52.212-2 EVALUATION – COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsive and responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Award will be made on the basis of the lowest price technically acceptable (LPTA) source selection process.

The technical factors will be evaluated on an “Acceptable” or “Unacceptable” basis. Quotes shall completely and adequately address non-cost/price factor(s) to demonstrate that the Offeror can successfully perform the solicitation technical requirements to be considered “Acceptable” and therefore technically acceptable.

The Government will first evaluate quotes in order to identify the lowest-priced quote. Only the lowest price quote will be evaluated for technical acceptability. If found to be technically acceptable; then that quote price will be evaluated for accuracy, completeness, and balance. The remaining technical quotes, if any, shall not be evaluated as to technical acceptability unless the lowest price offeror is found to be technically unacceptable. If the lowest priced quote is found to be technically unacceptable, then the second lowest priced quote (and so on) will be evaluated for technical acceptability.

The evaluation factors that establish the requirements of acceptability are set forth as follows:

Factor 1 – Technical Approach

Offerors shall provide sufficient detailed information which demonstrates their technical approach to meet the requirements of the SOW. Offerors shall provide documentation that addresses the following:

1. Approval and/or certification from the NWS Radar Operations Center (ROC) to perform repairs on NEXRAD klystrons.

NWS ROC Approval/Certification Acceptability Criteria Rating Description

Acceptable The Offeror submits documentation indicating they have approval/certification from the ROC to perform repairs on NEXRAD klystrons

Unacceptable The Offeror DOES NOT submit documentation indicating they have approval/certification from the ROC to perform repairs on NEXRAD klystrons

2. The Small Business Subcontracting Plan applies to all offerors except small businesses and is mandatory for award to an other than small business. The Offeror’s Small Business Subcontracting Plan shall be evaluated on an “Acceptable” or “Unacceptable” basis.

Offerors must receive an “Acceptable” rating to be considered for award. The successful awardee will be required to work with the NOAA Small Business Office to ensure acceptability of the Small Business Subcontracting Plan, which will then be incorporated into any resultant contract upon approval from the Contracting Officer.

Small Business Subcontracting Plan Acceptability Criteria

Acceptable The Offeror submits a completed Small Business Subcontracting Plan using the NOAA template provided.

Unacceptable The Offeror DOES NOT submit a completed Small Business

Subcontracting Plan on the required template or fields on the template are not completely filled in.

3. A work process plan that addresses the offeror’s plan, operations, and/or process to meet the requirements of the SOW. The work process plan shall be evaluated on an “Acceptable” or “Unacceptable” basis. Offerors shall not simply reiterate requirements directly from the SOW, but should describe their own processes and information.

Work Process Plan Acceptability Criteria

Acceptable The Offeror submits a work process plan that addresses all of the following: 1) Evaluation Process. Description of the evaluation process used to determine each of the five (5) levels of repair needed;

2) Repair Process. Description of level of effort required for each of the five (5) levels of repair; 3) Repair Time. Provide repair times for each of the five (5) levels of repair.

Unacceptable The Offeror DOES NOT submit a work process plan that addresses all of the following: 1) Evaluation Process. Description of the evaluation process used to determine each of the five (5) levels of repair needed;

2) Repair Process. Description of level of effort required for each of the five (5) levels of repair; 3) Repair Time. Provide repair times for each of the five (5) levels of repair.

Factor 2 – Past Performance

To be considered technically acceptable, the offeror shall demonstrate relevant past performance or affirmatively state that it possesses no relevant past performance. Relevant past performance is performance under contracts or efforts, within the past 3 years from the date of this solicitation that is of the same or similar scope, magnitude, and complexity to that which is described in the SOW.

The offeror shall provide a list of NO MORE than three (3) current/previous contract performance references that includes: contract numbers, points of contact with valid telephone numbers and email addresses, periods of performance, role on the contract (prime or subcontractor), and other relevant information.

Evaluation of past performance shall be based on the references provided, the offeror’s recent and relevant procurement history with NOAA or its affiliates, and/or any other available source of information available to the Government. A Past Performance Questionnaire (PPQ) may be sent by the Government, at its sole discretion, to the past performance references if deemed necessary. Data from the Past Performance Information Retrieval System (PPIRS), and/or any other available source of information, may be used at the Government’s discretion to supplement the references provided.

Past performance of a similar scope, magnitude, and complexity that demonstrates a minimum finding of satisfactory or higher by all considered sources, or past performance found to be neutral, will be found technically acceptable.

In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will receive a neutral past performance rating.

Factor 3 – Price

The offeror shall use the Pricing Schedule to quote all pricing. The offeror shall quote all-inclusive firm fixed pricing, including, but not limited to, profit, overhead, G&A, and shipping/returns, without exception, to perform the work specified in the SOW.

The offeror shall submit a price breakdown for each level of repair, including: 1) SCA Labor Categories or Professional Title. Identify the SCA labor category or professional title of individuals performing the work required for each of the five (5) levels of repair;

2) Labor Rates. Provide one example of a typical hourly labor rate required to perform each of the five (5) levels of repair; 3) Labor Hours. Provide an estimated number of hours for each of the five (5) levels of repair. The price breakdown shall support the firm fixed-price for each of the five (5) levels of repair.

A Total Quoted Price will be calculated by adding each level of repair for each year of performance. For example, the per unit price for No Defect Found, Minor Repair, Major Repair, Total Rebuild, and BER will be added together to get a subtotal for the Base Year of performance. This subtotal will be added to the other subtotals for the remaining years of performance to calculate the Total Quoted Price.

Providing pricing for the optional six-month extension period is not requested or required.

The Government will evaluate its option to extend services (see FAR Clause 52.217-8) by taking the total value of the contract ($1,500,000.00) and dividing it by 10 (5 one-year periods divided into 10 six-month periods). The Government will add $150,000 to the Total Quoted Price to calculate the Total Evaluated Price. As indicated in FAR 52.217-8 the government will have the option to extend the performance of the contract up to an additional 6 months when the contractor is provided written notice.

(b) Options. Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers or quotations for award purposes by adding the total price for all options to the total price for the basic requirement to determine the total evaluated price. This includes options under FAR clause 52.217-8, Option to Extend Services, which applies to this solicitation. Evaluation of options will not obligate the Government to exercise the option(s). The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced.

(1) □ Are, □ are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(2) □ Have, □ have not, within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a Federal, state or local government contract or subcontract; violation of Federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or https://www.acquisition.gov/sites/default/files/current/far/html/52_223_226.html#wp1169151 https://www.acquisition.gov/sites/default/files/current/far/html/FARTOCP25.html#wp225048 destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property;

(3) □ Are, □ are not presently indicted for, or otherwise criminally or civilly charged by a Government entity with, commission of any of these offenses enumerated in paragraph (h)(2) of this clause; and

(4) □ Have, □ have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(i) Taxes are considered delinquent if both of the following criteria apply:

(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(ii) Examples.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. §6159.

The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. §362 (the Bankruptcy Code).
