14. DESCRIPTION OF AMENDMENT/MODIFICATION : Attached are: Answers to Pre-Bid meeting questions and a pre-bid meeting attendee list.

1. Solicitation 1283D518Q0002 is hereby amended to include the questions fielded at the pre-bid meeting held June

20, 2018, their respective answers and the pre-bid meeting attendee list:

a.) Q1. Will GPS files of the project be available and in what format?

Answer: Pg. 7 of Solicitation states, “All treatment area boundaries, overall project boundaries, and avoidance area boundaries will be clearly marked with high visibility flagging, by fence line and/or provide GPS shape files.” GPS shape files can be provided in most commonly used file formats including, .gpx, .shp, .kmz, .kml, and geo referenced .pdf.

b.) Q2. How should dead and down trees be treated?

Answer: If the dead tree is an eastern red cedar it should be masticated, If the dead or down tree is within the guideline 1 and under 5” it should be masticated. Otherwise, it is up to the contractor if they want to masticate any dead and down that they see fit. (i.e. If it is easier to masticate a dead or down tree than move it to get to a target tree.) If the dead or downed tree is within guideline 2 and it is a red cedar it should be masticated. Otherwise, it is up to the contractor if they want to masticate any dead and down that they see fit. (i.e. If it is easier to masticate a dead or down tree than move it to get to a target tree.)

c.) Q3. Where are the access points for unit 001 (BKNG unit 74)?

Answer: There are two access points on the north side of the unit and one on the southeast corner.

d.) Q4. What constitutes finished or completed work?

Answer: Pg. 12 of the solicitation states “Inspection for acceptance of work will be accomplished by a visual or random plot inspection of each unit and will be based on adherence to the specifications.”

If visual inspection indicates less than quality work the following will apply as stated on pg 12 of solicitation: “In the event visual inspection indicates that work quality is less than acceptable and the operator will not re-work the unit voluntarily, then the Government shall, by formal inspection, determine if the specified methods of work have been used. Failure to use specified methods shall require prompt corrective action. Repeated failure to follow the specified methods of work may be cause for termination of the Contractor’s right to proceed and the contract considered in default.

In the case to where visual inspection yields unacceptable work and the contractor refuses to take corrective actions, the USFS Black Kettle Staff will survey the entire project area and will mark and map all missed trees within the project area. Work should be within the following standards:

Standards of acceptable work are:

No trees left 10 feet tall or larger per project area as specified in the scope of work.

No more than 1cedar tree per project area 3.0’ - 9’11” as specified in the scope of work.

No more than 10 cedar trees per project area 0” - 2’11” as specified in the scope of work

No more than 10 stumps per project area cut greater than 6” from ground level as specified in the scope of work.

No more than 10 marked leave trees, prescribed leave trees or cottonwoods damaged in a project area.”

e.) Q5. How should the fence rows be treated? Do they need to be cleared?

Answer: It is the contractors responsibility to masticate target trees inside and up to the fence inside of the unit. Trees in roadway ROW’s are not required to be removed. If a red cedar tree is growing in the fence it is required to be removed.

f.) Q6. What if a contractor damages a fence?

Answer: If a fence or any other government property is damaged it is the responsibility to fix or mend the fence. Pg. 17 of the solicitation states, “The Contractor shall also be responsible for all damages to persons or property that occurs as a result of the Contractor's fault or negligence.”

H8 FAR 52.236-9 on pg. 17 also states the following:

Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements (Apr

1984)

(a) The Contractor shall preserve and protect all structures, equipment, and vegetation (such as trees, shrubs, and grass) on or adjacent to the work site, which are not to be removed and which do not unreasonably interfere with the work required under this contract. The Contractor shall only remove trees when specifically authorized to do so, and shall avoid damaging vegetation that will remain in place. If any limbs or branches of trees are broken during contract performance, or by the careless operation of equipment, or by workmen, the Contractor shall trim those limbs or branches with a clean cut and paint the cut with a tree-pruning compound as directed by the Contracting Officer.

(b) The Contractor shall protect from damage all existing improvements and utilities

(1) at or near the work site, and

(2) on adjacent property of a third party, the locations of which are made known to or should be known by the Contractor.

The Contractor shall repair any damage to those facilities, including those that are the property of a third party, resulting from failure to comply with the requirements of this contract or failure to exercise reasonable care in performing the work. If the Contractor fails or refuses to repair the damage promptly, the Contracting Officer may have the necessary work performed and charge the cost to the Contractor.

(End of Clause) g.) Q7. Will the treatment area be flagged prior to start?

Answer: Pg 7 of the solicitation states:

“There are 11 small areas totaling 12.23 acres combined across all treatment areas that are considered sensitive, and no heavy equipment can be used within these areas. These equipment avoidance areas will be clearly marked prior to implementation.

All treatment area boundaries, overall project boundaries, and avoidance area boundaries will be clearly marked with high visibility flagging, by fence line and/or provide GPS shape files.”

Unit boundaries will be clearly identified by either fence line or delineated by flag line. The guideline boundaries will not be marked, however gps files will be available to the contractor and the COR will work closely with the contractor when a boundary delineation is needed or not understood.

h.) Q8. Since not all treatment units are guaranteed in this solicitation, is there a way to show a discount if more items are awarded after the base item? For example: “If all four are awarded I might give 10% discount.”

Answer: Prospective contractors are required to provide pricing for the base item and all optional items as part of their complete response to the solicitation. It is up to the discretion of the contractor as to their pricing methodology for the base and optional items. See page 2, # 3, of the solicitation which states, “This solicitation is comprised of a base item and 3-EA optional items which may be awarded by the Government and are subject to available funding. Please provide a quotation on the base schedule and each of the three optional schedules.”

2. The pre-bid meeting attenbdance sheet is attached and is titled, “Pre-Bid Meeting Attendance Sheet

3. The due date and time for the solicitation response remains on or before 1:00 PM MDT June 26, 2018.
