5% variation shall not require a decrease in total funds allocated, nor shall any additional funding be added to cover an increase in acreage for the variation. Acreages listed and shown (on maps) are the best available estimates of actual acreages and will be used as such for bid and payment purposes.

Four individual treatment areas (Item 001, 002, 003, and 004) will be bid under this solicitation. For each unit, there are two different treatment guidelines applied. Leave trees will be clearly marked or flagged at diameter breast height (DBH).

Care shall be taken not to scar cottonwoods and other desirable leave trees.

Hand work with chain saws may be required in some terrain and tree density situations with lop and scatter permitted for slash, not to exceed a vertical above ground height of 18” and length of pieces not to exceed 48”. All trees hand cut shall have stump cut to ground level.

In areas of steep slope cut banks, awardee shall take necessary measures to assure the stability of the soil and not to damage the resource.

Outside of the 75’ radius of cottonwood trees:

SECTION E--INSPECTION AND ACCEPTANCE

Quality Assurance Surveillance Plan (QASP)

FY 2018 TIER III BLACK KETTLE NATIONAL GRASSLAND

RIPARIAN RESOTRATION AND EASTERN RED CEDAR REMOVEL

The objective of this plan is to provide a quality surveillance plan for mastication treatment performed on the Cibola National Forest, Black Kettle National Grasslands. This plan provides a basis for the Contracting Officers Representative to evaluate the quality of the Contractor’s performance. The oversight provided for in the contract and in this plan will help ensure that quality levels reach the required levels of performance.

Performance Standards A. Quality Level: By monitoring the Contractor, the COR will determine whether the performance levels set forth in the contract have been attained. Quality standards for all tasks are specified in the

PWS.

B. On-Site Inspections: The COR will evaluate the current levels of performance, according to the standards set forth in this contract at the discretion of the COR.

C. Records Inspections: The Contractor shall provide and maintain an inspection system acceptable to the government covering the services under this contract. Complete records of all inspection work performed by the Contractor shall be maintained and made available to the Government during contract performance and for as long afterwards as the contract requires.

D. Documentation: The COR will keep a file containing the following:

Copy of the contract

Copy of COR and Government Inspector appointment letters

Copy of Contractor Designated Representatives letter

Copies of all required documents provided by the Contractor under this contract

All contract correspondence initiated or received by the COR

All modifications to the contract

Copies of all completed inspection reports, checklists, logs, diaries, contract discrepancy reports and surveillance certifications

Records of meetings attended

Copies of processed invoices and receipt documents

The government will make periodic inspections while work is in progress to assure that work is proceeding satisfactorily. These inspections will initially be done daily but may vary if work progresses in a satisfactory manner. Inspection for acceptance of work will be accomplished by a visual or random plot inspection of each unit and will be based on adherence to the specifications. If the work quality is determined to meet acceptable work standards, payment will be made at 100 percent of unit price.

Visual Inspection Indicating Less Than Quality Work

In the event visual inspection indicates that work quality is less than acceptable and the operator will not re-work the unit voluntarily, then the Government shall, by formal inspection, determine if the specified methods of work have been used. Failure to use specified methods shall require prompt corrective action. Repeated failure to follow the specified methods of work may be cause for termination of the Contractor’s right to proceed and the contract considered in default.

In the case to where visual inspection yields unacceptable work and the contractor refuses to take corrective actions, the USFS Black Kettle Staff will survey the entire project area and will mark and map all missed trees within the project area. Work should be within the following standards:

Standards of acceptable work are:

No trees left 10 feet tall or larger per project area as specified in the scope of work.

No more than 1cedar tree per project area 3.0’ - 9’11” as specified in the scope of work.

No more than 10 cedar trees per project area 0” - 2’11” as specified in the scope of work

No more than 10 stumps per project area cut greater than 6” from ground level as specified in the scope of work.

No more than 10 marked leave trees, prescribed leave trees or cottonwoods damaged in a project area.

Any work deemed below standard will be documented and marked on project map. In order to meet compliance the contractor would have to remove all marked trees in order to receive payment.

Anything less would be consider unsatisfactory work

Inspection of treated slash, road maintenance, and erosion control will occur as a visual examination of the units as they are completed. Elements that will be evaluated are stated in the PWS. The contractor will be informed of unsatisfactory work and asked to fix it should it fall below required standards. Any exceptions must have prior approval by the COR.

Determination of Acceptable Work

There is no graduated pay scale for this project. In order to receive payment, work must be complete to 100%. To determine work as satisfactory, the total number of unacceptable trees will be tallied and any result with values greater than 0.0 for cedar trees 10feet tall; 1.0 for cedar trees 3’-9’11”; or

10.0 for cedar trees 0” – 2’11” will be considered unsatisfactory. In order to meet compliance the contractor would have to remove all marked trees in order to receive payment. Anything less would still be considered unsatisfactory work.

Example: If Unit #1 has 100 acres and the COR has completed the disputed area’s surveillance and marking with the following findings: 3 cedar trees 10-feet tall, 7 cedar trees 3’-9’11”, and 40 cedar trees 0”- 2’11” . In order to meet compliance the contractor would have to remove all marks trees in order to receive payment. Anything less would be considered unsatisfactory work.

Re-inspection Upon Contractor’s Request If the original inspection results are unacceptable to the Contractor on either a completed or partially completed unit, re-inspection will be completed upon written request. The same inspection procedures will be used, but different plots will be measured. If the re-inspection confirms the original inspection is not meeting standards, the Contractor will reimburse the Government for the cost of the re-inspection. If the work meets acceptable standards, the Government assumes the cost of re-inspection and payments will be based on the results of the re-inspection.

Acceptance

Non-compliance with any specification or work standards will classify the treatment as unsatisfactory and re-work will be required to bring the treatment up to specifications and work standards.

Government inspection alone does not imply acceptance. Acceptance will be based upon the satisfactory completion of all contract specifications. Payment will be processed promptly following acceptance of completed units.

(a) Definitions. As used in this provision—

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

(D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional System for Award Management records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

“Registered in the System for Award Management (SAM) database” means that—

(1) The Offeror has entered all mandatory information, including the DUNS number or the
