SOLICITATION PROVISIONS

The Solicitation Provisions are for solicitation purposes only. They will be physically removed from any resultant award, but will be deemed to be incorporated by reference in the award.

52.212-1 -- Instructions to Offerors -- Commercial Items (OCT 2018)

A. To assure timely and equitable evaluation of the proposal, the offeror must follow the instructions contained herein. The proposal must be complete, self-sufficient, and respond directly to the requirement of this solicitation. Offerors are required to meet all solicitation requirements, including terms and conditions, and representations and certifications. Failure to meet a requirement may result in an offer being ineligible for award. Offerors must clearly identify any exception to the solicitation terms and conditions and provide complete accompanying rationale.

B. Submission of Offers. Responses shall include the following:

C. General Information:

• This solicitation is issued as a Request for Quotation (RFQ), for a firm fixed price contract. All responsible sources may submit a quotation in response to this solicitation, which shall be considered.

• The RFQ due date for proposal is on or before 3:00 pm Pacific Time, April 9th, 2019. Quotes must be submitted via email to the Contracting Officer at alicia.hawkins@usda.gov.

• Invoices must be submitted electronically through the Department of Treasury’s Invoice Processing Platform (IPP) at https://www.ipp.fms.treas.gov/login/IPPLogon_Index.htm

• Period of Acceptance: The offeror agrees to hold its offer firm for 90 calendar days from the date specified for receipt.

52.212-2 -- Evaluation -- Commercial Items (OCT 2014)

EVALUATION FACTORS

The government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(i) Technical. Offerors may provide a technical capability statement, resumes and/or list of technical reports that address the following:

• Demonstrated experience in auditing Unit Collection Officers, Collection Officers, Property

Custodians, and Imprest Cashiers within the Forest Service; or other Federal or commercial land management agencies.

• Demonstrated experience and understanding of the Point of Sale System (POSS); Natural Resource Management (NRM), and Timber Information Manager (TIM) systems.

• Demonstrated experience in auditing the collections process; to insure permits are accounted for and reconciled between the POSS, NRM, and TIM systems.

• Demonstrated experience regarding the safekeeping of government funds, adequate records are being maintained, adequate safekeeping facilities, and that funds are transmitted according to established frequencies.

• Demonstrated ability to produce high-quality, detailed reports; especially for unusual audits situations where there is a discovery of theft, fraud, or abuse.

• Capacity to expedite and complete audits and reporting according to schedule.

Rating Definition

Outstanding Proposal exceeds requirements and demonstrates an exceptional approach and/or understanding of the requirements. The proposal contains multiple strengths and no deficiencies.

Good Proposal substantially meets requirements and indicates a thorough approach and/or understanding of the requirements. Proposal contains at least one strength and no deficiencies.

Acceptable Proposal meets requirements and indicates an adequate approach and/or understanding of the requirements. Proposal has no strengths or deficiencies.

Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach or understanding of the requirements.

Unacceptable Proposal does not meet requirements and contains one or more deficiencies.

(ii) Past Performance (include recent & relevant contracts). The Government will evaluate the quality and extent of offeror's performance deemed relevant to the requirements of this solicitation. The Government will use information submitted by the offeror and other sources such as other Federal Government offices and commercial sources, to assess performance. Provide a list of no more than five (5), of the most relevant contracts performed for Federal land management agencies and commercial customers within the last three (3) years. Relevancy definitions are as follows:

Somewhat Relevant

Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.

(iii)Price (The degree of importance of the price will increase with the degree of equality of the quotes in relation to the other factors on which selection is to be based, or when the price is so significantly high as to diminish the value of the technical superiority to the Government). Include cost breakdown by proposed labor category, hourly rate, and travel (if applicable).

When combined, the non-price factors are significantly more important than the price. The Government reserves the right to make price/non-price trade-offs that are in the best interest and to the advantage of the Government.

BASIS FOR CONTRACT AWARD

Award may not necessarily be made to the Offeror submitting the lowest quote. The Government reserves the right to make price/non-price trade-offs that are in the best interest and to the advantage of the Government. Award may be made without further discussions. Offer should be submitted initially on the most favorable terms, from a price and technical standpoint, which the offeror can submit to the Government. However, the Government may, after evaluation of offers, conduct further oral or written discussions as appropriate.

A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there negotiations after its receipt, unless a written notice of withdrawal is received before award.

STATEMENT OF WORK

Background:

This contract will provide for the required annual audits for collection officers located within Region 5.

Purpose/Scope of the Contract:

The purpose of this Contract is to perform required audits of Collection Officers (Accountable Officers) within Region 5.

The contractor will be required to travel to the worksite of the Accountable Officer. The locations of the Accountable Officers is shown on attachment Exhibit B.

The schedule of audits will be further defined by the contractor in their Performance Work Statement (PWS).

Performance Objectives/Technical Requirements:

All Accountable Officers shall be audited on an annual basis.

Audits conducted in accordance with the following FS policy:

The offeror will provide, as a part of the Performance Work Statement (PWS), their process of ensuring their employees are oriented and retain the level of expertise to perform the requirements of the contract.

The end result of this contract is to have ensured that all Accountable Officers have received an annual audit.

IAW the above policies and at a minimum the Contractor shall:

-Maintain a list of Accountable Officers and their annual audit statuses -Update a list of Accountable Officers as needed -Conduct a 30-day audit of new Accountable Officers -Conduct audit(s) at termination of Accountable Officers (permanent employees only)

The contractor shall meet with the AA & their supervisor to provide the results of the audit. The final report will contain the signatures of the AA and auditor.

The contractor shall provide the results of the audits to the COR on a quarterly basis at a minimum.

Contact COR immediately when cash shortage or appearance of fraudulent behaviors are discovered.

Special Audits: Special audits are additional audits that are more detailed or unusual compared to what is anticipated during the standard audit process. The audits could be required in instances where theft, fraud, or other unusual circumstances are discovered. In addition to the unusual circumstances of the audits themselves, additional coordination may be required of the contractor to brief audit results to Law Enforcement Officials and/or other interested parties.

The Period of Performance will be:

Base Year: May 1, 2019 thru April 30, 2020 Option Year 1: May 1, 2020 thru April 30, 2021 Option Year 2: May 1, 2021 thru April 30, 2022 Option Year 3: May 1, 2022 thru April 30, 2023 Option Year 4: May 1, 2023 thru April 30, 2024

This number of audits is a best estimate of the work required for this contract. If the number of audits is less than this estimate, the contractor shall only be paid for actual audits/training performed. If the number is more than this estimate, then the contractor shall notify the Technical Contact and Contracting Officer as soon as possible. The contractor shall suspend work until a contract modification is processed by the Government that increases the amount of the contract.

No modifications will be allowed to adjust the initial lump sum price on the travel line item. As of January 1, 2019 if use of privately owned automobile is authorized or if no Government-furnished automobile is available then the rate per mile is $0.545. - Invoices shall not exceed bi-weekly invoicing for completed services.

- Invoices will be approved upon receiving a complete audit package, outlined in the attachments (all sections accounted for, appropriate documentation to support findings, no missing signatures, etc.). This is subject to change, via a modification, if the agency issues new direction on collection officer policy, audit requirements or forms.

- Contractor shall return with the quote, a Proposed Schedule of when the audits will be done on each Forest/location so that we can notify our offices in advance. This schedule is dependent on weather and is subject to change. If there a change to the schedule we ask that you notify the technical contact below of the change as soon as possible.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement.

Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

AGAR 452.228-71 INSURANCE COVERAGE. (NOV 1996)

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. The Contractor shall have bodily injury liability insurance coverage written on a comprehensive form of policy of at least $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury.

Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

FAR 52.217-8 OPTION TO EXTEND SERVICES (NOV 1999)

The Government may require continued performance of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of Labor. The option provision may be exercised more than once, but the total extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the option by written notice to the Contractor within 30 days.

FAR 52.217-9 OPTION TO EXTEND THE TERM OF THE CONTRACT (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30 days; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 45 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 5 years.

FAR 52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from the Contracting Specialist.

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.
