The Contractor shall provide catering services for NIST events.
GENERAL REQUIREMENTS – POST AWARD ORDERING PROCESS
-Catering services provided by the Contractor shall be limited to the items and services identified below, and shall be priced, based upon prices negotiated between the Government and the Contractor, at the time of award.
-The Government intends to award a purchase order for a base period of one year with three one-year option periods. Each period of performance will identify a “not-to-exceed” amount. The aggregate value of all catering events, within the period of performance, shall not exceed the not-to-exceed amount.
-The Government will not issue individual orders for each event. The Government will confirm the total price for each event, prior to authorizing the Contractor to proceed with work.
-For each catering order, the NIST Contracting Officer’s Representative (COR) will email the Contractor, with a cc to the Contracting Officer (CO), and specify the following, as appropriate:
*The required catering services, in accordance with the menu categories described below;
*The number of attendees;
*The date(s)/time(s) for each event;
*Dietary restriction requirements;
* Relevant agenda items for each event;
*Equipment and service packages that will be required and the length of time each will be needed.
-NIST will make every effort to provide a minimum of two weeks’ notice to the Contractor for catering requests, however, the Contractor must be prepared to confirm pricing in timelines as short as 3-5 days.
-The Contractor shall confirm the total amount of the catering services, based upon the negotiated prices in the contract award, and the information provided by the COR. The Contractor shall email the COR, with a cc to the
CO, the total price for catering services. The total price must be broken down as follows:
*Item name from list of items and services;
*Quantity;
*Unit Price in accordance with negotiated prices;
*Total amount for each item/service
*Total amount for the event.
-NIST, as a federal government agency, is tax exempt. Quotations and invoices must not include sales tax.
PAGE 14 OF 39 1333ND22QNB100131
-The COR and CO will review the quoted price, and as needed, enter discussions with the Contractor. The
Contractor must submit a revised price quotation consistent with issues identified during discussions.
-The COR shall review the revised quotation and confirm the availability of funds. The COR shall provide written authorization to the Contractor, with a cc to the CO, to proceed with work. No work shall commence on any catering order until NIST and the Contractor mutually agree on a fixed price cost and a schedule of deliverables for each order. Each agreed upon task description requiring catering services must confirm that key personnel, identified in the contract, will manage the event.
-No changes shall be made to any catering order without the prior written concurrence of the Contracting
Officer. Changes made without such concurrence shall be made at the Contractor’s sole financial risk.
-The Contractor shall invoice for each event. The invoice must include all items required by the billing clause, the event date, event name and total amount of the event.
GENERAL REQUIREMENTS – CATERING SERVICES
-The Contractor shall provide catering services for NIST events in accordance with the list of items and services below.
-NIST does not have a “back of house” site. “Back of house” refers to the kitchen, where food and beverage items are prepped, cooked, and stored. Food/beverage preparation cannot be done at the NIST site for any event. The site does not have a kitchen, refrigerator, stove, ice, or the inherent ability to brew coffee.
The Contractor shall be responsible for preparing, storing, transporting, and serving all food and beverages in accordance with all required laws, regulations, policy and guidelines to ensure that all beverage items are served hot or cold, as appropriate, and all items are 100% safe for human consumption.
-The Contractor shall be responsible for all clean up, ensuring that the site is broom swept clean and free of all debris, spots and trash.
-The Contractor shall provide substitutions to accommodate vegan, vegetarian, gluten-free, and nut-free.
-The Contractor shall label all food items appropriately.
-The Contractor shall possess a full understanding of today’s common allergens and food safety guidelines.
-Contractor staff must be trained in food handling techniques.
-NIST will provide final guest count with dietary restrictions and food allergies three business days prior to events.
-The General Services Administration (GSA) sets forth the maximum limits for meals and incidental expenses
(M&IE) for Boulder, Colorado.
Breakfast: $16 per person inclusive of gratuity and all service charges;
Lunch: $17 per person inclusive of gratuity and all service charges.
These rates will be updated on an annual basis, as appropriate.
-COVID-19. The NIST campus may be subject to limited access due to the impact of COVID-19. The
Contractor must comply with all requirements relevant to COVID-19 when working on-site at NIST. The
Contractor shall monitor the NIST website for requirements.
PAGE 15 OF 39 1333ND22QNB100131
-Security. Not later than 15 days after award, the Contractor shall provide the COR and the CO a complete list of personnel who are likely to work on-site when catering services are required. This list can be updated periodically at the Contractor’s discretion.
Only personnel on the list will be allowed access to NIST Gaithersburg. Personnel not on the list will be denied access to NIST. NIST shall not be responsible for service interruptions due to personnel being denied access to the facility.
Contractor personnel must present current, valid photo identification.
NIST is a restricted campus. An identification badge is required for access for entry into buildings. Contractor personnel must present current, valid photo identification to obtain an identification badge. (a) North American Industry Classification System (NAICS) code and small business size standard.
The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern that submits an offer, other than on a construction or service acquisition, but proposes to furnish an end item that it did not itself manufacture, process, or produce is 500 employees if the acquisition--
(1) Is set aside for small business and has a value above the simplified acquisition threshold;
(2) Uses the HUBZone price evaluation preference regardless of dollar value, unless the offeror waives the price evaluation preference; or
(3) Is an 8(a), HUBZone, service-disabled veteran-owned, economically disadvantaged women-owned, or women-owned small business set-aside or sole-source award regardless of dollar value.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) Remit to address, if different than mailing address;
(8) A completed copy of the representations and certifications at Federal Acquisition Regulation (FAR) 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with FAR subpart 4.10), or alternative commercial products or commercial services for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers.
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)
(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is late and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
PAGE 17 OF 39 1333ND22QNB100131
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at anytime before the exact time set for receipt of offers. Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
