Response to Questions Received to Date
Q1. The solicitation states “Due to COVID-19 concerns, the site visit will be done by teleconference on March 18, 2022 at 10:00 CT with pictures of the site posted to FBO.” Was the teleconference held on March 18, 2022, and if so, are there meeting minutes from the meeting? Also, we do not see the pictures on FBO (SAM.gov) that are mentioned about being posted. Will these be posted?
A1: The teleconference was held on March 18th but it appears there may have been some technical difficulties that prevented all interested parties from attending. In order to ensure potential bidders have an opportunity to inspect the site, an on-site visit. Interested contractors should plan to meet at the USDA Natural Resources Conservation Service Field Office at 100 Roberts Road in Liberty, MS at 10:00CT on April 19, 2022. Pictures of the sites are also attached for reference.
Additionally, the due date for bids is being extended to April 29, 2022 at 10:00CT.
Q2. The solicitation states “Bids and bid guarantees may only be submitted electronically due to COVID-19 restrictions.” How are the bids and bid guarantees supposed to be submitted electronically? Just simply scan in the documents and email them to your email address (guy.trampe@usda.gov), or this there some sort of secure site that the documents are to be uploaded to?
A2. Please follow the directions starting on page 45. Send by email to laureen.eipp@usda.gov (this is a change from the original solicitation): Please include the works Bid Submission and the solicitation number in the subject line. The Bid and Bid Bond can be two separate documents or combined as one. They both must be signed, and you must be able to see the Corporate Seal of Principal and Surety if required.
Q3. The solicitation states “A formal bid opening will be held virtually.” Question: How will this formal bid opening will be held virtually? Is there a site that the contractors can log into in order to view the bid opening online?
A3. Please refer to the instruction under PUBLIC BID OPENING PROCESS on page 46 of the solicitation package. You will only be able to hear the bid opening.
Q4. Bids are due: Apr 12, 2022 10:00 am CDT. Does this mean that if bids are due via email, that the email needs to be send prior to the date / time or the email needs to be received by you prior to the date / time? How can we confirm that you received it prior to the bid due date / time?
A4. Bids must to be received prior to or by the listed date and time for bid opening. The bid opening is being extended to April 29, 2022. An email confirmation will be send upon receipt of your bid. Please refer to SUBMISSION OF BIDS BY EMAIL instructions beingin gon page 45, specifically paragraph (g).
Q5: Who will be administering this contract and performing the onsite inspection(s)?
A5: The contract awarded will be a federal contract administered by the USDA Farm Production and Conservation Business Center (FPAC) on behalf of USDA Natural Resources Conservation Service (NRCS). Ms. Laureen Eipp is the Contracting Officer, and Mr. Norman Patterson, is the Contracting mailto:guy.trampe@usda.gov mailto:laureen.eipp@usda.gov
Officer Representative. There will also be Government appointment inspectors in site during construction.
Q6. Question: The bid schedule shows 600 CY of earthfill, while the drawings indicate 1100 CY earthfill for both sites. Please clarify.
A6. The quantities on the drawings are all correct. The Newman Road Site requires 100 cy of earthfill. Powell Road requires 1,000 cy of earthfill; which totals 1,100 cy. However, Powell Road requires 500 cy of excavation (as shown on drawing); which will be used for earthfill. As stated in CS 23.10.a.2, the earthfill shall be obtained from excavation areas. Consequently, subtracting the 500 cy of on-site earthfill from the required 1,100 cy: 1,100 cy – 500 cy = 600 cy of off-site earthfill needed. The 600 cy of off-site earthfill is identified in the bid schedule.
Q7. Is the project tax exempted?
A7. The government’s tax exempt status is not directly conveyed to the contractor. The following is an excerpt out of FAR Part 29.303 Application of State and local taxes to Government contractors and subcontractors.
“ (a) Prime contractors and subcontractors shall not normally be designated as agents of the Government for the purpose of claiming immunity from State or local sales or use taxes. Before any activity contends that a contractor is an agent of the Government, the matter shall be referred to the agency head for review. The referral shall include all pertinent data on which the contention is based, together with a thorough analysis of all relevant legal precedents.
(b) When purchases are not made by the Government itself, but by a prime contractor or by a subcontractor under a prime contract, the right to an exemption of the transaction from a sales or use tax may not rest on the Government’s immunity from direct taxation by States and localities. It may rest instead on provisions of the particular State or local law involved, or, in some cases, the transaction may not in fact be expressly exempt from the tax. The Government’s interest shall be protected by using the procedures in 29.101. “
