SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

C-1 SCOPE OF CONTRACT

The Nez Perce-Clearwater National Forest requires annual trail opening and maintenance on Forest Service trails. The work includes logging out, drainage maintenance and rock removal on non-wilderness and wilderness trails as described in the technical specifications. Slide maintenance and tread repair are required in connection with uprooted trees. Contractors shall be held responsible for all downed trees;

there will be NO tree counting. However, trees felled by unusual, extreme wind events are outside the scope of this contract. Slide maintenance/tread repair (outside of that referred to above) and brushing are not standard trail opening/maintenance requirements but may be authorized by separate orders as needed and negotiated under the rates provided in Items 17-19. The Contractor(s) shall furnish all labor, supervision, equipment and materials to perform all operations necessary to accomplish the work in accordance with the contract terms, conditions, specifications, drawings and contract attachments/exhibits.

This solicitation will result in the award of multiple firm fixed priced contracts. Each resultant award will require performance of trail maintenance work for the Forest in a specific geographic area as defined by the Item descriptions and maps provided as attachments to the contract. Only one contractor will be awarded work for each geographic area.

This project is one of the implementation projects of the Collaborative Forest Landscape Restoration Project (CFLRP). The goal of the CFLRP project is to utilize collaborative, science based ecosystem restoration techniques to improve watershed function while encouraging ecological, economic and social sustainability with an emphasis on providing local employment opportunities.

This project is also within the Central Idaho Complex Priority Trail Maintenance area.

C-3 REQUIREMENTS (982, Logging Out, 984 Loose Rock Removal, and 991 Drainage Maintenance)

Section 982 – Logging Out Description

982.01 Work. This work consists of removing brush, logs, and down trees from the clearing limits.

Requirements

982.02 Clearing Out. Cut and remove all logs that extend across or into the clearing limits as SHOWN ON THE DRAWINGS or 1 ft. above the top of the cut-slope of all ditches, catch basins, and trail structures, whichever is greater. This includes all previously cut logs within the defined clearing limits.

All limbs from fallen trees that extend into the clearing limits must be cut flush to the bole of the tree and removed. The portions of cut logs that remain on the upper side of the trail shall be either firmly anchored to prevent sliding or rolling onto the trail way or moved across the trail to the lower side and scattered outside the clearing limits.

Fell all trees over 3 inches in diameter that are leaning into the clearing limits and that are within 10 feet above the trail bed as SHOWN ON THE DRAWINGS. Stump height of leaning trees that are cut outside the clearing limits shall be cut flush on the uphill side of the stump. Disposal and payment for the leaning trees described above will be the same as for down logs and trees.

Remove roots, root wads, and stumps from trees within the clearing limits that have been uprooted. Fill any holes within the clearing limits with suitable material and compact.

Rerouting the trail around windfalls, uprooted trees, and other obstacles will not be permitted. Repair sections of the trail tread that have been damaged by uprooted stumps as necessary to provide safe passage on the trail. Payment for such work will be incidental to the specified work item, and no extra payment will be made.

Remove sticks or wood chunks exceeding 2 inches in diameter or 1 foot in length that have fallen on to the trail bed.

Scatter the down trees on the lower side of the trail way outside the clearing limits. Do not place such materials in stream channels, drainage ways, ditches, culvert catch basins, or other locations where they would prevent the free flow of water away from the trail bed.

Measurement

982.03 Method. Determine the quantity of logging out units by measuring the slope distance along the trail centerline.

Section 984 – Loose Rock Removal Description

984.01 Work. This work consists of removal and disposal of loose rock from the trail tread

Requirements

984.02 General. Remove loose rocks that are larger than two (2) inches at their greatest dimension from the trail bed. Remove any loose rock in drainage dips or ditches that may impede water flow off the trail.

Loose rocks are rocks that are not firmly embedded in the trail and can be removed by hand. Where the trail bed consists predominantly of rock with little or no soil present, remove all loose rock larger than 3 inches.

Fill any holes remaining from rock removal with suitable material and compact. If the rock removed is not needed for other items of maintenance work, scatter the rock by side casting to the lower side of trail way beyond the clearing limits, and distribute rock to ensure that no blockage of drainage or creation of a windrow occurs. Do not dispose of waste materials in watercourses.

Measurement

984.03 Method. Determine the quantity of loose rock removal units by measuring the slope distance along the trail centerline.

984.04 Basis. Make payment, for all units inspected and accepted, at the unit price SHOWN IN THE

Section 991 – Drainage Maintenance Description

991.01 Work. This work consists of cleaning all drainage structures such as: culverts, water bars, drainage dips, ditches, stream fords, gully crossings, puncheons and bridges. Drainage maintenance also includes removal of vegetation and debris from the disturbed (constructed) surface area of the drainage structure, such as ditches, catch basins, water bar spillways, sumps, etc.

Materials

991.02 Requirements. Use materials meeting the requirements of the following sections:

961 -- Rock, Grid Pavement Units, and Aggregate 962 – Materials for Timber Structures

Requirements

991.03 General. Where trail drainage facilities have been plugged and the water has been diverted from the intended channel, remove the debris causing the diversion and return the drainage to the channel.

Divert water off and away from the trail bed.

Clean ditches to permit the free flow of water into culverts and away from the trail. Remove all woody vegetation that is within 1 ft. of the top of the cut-slope of all ditches and catch basins.

Scatter all unusable or unneeded material that is cleared from the drainage structures 3 feet or more beyond and below the trail or drainage facility and out of watercourses.

991.04 Culverts. Remove debris and soil from catch basins and inlet and outlet ditches and inside culverts to permit the unobstructed flow of water into, through, and away from the culvert.

991.05 Water bars. Clean the upgrade side of all existing water bars and maintain them as SHOWN ON THE DRAWINGS. Use and compact suitable material removed from the upgrade side of wood and rock water bars to bring the trail tread flush with the top of those water bars on the downgrade side. Rubber belted water bars should have all debris removed from the upgrade and downgrade sides of the rubber belting in order to allow the rubber to flex as intended. Remove all accumulated soil and debris from the leadoff area and outlet ditches of all water bars until the drain is a minimum of 4 in. deep and ditches are a minimum of 12 in. wide with angled cut slopes as SHOWN ON THE DRAWINGS. All leadoff ditches must maintain a sustained negative grade until water flows freely down the hill slope.

991.06 Drainage Dips. Clean deposited material and restore drainage dips as SHOWN ON THE DRAWINGS. Remove all debris from the leadoff area of dips until the drain is a minimum of 4 in. deep and ditches are a minimum of 12 in. wide with angled cut slopes as SHOWN ON THE DRAWINGS. All leadoff ditches must maintain a sustained negative grade until water flows freely down the hill slope.

Use suitable material obtained by cleaning dips for fill on the downgrade side, removing rock more than 2 inches at its greatest dimension. Compact all material placed in the trail tread.

991.07 Trail Structures. Clean all debris off of the surface of all lumber decked trail structures, such as bridges and puncheons. Dispose of debris on the down slope side of trail out of clearing limits. Do not place such materials in stream channels, drainage ways, ditches, culvert catch basins, or other locations where they would prevent the free flow of water away from the trail bed.

991.08 Stream fords and Gully Crossings. Remove debris and loose rocks over 2 inches from existing stream crossings to provide the tread width. Level and smooth the stream bottom with gravel or rock less than 2 inches in greatest dimension to provide a crossing.

Measurement

991.09 Method. Determine the quantity of drainage maintenance units by measuring the slope distance along the centerline. Measure other items by a count of those designated.

991.10 Basis. Make payment for all units inspected and accepted, at the unit price SHOWN IN THE

C-4 PERFORMANCE DEADLINES

The starting dates in the table below are estimates of when work may begin on an Item; however, not all trail segments within an Item are expected to be open on that date. Regardless of actual starting date, all Trail Maintenance Items shall be completed no later than the dates shown in the table below for the year in which award or renewal was made.

The Contractor shall make progress at a rate that will assure completion of work by the required completion date for each Item. Award of more than one Item to a Contractor will not change the required performance period for each Item. If multiple Items are awarded to one Contractor, the respective performance times will run concurrently, not consecutively. Work may be performed on each Item in succession provided a rate of progress is maintained to ensure completion of all work by the required deadlines.

Prior to commencement of work, the COR will arrange a meeting with the Contractor to discuss the contract terms and work performance requirements. Also at this meeting such things as work progress schedule and fire prevention and suppression plans shall be discussed. The Contractor may begin work under the contract when conditions are suitable and upon issuance of a Notice to Proceed (see FAR 52.211-10 Alt I).

C-5 GOVERNMENT FURNISHED PROPERTY NONE

C-6 USE OF MOTORIZED EQUIPMENT AND VEHICLES

It is the responsibility of the successful bidder to ensure that motorized equipment and/or transport/use is commensurate with the management directions for the areas in which the trails are located. The Nez Perce-Clearwater National Forest Motor Vehicle Use Map (MVUM) for the Clearwater NF and Forest Access guide for the Nez Perce NF provide information on roads and trails with motorized use restrictions. These guides are available from Nez Perce-Clearwater National Forest Supervisor’s and Ranger District Offices. All areas outside of wilderness provide for the use of chainsaws.

C-7 STOCK LIMITATIONS

In order to decrease chances for site degradation, the use of saddle and pack stock will be kept at the minimum necessary to accomplish the project. A maximum 6 head per trip addresses the initial camp and tool supply. Once tools and camp are transported into the job site, use of stock will be limited to 3 head* during the length of the project. At the end of the project and for complete camp movement during the project, stock shall not exceed 6 head. Stock not in use shall be removed from the National Forest until such time as they are required.

*Based on a 2 person crew – 2 riding and 1 pack animal. (Requests for additional stock will be submitted in writing and approved by the CO prior to use.)

C-8 CAMPING

There are a limited number of campsites in some trail areas. Campsites shall be addressed and designated at the pre-work meeting. The Contractor's campsite will be subject to weekly inspections by a Government Inspector to assure that minimum impact requirements are met. (See Attachment 1 - Minimum Impact Camping Guidelines)

C-9 CLEANUP OF WORK AND CAMP AREAS

The project area(s) shall be restored to as close to its original natural appearance as possible. The work area impact must be kept to a minimum. All debris and litter shall be removed from site. Litter shall be packed out, and the native debris shall be scattered outside the trail clearing limit. No debris shall be scattered into any stream, lake, snow pond, meadow, or other water course. (See Attachment 1 - Minimum Impact Camping Guidelines)

Noxious Weed Closure Order. The contractor shall comply with the Special Order issued for all National Forest System Lands within the State of Idaho which prohibits the possession or storage of hay, straw or mulch that is not certified by an authorized official as being Noxious weed or Noxious Weed Seed Free. A Contractor possessing hay, straw or mulch in the National Forest shall present the weed free certificate upon request.

Access and Equipment Drops in Wilderness:

Use of motor vehicles (including trail motorcycles, ATV’s) and motorized/mechanized equipment (such as chainsaws, generators, or bicycles) are prohibited in designated Wilderness Areas.

Use of helicopters for equipment/supply drops or for ferrying personnel into a Wilderness area will not be allowed.

In general, storing equipment, personal property or supplies at one cache site for more than 14 consecutive days within a 45-day period is prohibited in both Wilderness and Non-Wilderness areas, subject to specific Wilderness stay limits.

The Government issued contract number is to be referenced on all official communication starting upon notice of award.

52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 60 days after receipt of the notice to proceed. The time stated for completion shall include final cleanup of the premises.

Post Award Conference (NOV 1996) A post award conference with the successful offeror is required. It will be scheduled and held after contract award. The conference date, time, and location will be determined after award.

KEY PERSONNEL

(a) The Contractor shall assign to this contract the following key personnel: Project Foreman.

(b) During the first ninety (90) days of performance, the Contractor shall make no substitutions of key personnel unless the substitution is necessitated by illness, death, or termination of employment. The Contractor shall notify the Contracting Officer within 15 calendar days after the occurrence of any of these events and provide the information required by paragraph (c) below. After the initial 90-day period, the Contractor shall submit the information required by paragraph (c) to the Contracting Officer at least 15 days prior to making any permanent substitutions.

(c) The Contractor shall provide a detailed explanation of the circumstances necessitating the proposed substitutions, complete resumes for the proposed substitutes, and any additional information requested by the Contracting Officer. Proposed substitutes should have comparable qualifications to those of the persons being replaced. The Contracting Officer will notify the Contractor within 15 calendar days after receipt of all required information of the decision on substitutions. The contract will be modified to reflect any approved changes of key personnel.

USE OF PREMISES

(a) Before any camp, quarry, borrow pit, storage, detour, or bypass site, other than shown on the drawings, is opened, or operated on USDA land or lands administered by the USDA, the Contractor shall obtain written permission from the Contracting Officer. A camp is interpreted to include a campsite or trailer parking area of any employee working on the project for the Contractor.

(b) Unless excepted elsewhere in the contract, the Contractor shall (i) provide and maintain sanitation facilities for the work force at the site and (ii) dispose of solid waste in accordance with applicable Federal, State, and local regulations.

ARCHAEOLOGICAL OR HISTORIC SITES

If a previously unidentified archaeological or historic site(s) is encountered, the Contractor shall discontinue work in the general area of the site(s) and notify the Contracting Officer immediately.

CONTROL OF EROSION, SEDIMENTATION, AND POLLUTION

(a) Operations shall be scheduled and conducted to minimize erosion of soils and to prevent silting and muddying of streams, rivers, irrigation systems, and impoundments (lakes, reservoirs, etc.).

(b) Pollutants such as fuels, lubricants, bitumens, raw sewage, and other harmful materials shall not be discharged on the ground; into or nearby rivers, streams, or impoundments; or into natural or man-made channels. Wash water or waste from concrete or aggregate operations shall not be allowed to enter live streams prior to treatment by filtration, settling, or other means sufficient to reduce the sediment content to not more than that of the stream into which it is discharged.

(c) Mechanized equipment shall not be operated in flowing streams without written approval by the Contracting Officer.

INSURANCE COVERAGE

Pursuant to FAR clause 52.228-5, Insurance-Work on a Government Installation, the Contractor will be required to present evidence to show, as a minimum, the amounts of insurance coverage indicated below:

(a) Workers Compensation and Employer's Liability. The Contractor is required to comply with applicable Federal and State workers' compensation and occupational disease statutes. If occupational diseases are not compensable under those statutes, they shall be covered under the employer's liability section of the insurance policy, except when contract operations are so commingled with a Contractor's commercial operations that it would not be practical to require this coverage. Employer's liability coverage of at least $100,000 shall be required, except in States with exclusive or monopolistic funds that do not permit worker's compensation to be written by private carriers.

(b) General Liability. (1) The Contractor shall have bodily injury liability coverage written on a comprehensive form of policy of at least $500,000 per occurrence. (2) The Contractor shall have property damage liability insurance shall be required in the amount of $500,000 per occurrence.

(c) Automobile Liability. The Contractor shall have automobile liability insurance written on a comprehensive form of policy. The policy shall provide for bodily injury and property damage liability covering the operation of all automobiles used in connection with performing the contract. Policies covering automobiles operated in the United States shall provide coverage of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage or loss.

(d) Aircraft Public and Passenger Liability. When aircraft are used in connection with performing the contract, the Contractor shall have aircraft public and passenger liability insurance. Coverage shall be at least $200,000 per person and $500,000 per occurrence for bodily injury, other than passenger injury.

Coverage for passenger injury shall be at least $200,000 multiplied by the number of seats or passengers, whichever is greater.
