Facilitator/Meeting Planner for Aquaculture Gear/Protected Species Interactions

Workshop

A. Background: A facilitator/workshop planner will be contracted to assist the NOAA

WCR Aquaculture Coordinator in developing the framework for and facilitating a 2-day workshop to address marine aquaculture gear and protected species potential interactions in southern California. As NOAA Fisheries has prioritized development of sustainable marine aquaculture in both federal and state waters, the need for science— based information to inform the regulatory process with Army Corps of Engineers, Environmental Protection Agency, and California Coastal Commission permit determinations, as well as Endangered Species Act, Marine Mammal Protection Act, Magnuson-Stevens Act/Essential Fish Habitat consultations, is vital to advancing the aquaculture industry and conserving marine ecosystems. While there is much information available regarding various commercial fishing gear types and their potential interactions with marine species such as pinnipeds, cetaceans, and sea turtles, often aquaculture gear is equated with other commercial fishing gear types erroneously.

Aquaculture gear types vary considerably from commercial fishing gear, but this is not well understood. However, there has been a marked increase in marine mammal entanglement incidents in recent years offshore of southern California with both the crab and the lobster fisheries. This increase is alarming in the context of conserving marine resources and heightens concerns about potential entanglement with aquaculture gear as the industry expands.

Development of a sustainable marine aquaculture industry must include consideration of aquaculture gear interactions with protected species, as well as outlining how to potentially conduct associated risk assessments; this proposed workshop is a critical piece and opportunity to bring together aquaculture gear and protected species experts in addressing these issues. The workshop and its outcomes will serve to inform regulatory and environmental review of future marine aquaculture projects and enhance regulatory understanding of aquaculture gear operationally as well as presence and behaviors of protected species in areas where aquaculture projects may be operated. In addition, outcomes from the workshop will inform both NEPA (in federal waters) and

CEQA (in state waters) environmental reviews of potential marine aquaculture projects.

A similar workshop was conducted in the Greater Atlantic Region (Gloucester, MA) a few years ago to address similar concerns and issues. A National Ocean Service/Coastal

Aquaculture Siting and Sustainability Program Technical Report was prepared and issued in January 2017 as an outcome of the Gloucester workshop process and will serve as part of the foundation for this southern California-focused workshop:

https://coastalscience.noaa.gov/data_reports/protected-species-and-marine-aquaculture-interactions/

This southern California workshop will require contractor assistance for the RAC in forming a NOAA WCR Protected Resources (PR) and Southwest Fisheries Science

Center (SWFSC) internal planning team or subcommittee to outline the framework for the workshop and build the workshop agenda, as well as identify subject-matter experts to participate in the workshop.

B. Objectives: This contracting effort will provide necessary workshop planning and support related specifically to marine aquaculture and protected species, as well as providing outstanding facilitation expertise, to make this important workshop a meaningful and successful effort.

This contract will aid NOAA’s WCR in addressing identified concerns related to marine aquaculture gear types and potential interactions with protected species. The workshop must provide appropriate expertise to insure understanding by workshop participants of aquaculture gear operations, protected species presence in areas of interest for aquaculture development, understanding of species’ behaviors and vulnerabilities to entanglement from what has been learned from the crab and lobster fisheries, and what to incorporate into risk assessment as well as monitoring requirements regarding potential entanglement.

The workshop will include consideration of utilizing an offshore aquaculture working group to continue the dialog beyond this workshop. The workshop will also identify next steps beyond the workshop. A workshop summary report will be produced by the contractor as one of the outcomes of this contract. This report will serve to inform future efforts to address the concerns identified above as sustainable marine aquaculture development expands, to insure sound methodologies and best available science are utilized in assessing risk of entanglement and associated monitoring requirements. The workshop and summary report will serve to inform regulatory and environmental review and permitting for local, state, and federal government agencies, industry, NGOs, and various stakeholders.

C. Scope: NOAA Fisheries anticipates a timely and productive workshop that recognizes the challenges of assessing potential risk of entanglement as well as education and outreach about aquaculture practices and gear types in a well-managed and proactive manner. The role of the contractor in assisting NOAA Fisheries and the RAC as an expert meeting planner and facilitator familiar with the NOAA organization, its leadership in different programs nationally, and the issues being addressed in the workshop (marine aquaculture, protected species, gear entanglement risk) is critically important to the success and utility of this workshop. The contractor must possess experience and skills in working with the NOAA organization’s multiple programs, at the Headquarters and Field Office levels of leadership; the contractor should have experience working on complex and controversial marine aquaculture and protected species-related projects with local, state, and federal agencies and various stakeholder groups. The contractor must have experience building consensus with diverse https://coastalscience.noaa.gov/data_reports/protected-species-and-marine-aquaculture-interactions/ https://coastalscience.noaa.gov/data_reports/protected-species-and-marine-aquaculture-interactions/ stakeholders and agencies on controversial marine-related projects that includes marine aquaculture, protected species, and overall marine resource conservation and management.

D. Tasks/Deliverables: Contractor must work independently but in coordination with

RAC, closely monitoring and updating RAC on progress towards completing the tasks outlined below. The contractor will be assisting the RAC throughout planning and development of the workshop framework and facilitating the workshop. The workshop planning will require the RAC and WCR PR and SWFSC staff to form a small planning subcommittee. It is critical that the contractor develop a professional relationship with the subcommittee members and to insure subcommittee members are heard and their input is acknowledged and informs the workshop framework. The contractor can work from his or her office but is encouraged to maintain email and phone contact regularly as well as periodic in-person and conference call meetings with the subcommittee.

4.1 Task 1 – Coordinate with RAC to convene and manage Planning Team/Sub- Committee

Contractor to work closely with RAC to identify appropriate steering committee members in NOAA Fisheries WCR and SWFSC. Contact potential committee members, survey their interest in participating and recommendations as committee members. This will include identification of key interested parties, guidance to shape workshop, key issues/concerns, focus areas for workshop, list of potential gear/species interactions, leading to workshop objectives.

Contractor to convene monthly Planning Team/Sub-Committee meetings via conference call primarily, but at least 1-2 in person meetings should be attempted.

Survey RAC and Planning Team/Sub-Committee for input on best available information regarding marine aquaculture operations and gear, protected species/habitats of concern, formulate list of subject matter experts to participate in the workshop. This should include preliminary identification of key data gaps.

4.2 Task 2 – Frame and prioritize key issues

Develop short list of where to focus workshop objectives and demonstrate clear understanding of key issues by contractor and Planning Team/Sub-Committee. A broad understanding of these key issues and where to focus resources will be needed from the contractor, to guide the Planning Team/Sub-Committee productively.

Maintain updated spreadsheet of key issues to insure workshop addresses them. This spreadsheet will be the basis of identification of potential monitoring protocols in the workshop.

4.3 Task 3 – Develop Workshop Agenda

In coordination with the RAC and Planning Team/Sub-Committee, develop workshop agenda that is responsive to identified key issues/concerns. The agenda should lead to an enhanced understanding of aquaculture gear and operations as well as protected species migration pathways, presence/absence information, and species behaviors. The agenda should also frame discussions about understanding risk and vulnerability to entanglement, as well as how to frame risk assessment, and develop sound monitoring protocols based on best available science.

Contractor will also assist in noticing workshop and invitations for attendees.

4.4 Task 4 – Facilitate Workshop

Contractor must insure shared understanding of key issues/concerns relative to aquaculture gear types and potential species interactions. Facilitation should also insure inclusiveness for all workshop participants, and also be mindful of following the agenda, and employ facilitation tools to insure discussions are productive, the group stays on topic, side issues/topics are noted and addressed as time allows. Discussions should explore multiple approaches and tools to address workshop issues, and consideration of utilizing/re-engaging an offshore aquaculture working group to continue these discussions and efforts beyond the workshop.

4.5 Task 5 – Produce Workshop Summary Report

Contractor will prepare, based on workshop notes and observations, a summary report of the workshop process, outcomes, and next steps. A draft report should be prepared first and circulated for review with the Planning Team/Sub-Committee, then finalized based on their review. The RAC will circulate the final report to workshop attendees and post it online on the NOAA WCR Aquaculture webpage. This report will be key to addressing potential entanglement concerns as sustainable marine aquaculture development progresses in offshore southern California waters. The report will be an important tool to inform the regulatory permitting process and environmental review as well as inform related monitoring permit requirements. The report will also be an important document to guide re-engagement of an offshore aquaculture working group.
