Agricultural Conservation Easement Programs

SOLICITATION # 12FPC125Q0003

AMENDMENT 0002

Amendment 0001 provides amended solicitation and implements Government responses to questions.

1. Question 1: Can you confirm if prior title work on conservation easements from outside Kansas is acceptable for meeting the technical capability requirement?

Response 1: Yes. Work on conservation easements in any state is acceptable, see update to M.1.2.2.1.1.

2. Question 2: For proof of experience, are redacted examples of completed easement work acceptable if the clients' details cannot be shared for confidentiality?

Response 2: Yes. Redacted examples will be sufficient, see update to M.1.2.2.1.1.

3. Question 3: If we partner with a Kansas-licensed title company, does that satisfy the proof of a Kansas license requirement, or must the prime contractor hold this license?

Response 3: Prime contractor must be a Kansas-licensed title company, see M.1.2.2.1.2.

4. Question 4: Is there flexibility in the 15-business-day deadline for Title Commitments and Preliminary Title Searches if unexpected delays (e.g., from county offices) occur?

Response 4: Yes, flexibility is available, see update to C.5.1.4.

5. Question 5: How should we handle optional costs like photocopies, recording fees, and credit card processing? Should these be included as separate line items or rolled into a total cost?

Response 5: Recording fees should be identified in row 20 of Price Schedule and Credit card processing fees in cell F31. Any other fees should be rolled into costs for pertinent phase.

6. Question 6: Does the government require any specific discount structure in the pricing schedule, or is it acceptable to provide standard commercial rates?

Response 6: No discount structure is required.

7. Question 7: Can you clarify what would be deemed "materially unbalanced pricing"? Are there any specific thresholds or benchmarks we should avoid?

Response 7: Materially unbalanced pricing is deemed as prices for certain items that are significantly lower than expected while other items are priced significantly higher than expected. No thresholds or benchmarks are available.

8. Question 8: Are the Title Commitment Updates (after survey changes) priced per occurrence or included in the original Title Commitment pricing?

Response 8: Title commitment update is priced separately from preliminary title search.

9. Question 9: Can you confirm that technical acceptability will be evaluated only on meeting the listed qualifications, with no additional preference for experience or past performance beyond the minimum?

Response 9: Technical acceptability will be determined based on meeting requirements in M.1.2.2.1.

10. Question 10: How will the pricing for Title Insurance Premium Rates be evaluated (e.g., is it based on actual quotes or estimates)?

Response 10: See M.1.2.1 which states, “Lowest priced quote will be determined by adding estimated totals for all five (5) years and quantity of one (1) of each base title insurance premium rate”

11. Question 11: Are the listed estimated quantities for Preliminary Title Searches, Title Commitments, and Closings (9, 5, 6, etc.) fixed, or can they increase during the BPA term?

Response 11: Quantities are not fixed and actual BPA Calls may be different than estimated quantities.

12. Question 12: In case the property boundaries or easement legal descriptions change after the initial search, will NRCS provide updated guidance promptly? How will additional work be priced?

Response 12: Any changes to boundaries will not impact original title search area.

13. Question 13: Is there a specific format or software required for delivering final recorded deeds and curative documents, or will standard PDF formats be acceptable?

Response 13: Standard Portable Document Format (PDF) is acceptable.

14. Question 14: During contract execution, will the primary contact for resolving technical issues be the Contracting Officer's Representative (COR) or the Easement Program Coordinator?

Response 14: Both will be included in all correspondence.

15. Question 15: Are there any additional conflict-of-interest provisions beyond what is listed that we should be aware of (e.g., ownership interest in third-party title companies)?

Response 15: No.

16. Question 16: Are there any additional attachments, appendices, or exhibits other than “A” and “B”?

Response 16: No.
