About this file
This file is a Questions and Answers document addressing clarifications regarding the Flatwoods Job Corps Center Medical Services RFQ (Solicitation Number 1282A727Q0003). The Q&A addresses key personnel and staffing requirements, confirming that offerors must propose named candidates with full credentials at the time of quotation submission rather than contingent upon award. If a proposed candidate becomes unavailable after contract award, the contractor must identify a qualified replacement in a timely manner, with failure to do so constituting grounds for contract termination. The document clarifies that the Service Contract Act wage determination does not apply due to the Professional Services Exemption under 29 CFR Part 541.
Regarding medical liability insurance, the Q&A confirms that either a certificate of insurance or binder in the offeror's name listing the proposed clinician, or a certificate showing $1 million coverage under an individual clinician's malpractice policy, is acceptable at the quotation stage. A backup clinician may be proposed but is not required for award eligibility. The document permits a split of 200 physician hours and 200 Nurse Practitioner/Physician Assistant hours, provided all providers comply with applicable state medical laws and regulations, including required practice authority and any physician collaboration agreements for NP/PA services.

Text version
1. May an offeror propose a candidate whose participation is contingent upon contract award, and is a signed commitment letter required?
A formal commitment letter is not required; however, a candidate must be proposed as part of the quote with all required credentials—proposing a candidate contingent on award is not acceptable—and quotes that do not include proposed key personnel may be removed from further consideration.
1. If that candidate becomes unavailable before performance begins, may the awardee submit an equally qualified replacement for Government approval?
If a candidate is proposed and accepted but becomes unavailable after the award, it is the contractor's responsibility to find a qualified replacement candidate in a timely manner. Failure to find a qualified replacement candidate in a timely manner will be considered non-compliance and may result in the termination of the contract.
1. The solicitation includes FAR 52.222-52 and 52.222-53 but no wage determination. Please confirm the Service Contract Act wage determination does not apply to this requirement.
The Service Contract Act does not apply to this requirement due to the Professional Services Exemption In Accordance With 29 CFR Part 541.
1. For proof of medical liability insurance in the quote, is a certificate of insurance or binder in the offeror's name that lists the proposed clinician acceptable?
Yes this is acceptable.
1. If the clinician's individual malpractice policy is used instead, is a certificate showing $1 million coverage sufficient at the quote stage?
Yes this is acceptable.
1. May an offeror propose a primary clinician plus a named backup clinician for coverage, with the backup subject to Job Corps approval under SOW 5.2.4?
An backup clinician is not required to be eligible for award.
1. Does this permit split of 200 physician hours and 200 NP/PA hours?
This is permitted; however, all providers need to be in compliance with State medical laws in medical regulations. In the case of an NP/PA, this includes having the requisite practice authority and may include a required agreement with a physician.
