Q&A #1
Q: I am reaching out to see if you can provide additional information for bidding the Scenic Byway Creek Road Repairs project. Specifically, your process for submittal of the electronic bid bond, is there a program or link for us to upload and verify our bond? What electronic bid providers do you accept, is Surety2000 acceptable? We also have been unable to locate a checklist or detailed list of required documents to be submitted with our bid package.
A: There is no program that you need to use to submit your information – just please send to the email address stated in the solicitation (Kelly.ollivant@usda.gov). I can accept any bids that are in Microsoft Office format (Word, Excel) or Adobe PDF documents.
No checklist was included with the solicitation, but all documents required for bid submission are described within the solicitation. The list includes:

Q: Does Chip seal require a Fog Seal?
A: No, see Attachment J.2 Forest Service Supplemental Specification 407 and table 407.2 for details.
Q: How wide is the road?
A: The road is 22 feet wide for much of the project, although there may be a few areas where the road narrows for a few feet. See “Typical Cross Section” in Attachment J.3 Drawings for Phase 2 of Scenic Byway Creek Fire Road Repair.
mailto:Kelly.ollivant@usda.gov
Q: How many SF of Chip Seal in Parking areas?
A: See notes section in Attachment J.3 Drawings for Phase 2 of Scenic Byway Creek Fire Road Repair. Mile High Parking Area is approximately 2,170 square yards and Arch Rock is approximately 240 square yards.
Q: For chip seal how many SQ feet of shoulders for 2nd coat?
A: The shoulder’s width varies, but vendors can assume approximately 1 foot shoulder on each side of road for estimating purposes.
Q: Chip Seal is calculated by the SY per coat. With snow on the ground, it’s going to be tough to measure.
A: Interested vendors were advised to visit site as soon as possible prior to snow accumulating on the ground. Drawings and estimates are provided to determine quantities for each item. See FAR clause 52.211-18 Variation in Estimated Quantity (APR 1984) for equitable adjustment for actual quantity of items varying more than 15% above or below the estimated quantity.
Q: I wanted to see if there is going to be an extension on this project due to weather conditions. The solicitation states that some of the roadwork is located at elevations of over 8000ft.
A: The Forest Service does not currently anticipate an extension of this project due to weather conditions. The construction work is anticipated to begin in April, 2023, depending on snow melt and conditions. The construction period of performance for this project is anticipated to be 60 calendar days once the Notice to Proceed for construction work.
Q: The IFB currently contains a clause which states, “52.236-1 Performance of Work by the Contractor (APR 1984): The Contractor shall perform on the site, and with its own organization, work equivalent to at least ____51___ percent of the total amount of work to be performed under the contract. This percentage may be reduced by a supplemental agreement to this contract if, during performing the work, the Contractor requests a reduction and the Contracting Officer determines that the reduction would be to the advantage of the Government.”
However, CFR 125.6 states, “125.6(a)(3): General. In order to be awarded a full or partial small business set-aside contract with a value greater than the simplified acquisition threshold (as defined in the FAR at 48 CFR 2.101), an 8(a) contract, an SDVO SBC contract, a HUBZone contract, or a WOSB or EDWOSB contract pursuant to part 127 of this chapter, a small business concern must agree that: In the case of a contract for general construction, it will not pay more than 85% of the amount paid by the government to it to firms that are not similarly situated. Any work that a similarly situated subcontractor further subcontracts will count towards the 85% subcontract amount that cannot be exceeded. Cost of materials are excluded and not considered to be subcontracted.
