Questions and Answers

Cedar Creek Watershed Site 16 & 16A Remedial Dam Repairs

Please see attached Site Showing Technical Notes for additional information.

Question: Could the Government please clarify what is required for submission?

On pages 18 and 19 of 24, the Government states (emphasis mine):

Technical Approach:

The technical approach will evaluate the ability of the offeror to provide a sound and compliant approach that meets all requirements and shows a thorough understanding of them. It is the contractor's responsibility to ensure their quotation clearly demonstrates their capability to meet these requirements. All offerors must provide the following minimum information and documentation with their quotations to be considered responsive and have their offers evaluated:

• Ability of the offeror to meet the schedule requirements listed in the Statement of Work

(SOW).

• Detailed explanation of any requirement listed in the SOW that cannot be successfully accomplished by the offeror.

Past Performance:

The Government may utilize any references provided by the Contractor, along with information available from past contracts/orders with the USDA and any information found using sources such as Federal Government sources or the Contractor Performance Assessment Reporting System (CPARS) to determine if the Contractor has acceptable or neutral Past Performance.

However, on page 22 of 24, the Government lists the four items that are required for submission:

1. Completed Schedule of items (Page 8)

2. Completed Vendor Information Sheet;

3. Submit the required bid guarantee, Bid Bond (see provision 52.228-1)

4. Active/complete registration in SAM (including designation as a Small Business).

None of these four items are a technical approach, past performance/CPARS, or customer references.

Anwer: Yes, a technical approach is required to substantiate your ability to perform the work.

These four points were added to provide clarification/reminders or ‘Additional Information for Offerors’ to ensure that the other aspects often overlooked were also included. Listing the technical approach appeared redundant, moving forward I will list the technical approach here as well.

Question: Could you please confirm that questions are due at 3pm CT on August 13th, and that the proposal itself is due at 4pm CT on August 25th?

Answer:

Questions are due at 3pm CT on August 13th, and the quote is due date is extended on amendment 1 to 5pm CT on August 28th.

Question:

Is there no SF 1442 and certifications section?

Answer:

SF 1442 is incorporated on Amendment 1: Please complete and include with your response.

Question: Is there no bid bond requirement?

Question: There is no where in the solicitation that specifies about the bid bond information, can you please provide the information of how much and to whom it is for?

Answer: Yes, a bid bond is required, FAR Clause 52.228-1 Bid Guarantee (Sep 1996), 52.228-15 Performance and Payment Bonds-Construction (Jun 2020), and 52.228-14, Irrevocable Letter of Credit, is in the solicitation.

A bid bond/guarantee shall be 20% of the total price or $3 Million, whichever is less, is required to be submitted with quotes. The bid bond must be executed by a surety company authorized to operate in the state where the project is located. The bid bond guarantees that the bidder will not withdraw its bid during the acceptance period and, if awarded the contract, will execute all required contractual documents and provide the necessary performance and payment bonds within the specified timeframe

Payment Bond (SF-25A), Irrevocable Letter of Credit (ILC), or a Tripartite Escrow Agreement in the amount of 100% of the project cost will be required within 10 calendar days of award of the contract.

Question: Cedar Creek 16A - What do we do with the gate at Sta. 20+65?

Answer: Replace gate and pipe fence.

Question: Cedar Creek 16A - Is the gate at Sta 20+65 a property line?

Answer: Yes, it is a property line.

Question: Cedar Creek 16 & 16A - Will we get paid for the extra width of each lift on the upstream repair due to the width of the 34” plow equipment?
