About this file

This file contains Questions and Answers from the federal contract opportunity for Pine Ridge Medical Services. The Q&A addresses a critical clarification regarding contractor supervision responsibilities under Section 1.4 of the Statement of Work. The government confirmed that "direct supervision" refers specifically to administrative oversight, including scheduling, attendance, contract compliance, and personnel management—not clinical supervision or the establishment of an employer-employee relationship. The government further clarified that contractors may utilize locum tenens staffing firms or independent contractors to provide qualified medical personnel, provided the contractor retains responsibility for administrative oversight and overall contract performance.

The government's response emphasizes that while the nature of contractual relationships between the contractor and medical personnel (employees versus independent contractors) is not mandated, all medical personnel must meet licensing requirements, possess necessary practice authority, and maintain adequate insurance coverage. This clarification allows offerors flexibility in staffing models while establishing clear expectations for administrative accountability and personnel qualifications for the medical services contract at Pine Ridge Job Corps Center in Chadron, Nebraska.

Section 1.4 of the Statement of Work states that the contractor shall be responsible for the direct supervision of contractor personnel on the Center.

Please clarify whether “direct supervision” refers to administrative oversight, including scheduling, attendance, contract compliance, and personnel management, or whether the contractor is expected to exercise clinical supervision or maintain an employer-employee relationship with the medical provider.

Please also confirm whether a locum tenens staffing firm may provide the qualified medical personnel as independent contractors while retaining responsibility for administrative oversight and contract performance.

1. Direct supervision refers to administrative oversight.

2. The government does not mandate the nature of the contractual relationship: i.e. employees versus independent contractors. However, medical personnel need to meet all requirements, including have the necessary licensing and practice authority, as well as having adequate insurance coverage.
