About this file

This is Amendment 0001 to solicitation 12FPC425Q0016, issued by USDA FPAC Business Center Eastern Section, addressing questions received from industry regarding title abstract and settlement services in Iowa. The amendment clarifies two key points: 1) Since private sale of title insurance is prohibited in Iowa under state code § 515.48(10), the government will accept documentation showing qualifications to do business with Iowa Title Guaranty (ITG) and a law license to satisfy contractor licensure requirements; 2) For the technical criteria requiring three samples of commitments/policies for federal clients, the government will accept prior ITG commitments/policies or attorney title opinions as work examples, given Iowa's state law limitations on private title insurance. The period of performance is February 1, 2025 to January 31, 2030.

The purpose of this amendment is to provide questions received from industry with responses for solicitation 12FPC425Q0016.

Question 1: Sec. 2.2(2), Contractor Personnel Qualifications, under the Statement of Work requires agent be licensed to engage in title insurance business in the state. Item #1 under Technical Criteria of the Combined Synopsis requests license/certification information to conduct Title Abstract and Settlement. examinations of approved abstracters and attorneys. Please clarify whether an active company registration to do business with the Iowa

Secretary of State, together with law license, and ITG membership/participant number, satisfy the contractor licensure requirements referenced in the Solicitation and attachments.

Answer 1: Yes, the Government will accept documentation that reflects your qualifications to do business with ITG and your law license.

Question 2: Item #9 under Technical Criteria of the Combined Synopsis requests three samples of a commitment and policy issued by the firm for a federal client. Pursuant to Iowa Code §

515.48(10), it is unlawful for private insurers authorized to do business in the State of Iowa to engage in the sale of title insurance. Iowa

Title Guaranty (ITG) is the exclusive authorized provider of coverage in this State, and issues all commercial/non-residential commitments and policies. Given the state law limitation on sale of private title insurance in Iowa, please clarify what documentation satisfies this requirement. Are prior ITG commitments/policies obtained by the firm on behalf of federal clients

- or attorney title opinions rendered for the purposes of obtaining coverage - sufficient?

Answer 2: Yes, the Government will accept 3 samples of previous work examples.

There are no other changes by reason of this amendment. All other solicitation terms and conditions remain unchanged.
