Q2. How many programmers with Atlassian software skills are needed?

A2. This is a Commercial off-the-shelf product (COTS) software tool used mainly for project management, issue/bug tracking and collaboration. So, there are no Atlassian programmers needed to work directly with OST.

A3. This is not applicable (N/A).

Q4. Do the programmers need clearance? If yes, what type of clearance.

REQUIREMENTS-24-1988

BRAND NAME JUSTIFICATION

FOR AN ACTION EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

USING SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL ITEMS

(AUTHORITY: FAR 13.501(a), 41 U.S.C. 1901)

1. Agency and contracting activity.

Department of Commerce, NOAA Acquisition and Grants Office (AGO), Western Acquisition Division, and NOAA Fisheries Office of Science and Technology (OST).

2. Nature and/or description of the action being approved.

This is a brand name justification for a follow-on requirement to a previous contract, 1333LF23FNFFK0064.

This will be a firm-fixed price (FFP) contract for Atlassian software and maintenance, and will be solicited to authorized resellers as a small-business set aside.

3. Description of supplies or services required to meet the agency’s needs (including the total estimated value).

OST requires the continued use of Atlassian software including Confluence, Custom Space User Management (CSUM), Elements Connect for Jira (Server), Git Integration for Jira, Google Drive and Documents for Confluence Data Center, Jira, and Jira Service Management.

The above-mentioned software platforms are required by OST to assist with collaboration, knowledge and document sharing across teams, and creating a space for users to document and track projects, issues, and problems for an uninterrupted and streamlined workflow within OST working groups. It allows centralized documentation and a platform for workflow efficiency.

The total estimated price for the base period of performance, plus four option years is .

The period of performance for the base year is from June 14, 2024 through June 13, 2025. With the following option periods: Option Year 1 from June 14, 2025 through June 13, 2026; Option Year 2 from June 14, 2026 through June 13, 2027; Option Year 3 from June 14, 2027 through June 13, 2028; and Option Year 4 from June 14, 2028 through June 13, 2029.

4. Statutory authority permitting the sole source (including brand name) acquisition.

41 U.S.C. 1901, using SAP up to $7.5M as authorized by FAR 13.500(a) and implemented by FAR 13.501(a).

5. Demonstration that the nature of the acquisition requires use of the authority cited. The contracting officer has determined the following circumstances justify the use of a brand name as supported below:

Brand Name – Atlassian is currently licensed, installed, and in use by all of NOAA Fisheries and requires continual renewal and maintenance of the software for the foreseeable future. The required support is not a stand-alone product; it provides for continuous service including technical support and product updates to the existing software product, which is proprietary.

The support and maintenance for the software can only be provided by authorized Atlassian resellers. If the requirement is not solicited for the brand name, it will impact the Government’s ability to collaborate on very important projects as well as the ability to track the status of these projects. Additionally, it will impact the government's ability to continue to analyze data and share research documentation.

By renewing Atlassian software, it provides NOAA Fisheries the ability to continue the work and alleviates disruptions associated with new software including learning a new system and migrating information to a new platform. Additionally, while other companies may have software that can provide an equivalent function, they would not be compatible with the existing Atlassian software and would require a system overhaul. A new software system is cost prohibitive, and maintaining existing software eliminates the large financial impact associated with a new deployment.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable, including whether a notice was or will be publicized as required by FAR Subpart 5.2 and, if not, which exception under FAR 5.202 applies.

The brand name justification will be posted with the solicitation, which will be posted publicly on SAM.gov in compliance with FAR Subpart 5.2.

7. Determination by the contracting officer that the anticipated cost to the Government will be fair and reasonable.

The contracting officer determines that the anticipated price(s) will be fair and reasonable due to expected competition and based on a price analysis to be conducted in accordance with FAR 13.106-3(a)(2). If the pricing cannot be determined fair and reasonable, the contract will not be awarded.

8. Description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted.

Atlassian authorizes many third-party distributors; an initial search in SBA dynamic small business database conducted on March 5, 2024, returned a result of one Women Owned Small Business (WOSB), one Economically Disadvantaged Women Owned Small Business (EDWOSB), one HUBZone, two Service Disabled Veteran Owned Small Business (SDVOSB) and three 8(a) small businesses. An email was sent to the contractors to request more information and three capability statements were received.

Additionally, a Sources Sought Notice was posted on March 6, 2024 under REQUIREMENTS-24-1988 on SAM.gov resulting in five responses from small-businesses. Of the five businesses that submitted a response, three were designated as a small business, one a HUBZone, and one an 8(a).

All vendors that submitted capability statements are licensed partners of Atlassian and can provide these services. In addition, eight vendors are verified Atlassian Solution Partners with additional training and resources.

Contractor Special Concern Provide Option Years?

On March 28, 2024, the capability statements were reviewed and determined the vendors can perform the scope of work. Previously, the contract was issued by Field Delegates who were limited to one-year period of performance, with no option periods. During the sources sought phase, vendors were specifically asked if they can provide pricing for a base, plus four option years. Of the eight vendors that submitted responses, two indicated they can provide the requested period of performance structure and another two indicated they can provide base, plus 2 option years.

11. A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

For future follow-on requirements, the program office will review possible software solutions, warranty agreements, and continually monitor the marketplace for a software equivalent that is also open sourced to maximize competition.
