About this file

This document is a Limited Source/Brand Name Justification form from the United States Department of Agriculture Agricultural Research Service for a soil fumigation service. The justification is for using TELONE™ II fumigant to treat two fields totaling approximately 4.5 acres at the San Joaquin Valley Agricultural Sciences Center in Parlier, CA. The document explains that TELONE™ II is the only fumigant chemical available on the market after methyl bromide was phased out, citing its effectiveness against vine mealybug and various plant parasitic nematodes. The justification details EPA regulations, limited alternative fumigant options, and the product's benefits to soil health, which align with the agency's mission to improve American agriculture.

The document includes certifications from Michael Hassett, both as a Contracting Officer and Supervisory Contracting Officer, who determines that the circumstances justify using a limited source. The justification is prepared under Federal Acquisition Regulation 13.106-1(b)(1) for Simplified Acquisitions, with no market research conducted due to TELONE™ being the only EPA-registered and California-approved fumigant chemical. The solicitation is a 100% Small Business Set Aside under NAICS code 561730 with a small business size standard of $9.5M, associated with solicitation number 12905B25Q0046 for Grape Fumigation Services in Parlier, CA.

United States Department of Agriculture Limited Source/Brand Name Justification

FAR 13.106-1(b)(1) – Simplified Acquisitions

1. Identification of the agency and the contracting activity.

1a. Requesting Activity Agency: Agricultural Research Service San Joaquin Valley Agricultural Sciences Center 9611 S Riverbend Ave Parlier, CA 93648

1b. Contracting Activity: USDA, REE, ARS, PWA, Acquisition 12905B

2. Description of supply or service required to meet the agency’s needs.

Center will prepare the soil as per the recommendation of the company. Two fields of total ~4.5 acres will be treated with TELONE™ II fumigant to control Vine mealybug, a harmful pest that transmit virus diseases, and effective against the most destructive plant parasitic nematodes, including root-knot, gauva root-knot, columbia root-knot, lesion, stubby root, dagger, ring, cyst and other harmful fungi.

TELONE™ II is the only fumigant chemical available in the market after methyl bromide was phased out due to harmful impacts on the human health. TELONE™’ is known for its proven efficacy, combined with application flexibility, make it the preferred nematicide for growers across a wide spectrum of high-value crops. It also improves soil health by allowing beneficial bacterial populations to quickly rebound post-fumigation. Based on these properties, we consider it meeting the agency needs and mission statement to make American agriculture work better, and stronger.

3. The rationale or circumstances for limiting competition.

The number of effective soil fumigant pesticides is limited. Chloropicrin, Dazomet, Metam Sodium/Potassium and Methyl Bromide are few among known soil fumigants. However EPA identified potential human health risks associated with the above fumigants with potential to move off-site, EPA is concerned with inhalation exposure to handlers, bystanders, and workers. Methyl bromide use is banned in the state of California. TELONE™ (active ingredient 1,3-Dichloropropene) was reregisterd to use by the EPA.

4. A description of the market research conducted and the results or a statement of the reason market research was not conducted.

Further market research was not conducted as TELONE™ is the only fumigant chemical available on the market, the only fumigate chemical registered for use by the EPA, and the only fumigant chemical allowed to be used in the State of California based on state law. Further market research would yield no additional benefit to the Government.

5. Estimated price, including all options, if applicable.

6. Recommended source(s).
