SOLICITATION NOTICE FOR REQUEST FOR QUOTATION (RFQ): FIRM-FIXED PRICE
requirement for property record searches for NRCS Easement Programs - Closed Easements - Property Record Searches in the following States of Mississippi (MS), Rhode Island (RI), Wyoming (WY), and South Carolina (SC).
SYNOPSIS. This is a combined synopsis/solicitation for commercial services prepared in accordance with the format in Subpart 12.6, as supplemented with additional information included with this notice. This announcement constitutes the only solicitation. Quotes are being requested and a written solicitation will not be issued.
The solicitation number 12FPC221Q0050 is being issued as a Request for Quotation (RFQ) and is being conducted a 100% total small business set aside. The North American Classification System Code is 541191 Title Abstract and Settlement Offices with a size standard of $12.0 million average annual income. This RFQ incorporates provisions and clauses that are in effect through Federal Acquisition Circular 2021-06 effective July 12, 2021 which can be found at http://www.acquisition.gov/far/index.html under the current FAR section. This requirement will be awarded as a commercial item, firm fixed price purchase order under the procedures at FAR Parts 13, Simplified Procedures.
OBJECTIVE.
The USDA Natural Resources Conservation Service (NRCS) requires the services of a Title Company to obtain copies of certain real property records related to real property interests held by the United States in MS, RI, WY, and SC; therefore, is issuing a Request for Quote. NOTE:
See attached Statement of Work (SOW) for full details.
WORK TO BE PERFORMED BY CONTRACTOR. Contractor will be provided with a list of up to 2100 real property records in MS, RI, WY, and SC. Note. See attached Statement of Work (SOW) for details.
TIME FRAMES/DATE. Within 5 working days of notice of award NRCS will schedule a kickoff meeting with the vendor and CO or CS. Within 15 days of the kickoff meeting NRCS will provide a list of real property records for each state. Within 60 days after receipt and acceptance of the list, noted above, from NRCS, the vendor will deliver electronic copies of each of the listed documents as requested by the government. The electronic files must each be saved as individual records/files referenced in Section V. Description of Services. (Refer to the Attached SOW)
The Government intends to place a Single, Firm-Fixed Price contract without discussions.
Therefore, offerors should submit their best quote up front. Do not assume you will be able to revise your offer.

PREPARATION/SUBMISSION OF OFFERS
Submission of Offers to read as follows: (1) the solicitation number; (2) the name, address, and telephone number of the quoter (3) the price (4) details of services to be provided for requirement identified with pricing. (6) quotes shall be submitted on company letterhead, with DUNS number, CAGE code, company Name, Address and POC included and sent via email to Erica Robinson, Contract Specialist, email: Erica.Robinson@usda.gov, and Contracting Officer, email: Nancy.Harris@usda.gov, no later than September 16, 2021, 1:00 PM EST. The quoter shall provide the NRCS with a Firm Fixed Price quote that is in accordance with this solicitation.

Potential quoters are advised that they are responsible for obtaining and acknowledging any and all amendments to the solicitation. The Government will issue a purchase order resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The Government's objective is to obtain the highest technical quality considered necessary to achieve the project objectives at a fair and reasonable price which represents the best value to the Government. The Government will issue a firm fixed price purchase order to the vendor whose quote is determined to be the lowest price technically acceptable to the Government. The lowest price technically acceptable determination will be made on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for non-cost factors. The Government will evaluate all quotes in accordance with the factors and criteria established in the solicitation.
The criteria below provide the basis upon which each evaluation will be based and are intended to ensure that the evaluation will be a structured process employing equitable measures. FAR Part 15 procedures do not apply to this RFQ. Award will be made to the responsible quoter whose quote is considered the most advantageous to the Government, price and other factors considered.
When conducting the evaluation, the Government may use data included by quoters in their quotes.
The Government reserves the right to use data obtained from other sources while conducting its evaluation. Each quoter is responsible for ensuring that the information provided is thorough, accurate, and complete.

Factor 1. Qualifications:
Vendor is responsible for having a current knowledge of the requirements of state law in connection with searching real estate transactions. The Contractor must be on the United States Attorney General’s list of approved companies and must comply with all state laws.
Required: Provide Resumes of key personnel reflecting knowledge of requirements and confirmation of United States Attorney General’s list of approved companies.
Evaluation Criteria/Methodology:
• Proof of being on the United States Attorney General’s list of approved companies will be a go/no go factor.
• Ratings will be based on depth and breadth of key personnel experience of requirements and state laws.
Factor 2: Prior Experience 2.1: Vendor must provide information on three reference contracts demonstrating experience within the past 36 months for title work that primarily deals with federally owned property, conservation or like easements within the subject area.
This should be a summary to include:
• County or Counties
• Scale of the project
• Deliverable for project
• Primary Contact for Reference
• Was project due date achieved?
Evaluation Criteria/Methodology: Ratings will be based on depth and breadth of experience. This evaluation will result in an assessment of the quoter’s probability of meeting the solicitation requirements, based on prior experience.
Quoters are advised that the Government may use all data provided by the Quoter in this quote and data obtained from other sources, including, but not limited to, other USDA contracts and information from Government repositories (e.g., CPARS, PPIRS, etc.). Past Performance information on contracts not listed by the quoter, or that of planned subcontractors, may also be evaluated. The Government may contact references provided by the quoter, as well as any other source it identifies, and information received may be used in the evaluation.
Factor 3: Price Submission Requirements: Quotes shall be submitted on company letterhead, with DUNS number, CAGE code, company Name, Address and POC included.
Evaluation Criteria/Methodology: The Government anticipates that adequate price competition will establish a fair and reasonable price. However, if the Government does not receive adequate price competition, it will evaluate price quotes to ensure price reasonableness of the services being provided to the Government, considering the specific terms and conditions and relevant practices.
Each price quote will be evaluated but will not be assigned a rating. The evaluation of the price quote will include accuracy, completeness, and reasonableness, In the event of a mathematical error, the unit price takes precedence over the extended price.
CONTRACT CLAUSES
Offerors are required to complete the provision at 52.212-3, Offeror Representations and Certifications—Commercial Items (MAR 2020). This must be completed at the System for Award Management, www.sam.gov and the registration be in an “Active” status.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records-Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)

AGAR 452.224-70 Confidentiality of Information (FEB 1988)
(a) Confidential information, as used in this clause, means --
(1) Information or data of a personal nature, proprietary about an individual or (2) information or data submitted by or pertaining to an organization.
(b) In addition to the types of confidential information described in (a)(1) and (2) above, information which might require special consideration with regard to the timing of its disclosure may derive from studies or research, during which public disclosure of primarily invalidated findings could create an erroneous conclusion which might threaten public health or safety if acted upon.
(c) The Contracting Officer and the Contractor may, by mutual consent, identify elsewhere in this contract specific information and/or categories of information which the Government will furnish to the Contractor or that the Contractor is expected to generate which is confidential.
Similarly, the Contracting Officer and the Contractor may, by mutual consent, identify such confidential information from time to time during the performance of the contract. Failure to agree will be settled pursuant to the "Disputes" clause.
(d) If it is established that information to be utilized under this contract is subject to the Privacy Act, the Contractor will follow the rules and procedures of disclosure set forth in the Privacy Act of 1974, 5 U.S.C. 552a, and implementing regulations and policies, with respect to systems of records determined to be subject to the Privacy Act.
(e) Confidential information, as defined in (a)(1) and (2) above, shall not be disclosed without the prior written consent of the individual, institution or organization.
(f) Written advance notice of at least 45 days will be provided to the Contracting Officer of the Contractor's intent to release findings of studies or research, which have the possibility of adverse effects on the public or the Federal agency, as described in (b) above. (g) Whenever the Contractor is uncertain with regard to the proper handling of material under the contract, or if the material in question is subject to the Privacy Act or is confidential information subject to the provisions of this clause, the Contractor shall obtain a written determination from the Contracting Officer prior to any release, disclosure, dissemination, or publication.
(h) The provisions of paragraph (e) of this clause shall not apply when the information is subject to conflicting or overlapping provisions in other Federal, State or local laws.
