About this file
This is a Collection Agreement for Emergency Watershed Protection between the West Virginia Conservation Agency (Sponsor) and the Natural Resources Conservation Service (NRCS), United States Department of Agriculture.
The agreement establishes a cost-sharing partnership to implement emergency watershed protection measures for two streambank erosion sites (Elkhorn and Northfork) in McDowell County, West Virginia that pose an imminent threat to improved property. The total estimated construction cost is $268,043, with NRCS contributing 90 percent ($241,239) as McDowell County qualifies as a Limited Resource Area, and the Sponsor contributing 10 percent ($26,804) from non-Federal sources. The agreement is effective through June 20, 2030 (5-year performance period), with all work to be completed within this timeframe. NRCS will provide contracting services, contract administration, and technical oversight in accordance with federal contracting procedures. The Sponsor is responsible for acquiring adequate real property rights, obtaining all required Federal, State, and local permits, securing utilities relocation, and assuming operation and maintenance of the completed project measures. Payment terms require the Sponsor to reimburse NRCS within 30 calendar days of billing. The agreement may be amended by mutual written consent or terminated by either party with 30 days' written notice. The arrangement is contingent upon Congressional appropriations and compliance with applicable Federal civil rights laws, regulations, and policies.
