Question 1: The solicitation states that it is unrestricted, full and open competition. It also states the small business size standard for which is $39.5 million. Is there a size restriction or any other restrictions on the contractor's that will be allowed to participate?

Answer 1: The solicitation is unrestricted, full and open competition.

Question 2: Construction specification 5 - Pollution Control, 2. Material. - Material specification 592 is not provided in the current set of Specs?

Answer 2: Material specification 592 is attached and will be incorporated into the project specifications.

Permits - Could these permits be provided for contractors to review?

Answer 3: Copies of ADF&G Fish Habitat Permit and USACE NWP permit are attached. First bullet in CS- 5, Section 8.a.3 shall be deleted.

Question 4: Construction specification 9 - Traffic Control, 7. Items of work and construction details. 3. - It states no separate payment will be made for Traffic Control. If so why is there a bid item on the schedule for this?

Answer 4: This was an error. Please line out Bid Item 6, Traffic Control, on the bid schedule. It is a subsidiary item.

Question 5: Construction specification 10 - Water for Construction, 8. Items of work and construction details. 2. - Trucks shall be equipped with a means of accurately measuring the volume of water withdrawn and applied. Why if this is a subsidiary item?

Answer 5: We want to track the water volume used even though this is a subsidiary item.

Determination of water truck volume and reporting the number of loads withdrawn/utilized could be an acceptable method of tracking water use.

Question 6: Construction specification 11 - Removal of Water, 3 Dewatering the Construction Site. - Does the stream barb excavation work prior to placing Rip Rap need to be kept free of standing water and muddy conditions?

Answer 6: Dewatering of the stream barb foundations is not required. Rock riprap for revetment extension, rock riprap for stream barbs, and rockfill are allowed to be placed underwater if the underwater placement can be accomplished in accordance with contract requirements.

Question 7: Construction specification 61 - Rock Riprap, 8. Items of work and construction details. C. 6. - How will the remaining quantities of rock riprap be paid for? Payment methods basically refer to comparing neat line surfaces?

Answer 7: Payment will not be made on any remaining riprap quantities after the work is complete.

Amending last sentence in paragraph 4 on page 6 of 48 to read "Rock riprap and other quarry materials can be stockpiled in McGrath within the work limits at the designated Revetment Extension area and within the work limits at the designated Staging Area." Amending fourth sentence in paragraph 5 on page 6 of 48 to read "No set performance time is established for the production of riprap and other quarry materials and transport of those materials to McGrath other than all quarry materials obtained from the local quarry near McGrath must be stockpiled at the designated Revetment Extension area and designated Staging Area in McGrath no later than March 31, 2022."

Question 8: Material Specification 523 - Rock for Riprap 5. - Grading refers to rock conforming to specified grading limits after it has been placed and that grading tests must be performed. On page 6 of 48 it states the deadline for stockpiling includes all testing necessary to verify materials meet requirements. Won't the rock have to be removed from final placement to test and then placed again?

This seems counterproductive considering it will already have been tested prior to stockpiling.

Answer 8: The contractor shall perform Bid Item 10, Gradation Testing, Rock Riprap, on the stockpiled rock riprap. NRCS does not intend to require contractor to perform gradation testing of placed rock riprap but we reserve the right to require/perform such gradation tests if there is reason to believe the contractor's handling and placement methods are resulting in breakage or segregation of the riprap such that the in-place riprap materials no longer meet contract gradation requirements.

C - DESCRIPTION/SPECIFICATIONS

The village of McGrath is located in interior Alaska, approximately 220 miles northwest of Anchorage, with a population of about 325. McGrath is situated on the banks of the upper Kuskokwim River, at the confluence of the Takotna River. McGrath is a remote Alaska community not accessible by road and can only be reached via air or water transportation.

The McGrath EWP 2021 project seeks to stabilize eroding riverbank downstream of the existing riprap revetment. A series of four stream barbs will be constructed to stabilize the eroding bank. A riprap revetment extension will also be constructed upstream of the existing riprap revetment. The purpose of this revetment extension is to prevent flanking of the existing revetment due to continued bank erosion upstream.

There is a local source of rock material approximately 12 miles outside of McGrath, but this source is only accessible by unimproved road. This road is capable of neither supporting significant volumes of traffic nor any heavy loads necessary to transport rock materials from the quarry to McGrath. Based on previous experience in the area, contractors typically produce riprap when it fits into their work schedule and then transport the riprap or other quarry materials to McGrath during December-March timeframe when the unimproved road is frozen to such a degree that it can bear the heavy and repetitive loads without damage. NRCS makes no representation as to whether the local quarry is capable of producing construction materials meeting the requirements of the contract. It is also possible that the successful bidder may choose to barge rock riprap and other materials into McGrath. NRCS has not designated a source of the riprap or other construction materials.

It is anticipated that the successful bidder will mobilize to McGrath during the summer of 2021 and will begin producing rock riprap sometime between late summer 2021 and January 2022. It is further anticipated that the contractor will transport the rock riprap and other quarry materials to McGrath in the January-March 2022 timeframe, when the unimproved road is frozen to the degree it can handle the traffic. Rock riprap and other quarry materials can be stockpiled in McGrath within the work limits at the designated Revetment Extension area and within the work limits at the designated Staging Area.

Actual construction of the project work, including the revetment extension and the four stream barbs, is anticipated to occur sometime in the June-September 2022 timeframe. Actual notice-to-proceed will be issued by the Contracting Officer when conditions are suitable at the site to commence work.

Performance time is 90 calendar days for the actual construction work. No set performance time is established for the production of riprap and other quarry materials and transport of those materials to McGrath other than all quarry materials obtained from the local quarry near McGrath must be stockpiled at the designated Revetment Extension area and designated Staging Area in McGrath no later than March 31, 2022. This deadline includes all testing necessary to verify the materials meet contract requirements and measuring volumes to ensure adequate quantities of materials have been delivered.

Material Specification 592—Geotextile

1. Scope This specification covers the quality of geotextile, including geotextile for temporary silt fence.

2. General Requirements Fiber (thread and yarn) used in the manufacture of geotextile must consist of synthetic polymer composed of a minimum of 85 percent by weight polypropylene, polyester, polyamide, polyethylene, polyolefin, or polyvinylchloride. The fiber must be formed into a stable network of filaments retaining dimensional stability relative to each other. The geotextile must be free of defects such as holes, tears, and abrasions.

The geotextile must be free of any chemical treatment or coating that significantly reduces its porosity.

Fibers must contain stabilizers, inhibitors, or both to enhance resistance to ultraviolet light. Geotextile, other than that used for temporary silt fence, must conform to the requirements in tables 592–1 or 592–2, as applicable. Geotextile used for temporary silt fence must conform to ASTM D6461.

Thread used for factory or field sewing must be of a color contrasting to the color of the fabric and made of high-strength polypropylene, polyester, or polyamide material. It must be as resistant to ultraviolet light as the geotextile being sewn.

3. Classification There are two geotextile classifications, woven and nonwoven. Geotextile for temporary silt fence may be either woven or nonwoven. Slit film woven geotextile may not be used except for temporary silt fence.

Woven geotextiles are made from fabric that is formed by the uniform and regular interweaving of the threads or yarns in two directions. Woven fabrics must be manufactured from monofilament yarn formed into a uniform pattern with distinct and measurable openings, retaining their position relative to each other. The fabric must have a selvedge edge or otherwise be finished to prevent unraveling.

Nonwoven geotextiles are made from fabric that is formed by a random placement of threads in a mat and bonded by needle punching, heat bonding, or resin bonding. Nonwoven geotextile must have distinct but variable small openings, retaining their position relative to each other when bonded. The use of heat- or resin-bonded nonwovens is restricted as specified in note 2 of table 592-2.

4. Sampling and Testing The geotextile must conform to tables 592–1, 592–2, or ASTM D6461 as applicable for the product type shown on the label. Documentation described in either a. or b. below is required to verify the product meets the specified requirements:

a. Product properties as listed in the latest edition of the "Specifiers Guide," Geosynthetics (Industrial Fabrics Association International, 1801 County Road B, West Roseville, MN 55113-4061 or at http://www.geosindex.com), and that represent average roll values, are acceptable.

b. Test data from the geotextile production run for each of the specified tests listed in tables 592–1, 592– 2, or ASTM D6461, as applicable.

5. Shipping and Storage Each roll of geotextile must be labeled or tagged to clearly identify the brand, class, and the individual production run in accordance with ASTM D4873. The geotextile must be shipped and transported in rolls wrapped with a cover for protection from moisture, dust, dirt, debris, and ultraviolet light. The cover must be maintained undisturbed to the maximum extent possible before placement.

This is in response to your February 3, 2021, application for a Department of the Army (DA) permit, to discharge a total of 4367 cubic yards of clean rock fill into 0.45-acres of the Kuskokwim River in order to construct an extension of an existing riprap revetment and constructing four rock stream barbs for the purpose of protecting the eroding streambank of the Kuskokwim River. It has been assigned file number POA- 2021-00069, Kuskokwim River, which should be referred to in all future correspondence with this office. The project site is located at Latitude 62.954º N., Longitude -155.590º W. (center of the site); in the city of McGrath, Alaska.

DA authorization is necessary because your project will involve fill material into waters of the U.S. under our regulatory jurisdiction.

Based upon the information and plans you provided, we hereby verify that the work described above, which would be performed in accordance with the attached project plans, sheets 1 – 5, dated 3/4/2021 (Enclosure 1), is authorized by Nationwide Permit (NWP) No. 13, Bank Stabilization. Enclosed is a copy of the NWP No. 13 (Enclosure 2), as well as the Regional and General Conditions (Enclosures 3 and 4). These documents are also available on our website at:

www.poa.usace.army.mil/Missions/Regulatory/Permits. Regional Condition F, Maintenance of Hydrology Patterns, applies to your project. You must comply with all terms and conditions associated with NWP No. 13.

Further, please note General Condition 30 requires that you submit a signed certification to us once any work and required mitigation are completed. Enclosed is the form for you to complete and return to our office (Enclosure 5).

Unless this NWP is modified or revoked, it expires on March 18, 2022. If you commence or are under contract to commence this activity before the date that the 2017 NWPs are modified or revoked, you will have twelve (12) months from the date of

13. Bank Stabilization

Bank stabilization activities necessary for erosion control or prevention, such as vegetative stabilization, bioengineering, sills, rip rap, revetment, gabion baskets, stream barbs, and bulkheads, or combinations of bank stabilization techniques, provided the activity meets all of the following criteria:

a) No material is placed in excess of the minimum needed for erosion protection;

b) The activity is no more than 500 feet in length along the bank, unless the district engineer waives this criterion by making a written determination concluding that the discharge will result in no more than minimal adverse environmental effects (an exception is for bulkheads—the district engineer cannot issue a waiver for a bulkhead that is greater than 1,000 feet in length along the bank);

c) The activity will not exceed an average of one cubic yard per running foot, as measured along the length of the treated bank, below the plane of the ordinary high water mark or the high tide line, unless the district engineer waives this criterion by making a written determination concluding that the discharge will result in no more than minimal adverse environmental effects;

d) The activity does not involve discharges of dredged or fill material into special aquatic sites, unless the district engineer waives this criterion by making a written determination concluding that the discharge will result in no more than minimal adverse environmental effects;

e) No material is of a type, or is placed in any location, or in any manner, that will impair surface water flow into or out of any waters of the United States;

f) No material is placed in a manner that will be eroded by normal or expected high flows (properly anchored native trees and treetops may be used in low energy areas);

g) Native plants appropriate for current site conditions, including salinity, must be used for bioengineering or vegetative bank stabilization;

h) The activity is not a stream channelization activity; and

i) The activity must be properly maintained, which may require repairing it after severe storms or erosion events. This NWP authorizes those maintenance and repair activities if they require authorization.

This NWP also authorizes temporary structures, fills, and work, including the use of temporary mats, necessary to construct the bank stabilization activity. Appropriate measures must be taken to maintain normal downstream flows and minimize flooding to the maximum extent practicable, when temporary structures, work, and discharges, including cofferdams, are necessary for construction activities, access fills, or dewatering of construction sites.

Temporary fills must consist of materials, and be placed in a manner, that will not be eroded by expected high flows. After construction, temporary fills must be removed in their entirety and the affected areas returned to pre- construction elevations. The areas affected by temporary fills must be revegetated, as appropriate.

Notification: The permittee must submit a pre-construction notification to the district engineer prior to commencing the activity if the bank stabilization activity: (1) Involves discharges into special aquatic sites; or is in excess of 500 feet in length; or will involve the discharge of greater than an average of one cubic yard per running foot as measured along the length of the treated bank, below the plane of the ordinary high water mark or the high tide line. 32. Pre-Construction Notification

Note: To qualify for NWP authorization, the prospective permittee must comply with the following general conditions, as applicable, in addition to any regional or case-specific conditions imposed by the division engineer or district engineer.

Prospective permittees should contact the appropriate Corps district office to determine if regional conditions have been imposed on an NWP. Prospective permittees should also contact the appropriate Corps district office to determine the status of Clean Water Act Section 401 water quality certification and/ or Coastal Zone Management Act consistency for an NWP. Every person who may wish to obtain permit authorization under one or more NWPs, or who is currently relying on an existing or prior permit authorization under one or more NWPs, has

POA-2021-00069, NWP 13 Page 1 of 19 Enclosure 4 been and is on notice that all of the provisions of 33 CFR 330.1 through 330.6 apply to every NWP authorization. Note especially 33 CFR 330.5 relating to the modification, suspension, or revocation of any NWP authorization.

1. Navigation

a) No activity may cause more than a minimal adverse effect on navigation.

b) Any safety lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, must be installed and maintained at the permittee’s expense on authorized facilities in navigable waters of the United States.

c) The permittee understands and agrees that, if future operations by the

United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.

2. Aquatic Life Movements

No activity may substantially disrupt the necessary life cycle movements of those species of aquatic life indigenous to the waterbody, including those species that normally migrate through the area, unless the activity’s primary purpose is to impound water. All permanent and temporary crossings of waterbodies shall be suitably culverted, bridged, or otherwise designed and constructed to maintain low flows to sustain the movement of those aquatic species. If a bottomless culvert cannot be used, then the crossing should be designed and constructed to minimize adverse effects to aquatic life movements.

3. Spawning Areas

Activities in spawning areas during spawning seasons must be avoided to the maximum extent practicable. Activities that result in the physical destruction (e.g., through excavation, fill, or downstream smothering by substantial turbidity) of an important spawning area are not authorized.

4. Migratory Bird Breeding Areas

Activities in waters of the United States that serve as breeding areas for

5 . Shellfish Beds

No activity may occur in areas of concentrated shellfish populations, unless the activity is directly related to a shellfish harvesting activity authorized by NWPs 4 and 48, or is a shellfish seeding or habitat restoration activity authorized by

NWP 27.

6. Suitable Material

No activity may use unsuitable material (e.g., trash, debris, car bodies, asphalt, etc.). Material used for construction or discharged must be free from toxic pollutants in toxic amounts (see section 307 of the Clean Water Act).

7. Water Supply Intakes

No activity may occur in the proximity of a public water supply intake, except where the activity is for the repair or improvement of public water supply intake structures or adjacent bank stabilization.

8. Adverse Effects from Impoundments

If the activity creates an impoundment of water, adverse effects to the aquatic system due to accelerating the passage of water, and/or restricting its flow must be minimized to the maximum extent practicable.

9. Management of Water Flows

To the maximum extent practicable, the pre- construction course, condition, capacity, and location of open waters must be maintained for each activity, including stream channelization, storm water management activities, and temporary and permanent road crossings, except as provided below. The activity must be constructed to withstand expected high flows. The activity must not restrict or impede the passage of normal or high flows, unless the primary purpose of the activity is to impound water or manage high flows. The activity may alter the pre- construction course, condition, capacity, and location of open waters if it benefits the aquatic environment (e.g., stream restoration or relocation activities).

10. Fills Within 100-Year Floodplains

The activity must comply with applicable FEMA-approved state or local floodplain management requirements.

Heavy equipment working in wetlands or mudflats must be placed on mats, or other measures must be taken to minimize soil disturbance.

12. Soil Erosion and Sediment Controls

Appropriate soil erosion and sediment controls must be used and maintained in effective operating condition during construction, and all exposed soil and other fills, as well as any work below the ordinary high water mark or high tide line, must be permanently stabilized at the earliest practicable date. Permittees are encouraged to perform work within waters of the United States during periods of low-flow or no-flow, or during low tides.

13. Removal of Temporary Fills

Temporary fills must be removed in their entirety and the affected areas returned to pre-construction elevations. The affected areas must be revegetated, as appropriate.

14. Proper Maintenance

Any authorized structure or fill shall be properly maintained, including maintenance to ensure public safety and compliance with applicable NWP general conditions, as well as any activity-specific conditions added by the district engineer to an NWP authorization.

15. Single and Complete Project

The activity must be a single and complete project. The same NWP cannot be used more than once for the same single and complete project.

16. Wild and Scenic Rivers

a) No NWP activity may occur in a component of the National Wild and Scenic River System, or in a river officially designated by Congress as a ‘‘study river’’ for possible inclusion in the system while the river is in an official study status, unless the appropriate Federal agency with direct management responsibility for such river, has determined in writing that the proposed activity will not adversely affect the Wild and Scenic River designation or study status.

b) If a proposed NWP activity will occur in a component of the National Wild and Scenic River System, or in a river officially designated by Congress as a ‘‘study river’’ for possible inclusion in the system while the river is in an official study status, the permittee must submit a pre-construction

The district engineer will coordinate the PCN with the Federal agency with direct management responsibility for that river. The permittee shall not begin the NWP activity until notified by the district engineer that the Federal agency with direct management responsibility for that river has determined in writing that the proposed NWP activity will not adversely affect the Wild and Scenic River designation or study status.

c) Information on Wild and Scenic Rivers may be obtained from the appropriate Federal land management agency responsible for the designated Wild and Scenic River or Study River (e.g., National Park Service, U.S. Forest Service, Bureau of Land Management, U.S. Fish and Wildlife Service). Information on these rivers is also available at:

17. Tribal Rights

No NWP activity may cause more than minimal adverse effects on tribal rights (including treaty rights), protected tribal resources, or tribal lands.

18. Endangered Species

a) No activity is authorized under any NWP which is likely to directly or indirectly jeopardize the continued existence of a threatened or endangered species or a species proposed for such designation, as identified under the Federal Endangered Species Act (ESA), or which will directly or indirectly destroy or adversely modify the critical habitat of such species. No activity is authorized under any NWP which ‘‘may affect’’ a listed species or critical habitat, unless ESA section 7 consultation addressing the effects of the proposed activity has been completed. Direct effects are the immediate effects on listed species and critical habitat caused by the NWP activity. Indirect effects are those effects on listed species and critical habitat that are caused by the NWP activity and are later in time, but still are reasonably certain to occur.

b) Federal agencies should follow their own procedures for complying with the requirements of the ESA. If pre- construction notification is required for the proposed activity, the Federal permittee must provide the district engineer with the appropriate documentation to demonstrate compliance with those requirements. The district engineer will verify that the appropriate documentation has been submitted. If the appropriate documentation has not been submitted, additional ESA section 7 consultation may be necessary for the activity and the respective federal agency would be responsible for fulfilling its obligation under section 7 of the ESA.

c) Non-federal permittees must submit a pre-construction notification to the district engineer if any listed species or designated critical habitat might be affected or is in the vicinity of the activity, or if the activity is located in designated critical habitat, and shall not begin work on the activity until notified by the district engineer that the requirements of the ESA have been satisfied and that the activity is authorized. For activities that might affect Federally-listed endangered or threatened species or designated critical habitat, the pre-construction notification must include the name(s) of the endangered or threatened species that might be affected by the proposed activity or that utilize the designated critical habitat that might be affected by the proposed activity.
