COMBINED SYNOPSIS/SOLICITATION

For Soil Climate Analysis Network (SCAN) Stations Maintenance

USDA-NRCS

SUBJECT: Request for Quote-for 12FPC322Q0075

1. This letter is to advise you that the United States Department of Agriculture, Farm Production and Conservation Business Center on behalf of the USDA-NRCS Office intends to award a contract for Soil Climate Analysis Network (SCAN) Stations Maintenance Services.

Award is projected by 31 August 2022 and will be contingent upon the acceptance of quote submission of a fair and reasonable price at a fair market price. If you are interested, please see below:

PLEASE READ THIS NOTICE CAREFULLY AS IT CONSTITUTES THE ONLY NOTICE THAT WILL BE ISSUED

i. This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12,6 as supplemented with additional information included in this notice. This announcement constitutes the only solicitation, quotes being requested, and a written solicitation will not be issued.

ii.The solicitation number 12FPC322Q0075 is being issued as a Request for Quote (RFQ). The acquisition procedures at FAR Parts 12 & 13 are being utilized. The Government anticipates the award of a firm-fixed-price, commercial contract. Award will be made to the responsible quoter whose quote responds to the terms of this RFQ and is the best value of for the Government.

iii. This solicitation documents and incorporates provisions and clauses that are in effect through Federal Acquisition Circular (FAC ) 2022-06 Effective May 26, 2022.

iv. This solicitation is being conducted as a 100% small business set-aside. The North American Classification System Code (NAICS) is 811219; the size standard is $22.0M. For more information on size standards visit http://www.sba.gov/size. Active SAM registration is required to be awarded this contract and must remain active throughout the period of performance.

vi. Description of Services: The Contractor shall furnish the necessary personnel, supplies, materials, and equipment necessary to provide Soil Climate Analysis Network (SCAN) Stations Maintenance Services in accordance with the Statement of Work/Specifications, and safety standard.

vii. Date(s) and Place(s) of Delivery and Acceptance: This award is estimated to be for a base period with the period of performance of 31 August 2022 through 31 December 2023. Places of performance will be multiple locations please see Attachment 2 - Site Maintenance Punch List.

vii. The provision at 52.212-1, Instructions to Quoters-Commercial, applies to this acquisition. Quoters must read and follow the additional instructions contained within this solicitation to receive consideration.

52.212-1 Instructions to Offerors-Commercial Items.

As prescribed in 12.301(b)(1), insert the following provision:

Instructions to Quoters-Commercial Items (Nov 2021)

(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code(s) and small business size standard(s) for this acquisition appear elsewhere in the solicitation. However, the small business size standard for a concern which submits an quote in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(b) Submission of quotes. Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotes must show—

(1) The solicitation number;

(2) The time specified in the solicitation for receipt of quotes;

(3) The name, address, and telephone number of the quoter;

(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;

(5) Terms of any express warranty;

(6) Price and any discount terms;

(7) "Remit to" address, if different than mailing address;

(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoters shall complete electronically);

(9) Removed

(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and

(11) Removed.

(c) Removed.

(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotes. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during preaward testing.

(e) Multiple quoters. Quoters are encouraged to submit multiple quotes presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.

Each quote submitted will be evaluated separately.

(f) Issuance of Purchase Order. Your quotation should contain your best technical and price terms. The Contracting Officer may reject any or all quotes. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotes, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.”

(1) Quoters are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes or revisions are due.

(i) Any quote, modification, revision, or withdrawal of an quote received at the Government office designated in the solicitation after the exact time specified for receipt of quote is "late" and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition; and-

(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of quotes; or

(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of quotes and was under the Government’s control prior to the time set for receipt of quotes; or

(C) If this solicitation is a request for quotes it was the only quote received.

(ii) However, a late modification of an otherwise successful quote, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.

(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the quote wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.

(4) If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.

(5) Quotes may be withdrawn by written notice received at any time before the exact time set for receipt of quotes.

Oral quotes in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile quotes, quotes may be withdrawn via facsimile received at any time before the exact time set for receipt of quotes, subject to the conditions specified in the solicitation concerning facsimile quotes. An quote may be withdrawn in person by an quoter or its authorized representative if, before the exact time set for receipt of quotes, the identity of the person requesting withdrawal is established and the person signs a receipt for the quote.

(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate quotes and award a contract without discussions with quoters. Therefore, the quoter’s initial quote should contain the quoter’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received.

(h) Multiple awards. The Government reserves the right to issue multiple purchase order for different line items when advantageous to the government.

(i) Availability of requirements documents cited in the solicitation.

The Quoter shall enter, in the block with its name and address on the cover page of its quote, the annotation "Unique Entity Identifier" followed by the unique entity identifier that identifies the Quoter’s name and address. The Quoter also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Quoter to establish additional SAM records for identifying alternative EFT accounts (see FAR subpart 32.11) for the same entity. If the Quoter does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Government intends to evaluate quotes in response to this RFQ without discussions and will award to the responsible quoter whose quote, conforming to the RFQ, will be most advantageous to the Government, considering only price.

The Government may reject any or all quotes if such action is in the public interest and may accept other than the lowest priced quote.

Please provide or attach any additional information for any pricing rationale that you wish to be considered.

CONTRACTING OFFICER’S AUTHORITY

The Contracting Officer (CO) is the only person authorized to approve changes in any of the requirements of this contract. This authority remains solely with the CO. In the event that the Contractor effects any change at the direction of any person other than the CO, the change will be considered to have been made without authority and NO adjustment will be made in the contract price to cover any INCREASE in costs incurred as a result thereof.

CONTRACTING OFFICER’S REPRESENTATIVE

The Contracting Officer’s Representative (COR) is an individual designated in writing by the Contracting Officer (CO) to act as an authorized representative of the CO to perform specific contract administrative functions within the scope and limitations as defined by the CO in the COR’s appointment letter. This letter specifies the extent of the COR’s authority to act on behalf of the CO. The COR is not authorized to make any commitments or changes that will affect price, quality, quantity, delivery or any other term or condition of the contract. Any subsequent change to the COR or COR responsibilities will be confirmed, in writing, by the CO. A COR does not have the authority to and may never –

1. award, agree to, or execute any contract, contract modification, or notice of intent;

2. obligate, in any way, the payment of money by the Government;

3. make a final decision on any contract matter which is subject to the clause at FAR 52.233-1,Disputes; or

4. terminate, for any cause, the contractor’s right to proceed.

If the contractor does not receive a copy of the COR appointment letter, the contractor is required to request a copy of it from the CO prior to commencing work.

Individuals not designated in writing as a COR by the CO are not considered a COR and do not have the authority delegated to the COR. If the contractor considers any action or inaction by a COR, any other government employee (such as an inspector), or representative or agent of the government as a change to the contract terms and conditions, they must notify the contracting officer immediately and not proceed with any such change until approved by the contracting officer.

ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INVOICE PAYMENT PLATFORM (IPP)

Invoices must be submitted electronically through the U.S. Department of the Treasury’s Invoice Payment Platform System (IPP) or the Contractor must be willing to accept payment by Government purchase card.

The Contractor must use the IPP website (https://www.ipp.gov) to register, access, and use IPP for submitting invoices. Contractor assistance with enrollment can be obtained by calling (866) 973- 3131.

Invoices submitted by means other than IPP will not be accepted unless the Contracting Officer authorizes alternate procedures in writing.

452.224-70 Confidentiality of Information (Feb 1988)

(a) Confidential information, as used in this clause, means -

(1) information or data of a personal nature, proprietary about an individual, or (2) information or data submitted by or pertaining to an organization.

(b) In addition to the types of confidential information described in (a)

(1) and (2) above, information which might require special consideration with regard to the timing of its disclosure may derive from studies or research, during which public disclosure of primarily invalidated findings could create an erroneous conclusion which might threaten public health or safety if acted upon.

(c) The Contracting Officer and the Contractor may, by mutual consent, identify elsewhere in this contract specific information and/or categories of information which the Government will furnish to the Contractor or that the Contractor is expected to generate which is confidential.

Similarly, the Contracting Officer and the Contractor may, by mutual consent, identify such confidential information from time to time during the performance of the contract. Failure to agree will be settled pursuant to the “Disputes” clause.

(d) If it is established that information to be utilized under this contract is subject to the Privacy Act, the Contractor will follow the rules and procedures of disclosure set forth in the Privacy Act of 1974, 5 U.S.C. 552a, and implementing regulations and policies, with respect to systems of records determined to be subject to the Privacy Act.

(e) Confidential information, as defined in (a)

(1) and (2) above, shall not be disclosed without the prior written consent of the individual, institution or organization.

(f) Written advance notice of at least 45 days will be provided to the Contracting Officer of the Contractor's intent to release findings of studies or research, which have the possibility of adverse effects on the public or the Federal agency, as described in (b) above. If the Contracting Officer does not pose any objections in writing within the 45-day period, the Contractor may proceed with disclosure. Disagreements not resolved by the Contractor and Contracting Officer will be settled pursuant to the “Disputes” clause.

(g) Whenever the Contractor is uncertain with regard to the proper handling of material under the contract, or if the material in question is subject to the Privacy Act or is confidential information subject to the provisions of this clause, the Contractor shall obtain a written determination from the Contracting Officer prior to any release, disclosure, dissemination, or publication.

(h) The provisions of paragraph (e) of this clause shall not apply when the information is subject to conflicting or overlapping provisions in other Federal, State or local laws.

452.237-75 Restrictions against Disclosure (Feb 1988)

(a) The Contractor agrees, in the performance of this contract, to keep all information contained in source documents or other media furnished by the Government in the strictest confidence. The Contractor also agrees not to publish or otherwise divulge such information in whole or in part in any manner or form, or to authorize or permit others to do so, taking such reasonable measures as are necessary to restrict access to such information while in the Contractor's possession, to those employees needing such information to perform the work provided herein, i.e., on a "need to know" basis. The Contractor agrees to immediately notify in writing, the Contracting Officer, named herein, in the event that the Contractor determines or has reason to suspect a breach of this requirement.

(b) The Contractor agrees not to disclose any information concerning the work under this contract to any persons or individual unless prior written approval is obtained from the Contracting Officer. The Contractor agrees to insert the substance of this clause in any consultant agreement or subcontract hereunder.

452.246-70 Inspection and Acceptance (Feb 1988) Inspection and Acceptance (FEB 1988)

(a) The Contracting Officer or the Contracting Officer's duly authorized representative will inspect and accept the supplies and/or services to be provided under this contract. Work that, in the opinion of the CO, does not meet data quality Standards will be returned to the Contractor for correction. Inconsistencies/edits may be reviewed, resolved, and approved via communications.

Statement of Work (SOW) Attachment 1 for

Project: Soil Climate Analysis Network (SCAN) Maintenance

GENERAL INFORMATION

1.0 Scope: The United States Department of Agriculture (USDA) National Resources Conservation Service (NRCS) National Water and Climate Center (NWCC) operates and maintains the Soil Climate Analysis Network (SCAN) stations across the US, including Alaska, Hawaii, Puerto Rico and the US Virgin Islands, with a focus on U.S. agricultural areas. Currently, there are 210 SCAN stations that provide soil and climatic data in near real-time that are used for agricultural practices and climate analysis. In addition to the SCAN stations, the agency is currently involved with assisting tribes in the installation of Tribal SCAN (TSCAN) stations on lands across the US, focused on agricultural lands situated on Tribal lands in the U.S.

SCAN is an essential tool for assessing climatic conditions, carrying out precision agriculture and drought mitigation. The Under Secretary for USDA held a workshop in January 2020 to bring together other federal agencies in supporting SCAN as a tool with multiple applications that fits in with mission priorities. The network has generated widespread interest across government agencies and the data provide a unique representation of local, regional and national soil characterizations and hydrology. To accurately assess conditions, a long-term record is required for each site that spans decades, and therefore it is critical to properly maintain the current network while expanding the number of stations in areas with sparse data coverage.

2.0 Background: SCAN data collection station sites collect hourly information on soil moisture content and soil temperature at standard depths (2, 4, 8, 20, and 40 inches), air temperature, relative humidity, solar radiation, wind speed/ direction and liquid precipitation. Each station consists of a tower (typically 20 ft high), electronics box and soil probes. The sites utilize sensors for data collection and use primarily Cellular Telemetry, but in some cases, satellite or meteor burst radios. Sites are powered by 12-volt batteries that are charged by solar panels. Each site requires annual maintenance which includes changing out certain site components, maintaining site vegetation and making minor repairs. There are some sites that may require significant repairs that will require specialized experience and expertise related to electronics and the physical ability to climb towers and handle heavy and awkward loads (e.g., batteries, antennas and solar panels).

SCAN is the largest comprehensive soil moisture monitoring network in existence and the only broad-scale network established with the purpose of collecting soil climate (temperature and moisture) data. There are many requests for new SCAN stations all the time from federal partners and the NRCS States across the US. In addition, there are guidelines set down by the Chief of NRCS as outlined in

National Instruction 450-303-NI, 1st Ed., Amend. 1, Mar 2018) 303-1 – Guidance on Soil Climate Analysis Network (SCAN) Station Investment related to external requests for new SCAN stations.

CONTRACTOR REQUIREMENTS

3.0 Technical Requirements/Tasks:

• The Contractor shall perform all duties as prescribed in the SCAN site punch list to the standards defined by the SCAN Maintenance Manual.

4.0 Government Furnished:

• All SCAN Site components and replacement parts will be provided by the government. Field verification devices will also be provided by the government.

• The Contractor shall provide Field Technicians for continued maintenance of the NRCS SCAN network. The Field Technician shall be able to Climb ladders excavate holes, install sensors and equipment.

• The Field Technician shall have familiarity of electronics, preferably with background in Campbell Scientific dataloggers, telemetry, and scientific instrumentation. The work may take place in extreme environments mainly hot and humid conditions, but some sites and seasons may be on the cold extreme.

Work continues in rainy and windy conditions (if not unsafe). A current Driver’s license is required for this position.

Equipment and sensors that are identified as malfunctioning are expected to be replaced.

• Site maintenance must be completed within the maintenance windows listed on the punch list.

o Any work designated to be complete no later than (NLT) 4 months from the contract award date must be completed prior to any other work being started.

o If special circumstances arise for date of completion for any work, it must be discussed with and approved by SCAN staff.

• Random audit of work - Proof of checklist items will be required in the form of photos taken after the completion of work and emailed to SCAN staff, when requested.

o These are separate from photos required to complete Survey123 and must include photo proof that work has been completed for actions including proof of sensor level, sensor installation, vegetation management, sensor cleanliness and sensor validation check.

• Return shipping will be paid for by the contractor and must be coordinated with SCAN staff.

o All return items must be packaged with care and, where indicated, in accordance with the punchlist instructions.

o Ensure to label returned components with the site they were taken out of. Do not write on the component or box.
