About this file
This document is a site showing summary and questions and answers for the Assunpink Dam Site 8 Rehabilitation project, a USDA NRCS-sponsored construction contract.
The project involves rehabilitation of Assunpink Dam in Hamilton Township, New Jersey, with an anticipated performance period of 580 calendar days (367 work days, excluding 17 holidays, 76 weekends, and 44 weather days). The corrected solicitation specifies this timeline rather than the initially noted 180-day error. Six contractors attended the September 17, 2026 site showing: KC Construction, Abbonizio Contractors Inc., Scrimgeour's Farm All LLC, Rain for Rent, Tier 1 Management, and CMS Construction Inc. The project includes construction of a Roller Compacted Concrete (RCC) cutoff wall, concrete spillway weir, and permanent grass stabilization to 80% perennial coverage. Key requirements include maintaining a minimum 100-foot unobstructed width of the auxiliary spillway during construction except during RCC cutoff wall installation, submitting drainage and dewatering plans for government approval, closing the park to the public with contractor-provided barriers, and maintaining grass during construction. Liquidated damages are assessed at $900 per day. The township has obtained permits through Mercer County Soil Conservation District, NJ DEP Dam Safety, and NJ DEP Wetlands; a Lake Lowering permit will be obtained once a construction date is determined. Contractors must submit bid bonds of at least 20% of bid price (capped at $3 million) using Standard Form 24 and demonstrate past experience with dam construction and roller compacted concrete installation. The solicitation is conducted under FAR Part 12 Request for Quotes procedures rather than FAR 14 Sealed Bidding.

Questions during the site showing included:
1. Performance time – The solicitation noted 180 days for a performance time. This appears to be an error. The anticipated performance time is 580 calendar days. 367 work days, 17 holidays, 76 weekends (Saturday and Sunday) 152 days, 44 weather days (monthly number of days precipitation > 0.1 inches for Trenton area, NJ)
Contracting can extend the time due to weather or government delay, etc. via modification, with NRCS request and approval.
2. Geotechnical and Hydrologic/Hydraulic Reports will be shared with the contractors to aid in dewatering plans to be prepared by the contractor’s engineer.
3. Closure of the park during construction – The contractor will be responsible for the work zone and safety during the period of performance. Barriers will be supplied and installed by the contractor. The two access points to the site will be closed to the public for the duration of the project. Coordination with the township’s OEM officials will be needed.
The contractor will be responsible for maintenance of the grass on the site during construction. Township officials will discontinue mowing operations in the work area while the site is under construction.
4. Discharge for dewatering purposes – The contractor’s engineer will submit a drainage and dewatering plan to the government for review and approval according to Construction Specification 11 – Removal of Water. Further, water from excavation dewatering operations shall not be pumped directly into live streams. At a minimum, pumped water shall be directed to a filter bag before being discharged into live streams. Surface water may be directed around the work area and discharge downstream provided the requirements in Construction Specification 5, Pollution Control are met.
5. Clarification regarding CS11 Removal of Water, Section 8.A.8):
The Contractor shall minimize constriction of the auxiliary spillway (ASW) flow area throughout construction operations. Stockpiling of materials, placement of construction vehicles and equipment, and establishment of the RCC batch plant shall be arranged such that a minimum unobstructed ASW width of 100 feet is maintained.
Notwithstanding this requirement, construction of the Roller Compacted Concrete (RCC) cutoff wall shall be performed across the entire width of the ASW in a single phase. Excavation across the full width of the ASW and construction of the RCC cutoff wall associated with this work shall not be considered a violation of the 100-foot minimum unobstructed-width requirement.
6. Gravel for access road – The access road and construction entrance shall be 15 ft wide, max. Gravel may remain in the access road and construction entrance upon completion of the project.
7. Liquidated damages – $900/day
8. Tree trimming – Tree trimming for construction access is permitted. Coordination with Hamilton Township officials will be needed.
Questions presented by email:
1. What permits are currently in place for this project, and which permits are expected to be obtained by the contractor? If new permits are required, has the lead time been factored into the project schedule for obtaining additional permits?
The township obtained permits through the:
Mercer County Soil Conservation District – Soil Erosion and Sediment Control Permit
NJ DEP Dam Safety NJ DEP Wetlands A Lake Lowering permit will be obtained by the township once a construction date has been determined.
2. Does the permanent grass stabilization need to be fully grown and established within the 180-day timeframe? Grass shall be established and provide at least 80% perennial coverage within the time of the period of performance, 580 days.
3. The designated laydown yards appear to be located in the flood zone. Are materials and equipment permitted to be stockpiled in the flood zone under the NPDES/SWPPP and Sediment and Erosion Control Plans?
Materials and equipment may be staged in areas shown on the plans.
4. Can the concrete spillway weir be completed without the RCC going into Spring flood period?
The contractor will submit a transporting and conveying plan for the RCC which will describe the protection of the concrete spillway weir if it is to be installed prior to the RCC.
5. Please confirm that the fine and coarse drainfill associated with the RCC control section is paid under Item 16 and Item 17. Specification section CS-24 only includes the embankment toe drain and filter diaphragm in the scope description.
NRCS-NJ team replied: The fine and coarse drainfill associated with the RCC control section is paid under Items 16 and 17. The scope of CS-24 encompasses all structure drainage systems.
6. I do not see the bid docs or bid bond information in the spec for the Assunpink Creek Site 8 Dam Rehab - Quote project. Where can I find the bid bond example and the bid documents? Referring to the bid documents to release information with bidders check list, bid bond example/surety. Etc.
There is no bidders check list with 12FPC326Q0056 Assunpink Creek Site 8 Dam Rehab. All required documents needed to submit a quote are uploaded to the SAM.gov posting, simultaneous released to all who wish to quote.
Under FAR Part 12, there is no requirement for a bidder’s checklist for document release, even under the Revolutionary FAR Overhaul “RFO”.
Please note, FAR 14 Sealed Bidding is not being used. Request for Quotes under FAR 12 is being used, according to the RFO overhaul.
If your referring to required bid bond information:
Must be at least 20% of the bid price, capped at $3 million.
You can use Standard Form 24 – Bid Bond https://www.gsa.gov/reference/forms/bid-bond
Other clarifications:
1. Eight trees with plaques at the southern end of the dam will be removed by the township.
2. Benches at the top of the dam will be removed by the contractor. The contractor will replace the metal benches and their foundations. Bench style will be coordinated with the township.
3. The Contractor must describe their past experience with dam construction and installation of roller compacted concrete, for Past Performance.
