SOLICITATION 13-100-SOL-00016
Emergency Prescription Assistance Program Support
STATEMENT OF WORK
EPAP Claims Adjudication andReimbursement
1. REQUIRING ORGANIZATION
Department of Health and Human Services
OS/ASPR/OEM
2. OBJECTIVE
The purpose of this contract is to obtain services of a qualified vendor to perform the activities related to adjudicating prescription drug claims for medications, specific medical supplies, and durable medical equipment (DME) and reimbursing pharmacies enrolled in the Emergency Prescription Assistance Program (EPAP) on the Government’s behalf. Additionally, this contract will permit the adjudication and reimbursement for the administration or dispensing of specific medications and vaccines by community pharmacies. This effort will allow any pharmacy in the United States and its territories to use existing electronic pharmacy systems as an infrastructure to efficiently process prescriptions, specific medical supplies, and DME for individuals that are eligible for the EPAP. The ASPR may issue a task order to the contractor to perform tasks under the contract at any time. EPAP activities provide “essential assistance” to support state and local jurisdictions as defined in Section 403 and 502 of the Stafford Act, 42 USC 5170b.
Program activation will occur under the Robert T. Stafford Disaster Relief and Emregency Assistance Act or under the authorities of the National Disaster Medical System (NDMS) to provide emergency medical care to the victims of public health emergencies and catastrophic events that overwhelm the capacity of state and local emergency medical systems to respond to these disasters. Section 2812 of the PHS Act provides that the Secretary may activate the NDMS to “provide health services, health-related social services, other appropriate human services, and appropriate auxiliary services to respond to the needs of victims of a public health emergency (whether or not determined to be a public health emergency under section 319).
3. BACKGROUND
Section 2811 of the Public Health Service Act establishes within the Department of Health and Human Services the position of the Assistant Secretary for Preparedness and Response (HHS/ASPR) to serve as the principal advisor to the Secretary on all matters related to Federal public health and medical preparedness and response for public health emergencies. ASPR has agreed to accept a subtask from HHS/ASPR to provide pharmaceutical supplies, specific medical supplies, limited durable medical equipment and personnel sufficient to support disaster response operations.
In the aftermath of Hurricane Katrina, community retail pharmacies were ready, willing and able to assist victims and evacuees. Indeed, in many disaster areas, community pharmacists were on the scene before any other medical professionals providing first aid and prescription drug assistance to victims. Through the coordinating efforts of
DHHS/ASPR, community pharmacists were able to set up and serve the emergency needs of evacuees from Katrina at the Astrodome, Kelly Air Force Base, the Convention Center and hundreds of other evacuee sites using the existing private drug distribution system.
Conflicting directions from Federal, State, local and private agencies, along with the lack of any established process for enlisting the help from this community resource were among the biggest challenges for these pharmacies. In fact, many pharmacies that dispensed medications to Katrina evacuees were unable to settle claims due to the lack of clarity about what agency is responsible for paying which prescriptions dispensed during the Katrina disaster response.
Prescription drugs, specific medical supplies, and durable medical equipment (DME) are critical first line therapies in treating both acute and chronic conditions. For this reason, assuring an adequate and readily available supply should be a priority for emergency planning.
As a byproduct of our experience with Hurricane Katrina, the federal government established the Emergency Prescription Assistance Program (EPAP) to fully leverage private sector resources for efficient prescription drug, specific medical supplies and DME distribution. The EPAP will provide access to necessary prescription drugs, specific medical supplies, and limited durable medical equipment (DME) for individuals who were affected by a major disaster or emergency and have a need for drug, medical supply, or DME coverage (including co-payments as a separate optional requirement for those underinsured) at any pharmacy in the nation or U.S. territories. Additionally, the EPAP will facilitate communications between government and private industry to identify and address any potential pharmaceutical and medical supply needs during the initial disaster response.
4. SCOPE
The Contractor shall provide access, at any EPAP-enrolled pharmacy in the nation or U.S. territory to ASPR- identified prescription drugs, medical supplies, and limited DME for individuals who were affected by a major disaster or emergency. The activation of this contract for adjudication and reimbursement for the administration or dispensing of specific medications and vaccines by community pharmacies in response to a public health emergency will be by determined by the ASPR.

Alternatively, Participating Pharmacy shall provide records or copies of records requested by Contractor, ASPR, or their third party designees within a reasonable period of time from the date of a written request for such records.
Payments:
The government expects the contractor to pay the reimbursable claims from the contractor’s source of funds and to invoice the government with proof of receipt of payments by the participating pharmacies to be reimbursed as follows:
a. When prescription, specific medical supplies, and DME medical care is authorized by
EPAP, the government will provide a task order under this contract which will define the total amount of payments that the contractor may make to pharmacies under the EPAP, the total number of claims that the contractor is authorized to process at the fixed fee per claim quoted in the indefinite delivery/indefinite quantity (IDIQ) part of this contract. In their business proposal, the contractor should state the amount of claims payments that the contractor is willing to make to pharmacies on behalf of EPAP before reimbursement is received from the government. Subject to negotiations, this amount will be specified in the contract and will be referred to as the “EPAP Reimbursement Limit”. The contractor will be required to establish EPAP Reimbursement Limit no greater than $1,000,000 for a given period although the contractor may choose to propose a higher EPAP Reimbursement Limit if desired.
b. The contractor shall be responsive to any patient served through the EPAP program who requests an explanation of benefits by phone, email, mail, or in person within three business days of receipt of the inquiry, after proper validation of patient identity in accordance with its procedures established for Privacy Act and Health Insurance Portability and Accountability Act (HIPAA) privacy regulation purposes.
c. The contractor shall implement a check template that identifies the purpose of funds (“EPAP Reimbursement Program”) and provides appropriate return address information. The government will review and approve the check template within 15 business days of a task order being issued.
d. By the 1st and the 15th of each month, the Contractor shall submit a remittance advice to the government of the claims determined to be eligible for payment. The government shall then review the proposed payments, and authorize the contractor to pay or not pay the claims they submit for approval by the government within 5 business days.
e. For those remittance advices approved by the government, the contractor shall provide a remittance advice to the EPAP Provider that documents the services and charges billed, dates of service, claims control number, dates of claims receipt and processing, and the program payment level (if any) by the following first or 15th of the month. The remittance advice must be mailed to the EPAP Provider prior to payment being made if payment is being made electronically as preferred. If the contractor intends to make payment with a paper check instead, the remittance advice must be mailed with the check.
f. After allowing time for the EPAP Provider to receive their copy of the remittance advice, the contractor shall make payment to the EPAP Provider via electronic funds transfer. The contractor will use the data documented from the SF 3881 form during the Provider Enrollment process to make electronic funds transfers to Providers.
g. Following payment to a EPAP Provider, the contractor shall provide the government with a copy of a confirmation notice or transaction log showing the date, time and amount of an electronic fund transfer successfully made to a Provider, and submit those receipts with the contractor’s monthly invoices, which will be needed before the contractor may obtain reimbursement for all claims paid out. It is highly recommended that the contractor use electronic funds transfer to make payments in order to help expedite reimbursement of the payments made by the contractor. If the contractor elects to issue paper checks to EPAP Providers instead, the contractor must supply proof that the check has been deposited by the EPAP Provider and the funds cleared before the payment can be submitted for reimbursement.
h. If the amount of reimbursable claims exceeds the EPAP Reimbursement Limit, the contractor shall cease making payments, unless authorized to do so by the Contracting Officer. Even if the threshold is reached, however, the contractor shall continue with the determination of pending claims.
i. It is possible that the reimbursement due to a single EPAP pharmacy may exceed the EPAP Reimbursement Limit. In this event, the government may modify the contract to allow payment above the EPAP Reimbursement Limit or the Government may opt to make a payment that exceeds the EPAP Reimbursement Limit directly to the pharmacy. In the latter case, the contractor shall provide the government with the SF 3881 form for the EPAP pharmacies so that the government can make an electronic payment to the EPAP pharmacies.
j. From the date that approval is received by the contractor from the COTR to reimburse a EPAP pharmacy, the contractor shall make payment to the pharmacies within 5 business days of such approval, unless the EPAP Reimbursement Limit has been reached. In the event of any delayed payment, the contractor shall notify the COTR, determine the status of the payment and take appropriate action. The contractor shall contact the pharmacy within 5 business days in the event that disbursements are returned for any reason.
k. The contractor shall process allegations that an EPAP Reimbursement Program check has been lost, stolen, defaced, mutilated, destroyed, or paid on a forged endorsement in accordance with the procedures set forth in 42 CFR §§424.350(b) and 424.352.
l. The contractor shall prepare and issue Form 1099s to EPAP Providers in accordance with Internal Revenue Service requirements by the end of January for the previous tax year. The contractor shall prepare and file any other forms required for income tax and similar reporting purposes.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.
Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

(ii) 52.219-8, Utilization of Small Business Concerns (Dec 2010) (15 U.S.C. 637(d)(2) and (3)), in all subcontracts that offer further subcontracting opportunities. If the subcontract (except subcontracts to small business concerns) exceeds $650,000 ($1.5 million for construction of any public facility), the subcontractor must include 52.219-8 in lower tier subcontracts that offer subcontracting opportunities.
