SECTION C

DESCRIPTION/SPECIFICATIONS/WORK STATEMENT

C.1 Statement of Work/Specifications

PAGE 10 OF 92 1333ND18RNB610011

The Contractor shall furnish the necessary personnel, material, equipment, services and facilities (except as otherwise specified) to supply neutron and gamma ray shields, which are tanks or shells of different shapes and sizes, made of aluminum, steel, or stainless steel. These tanks will be filled with different materials by the Government and used for personnel safety protection and background reduction.

Background:

The NIST Center for Neutron Research (NCNR) is a large laboratory facility consisting of a suite of instruments that measure the interaction of radiation with various materials to study their structure and properties. The NCNR maintains a wide variety of instruments that allows great flexibility in the type of samples and phenomena that can be studied and measured. One common requirement on all instrumentation is radiation shielding, both to protect personal safety and to ensure the validity and purity of the data collected on the instruments. Shielding varies according to the type and magnitude of the radiation being targeted, but in terms of volume, the vast majority of shielding consists of tanks or shells that are filled with a mixture of steel shot and paraffin wax. To remain a state-of-the-art neutron scattering facility, the NCNR continues to evolve by adding new instrumentation and upgrading existing instrumentation. Part of this evolution is a continual, but highly variable need for new shielding.

This requirement deals with the need for a mechanism for purchasing completed radiation shielding. The requirements can be divided and explained in the following format:

1. Shield Tanks

a. Empty Shield Tanks

b. Filled Shield Tanks

2. Solid Shields

3. Painting

4. Vacuum Vessels

The Contractor shall provide weldment services, on an as needed basis, in accordance with design specifications to be provided by NIST. All shields are custom made to the engineering drawings provided by NCNR engineering staff. The morphology of these shields varies widely and requires the ability to acquire, cut, machine or roll complex shapes from raw material. The composition of the shield tanks may be mild steel, stainless steel, or aluminum in thickness ranging from 1/8 inch to 4 inches. In addition, some fixtures on these shields may be as thick as

2.5 inches.

Some weldments may be required to be painted. Furthermore, some weldments may require filling. The type of filling will be specified later in the Statement of Work.

General Information:

Each weldment shall be described by an assembly and part drawings. The assembly drawing shall contain a Bill-of-Materials (BOM) containing a list of all component parts and their quantities. In addition, all critical features shall be dimensioned on the assembly drawing and this will serve as the acceptance standard for the finished weldment. In the note portion of the

PAGE 11 OF 92 1333ND18RNB610011

assembly drawing of shield tanks, the weight (filled), the weight (empty), the weld length (for reference only), the volume of shot and wax needed for filling, and the surface area will be given. In the note section of the assembly drawing of solid steel shields, the weight will be given for reference. This information is for internal NCNR use and the Government takes no responsibility for its accuracy or its use by the Contractor. Unless otherwise specified, all dimensions are basic at Maximum Material Condition (MMC). There is a 1/8-inch contour allowance toward Least Material Condition (LMC) on all surfaces. All drawings shall conform to ANSI Y14.5.

For each component listed in the BOM for the assembly, a dimensioned drawing will be provided in pdf format. However, these drawings are provided for reference only (with the exception of the drawing for lifting lugs or when otherwise specified) and their use in the fabrication of weldment components does not relieve the Contractor of the obligation to conform to the dimensional constraints of the assembly drawing. The specification of the material which is designated on component drawings is part of the requirement and the Contractor, if requested by the Government, must supply material certification with the weldment at or before delivery.

Ordering procedures will be covered under Section G of the contract. Upon receipt of a delivery order worksheet and associated drawings, Contractors shall prepare a quote (Firm, Fixed Price) and submit to the Contract Specialist within the specified time allotted. The quote shall be for the fabrication, inspection, testing and delivery of the specified items in the delivery order with the following constraints:

1. List of Requirements:

1.1. Shield Tanks:

1.1.1.Empty Shield Tanks:

1.1.1.1. Contractor shall furnish all material, equipment, and labor to fabricate, test, and inspect neutron and gamma ray shield tank weldments, made either of aluminum, steel, or stainless steel, per the part and assembly drawings, with plate thickness from 1/8 inch to 1 inch. In addition, some fixtures on these shields may be as thick as 2.5 inches.

1.1.1.2. All material shall be in accordance with the ASTM, AISI, or ASM specification, which will be noted on the delivery order and/or the drawings.

1.1.1.3. All welding shall be continuous and either water/air or vacuum tight (NIST will specify which, along with an allowable leak rate if applicable. This requirement will be specified on the WBOA Delivery Order Form for each line item in the delivery order) unless otherwise specified.

1.1.1.4. Contractor shall furnish all lifting lugs, tubing, angle, connecting fixtures and plates, and fabricated plates or parts necessary to fabricate the weldment(s). Fabricated parts may require shearing, cutting, rolling, bending, burning, machining, drilling, tapping, water jetting, plasma cutting or other operations.

1.1.1.5. The line item description box may specify the delivery of tack- welded shields to the NCNR for a “dry fit” (performed by and at the convenience of the NCNR staff). The initial delivery, return shipment to the contractor following the “dry fit”, any necessary modifications, leak testing, dimensional

PAGE 12 OF 92 1333ND18RNB610011

inspection, final weldment, and final delivery to the NCNR shall be the responsibility of the contractor. The timetable will be clearly defined in the delivery order package. All shipping arrangements and costs will be the responsibility of the contractor unless otherwise specified.

1.1.1.6. Contractor shall agree to follow any special instructions specified on the WBOA Delivery Order Form for each line item.

1.1.2.Filled Shield Tanks:

In some cases, NIST will require the shields to be filled with paraffin wax and either steel shot or stainless-steel shot depending on the different shielding requirements as well as the predicted magnetic fields in the areas where said shields will be used. The material used to fabricate shield tanks and the shot used to fill them shall remain consistent, unless otherwise specified. Appendix A provides information for a method of filling shields that has worked for the NCNR in the past. Contractors are welcome to come up with a different method that works for them as long as the actual weight doesn’t deviate from the projected weight of the shield by more than 4%.

1.1.2.1. Steel Shot - The steel shot used when filling the shield must be:

1.1.2.1.1. S-780 cast steel shot as specified in SAE Publication SAE J444 -

Cast Shot and Grit Size Specifications for Peening and Cleaning.

1.1.2.1.2. The steel shot must meet the required standards specified in the

Society of Automotive Engineers SAE J2175 – Specification for Low Carbon Cast Steel Shot or the required standards specified in the SAE J827 – Specifications for High Carbon Cast Steel Shot.

1.1.2.2. Stainless Steel Shot

1.1.2.2.1. Trivial name: Cast Stainless Steel Shot

Some requirements may dictate a more thorough prepping, such as SSPC-SP10/NACE 2. The paint prep required for each painted shield requirement will be noted on the WBOA delivery order form that accompanies the task order RFQ. For application information, refer to paint note on the PDF drawings that accompany the task order RFQ.

1.4. Vacuum Vessels

1.4.1.Vacuum Specification - Unless otherwise specified, the leak rate shall be demonstrated by evacuating the vessel interior to an absolute pressure of less than 10 x 10-3 torr. While at this pressure, the vessel shall be isolated from the pump.

The pressure shall not exceed 0.1 torr within 60 minutes of isolation.

PAGE 14 OF 92 1333ND18RNB610011

1.4.2.Vacuum Test - Vessel is placed under vacuum by connecting a pumping station to vessel with a vacuum gauge placed directly on the vessel or in the pumping line as close to the vessel as possible. If the vacuum gauge is placed in the pumping line, it must be placed between the valve and the vessel. Once the vacuum level (pressure) has stabilized at an acceptable level and sufficient time has elapsed to evacuate any oil or paint vapors, the vacuum valve is closed, isolating the vessel from the pumping station. The time and vacuum level is recorded (P1). After an hour (or longer) has elapsed, record the new vacuum level and the elapsed time (P2 and

ELAPSED TIME).

2. Shipment/Delivery: Shipment of all delivery orders, including tack-welded shield tanks traveling to and from the NCNR for a dry fit, shall be the responsibility of the contractor.

Contractor shall propose specific shipping instructions for NIST approval when submitting the proposal. Shipping shall conform to the following constraints:

2.1. Each delivery order shipment to and from the NCNR must incorporate a method to minimize the amount of rain, snow or debris that enters the shielding tanks and to minimize rusting of the shielding tanks and threads (i.e. tanks covered with tarp). It is the responsibility of the Contractor to specify instructions with the shipping company to achieve this.

2.2. Shield delivery orders shall be shipped in a manner that allows side forklift access (i.e.

there is no dock at the NCNR. Forklift travel is on the same surface as the trailer travel).

No box truck allowed. Government personnel will be available to place shield tanks onto a truck or trailer with a forklift for travel from NIST back to the contractor’s facility.

Arrangements and instructions for additional handling, covering, or securing of the shield tanks is the responsibility of the contractor.

2.3. Contractor shall notify COR of projected arrival times of deliveries at least 2 working days prior to arrival. Notification shall include date and approximate time of arrival, name of shipping company, and name and citizenship of driver(s). (This is for registration with NIST Security).

2.4. When applicable, NIST will notify contractor when dry fit shield tanks will be available for pick up as soon as this information is known. Contractor shall make all arrangements for return shipment and notify COR of expected arrival times of shipping truck(s) at least 2 working day prior to arrival. Notification shall include date and approximate time of arrival, name of shipping company, and name and citizenship of driver(s). (This is for registration with NIST Security).

2.5. Deliveries and pick-ups must be scheduled such that they arrive at NIST Gaithersburg between the hours of 7:00 a.m. and 2:00 p.m. ET on a normal working day. NIST reserves the right to request changes to the delivery schedule if activities at the NCNR prevent the timely unloading of delivery shipments.

2.6. All contracts are Freight on Board (FBO) destination.

3. Delivery Order Awards:

3.1. When submitting a quote, Contractor shall acknowledge and agree to abide by the delivery schedule specified in the WBOA Delivery Order Form for each line item.

PAGE 15 OF 92 1333ND18RNB610011

3.2. Following receipt of quotes and the deadline for quote submittal, the Contract Specialist and the COR shall review all quotes and award will be made to the Contractor submitting the lowest quote that is technically acceptable.

3.3. At time of award, notification of delivery due date will be specified and shall be in accordance with the performance period specified in the delivery order package used for preparation of the quote. Winning offeror shall acknowledge receipt of award notification.

3.4. Upon award of a delivery order, the contractor shall execute the delivery order by fabricating, leak testing, performing dimensional inspections and delivering all items listed in the delivery order.

4. Quality Control

4.1. Leak testing shall be performed by the contractor at the contractor’s (or subcontractor’s) site to demonstrate that all welds in each shield tank are water/air or vacuum tight (which, if either, of these applies will be specified on the assembly drawings or in the WBOA Delivery Order Form; or both). The method(s) used to verify leak tightness shall be proposed by the contractor in the technical proposal and must be approved by the Government. The results of the leak testing shall be recorded and this documentation shall be included with the shield delivery. The government reserves the right to witness the leak testing. If a request to witness the leak testing is made by the COR, the contractor shall give notice to the COR concerning the scheduling of such testing at least 2 working days prior to performing the test(s). All travel expenses for Government personnel to witness the testing are the responsibility of the Government. It should be noted that vacuum testing shall only be done for vacuum vessels which have adequate engineered reinforcement. Shield tanks shall be tested only with water; or by pressurizing them with air. The amount of air pressure equivalent than that of the hydrostatic pressure created by a few inches of water should be sufficient to test all welds.

4.2. Prior to delivery to NIST, the contractor shall perform a dimensional inspection of each shield on the delivery order. The method(s) used for the measurements shall be proposed by the contractor in the technical proposal and must be approved by the Government. The inspection report must include an as-built measurement for every dimension on the assembly drawing (except those designated as reference dimensions).

(The report can be as simple as a copy of the assembly drawing with the true dimensions handwritten next to the computer-generated dimensions). If any dimensions fail to meet the contour tolerance requirement described above, notification to the COR and Contract Specialist shall be made immediately describing the deviation(s). All remedies are the responsibility of the Contractor and do not relieve the Contractor of the obligation to keep the delivery schedule. The government reserves the right to witness the dimensional inspection. If a request to witness the dimensional inspection is made by the COR, the contractor shall give notice to the COR concerning the scheduling of such inspection at least 2 working days prior to performing the inspection(s). All travel expenses for Government personnel to witness the testing are the responsibility of the Government.

PAGE 16 OF 92 1333ND18RNB610011

4.3. In the situation where the WBOA Delivery Order Form specifies an intermediate delivery of tack-welded shields for a dry fit, an inspection of the tack-welded shield(s) shall be performed and a report prepared prior to shipment to NIST. Deviations from the assembly drawing(s) outside of tolerance shall be reported and remedied as in the preceding paragraph and the same conditions apply for the delivery schedule. The WBOA Delivery Order Form will dictate the turnaround time between delivery at NIST and the return trip to the Contractor’s facility for each line item. NIST reserves the right to lengthen this turnaround time at any time if activities at the NCNR prevent the performance of the dry fit in the original turnaround time period. In this case, the remaining schedule and final delivery date(s) will be modified to reflect this change.

Following the execution of the required modifications, final weldout, leak testing, dimensional inspection, and shipment to NIST shall occur in the manner described elsewhere in this document as it pertains to a delivery order requiring no dry fit. (In rare cases, it may be necessary to perform a second dry fit of a modified shield tank(s). In these instances, the above process applies to the additional dry fit cycle).

PACKAGING AND MARKING

D.1 NIST LOCAL-39 MARKING/PACKING INSTRUCTIONS

(1)If the total contract/order includes multiple quantities of the same or like item(s), segregated as separate CLIN/Item numbers, deliverables shall be packed accordingly. Each individual package/container in the shipment shall include deliverables on a per-CLIN or Item basis.

(2)For each shipment made under this contract/order, the Contractor shall furnish itemized packing list(s), enumerating the specific contents of each shipping container and what specific individual components constitute a full and complete "unit" for each bid item. The packing list shall include the brief description of each item found in the Schedule. If more than one container is required for each unit, each container should be marked accordingly, e.g., "Box 1 of 2," "Box 2 of 2," and the boxes, where feasible, should be taped or shrink-wrapped together as an issuable unit.

(3)The contract number AND CONTRACT LINE ITEM NUMBER (CLIN) OR

ORDER ITEM NUMBER shall be placed on the exterior of all containers.

SECTION E

INSPECTION AND ACCEPTANCE

E.1 52.246-2 INSPECTION OF SUPPLIES--FIXED-PRICE (AUG 1996)

(a) "Definition." "Supplies," as used in this clause, includes but is not limited to raw materials, components, intermediate assemblies, end products, and lots of supplies.

(b) The Contractor shall provide and maintain an inspection system acceptable to the Government covering supplies under this contract and shall tender to the Government for acceptance only supplies that have been inspected in accordance with the inspection system and have been found by the Contractor to be in conformity with contract requirements. As part of the system, the Contractor shall prepare records evidencing all inspections made under the system and the outcome.

These records shall be kept complete and made available to the Government during contract performance and for as long afterwards as the contract requires. The Government may perform reviews and evaluations as reasonably necessary to ascertain compliance with this paragraph. These reviews and evaluations shall be conducted in a manner that will not unduly delay the contract work. The right of review, whether exercised or not, does not relieve the Contractor of the obligations under the contract.

(c) The Government has the right to inspect and test all supplies called for by the contract, to the extent practicable, at all places and times, including the period of manufacture, and in any event before acceptance. The Government shall perform inspections and tests in a manner that will not unduly delay the work. The Government assumes no contractual obligation to perform any inspection and test for the benefit of the Contractor unless specifically set forth elsewhere in this contract.

(d) If the Government performs inspection or test on the premises of the Contractor or a subcontractor, the Contractor shall furnish, and shall require subcontractors to furnish, at no increase in contract price, all reasonable facilities and assistance for the safe and convenient performance of these duties. Except as otherwise provided in the contract, the Government shall bear the expense of Government inspections or tests made at other than the Contractor`s or subcontractor`s premises; provided, that in case of rejection, the Government shall not be liable for any reduction in the value of inspection or test samples.

(e)

(1) When supplies are not ready at the time specified by the Contractor for inspection or test, the Contracting Officer may charge to the Contractor the additional cost of inspection or test.

(2) The Contracting Officer may also charge the Contractor for any additional cost of inspection or test when prior rejection makes reinspection or retest necessary.

(f) The Government has the right either to reject or to require correction of nonconforming supplies. Supplies are nonconforming when they are defective in material or workmanship or are otherwise not in conformity with contract requirements. The Government may reject nonconforming supplies with or without disposition instructions.

(g) The Contractor shall remove supplies rejected or required to be corrected. However, the Contracting Officer may require or permit correction in place, promptly after notice, by and at the expense of the Contractor. The Contractor shall not tender for acceptance corrected or rejected supplies without disclosing the former rejection or requirement for correction, and, when required, shall disclose the corrective action taken.

(h) If the Contractor fails to promptly remove, replace, or correct rejected supplies that are required to be removed or to be replaced or corrected, the Government may either

(1) by contract or otherwise, remove, replace, or correct the supplies and charge the cost to the Contractor or

(2) terminate the contract for default. Unless the Contractor corrects or replaces the supplies within the delivery schedule, the Contracting Officer may require their delivery and make an equitable price reduction. Failure to agree to a price reduction shall be a dispute.

(i)

(1) If this contract provides for the performance of Government quality assurance at source, and if requested by the Government, the Contractor shall furnish advance notification of the time--

(i) When Contractor inspection or tests will be performed in accordance with the terms and conditions of the contract; and

(ii) When the supplies will be ready for Government inspection.

(2) The Government`s request shall specify the period and method of the advance notification and the Government representative to whom it shall be furnished. Requests shall not require more than 2 workdays of advance notification if the Government representative is in residence in the Contractor`s plant, nor more than 7 workdays in other instances.

(j) The Government shall accept or reject supplies as promptly as practicable after delivery, unless otherwise provided in the contract. Government failure to inspect and accept or reject the supplies shall not relieve the Contractor from responsibility, nor impose liability on the Government, for nonconforming supplies.

PAGE 19 OF 92 1333ND18RNB610011

(k) Inspections and tests by the Government do not relieve the Contractor of responsibility for defects or other failures to meet contract requirements discovered before acceptance. Acceptance shall be conclusive, except for latent defects, fraud, gross mistakes amounting to fraud, or as otherwise provided in the contract.

(l) If acceptance is not conclusive for any of the reasons in paragraph (k) hereof, the Government, in addition to any other rights and remedies provided by law, or under other provisions of this contract, shall have the right to require the Contractor

(1) at no increase in contract price, to correct or replace the defective or nonconforming supplies at the original point of delivery or at the Contractor`s plant at the Contracting Officer`s election, and in accordance with a reasonable delivery schedule as may be agreed upon between the Contractor and the Contracting Officer; provided, that the Contracting Officer may require a reduction in contract price if the Contractor fails to meet such delivery schedule, or

(2) within a reasonable time after receipt by the Contractor of notice of defects or nonconformance, to repay such portion of the contract as is equitable under the circumstances if the Contracting Officer elects not to require correction or replacement. When supplies are returned to the Contractor, the Contractor shall bear the transportation cost from the original point of delivery to the Contractor`s plant and return to the original point when that point is not the Contractor`s plant. If the Contractor fails to perform or act as required in paragraph (l)(1) or (l)(2) of this clause and does not cure such failure within a period of 10 days (or such longer period as the Contracting Officer may authorize in writing) after receipt of notice from the Contracting Officer specifying such failure, the Government shall have the right by contract or otherwise to replace or correct such supplies and charge to the Contractor the cost occasioned the Government thereby.

E.2 52.246-16 RESPONSIBILITY FOR SUPPLIES (APR 1984)

(a) Title to supplies furnished under this contract shall pass to the Government upon formal acceptance, regardless of when or where the Government takes physical possession, unless the contract specifically provides for earlier passage of title.

(b) Unless the contract specifically provides otherwise, risk of loss of or damage to supplies shall remain with the Contractor until, and shall pass to the Government upon--

(1) Delivery of the supplies to a carrier, if transportation is f.o.b. origin; or

(2) Acceptance by the Government or delivery of the supplies to the Government at the destination specified in the contract, whichever is later, if transportation is f.o.b. destination.

(c) Paragraph (b) of this clause shall not apply to supplies that so fail to conform to contract requirements as to give a right of rejection. The risk of loss of or damage to such nonconforming supplies remains with the Contractor until cure or acceptance. After cure or acceptance, paragraph

(b) of this clause shall apply.

(d) Under paragraph (b) of this clause, the Contractor shall not be liable for loss of or damage to supplies caused by the negligence of officers, agents, or employees of the Government acting within the scope of their employment.

NIST NCNR Building 235 100 Bureau Drive Gaithersburg, MD 20899

SECTION F

DELIVERIES OR PERFORMANCE

F.1 52.242-15 STOP-WORK ORDER (AUG 1989)

(a) The Contracting Officer may, at any time, by written order to the Contractor, require the Contractor to stop all, or any part, of the work called for by this contract for a period of 90 days after the order is delivered to the Contractor, and for any further period to which the parties may agree. The order shall be specifically identified as a stop-work order issued under this clause. Upon receipt of the order, the Contractor shall immediately comply with its terms and take all reasonable steps to minimize the incurrence of costs allocable to the work covered by the order during the period of work stoppage. Within a period of 90 days after a stop-work is delivered to the Contractor, or within any extension of that period to which the parties shall have agreed, the Contracting Officer shall either--

(1) Cancel the stop-work order; or

(2) Terminate the work covered by the order as provided in the Default, or the Termination for Convenience of the Government, clause of this contract.

(b) If a stop-work order issued under this clause is canceled or the period of the order or any extension thereof expires, the Contractor shall resume work. The Contracting Officer shall make an equitable adjustment in the delivery schedule or contract price, or both, and the contract shall be modified, in writing, accordingly, if--

(1) The stop-work order results in an increase in the time required for, or in the Contractor`s cost properly allocable to, the performance of any part of this contract; and

(2) The Contractor asserts its right to the adjustment within 30 days after the end of the period of work stoppage; provided, that, if the Contracting Officer decides the facts justify the action, the Contracting Officer may receive and act upon the claim submitted at any time before final payment under this contract.

(c) If a stop-work order is not canceled and the work covered by the order is terminated for the convenience of the Government, the Contracting Officer shall allow reasonable costs resulting from the stop-work order in arriving at the termination settlement.

(d) If a stop-work order is not canceled and the work covered by the order is terminated for default, the Contracting Officer shall allow, by equitable adjustment or otherwise, reasonable costs resulting from the stop-work order.

F.2 52.242-17 GOVERNMENT DELAY OF WORK (APR 1984)

(a) If the performance of all or any part of the work of this contract is delayed or interrupted

(1) by an act of the Contracting Officer in the administration of this contract that is not expressly or implied authorized by this contract, or

(2) by a failure of the Contracting Officer to act within the time specified in this contract, or within a reasonable time if not specified, an adjustment (excluding profit) shall be made for any increase in the cost of performance of this contract caused by the delay or interruption and the contract shall be modified in writing accordingly. Adjustment shall also be made in the delivery or performance dates and any other contractual term or condition affected by the delay or interruption.

However, no adjustment shall be made under this clause for any delay or interruption to the extent that performance would have been delayed or interrupted by any other cause, including the fault or negligence of the Contractor, or for which an adjustment is provided or excluded under any other term or condition of this contract.

(b) A claim under this clause shall not be allowed--

(1) For any costs incurred more than 20 days before the Contractor shall have notified the Contracting Officer in writing of the act or failure to act involved; and

(2) Unless the claim, in an amount stated, is asserted in writing as soon as practicable after the termination of the delay or interruption, but not later than the day of final payment under the contract.

F.3 52.247-34 F.O.B. DESTINATION (NOV 1991)

(a) The term "f.o.b. destination," as used in this clause, means--

PAGE 21 OF 92 1333ND18RNB610011

(1) Free of expense to the Government, on board the carrier`s conveyance, at a specified delivery point where the consignee`s facility (plant, warehouse, store, lot, or other location to which shipment can be made) is located; and

(2) Supplies shall be delivered to the destination consignee`s wharf (if destination is a port city and supplies are for export), warehouse unloading platform, or receiving dock, at the expense of the Contractor. The Government shall not be liable for any delivery, storage, demurrage, accessorial, or other charges involved before the actual delivery (or "constructive placement" as defined in carrier tariffs) of the supplies to the destination, unless such charges are caused by an act or order of the Government acting in its contractual capacity. If rail carrier is used, supplies shall be delivered to the specified unloading platform of the consignee. If motor carrier (including "piggyback") is used, supplies shall be delivered to truck tailgate at the unloading platform of the consignee, except when the supplies delivered meet the requirements of Item 568 of the National Motor Freight Classification for "heavy or bulky freight." When supplies meeting the requirements of the referenced Item 568 are delivered, unloading (including movement to the tailgate) shall be performed by the consignee, with assistance from the truck driver, if requested.

If the contractor uses rail carrier or freight forwarded for less than carload shipments, the contractor shall ensure that the carrier will furnish tailgate delivery, when required, if transfer to truck is required to complete delivery to consignee.

(b) The Contractor shall-- (1)

(i) Pack and mark the shipment to comply with contract specifications; or

(ii) In the absence of specifications, prepare the shipment in conformance with carrier requirements;

(2) Prepare and distribute commercial bills of lading;

(3) Deliver the shipment in good order and condition to the point of delivery specified in the contract;

(4) Be responsible for any loss of and/or damage to the goods occurring before receipt of the shipment by the consignee at the delivery point specified in the contract;

(5) Furnish a delivery schedule and designate the mode of delivering carrier; and

(6) Pay and bear all charges to the specified point of delivery.
