B- 3 Written Acceptance Any Purchase Order resulting from this solicitation will require written acceptance within 10 days of receipt by the Contractor.
B- 4 Basis of Award One award will be made. Offer of award will be made to the Quoter(s) whose quote, as determined by the Contracting Officer, provides the best value to the Government, considering but not limited to, such factors as price, past performance, and capability to accomplish this type of work. The Experience Questionnaire will be used as part of this evaluation.
PART I - THE SCHEDULE
SECTION C - DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK
General Specifications
C- 1 Scope of Contract
This contract requires performance of janitorial and cleaning services and related work in compliance with its terms, specifications, and provisions. This includes furnishing labor, supervision and transportation. The Government will furnish cleaning supplies, cleaning equipment and restocking supplies. The area to be cleaned or maintained consists of approximately 4,050 square feet of office and storage space.
This work is being solicited as a performance based service contract. Performance based means the Contractor is responsible for an end product. If an end product is not provided in compliance with the contract specifications, an adjustment to the payment will be made.
A. CONDUCT OF WORK
Janitorial services shall be performed in accordance with the Frequency Schedule (Section C-4 under Technical Specifications) between the hours of 6:00 p.m. and 6:00 a.m., TWO (non-consecutive) days per week, which may include over the weekend unless otherwise directed by the Contracting Officer’s Representative. The Contractor will not be required to perform work on a National Holiday, or the day the Holiday is observed. In the event that a work schedule falls on a National Holiday (or the day the Holiday is observed) the services normally scheduled for that day shall be performed either the day before or the day after the holiday.

Unforeseen Building Closures – When an unforeseen building closure occurs on a regularly scheduled day of work, the Government shall have the following options:
a. To require the contractor to perform work necessary to sustain operations on the following duty day.
b. To forgo the work and reduce payment due the Contractor accordingly for work not performed.
The Contractor shall prevent their employees from disturbing papers on desks, opening drawers or cabinets, or using telephones and office machines provided for Official Government use, and see that all articles found by contractor employees are turned in to an official of the Forest Service.
B. CONTRACTOR’S RESPONSIBILITY
1. The Contractor shall be responsible for all damages to persons or property that occurs as a result of his negligence, as well as that resulting from acts of his employees, agents or subcontractors, and the contractor shall save and keep harmless the Government against any or all loss, cost, damage, claims, expense, or liability in connection with the performance of this contract.
2. The Government will not be responsible in any way for damage, fire, theft, accident, or otherwise, to the Contractor’s stored supplies, materials, equipment, or to the Contractor’s belongings brought into the building.
3. The Contractor shall supply some type of identification that must be worn at all times while on the premises by the Contractor or his/her employees (FAR 4.1303 Personal Identify Verification of Contractor Personnel).
4. The Contractor shall inform the COR of any items in need of repair/replacement.
5. Key Control – The Contractor will establish and implement methods of ensuring that all keys issued by the Government are kept secure in the Contractor’s possession and are not used by unauthorized persons.
a. Keys issued by the Government shall not be duplicated.
b. The Contractor will report the occurrence of a lost key to the Contracting Officer not later than the next duty day.
c. The Contractor will be required to reimburse the Government for replacement the locks or re-keying as a result of the Contractor loss of keys. In the event a mater key is lot or duplicated, all locks and keys for that system will be replaced by the Government and the total cost deducted from the monthly payment due the Contractor.
d. It is the responsibility of the Contractor to prohibit the use of keys issued by the Government to persons other than the Contractor’s employees. It is also the responsibility of the Contractor’s employees to prohibit the opening of locked areas by Contractor’s employees to permit entrance of persons other than Contractor’s employees engaged in the performance of assigned work in those areas.
6. Energy Conservation – Contractor shall turn on lights in rooms only during the time needed to perform the required work and shall ensure that all lights, except those required remaining on, are turned off in each room as it is completed.
C- 2 Deliverables
The tasks for each functional area are outlined in Section C- 9 Technical Specifications. The performance of the tasks will be monitored periodically based on the Performance Requirements Summary Sheet (Attachment J- 4) and reported monthly via the Quality Assurance Checklist (Attachment J- 3). The completed Checklist will be retained in the Contracting Officer’s Representative (COR) file and a copy provided to the Contracting Officer.
C- 3 Quality A. Quality Assurance of Work - The Contractor and Contracting Officer’s Representative (COR) shall jointly prepare a work schedule, which will become a part of this contract. The schedule may be revised by obtaining written approval from the COR. Work will be completed in a professional manner and workmanship will be clean and neat so as to be enticing to the general public. Contractor will be responsible for filling in work schedule.
B. The Contractor shall develop and maintain a quality program to ensure the required services are performed in accordance with commonly accepted commercial practices, which may include service checklists or reports. The Contractor shall implement procedures to identify, prevent and ensure non-recurrence of defective services. As a minimum, the Contractor shall develop quality control procedures addressing the areas identified in the PWS.
C. The COR (or their designated Inspector) will perform bimonthly inspections to evaluate the quality of work being performed. At any time when work is performed and is not in compliance with specifications, the Contractor will be informed and required to correct the deficiencies in accordance with Clause FAR 52.246-4 Inspection of Services Fixed Price (see Section E- 1). Acceptance of work will be determined by inspection of the entire job and will be based on adherences to the specification. The COR will record the results of these inspections on Quality Assurance Checklist included as Exhibit J- 3. Inspection will be conducted more frequently as deemed necessary by the COR.
Work shall be considered acceptable if the specifications described in this contract are complied with.
D. Government Remedies – The Contracting Officer shall follow FAR 52.249-8, Default (Fixed Price Supply and Service), for Contractor’s failure to perform satisfactory services or failure to correct non-conforming services.
C- 4 Travel and Government Vehicles
Travel reimbursement is not authorized under this contract.
For purposes of this contract, Government furnished resources shall not include Government Vehicles, nor shall contractor personnel be allowed to ride in Government vehicles without prior authorization by the Contracting Officer.
C- 5 Security
The Contracting Officer’s Representative (COR) for this contract will assist with the Contractor’s entry into secure areas and inform the Contractor of security procedures. The Contractor shall comply with all security procedures.
All doors shall remain locked while Contractor performs the work and the Contractor shall ensure that all exterior doors are shut and locked prior to departure. The Contractor shall also ensure that all unnecessary lights and faucets are turned off, and all windows are closed.
All secured interior office doors shall remain locked while Contractor performs the work and the contractor shall ensure that those doors are locked and secured prior to departure. Offices shall only remain open while Contractor is present.
The Contractor shall not adjust any mechanical equipment controls, shall report any fires and hazardous conditions, shall turn in lost and found articles, and shall notify the Contracting Officer’s Representative (COR) when an unauthorized or suspicious person(s) is seen on the premises.
The Forest Service reserves the right to perform security checks on Contractor employees.
C- 6 Training
The Contractor is responsible for all training for its employees except when training can only be provided by the Forest
Service. Requests for training by exception must be provided to and approved by the CO prior to the Government conducting training.
C- 7 Identification of Contractor and Contractor Employees
All contract personnel are required to identify themselves as contractors. When working in any situation where their contractor status is not obvious to third parties, they must make their status known to avoid creating an impression that they are Government employees.
C- 8 Location and Description
Work will be completed at the Fremont River Ranger District – Loa Office. Office is located at 138 South Main, Loa, Utah 84747.
C- 9 Technical Specifications
A. TWO DAYS A WEEK (Wednesday and Saturday)
1. Restrooms
a. Floors shall be swept and wet mopped or scrubbed with a disinfectant as needed
(to include the junction of the wall and flooring to ensure that buildup of debris/dirt is not present).
b. Water closets and urinals shall be washed and sanitized. No rust or encrustation shall remain. Traps shall be maintained free from odor at all times. Wash basins shall be cleaned.
c. Mirrors, shelving, dispensers, and chromium fixtures shall be damp wiped and polished.
d. All other surfaces shall be spot-cleaned and horizontal surfaces dusted.
e. Paper towel receptacles shall be emptied and towel, soap, and toilet paper dispensers serviced. In addition, waste receptacles shall be emptied and the rooms policed to remove paper, trash or spillages on a schedule based upon traffic demand.
f. Wipe off all soiled area from walls and partitions.
2. General Office Cleaning
a. Vacuum all carpet traffic areas.
b. Wipe down drinking fountain.
c. Spot Clean any glass surfaces on doors and front counter.
d. Empty all trash receptacles.
e. Wipe down breakroom tables and cabinetry.
B. WEEKLY
1. Room Cleaning
a. Dust all furniture including tops of storage cabinets, bookcases, and other office equipment.
b. Dust all window sills, wall pictures, and ledges throughout all offices, hallways, and restrooms, including window blinds.
c. Dust all door facings and wipe off all counter tops.
d. Clean all glass doors in all bookcase sections, inside and out to remove all fingerprints, dirt, and dust.
e. Remove mats from under desks, vacuum carpets under desks, clean and replace mats.
f. All carpeted areas are to be vacuumed to remove dirt, dust and litter including corners and edges adjacent to wall.
g. All tile floors are to be damp mopped using cleaning agent and all black marks are to be removed.
2. Lobbies and Corridors
Clean all inside and outside entrances.
3. Storage Space
Keep storage room clean and free of clutter.
4. Room Cleaning – The office areas and the corridor adjacent to these areas shall receive the following:
a. All wastebaskets will have a trash can liner. Wastebaskets shall be emptied and the waste paper and trash removed to the main disposal area. All trash will be placed in the tied garbage bag and placed in the trash dumpster outside the building.
b. The floor areas not covered are to be vacuumed to remove all dirt, dust, and litter.
c. The carpet areas are to be vacuumed to remove all obvious surface dirt from traffic areas and from under furniture.
d. Horizontal surfaces of desks shall be dusted with a treated dust cloth. Glass desktops shall be cleaned with an untreated cloth. Government employees shall be responsible for cleaning by clearing off desktops Desks not prepared shall be dusted on cleared areas only.
e. Wipe off all soiled areas from walls.
f. Inspect and install needed light bulbs and fluorescent tubes.
5. Lobbies and Corridors
a. Floors shall be vacuumed.
b. Receptionist counter shall be damp wiped and free from any dust, dirt, and fingerprints.
c. Wipe off all soiled areas from walls.
d. Drinking fountains shall be cleaned with suitable scale removers, germicide, and deodorants.
6. Outside Entrances
a. Sweep building approaches to remove dust, dirt, or snow.
b. The main and secondary entrances including foyer shall be swept or vacuumed.
c. Glass and kick plates on both sides of entrance and foyer doors shall be cleaned and polished.
C. MONTHLY
1. All Wastepaper receptacles shall be damp wiped inside and out. If plastic bag liners are used, the liners will be replaced as needed.
2. Remove spots from carpeted areas.
D. OTHER SERVICES TO BE PERFOMRED
1. Windows, every four months, wash all windows both inside and outside and clean window tracks (this may involve removing windows and screens to ensure that window cleaning is completed correctly).
2. Clean all venetian blinds during the months of March and September or at other times agreeable to the COR.
C-10 Biobased Product Utilization The Government will provide the products to be utilized in performance of this project. Therefore, the contractor will not be responsible for procuring biobased products or reporting use of any products used to complete this contract.
C-11 Government-Furnished Property The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the “Government Property” FAR clause contained elsewhere in the contract.

Paper Towels

C-12 Government Quality Assurance
Quality assurance will be performed by the Government during the contract at regular intervals. Methods may include visual survey and review of Contractor quality control documents. Deduction for work may include rework at no cost to the Government or Government acceptance with price reduction.
C-13 Contractor Quality Control
The Contractor, not the Government, is responsible for management and quality control actions to meet the terms of this contract. The role of the Government is quality assurance to ensure contract standards are met.
Records of quality inspections shall be kept and made available to the Government throughout the performance period and for the period after contract completion until final settlement of any claims under this contract.
A description of the site specific quality control inspection plan shall be provided within thirty (30) days of contract award. The plan shall include; (1) control procedures for security of Government-provided items such as keys, and lock combinations; (2) location of the inspection documents; (3) corrective or preventive actions that will be taken to meet quality standards; and (4) a customer comments feedback system.
The Operation Plan must be reviewed and updated annually, and as required by the COR.

52.246-4 Inspection of Services - Fixed-Price (AUG 1996)
E- 2 Quality Assurance Inspections
(a) The Government will perform periodic review of the Contractor's Quality Control Procedures, Plan, Inspection Reports, and customer comments.
(b) Quality Assurance Inspections will be made by random sampling or entire inspection of the work, and follow up of customer comments. When validating customer comments, the possible cause of unacceptable performance will be determined. If any Government action or lack of action was the cause, the complaint is not valid and deficiencies shall not be counted against the Contractor.
(c) Periodic means one (1) review each month, but may be done more frequently if necessary.
(d) Work that does not meet the contract requirements will be brought to the Contractor's attention. Repetitive or continuous failure to meet contract requirements may result in a quality adjustment to payment or the Contractor's right to proceed may be terminated.

52.242-15 Stop Work Order (AUG 1989) 52.242-17 Government Delay of Work (APR 1984) F- 2 Contract Period and Renewal Option The contract period shall extend for one year. However, at the option of the Government, the contract may be renewed for additional one-year periods, not to exceed four renewal periods, at the same terms and conditions. The Government will notify the Contractor of its intent to renew not less than sixty (60) calendar days prior to the expiration of the current contract period. The preliminary notice does not commit the Governmen to an extension, but a purchase order will be the awarding document.

G- 1 Invoice Processing Platform (IPP)
The Forest Service is utilizing the Invoice Processing Platform (IPP) for the electronic submission and tracking of contracts/purchase orders, invoices, and payment information. IPP is a secure Government-wide, Web-based invoice processing service. Visit http://www.ipp.gov to learn more.
Upon award of a contract, Contractors will be enrolled automatically. Contractor will subsequently receive electronic notification from IPP of enrollment. AGRICULTURE ACQUISITION REGULATION (48 CFR CHAPTER 4) CLAUSES
H- 1 Use of Premises
The Contractor shall comply with the regulations governing the operation of premises which are occupied and shall perform his contract in such a manner as not to interrupt or interfere with the conduct of Government business.
H- 2 AGAR 452.237-74 Key Personnel (FEB 1988)
(a) The Contractor shall assign to this contract the following key personnel: Project Superintendent
(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.
(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.
H- 3 AGAR 452.236-77 Emergency Response (NOV 1996)
(a) Contractor’s Responsibility for Fire Fighting.
(1) The Contractor, under the provisions of FAR clause 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements, shall immediately extinguish all fires on the work site other than those fires in use as a part of the work.
(2) The Contractor may be held liable for all damages and for all costs incurred by the Government for labor, subsistence, equipment, supplies, and transportation deemed necessary to control or suppress a fire set or caused by the Contractor or the Contractor’s agents or employees.
(b) Contractor’s Responsibility for Notification in Case of Fire. The Contractor shall immediately notify the Government of any fires sighted on or in the vicinity of the work site.
(c) Contractor’s Responsibility for Responding to Emergencies. When directed by the Contracting Officer, the Contractor shall allow the Government to temporarily use employees and equipment from the work site for emergency work (anticipated to be restricted to fire fighting). An equitable adjustment for the temporary use of employees and equipment will be made under the Changes Clause, FAR 52.243-4.
H- 4 Contractor Performance Assessment Reporting System (FEB 2011)
(a) General. This contract is subject to Federal Acquisition Regulations (FAR), Agriculture Acquisition Regulations (AGAR), and Forest Service Acquisition Regulations (FSAR) that require past performance evaluations to be completed and entered into the Contractor Performance Assessment Reporting System (CPARS). Although the expected amount of this project is below the automatic reporting threshold, an evaluation may be entered into the CPARS system.
(b) Contact Information. At the Prework Meeting, the name and email address of the Contractor Representative may be required.
(c) Assessment. Upon completion of the work associated with the contract/delivery orders, an evaluation may be initiated by the Contracting Officer in the CPARS system and the Contractor Representative will receive an auto-email from CPARS with instructions for completion of the evaluation.
H- 5 Prework Conference
Prior to commencement of work, the Contracting Officer will arrange a meeting with the Contractor to discuss the contract terms and work performance requirements. Also at this meeting such things as work progress schedule and fire prevention and suppression plans shall be developed and established in writing.

(a) The Contractor shall comply with agency personal identity verification procedures identified in the contract that implement Homeland Security Presidential Directive-12 (HSPD-12), Office of Management and Budget (OMB) guidance M-05-24 and Federal Information Processing Standards Publication (FIPS PUB) Number 201.
(b) The Contractor shall account for all forms of Government-provided identification issued to the Contractor employees in connection with performance under this contract. The Contractor shall return such identification to the issuing agency at the earliest of any of the following, unless otherwise determined by the Government:
(1) When no longer needed for contract performance.
(2) Upon completion of the Contractor employee’s employment.
(3) Upon contract completion or termination.
(c) The Contracting Officer may delay final payment under a contract if the Contractor fails to comply with these requirements.
(d) The Contractor shall insert the substance of this clause, including this paragraph (d), in all subcontracts when the subcontractor’s employees are required to have routine physical access to a Federally-controlled facility and/or routine access to a Federally-controlled information system. It shall be the responsibility of the prime Contractor to return such identification to the issuing agency in accordance with the terms set forth in paragraph (b) of this section, unless otherwise approved in writing by the Contracting Officer.
I- 3 AGAR 452.204-71 Personal Identity Verification of Contractor Employees (OCT 2007)
(a) The Contractor shall comply with the personal identity verification (PIV) policies and procedures established by the Department of Agriculture (USDA) Directives 2620-002 series.
(b) Should the results of the PIV process require the exclusion of a Contractor’s employee; the Contracting Officer will notify the Contractor in writing.
(c) The Contractor must appoint a representative to manage compliance with the PIV policies established by the USDA Directives 4620-002 series and to maintain a list of employees eligible for a USDA LincPass required for performance of the work.
(d) The responsibility of maintaining a sufficient workforce remains with the Contractor. Contractor employees may be barred by the Government from performance of work should they be found ineligible or have lost eligibility for a USDA LincPass. Failure to maintain a sufficient workforce of employees eligible for a USDA LincPass may be grounds for termination of the contract.
(e) The Contractor shall insert this clause in all subcontracts when the subcontractor is required to have routine unaccompanied physical access to a Federally-controlled facility and/or routine unaccompanied access to a Federally-controlled information system.
(f) The PIV Sponsor for this contract is a designated program point of contact, which in most cases is the COR/COTR, unless otherwise specified in this contract.
I -4 Homeland Security Presidential Directive-12 (HSPD-12) In order to assure that all contracts for Janitorial/Custodial services are in compliance with Homeland Security Presidential Directive-12 (HSPD-12), and that the contractor and contractor employees (employees who will require access to the government facility) have successfully completed background investigations and received a LincPass (an identification card used to access the contract facility), the Clauses and Statements listed in full text below are added to this contract.
Contractors are required to identify all employees who will have routine access to the contract facility for a period of six months or more, and provide each employee with the attached Person Model Information Sheet. This is the first step in the process of contractor and contractor employees obtaining a LincPass. The contractor shall gather the Person Model Information Sheets and submit them, in one batch, to the Personal Identity Verification Sponsor identified below. The identified employees will then be contacted by the government and required to complete electronic fingerprinting and photo (at a Government Credentialing Center), hardcopy finger printing and a Questionnaire for Non-Sensitive Positions.
Employees who receive clear background investigations will receive notification to go to a Government Credentialing Center for LincPass activation and pickup. They may then continue working on the contract; employees who do not receive clear background investigations are subject to immediate removal from working on this contract per AGAR 452.204-71 PERSONAL IDENTITY VERIFICATION OF CONTRACTOR EMPLOYEES.
The government is charged a fee for each background investigation completed so contractors should only submit Person Model Information Sheets for the minimum number of employees required to work on this contract.
The Person Model Information Sheet shall be completed and returned to the Personal Identity Verification (PIV) Sponsor within 10 (ten) calendar days of contract award, project notice to proceed, modification to contract, etc.
The PIV Sponsor for this project will be Chris Hansen. When the Person Model Information Sheet is completed, it must be delivered to Chris Hansen at the Utah Acquisition Support Center. Option to Extend Services (NOV 1999)
The Government may require continued performane of any services within the limits and at the rates specified in the contract. These rates may be adjusted only as a result of revisions to prevailing labor rates provided by the Secretary of labor. The option provision may be exercised more than once, but th etotal extension of performance hereunder shall not exceed 6 months. The Contracting Officer may exercise the optin by written notice to the Contractor within 60 days of contrct expiration.
I- 6 FAR 52.217-9 Option to Extend the Term of the Contract (MAR 2000)
(a) The Government may extend the term of this contract by written notice to the Contractor within 60 days prior to contract expiration; provided, that the Government gives the Contractor a preliminary written notice of its intent to extend at least 60 days before the contract expires. The preliminary notice does not commit the Government to an extension.
(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.
(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed Five Years and 6 months.
I- 7 FAR 52.219-28 Post-Award Small Business Program Rerepresentation (JUL 2013)
(a) Definitions. As used in this clause—
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts—
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards.
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the rerepresentation required by paragraph (b) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor’s current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.

I- 9 FAR 52.222-62 Paid Sick Leave Under Executive Order 13706 (JAN 2017)
(a) Definitions. As used in this clause (in accordance with 29 CFR 13.2)–
“Child”, “domestic partner”, and “domestic violence” have the meaning given in 29 CFR 13.2.
“Employee”–
(1)
(i) Means any person engaged in performing work on or in connection with a contract covered by Executive Order (E.O.) 13706, and
(A) Whose wages under such contract are governed by the Service Contract Labor Standards statute (41 U.S.C. chapter 67), the Wage Rate Requirements (Construction) statute (40 U.S.C. chapter 31, subchapter IV), or the Fair Labor Standards Act (29 U.S.C. chapter 8),
(B) Including employees who qualify for an exemption from the Fair Labor Standards Act's minimum wage and overtime provisions,
(C) Regardless of the contractual relationship alleged to exist between the individual and the employer; and
(ii) Includes any person performing work on or in connection with the contract and individually registered in a bona fide apprenticeship or training program registered with the Department of Labor’s Employment and Training Administration, Office of Apprenticeship, or with a State Apprenticeship Agency recognized by the Office of Apprenticeship.
(2)
(i) An employee performs “on” a contract if the employee directly performs the specific services called for by the contract; and
(ii) An employee performs “in connection with” a contract if the employee’s work activities are necessary to the performance of a contract but are not the specific services called for by the contract.
“Individual related by blood or affinity whose close association with the employee is the equivalent of a family relationship” has the meaning given in 29 CFR 13.2.
“Multiemployer” plan means a plan to which more than one employer is required to contribute and which is maintained pursuant to one or more collective bargaining agreements between one or more employee organizations and more than one employer.
“Paid sick leave” means compensated absence from employment that is required by E.O. 13706 and 29 CFR part 13.
“Parent”, “sexual assault”, “spouse”, and “stalking” have the meaning given in 29 CFR 13.2.
“United States” means the 50 States and the District of Columbia.
(b) Executive Order 13706.
(1) This contract is subject to E.O. 13706 and the regulations issued by the Secretary of Labor in 29 CFR part 13 pursuant to the E.O.
(2) If this contract is not performed wholly within the United States, this clause only applies with respect to that part of the contract that is performed within the United States.
(c) Paid sick leave. The Contractor shall–
(1) Permit each employee engaged in performing work on or in connection with this contract to earn not less than 1 hour of paid sick leave for every 30 hours worked;
