Section C - Description of Services
Performance Work Statement
San Bernardino National Forest Surveys for California Spotted Owls
1.1 Purpose
Purpose of the contract is to determine the presence/absence and reproductive status of Forest
Service Sensitive California spotted owls (CASPO) in pre-identified areas of suitable habitat on the San Bernardino National Forest (SBNF) during the 2020, 2021, 2022, 2023, and 2024 breeding seasons. This information will be used by the SBNF for project planning and for contributing the long-term dataset of occupancy and reproduction of this species on the SBNF.
1.2 Contract Scope
The contractor will perform surveying, monitoring, and related activities of California Spotted
Owl Territories on the San Bernardino National Forest during the 2020 breeding season, in compliance with the contract terms, specifications, and provisions. This includes furnishing labor, equipment, supervision, transportation, operating supplies, and incidentals not otherwise provided by the government.
To address the possible variance in work during Option Years, territories to be surveyed would be known prior to exercising the option year and any increase or decrease will be agreed by both parties. Survey methods would be the same as described in this work statement.
2.0 PROJECT AREA AND LOCATION
All contract areas are located on the San Bernardino National Forest. The territories are located in the San Jacinto, San Bernardino and San Gabriel Mountains.
3.0 ACCESS
All work areas may be reached by driving on standard Forest Service roads, by driving on four-wheel drive roads, and/or by walking. Walking distances will vary by territory location and presence of owls. The Government will not provide special maintenance or snowplowing to keep roads open. The Government will provide gate keys to the contractor, if needed, to be returned upon completion of work. Contractor will be responsible for securing permissions across privately-owned lands, where necessary.
4.0 REQUIREMENTS AND LIMITATIONS
4.1 Equipment
Contractor will supply all equipment necessary for protocol surveys as listed described in Exhibit
7.5. This equipment includes but is not limited to: vehicles, USGS topo maps, equipment to play and record calls, binoculars, field guides, GPS units, survey forms, clipboard and permanent waterproof ink pen and aerial photographs.
4.2 Surveyor Qualifications
Proposed surveyors must provide at least three references with phone numbers or email of well-known and accomplished birders who can verify the surveying biologist’s knowledge of CASPO field biology and expertise in surveying for these species. If expertise cannot be verified, bids will not be considered.
4.3 Pre-Work Meeting and Coordination
A pre-work meeting with the SBNF wildlife biologists, and Contracting Officer’s Representative
(COR) at the Supervisor’s Office in San Bernardino, CA, will be mandatory.
Unless otherwise stated, the Contractor’s project leader shall communicate with the COR first.
The COR will relay requests/information to Forest Service personnel and will inform the
Contractor as to when they can contact Forest Service specialists without going through the
COR.
5.0 CALIFORNIA SPOTTED OWL PROTOCOL SURVEYS
5.1 Methods
The work to be performed consists of monitoring California spotted owl territories on the San
Bernardino National Forest. The surveys will determine occupancy status (occupied vs.
unoccupied), nesting status (nesting vs. non-nesting), and reproductive success (fledging success) for each territory. Nest sites will be mapped, photographed, and GPSed for each territory if nests are located. Nest trees will be measured, identified by species, and marked with white paint and a “wildlife tree” tag (provided by the SBNF). Roost locations or juvenile sightings will also be recorded and GPS coordinates provided. All data must be UTM Zone 11
North datum NAD83 (specifically referred to as WKID:26911 EPSG). A final report will be completed for each year.
Spotted Owl Surveys for presence/absence and reproduction on previously-identified spotted owl territories in areas specified by the Forest Service. Protocol-level surveys are to be done according to Forest Service Region 5 California Spotted Owl Survey Protocol that involves a minimum of 6 presence/absence surveys per territory and a minimum of 4 reproductive surveys at all territories occupied by spotted owls. Reproductive surveys will include both nesting status surveys and reproductive success surveys. Nesting status surveys will focus on identifying nest sites early in the nesting season as specified in the R5 Protocol.
In future option years, some territories may be surveyed using a partial protocol method. A total of three surveys will be performed. The partial protocol is to include 3 presence/absence visits during the protocol window for protocol presence/absence surveys. If owls are detected during either of the first two visits, the next visits would be reproductive surveys, conducted during the protocol window for reproductive surveys, including the walk-in to locate the nest tree. If no reproduction detected during reproductive surveys, no further surveys are required. If no owls are detected during the presence/absence surveys, or if animals are detected on the third presence/absence survey, no further visits are required.
In 2020, 94 territories are to be surveyed to protocol and 0 territories are to be surveyed in accordance with the partial protocol guidance. See Exhibit 7.2.
Work is to be performed only by qualified spotted owl surveyors with previous experience.
Contractor will also provide general consulting regarding habitat mapping, history of survey information, or other information regarding current or historical status of California spotted owls on the San Bernardino National Forest.
Work is to proceed in mid-March (exact date may vary depending on access due to winter conditions).
5.2 Survey Documentation
Document surveys in the following manner:
a. A CASPO Daily Log as provided in Exhibit 7.6. If no birds are found, the forms must still be completed.
b. Completed NRM Wildlife Data Form – Wildlife Observation Tab (Exhibit 7.8). This tab must include the list of animals observed during each survey that meet one or more of the following: 1) target species – CASPO; 2) Forest Service Sensitive or SBNF Watchlist wildlife species; 3) any other federally- or state-listed wildlife species, and 4) wildlife sited of interest observed including raptor nests, animal dens, breeding sites, etc.; 5) non-native plants or animals. ii. Embed representative photos of occupied habitat and nest sites into the written report.
iii. Summary of findings (survey efforts, occupancy status, nesting status, and reproductive status for each territory).
iv. Nest tree information (species, dead/living, height, diameter-at-breast-height, nest type, GPS coordinates of tree, etc.).
v. Where surveys are conducted in areas recently impacted by fire, provide a summary of post-fire habitat conditions for each fire-affected territory and an assessment of whether near-future occupancy surveys are warranted.
vi. Incidental species list and locations for all other wildlife species noted in the area (including common species).

(6) The maximum per diem rates referenced in subparagraph (a)(2) of this subsection generally would not constitute a reasonable daily charge --
(i) When no lodging costs are incurred; and/or
(ii) On partial travel days (e.g., day of departure and return). Appropriate downward adjustments from the maximum per diem rates would normally be required under these circumstances. While these adjustments need not be calculated in accordance with the Federal Travel Regulation or
Joint Travel Regulations, they must result in a reasonable charge.
(7) Costs shall be allowable only if the following information is documented --
(i) Date and place (city, town, or other similar designation) of the expenses;
(ii) Purpose of the trip; and
(iii) Name of person on trip and that person’s title or relationship to the contractor.

(b) Airfare costs in excess of the lowest priced airfare available to the contractor during normal business hours are unallowable except when such accommodations require circuitous routing, require travel during unreasonable hours, excessively prolong travel, result in increased cost that would offset transportation savings, are not reasonably adequate for the physical or medical needs of the traveler, or are not reasonably available to meet mission requirements. However, in order for airfare costs in excess of the above standard airfare to be allowable, the applicable condition(s) set forth above must be documented and justified.
(c)
(1) “Cost of travel by contractor-owned, -leased, or -chartered aircraft,” as used in this paragraph (c ), includes the cost of lease, charter, operation (including personnel), maintenance, depreciation, insurance, and other related costs.
(2) The costs of travel by contractor-owned, -leased, or -chartered aircraft are limited to the allowable airfare described in paragraph (b) of this section for the flight destination unless travel by such aircraft is specifically required by contract specification, term, or condition, or a higher amount is approved by the contracting officer. A higher amount may be agreed to when one or more of the circumstances for justifying higher than allowable airfare listed in paragraph (b) of this section are applicable, or when an advance agreement under subparagraph (c)(3) of this section has been executed. In all cases, travel by contractor-owned, -leased, or -chartered aircraft must be fully documented and justified. For each contractor-owned, -leased, or -chartered aircraft used for any business purpose which is charged or allocated, directly or indirectly, to a Government contract, the contractor must maintain and make available manifest/logs for all flights on such company aircraft. As a minimum, the manifest/log shall indicate --
(i) Date, time, and points of departure;
(ii) Destination, date, and time of arrival;
(iii) Name of each passenger and relationship to the contractor;
(iv) Authorization for trip; and
(v) Purpose of trip.
(3) Where an advance agreement is proposed (see 31.109), consideration may be given to the following:
(i) Whether scheduled commercial airlines or other suitable, less costly, travel facilities are available at reasonable times, with reasonable frequency, and serve the required destinations conveniently.
(ii) Whether increased flexibility in scheduling results in time savings and more effective use of personnel that would outweigh additional travel costs.
(d) Costs of contractor-owned or -leased automobiles, as used in this paragraph, include the costs of lease, operation (including personnel), maintenance, depreciation, insurance, etc. These costs are allowable, if reasonable, to the extent that the automobiles are used for company business. That portion of the cost of company-furnished automobiles that relates to personal use by employees (including transportation to and from work) is compensation for personal services and is unallowable as stated in 31.205-6(m)(2).
